Reform of the Regulation for the drilling of wells and use of groundwater N°43712-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the powers conferred by Articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution; Articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration N06227 of May 2, 1978; Article 177 of the Water Law N0276 of August 27, 1942; and Article 50 of the Organic Law of the Environment N°7554 of October 4, 1995.
I.—That in accordance with the Water Law N°276, in its Articles 17, 21, 27, 176, 177 and 178, the Ministry of Environment and Energy is the governing body for water at the national level and is responsible for ruling on its ownership, use, utilization, governance, and monitoring; which it carries out through its Water Directorate pursuant to Executive Decree N° 35669-MINAE of December 4, 2009, entitled "Organic Regulation of the Ministry of Environment and Energy." II.—That Law N°5516 of May 2, 1974, entitled "Reform of Articles 131 to 135 of the Water Law of 1942," establishes in its Article 2°, that to facilitate the powers of ownership, governance, and monitoring of public-domain waters vested in the Ministry of Environment and Energy, it shall maintain a registry for the registration of persons or companies engaged in the drilling of wells and shall not issue a license to drill to those not registered in said registry.
III.—That in accordance with Article 50 of the Organic Law of the Environment N°7554, water is public domain, and its conservation and sustainable use are of social interest.
IV.—That in accordance with the Organic Regulation of the Ministry of Environment and Energy, Executive Decree N°35669-MINAE, the Water Directorate of the Ministry of Environment and Energy is responsible for receiving, processing, and resolving applications for subsurface drilling for the exploration and for operating and maintaining the registry of well drilling companies.
V.—That as part of an ongoing process of regulatory improvement and the opportunity to allow greater availability to address other substantive tasks of the Water Directorate, such as the monitoring and administration of water in the field, the processes and timeframes have been adjusted and reduced, both for the Administration and for the regulated party, facilitating the procedure, but with added value in its control and follow-up.
VI.—That based on the legal analysis issued via official communication DA-2460-08-2022 of August 12, 2022, from the Water Directorate, the repeal (derogatoria) of Article 54 of the Regulation for the drilling of wells and use of groundwater, Executive Decree N°43053-MINAE of April 22, 2021, is appropriate.
VII.—That, in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree N°37045-MPMEIC and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or formalities that the regulated party must comply with, a situation for which the prior control procedure was not undertaken. Therefore;

Reforma Reglamento para la perforación de pozos y aprovechamiento de aguas subterráneas N°43712-MINAE EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE Y ENERGÍA En uso de las facultades que les confieren los artículos 50, 140 incisos 3) y 18), y 146 de la Constitución Política; artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública N06227 del 2 de mayo de 1978; artículo 177 de la Ley de Aguas N0276 del 27 de agosto de 1942; y el artículo 50 de la Ley Orgánica del Ambiente N°7554 del 4 de octubre de 1995.
I.-Que de conformidad con la Ley de Aguas N°276, en sus artículos 17, 21, 27, 176, 177 y 178, el Ministerio de Ambiente y Energía es el ente rector del agua a nivel nacional y le corresponde disponer sobre su dominio, aprovechamiento, utilización, gobierno y vigilancia de estas; lo cual realiza por medio de su Dirección de Agua conforme al Decreto Ejecutivo N° 35669-MINAE del 04 de diciembre de 2009, denominado "Reglamento Orgánico del Ministerio de Ambiente y Energía".
II.-Que la Ley N°5516 del 2 de mayo de 1974 denominada "Reforma artículos 131 a 135 Ley de Aguas de 1942", establece en su artículo 2°, que para facilitar las atribuciones de dominio, gobierno y vigilancia de las aguas de dominio público que corresponde al Ministerio de Ambiente y Energía, éste llevará un registro para la inscripción de las personas o empresas que tengan como actividad la perforación de pozos y no dará licencia para perforar a quienes no estén inscritos en el mencionado registro.
III.-Que de conformidad con el artículo 50 de la Ley Orgánica del Ambiente N°7554, el agua es de dominio público, y su conservación y uso sostenible son de interés social.
IV.-Que de conformidad con el Reglamento Orgánico del Ministerio de Ambiente y Energía, Decreto Ejecutivo N°35669- MINAE, corresponde a la Dirección de Agua del Ministerio de Ambiente y Energía, admitir, tramitar y resolver sobre solicitudes de perforación del subsuelo para la exploración y operar y mantener el registro de perforadoras de pozos.
V.-Que como parte de un proceso continuo de mejora regulatoria y la oportunidad de permitir mayor disponibilidad para atender otros quehaceres sustantivos de la Dirección de Agua, como es la vigilancia y administración del agua encampo, se han ajustado y disminuido los procesos y plazos, tanto para la Administración como para el administrado, facilitando el trámite, pero con valor agregado en su control y seguimiento.
VI.-Que con fundamento en el análisis jurídico emitido mediante oficio DA-2460-08-2022 del 12 de agosto de 2022 de la Dirección de Agua, procede la derogatoria del artículo 54 del Reglamento para la perforación de pozos y aprovechamiento de aguas subterráneas, Decreto Ejecutivo N°43053-MINAE del 22 de abril de 2021.
VII.-Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N°37045-MPMEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto;

Transitorio Único.-Todos los pozos artesanales que, a la fecha de vigencia del presente Decreto Ejecutivo, se encuentren en trámite de inscripción ante la Dirección de Aguas del Ministerio de Ambiente y Energía, continuarán con el trámite hasta concluirlo.
