in the entirety of the text - Complete Text of Norm 010 Delimitation of a sector of the public zone corresponding to the Tamarindo Estero-Mangrove, district 09° Tamarindo, canton 03º Santa Cruz, province 05º Guanacaste NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT NOTICE N° 010-2022 MARITIME TERRESTRIAL ZONE Delimitation of a sector of the public zone corresponding to the Tamarindo Estero-Mangrove, district 09º Tamarindo, canton 03º Santa Cruz, province 05º Guanacaste Based on the provisions of articles 140 and 240 of Law N° 6227 General Law of Public Administration of May 2, 1978; Law N° 59 Law of Creation and Organization of the National Geographic Institute of July 4, 1944; Law N° 8905 Reform of Article 2 of Law N° 5695, Creation of the National Registry, and its reforms; and modification of Law N° 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its reforms of December 7, 2010; Law N° 6043 Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulation; and articles 2 and 3 of Law N° 5695 Law of Creation of the National Registry of May 28, 1975 and its reforms.

1.-That by means of Law Nº 8905, the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which shall enter into the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law N.º 59, the IGN is the scientific and technical dependency governing national cartography, intended for the execution of the official basic Map and the basic geographical Description of the Republic of Costa Rica and for the studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.

2.-That Law N° 59 constitutes the IGN permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order originating from the work entrusted to its charge.

1. 3That in accordance with Law N° 59; Article 62 of Executive Decree N° 7841-P entitled: Regulation to the Law on the Maritime Terrestrial Zone recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree N° 7841-P indicates that the National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.
2. 4That in Executive Decree N° 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone", it is established according to article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.
3. 5That in Executive Decree N° 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05, shall constitute the sole official coordinate system for the Republic of Costa Rica from which all surveys and cartographic and geodetic activities developed within the National Territory by any public agency, person, or private national or foreign entity must be referenced."; while article 7 indicates that "As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish by appropriate means that information which has been made official."

6.-That Executive Decree Nº 40962-MJP Update of the Official Horizontal Reference Geodetic System for Costa Rica declares in its article 1 that The official horizontal reference geodetic system for Costa Rica, denominated CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, the changes and updates shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON, while article 2 establishes that The cartographic projection system CRTM05 shall continue to be official for the cartographic representation of the continental national territory, extended for purposes of application of this cartographic projection, up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined according to articles 5, 6 and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State.

On the other hand, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which all work on the continental territory of our country must be referenced, by stating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended up to the baseline of the territorial sea and, the "Universal Transverse Mercator" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the national territory by any public agency, private person or entity, national or foreign, that undertake or contract geodetic and cartographic work must be referenced, thereby contributing to avoiding public expenditure and obtaining, furthermore, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State.

7.-That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of elaborating regulatory plans (planes reguladores), the approval of surveying plans, the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning.

1. 8That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is denominated the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).

9.-That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree N° 7841-P "Regulation to Law N° 6043 on the Maritime Terrestrial Zone", b) Executive Decree N° 33797-MJ-MOPT "Declares CR05, and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica", and c) Executive Decree N° 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

10.-That article 16° of the Forest Law (Ley Forestal), Law N° 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall demarcate on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).

11.-That according to article 11 of CHAPTER I, General Provisions of Law N° 6043, it establishes that the public zone (zona pública) is also, whatever its extension, that occupied by all mangroves (manglares) of the continental and insular coastlines and estuaries (esteros) of the national territory.

12.-That Executive Decree N° 36786-MINAET titled Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica published in La Gaceta N° 217 of November 11, 2011, establishes among its objectives Identifying within the Maritime Terrestrial Zone those lands that classify as forests, of forest aptitude (soils Class VII and VIII), wetlands (mangroves, estuaries, rías, marshes, coastal lagoons, swamps, flooded forests, salt flats), to certify them and incorporate them as part of the Natural Heritage of the State (PNE).

1. 13That Executive Decree N° 36786-MINAET in point III.-Competencies for delimitation and certification establishes that The classification of lands within the ZMT shall be the responsibility of the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and of private professionals duly accredited by the respective Professional Colleges to classify the forests, lands of forest aptitude (soils Class VII and VIII), (mangroves, estuaries, rías, marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.

The validity of classification documents issued by private professionals shall be subject to the approval issued by the AC with corresponding territorial competence. The AC of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones. The location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone, must be carried out as part of the approval process of the Coastal Regulatory Plan (PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all zones to be concessioned within the ZMT and for the classification thereof at the level of cadastral plans. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas in order not to count them in the total area to be concessioned.

14.-The IGN used the methodology of Georeferenced Digital Lines, to delimit the public zone of the Maritime Terrestrial Zone of the Tamarindo estuary/mangrove, in district 09 Tamarindo, canton 03 Santa Cruz, province: 05º Guanacaste.

15.-That the Las Baulas National Marine Park includes within its limits the Tamarindo Estuary, as established by Law N° 7524. The determination of the limits of this protected area was the subject of analysis during the execution of the Cadastre and Registry Regularization Project. As part of that process, a commission appointed for this purpose prepared the document "Final Report Multidisciplinary Commission: Proposed Limits for the Las Baulas National Marine Park of Guanacaste" dated October 18, 2013.

16.-That the limits recommended in the Final Report Multidisciplinary Commission: Proposed Limits for the Las Baulas National Marine Park of Guanacaste, were made official through the publication of the resolution of the National Council of Conservation Areas R-SINAC-CONAC- 29-2019, in the Official Gazette La Gaceta N° 118 of June 25, 2019, Alcance 142.

17.-That the delimitation has internal technical endorsement according to the Technical Review report N° DIG-TOT-INF-0137-2022 of October 26, 2022, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute. And it is in conformity with the delimitation according to official communications ACT-OR-DR-1092-2022 dated September 28, 2022 and ACT-OR-T-931-2022 dated August 26, 2022 carried out by the Tempisque Conservation Area (Área de Conservación Tempisque).

18.-That article 140 of Law No. 6227 General Law of Public Administration indicates that "the administrative act shall produce its effect after it has been communicated to the administered party, unless it grants only rights, in which case it shall produce them from its adoption", a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the ideal instrument for communicating acts of a generic nature by stating that: "Acts of a general nature shall be communicated by publication and concrete ones by notification".

COMMUNICATES:

1. 1That, in the month of May 2022, field work was carried out to verify the definition of digital lines georeferenced to the national coordinate system of the public zone of the Tamarindo Mangrove located in Tamarindo Bay, district: 09º Tamarindo, canton: 03º Santa Cruz, province: 05° Guanacaste.

2°-The National Geographic Institute publishes the georeferenced digital delimitation of the public zone of 03 sectors that form part of the Tamarindo Mangrove located in Tamarindo Bay, district: 09º Tamarindo, canton: 03º Santa Cruz, province: 05° Guanacaste, based on the Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone and the methodology used and validated by the Tempisque Conservation Area (ACT) of SINAC-MINAE.

1. 3That the delimited public zone corresponds to 03 sectors of the Tamarindo Mangrove located in Tamarindo Bay, district: 09º Tamarindo, canton: 03º Santa Cruz, province: 05° Guanacaste in conformity with report N° DIG-TOT-INF-0137-2022 of October 26, 2022 issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute and official communications ACT-OR-DR-1092-2022 dated September 28, 2022 and ACT-OR-T-931-2022 dated August 26, 2022 carried out by the Tempisque Conservation Area (ACT).
2. 4That the public zone of the Maritime Terrestrial Zone concerning the mangrove sectors verified and delimited by the Tempisque Conservation Area in Tamarindo Bay corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05:

Mangrove Sector 2

Mangrove Sector 3

5°-The sectors located in the Tamarindo Mangrove located in Tamarindo Bay, district: 09º Tamarindo, canton: 03º Santa Cruz, province: 05° Guanacaste that currently have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

6°-The official technical data of the georeferenced delimitation of the 03 sectors of the public zone of the Maritime Terrestrial Zone of the Tamarindo Mangrove located in Tamarindo Bay, district: 09º Tamarindo, canton: 03º Santa Cruz, province: 05° Guanacaste, have been recorded in the Digital Georeferenced Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.

7°-Takes effect upon its publication.

1.-Que mediante ley Nº 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la ley N.º 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

2.-Que la ley N° 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

1. 3Que de conformidad con la ley N° 59; el artículo 62 del Decreto Ejecutivo N° 7841-P denominado: Reglamento a la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.
2. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
3. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."

6.-Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense.

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.

7.-Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

1. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

9.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

10.-Que el artículo 16° de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que según el artículo 11 del CAPÍTULO I, Disposiciones Generales de la ley N° 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

12.-Que el Decreto Ejecutivo N° 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

1. 13Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección. La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.

14.-El IGN utilizó la metodología de Líneas Digitales Georreferenciadas, para delimitar la zona pública de la Zona Marítimo Terrestre del estero/manglar Tamarindo, en el distrito 09 Tamarindo, cantón 03 Santa Cruz, provincia: 05º Guanacaste.

15.-Que el Parque Nacional Marino Las Baulas incluye dentro de sus límites el Estero Tamarindo, según lo establece la Ley N° 7524. La determinación de los límites de esta área protegida fue objeto de análisis durante la ejecución del Proyecto de Regularización de Catastro y Registro. Como parte de ese proceso, una comisión nombrada para tal fin elaboró el documento "Informe Final Comisión Multidisciplinaria: Propuesta de Límites del Parque Nacional Marino Las Baulas de Guanacaste" con fecha 18 de octubre del 2013.

16.-Que los límites recomendados en el Informe Final Comisión Multidisciplinaria: Propuesta de Límites del Parque Nacional Marino Las Baulas de Guanacaste, se encuentran oficializados mediante la publicación de la resolución del Consejo Nacional de Áreas de Conservación R-SINAC-CONAC- 29-2019, en el Diario Oficial La Gaceta N° 118 del 25 de junio 06 de 2019, Alcance 142.

17.-Que la delimitación cuenta con aval técnico interno conforme el informe de Revisión Técnica N° DIG-TOT-INF-0137-2022 del 26 de octubre de 2022, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional. Y está de conformidad a lo delimitado conforme los oficios ACT-OR-DR-1092-2022 de fecha 28 de setiembre de 2022 y ACT-OR-T-931-2022 de fecha 26 de agosto de 2022 realizados por el Área de Conservación Tempisque.

18.-Que el artículo 140 de la Ley No. 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1. 1Que, en el mes de mayo de 2022, se realizó el trabajo de campo para la verificación de la definición de líneas digitales georreferenciadas al sistema nacional de coordenadas de la zona pública del Manglar Tamarindo ubicado en Bahía Tamarindo, distrito: 09º Tamarindo, cantón: 03º Santa Cruz, provincia: 05° Guanacaste.

2°-El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de 03 sectores que forman parte del Manglar Tamarindo ubicado en Bahía Tamarindo, distrito: 09º Tamarindo, cantón: 03º Santa Cruz, provincia: 05° Guanacaste, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Tempisque (ACT) del SINAC-MINAE.

1. 3Que la zona pública delimitada corresponde a 03 sectores del Manglar Tamarindo ubicado en Bahía Tamarindo, distrito: 09º Tamarindo, cantón: 03º Santa Cruz, provincia: 05° Guanacaste en conformidad el informe N° DIG-TOT-INF-0137-2022 del 26 de octubre de 2022 emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional y los oficios ACT-OR-DR-1092-2022 de fecha 28 de setiembre de 2022 y ACT-OR-T-931-2022 de fecha 26 de agosto de 2022 realizados por el Área de Conservación Tempisque (ACT).
2. 4Que la zona pública de la Zona Marítimo Terrestre concerniente a los sectores de manglar verificado y delimitado por el Área de Conservación Tempisque en Bahía Tamarindo corresponde a las siguientes coordenadas en el sistema de proyección cartográfica oficial de Costa Rica CRTM05:

Sector 1 de Manglar Sector 1 de Manglar

Sector 2 de Manglar

Sector 3 de Manglar

5°-Los sectores ubicados en el Manglar Tamarindo ubicado en Bahía Tamarindo, distrito: 09º Tamarindo, cantón: 03º Santa Cruz, provincia: 05° Guanacaste que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

6°-Los datos técnicos oficiales de la delimitación georreferenciada de los 03 sectores de la zona pública de la Zona Marítimo Terrestre del Manglar Tamarindo ubicado en Bahía Tamarindo, distrito: 09º Tamarindo, cantón: 03º Santa Cruz, provincia: 05° Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN.

7°-Rige a partir de su publicación.
