in the entirety of the text Full Text of Norm 43690 Declaration of the cessation of the state of emergency declared by Executive Decree No. 40027-MP "Declares a national state of emergency due to Hurricane Otto in the cantons of Upala, Guatuso and Los Chiles and districts of Aguas Zarcas, Cutris and Pocosol, Río C No. 43690 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In accordance with the provisions of subsections 3) and 18) of article 140 and article 146 of the Political Constitution of the Republic of Costa Rica, articles 27 subsection 1) and 28 subsection 2) paragraph b) of Ley 6227, of May 2, 1978 and articles 30 and 37 of Ley No. 8488, of November 22, 2005, Ley Nacional de Emergencias y Prevención del Riesgo.

1. 1That by Executive Decree No. 40027-MP, of November 28, 2016, published in Alcance No. 274, to the Official Gazette La Gaceta number 229 of November 29, 2016, a national state of emergency was declared due to the situation caused by Hurricane Otto in the following cantons: Upala, Guatuso and Los Chiles, as well as the districts of Aguas Zarcas, Cutris and Pocosol, of the canton of San Carlos, Río Cuarto, of the canton of Grecia and Peñas Blancas, of the canton of San Ramón, all of the Province of Alajuela, canton of Sarapiquí of the Province of Heredia, cantons of Bagaces and La Cruz of the Province of Guanacaste, the cantons of Osa, Golfito and Corredores of the Province of Puntarenas and Pococí of the Province of Limón.
2. 2That by official letter DESNGR-OF-104-2022, dated March 25, 2022, the Strategic Development Unit of the National Risk Management System of the Comisión Nacional de Prevención y Atención de Emergencias (CNE), presented to the Board of Directors of the CNE the General Emergency Plan Closure Report, Executive Decree No. 40027-MP, which for its preparation, considered the count of actions and works developed with resources from the Fondo Nacional de Emergencia, through the executing units appointed by the Board of Directors of the CNE, under the exception framework and the contents of the General Emergency Plan.
3. 3That the reconstruction phase of a national state of emergency has a legal duration of five years in accordance with the Ley Nacional de Emergencias y Prevención del Riesgo Ley No. 8488, given that said decree was published in the year 2016.
4. 4That the Instituto Costarricense de Acueductos y Alcantarillados reported to the Board of Directors of the CNE in the session at Ordinary Session No. 06-04-2022 of April 6, 2022 that there was a group of recovery projects linked to the national emergency declared by decree 40027-MP and that are financed through the donation of resources received from the Government of the United Arab Emirates and regulated through a Resource Transfer Agreement between the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias and the Instituto Costarricense de Acueductos y Alcantarillados.
5. 5That in accordance with the report rendered by the Instituto Costarricense de Acueductos y Alcantarillados, the following projects are pending the initiation of administrative execution procedures: 1-Rehabilitation of the aqueduct system of the community of Canalete de Upala de Alajuela, 2-Rehabilitation of the aqueduct system of the community of Aguas Claras de Upala de Alajuela, 3-Rehabilitation of the aqueduct system of the community of Los Cartagos de Upala de Alajuela, 4-Rehabilitation of the aqueduct system of the community of Pata de Gallo de Upala de Alajuela, 5-Rehabilitation of the aqueduct system of the community of Zapote de Bijagua de Upala de Alajuela, 6-Rehabilitation of the aqueduct system of the community of Altamira de Upala de Alajuela, 7-Rehabilitation of the aqueduct system of the community of Buenos Aires de Aguas Claras de Upala de Alajuela, 8-Rehabilitation of the aqueduct system of the community of Colonia Libertad de Upala de Alajuela, 9-Rehabilitation of the aqueduct system of the community of Río Negro de Upala de Alajuela, 10-Rehabilitation of the aqueduct system of the community of Guayabo de Bagaces de Guanacaste and 11-Rehabilitation of the aqueduct system of the community of Rincón de la Vieja, which require being processed under the exception regime of the Ley Nacional de Emergencias y Prevención del Riesgo, Ley No. 8488.
6. 6That the Board of Directors of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias in its Ordinary Session No. 07-04-2022 of April 20, 2022 approves agreement No. 079-04-2022, by which they recommend to the Executive Branch the cessation of the State of Emergency declared in Executive Decree No. 40027-MP "Declares a national state of emergency due to the situation caused by Hurricane Otto in the following cantons: Upala, Guatuso and Los Chiles, as well as the districts of Aguas Zarcas, Cutris and Pocosol, of the canton of San Carlos, Río Cuarto, of the canton of Grecia and Peñas Blancas, of the canton of San Ramón, all of the Province of Alajuela, canton of Sarapiquí of the Province of Heredia, cantons of Bagaces and La Cruz of the Province of Guanacaste, the cantons of Osa, Golfito and Corredores of the Province of Puntarenas and Pococí of the Province of Limón". Incorporating a transitory provision that maintains the validity of the effects of the decree only for the projects cited above, indicated by the Instituto Costarricense de Acueductos y Alcantarillados for a period of six months counted from the entry into force of this decree. Therefore,

Considering:

en la totalidad del texto - Texto Completo Norma 43690 Declaración de la cesación de estado de emergencia declarado mediante decreto ejecutivo N° 40027-MP "Declara estado de emergencia nacional por el Huracán Otto en los cantones Upala, Guatuso y los Chiles y distritos de Aguas Zarcas, Cutris y Pocosol, Río C Nº 43690 EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE LA PRESIDENCIA De conformidad con lo dispuesto por los incisos 3) y 18) del artículo 140 y el artículo 146 de la Constitución Política de la República de Costa Rica, los artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley 6227, del 2 de mayo de 1978 y los artículos 30 y 37 de la Ley Nº 8488, del 22 de noviembre de 2005, Ley Nacional de Emergencias y Prevención del Riesgo.

1. 1Que mediante Decreto Ejecutivo Nº 40027-MP, del 28 de noviembre del 2016, publicado en el Alcance N° 274, al Diario Oficial La Gaceta número 229 del 29 de noviembre de 2016, se declaró estado de emergencia nacional por la situación provocada por el Huracán Otto en los siguientes cantones: Upala, Guatuso y los Chiles, así como los distritos de Aguas Zarcas, Cutris y Pocosol, del cantón de San Carlos, Río Cuarto, del cantón de Grecia y Peñas Blancas, del cantón de San Ramón, todos de la Provincia de Alajuela, cantón de Sarapiquí de la Provincia de Heredia, cantones de Bagaces y La Cruz de la Provincia de Guanacaste, los cantones de Osa, Golfito y Corredores de la Provincia de Puntarenas y Pococí de la Provincia de Limón.
2. 2Que mediante oficio DESNGR-OF-104-2022, de fecha 25 de marzo de 2022, la Unidad de Desarrollo Estratégico del Sistema Nacional de Gestión del Riesgo de la Comisión Nacional de Prevención y Atención de Emergencias (CNE), presenta ante la Junta Directiva de la CNE el Informe de Finiquito Plan General de la Emergencia, Decreto Ejecutivo Nº 40027-MP, el cual para efectos de su elaboración, consideró el recuento de las acciones y obras desarrolladas con recursos del Fondo Nacional de Emergencia, por medio de las unidades ejecutoras nombradas por la Junta Directiva de la CNE, al amparo del marco de excepción y los contenidos del Plan General de Emergencia.
3. 3Que la fase de reconstrucción de un estado de emergencia nacional tiene una vigencia por Ley de cinco años de conformidad con la Ley Nacional de Emergencias y Prevención del Riesgo Ley Nº 8488, siendo que dicho decreto fue publicado en el año 2016
4. 4Que el Instituto Costarricense de Acueductos y Alcantarillados reportó a la Junta Directiva de la CNE en la sesión a Sesión Ordinaria Nº 06-04-2022 del 06 de abril del 2022 que existía un grupo de proyectos de recuperación vinculados a la emergencia nacional declarada mediante el decreto 40027-MP y que son financiados mediante la donación de recursos recibidos por parte del Gobierno de los Emiratos Árabes Unidos y regulados mediante un Convenio de Traspaso de Recurso de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias y el Instituto Costarricense de Acueductos y Alcantarillados.
5. 5Que de conformidad con el informe rendido por el Instituto Costarricense de Acueductos y Alcantarillados, se encuentran pendientes de iniciar los trámites administrativos de ejecución los siguientes proyectos: 1-Rehabilitación del sistema de acueducto de la comunidad de Canalete de Upala de Alajuela, 2-Rehabilitación del sistema de acueducto de la comunidad de Aguas Claras de Upala de Alajuela, 3-Rehabilitación del sistema de acueducto de la comunidad de Los Cartagos de Upala de Alajuela, 4-Rehabilitación del sistema de acueducto de la comunidad de Pata de Gallo de Upala de Alajuela, 5-Rehabilitación del sistema de acueducto de la comunidad de Zapote de Bijagua de Upala de Alajuela, 6-Rehabilitación del sistema de acueducto de la comunidad de Altamira de Upala de Alajuela, 7-Rehabilitación del sistema de acueducto de la comunidad de Buenos Aires de Aguas Claras de Upala de Alajuela, 8-Rehabilitación del sistema de acueducto de la comunidad de Colonia Libertad de Upala de Alajuela, 9-Rehabilitación del sistema de acueducto de la comunidad de Río Negro de Upala de Alajuela, 10-Rehabilitación del sistema de acueducto de la comunidad de Guayabo de Bagaces de Guanacaste y 11-Rehabilitación del sistema de acueducto de la comunidad de Rincón de la Vieja, los cuales requieren de ser tramitados en el marco del régimen de excepción de la Ley Nacional de Emergencias y Prevención del Riesgo, Ley Nº 8488.
6. 6Que la Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias en su Sesión Ordinaria Nº 07-04-2022 del 20 de abril del 2022 aprueba el acuerdo Nº 079-04-2022, mediante el cual recomiendan al Poder Ejecutivo la cesación del Estado de Emergencia declarado en el Decreto Ejecutivo Nº 40027- MP "Declara estado de emergencia nacional por la situación provocada por el Huracán Otto en los siguientes cantones. Upala, Guatuso y los Chiles, así como los distritos de Aguas Zarcas, Cutris y Pocosol, del cantón de San Carlos, Río Cuarto, del cantón de Grecia y Peñas Blancas, del cantón de San Ramón, todos de la Provincia de Alajuela, cantón de Sarapiquí de la Provincia de Heredia, cantones de Bagaces y La Cruz de la Provincia de Guanacaste, los cantones de Osa, Golfito y Corredores de la Provincia de Puntarenas y Pococí de la Provincia de Limón". Incorporando un transitorio que mantenga la vigencia de los efectos del decreto únicamente para los proyectos supra citados, señalados por el Instituto Costarricense de Acueductos y Alcantarillados por un plazo de seis meses contados a partir de la entrada en vigencia del presente decreto. Por tanto,
