I.That through Executive Decree No. 39724 of May 2, 2016, published in Digital Supplement No. 87 to Gazette No. 103 of Monday, May 30, 2016, of the Official Journal La Gaceta, the Regulation for the Control of Polluting Emissions Produced by Vehicles with Internal Combustion Engines was issued, in which the obligation to comply with emission standards was established by applying those issued by the European Union (Euro) and the Federal specifications of the United States (TIER) for new or used vehicles entering the national territory, in accordance with the entry schedule table. By reason of the foregoing, as of the year 2018, only the entry of new and used vehicles that complied with Euro IV and TIER II standards or higher was permitted, and as of 2021, only new and used vehicles that complied with Euro VI and TIER III standards or higher entered, in order to protect the health of people and the environment, as well as the fundamental third-generation rights, without thereby hindering the conditions of competitiveness for the development of the country's economic activity.
II.That through Executive Decree No. 43166-MOPT-MINAE-S of August 11, 2021, Amendment to the Regulation for the Control of Polluting Emissions Produced by Self-propelled Vehicles with Internal Combustion Engines, published in Supplement No. 213 of La Gaceta No. 202 of October 20, 2021, an amendment was made to Article 7 of Executive Decree No. 39724, Regulation for the Control of Polluting Emissions Produced by Vehicles with Internal Combustion Engines, in which, for new or used vehicles entering the national territory, the entry into force of the Euro VI, TIER III standard, or higher, was established as of January 1, 2023.
III.That through House of the Presidency Press Release CP-017-2022 issued on May 22, 2022, corresponding to the measures to reduce the cost of fuels, the postponement of the application of Executive Decree No. 43166-MOPT-MINAE-S, called Amendment to the Regulation for the control of polluting emissions produced by self-propelled vehicles with internal combustion engines, was established as the fourth measure, since its application would make the prices of diesel and super gasoline even more expensive, to the detriment of consumers; the foregoing as a result of the increase in the prices of refined products that Costa Rica must import.

As of January 1, 2027, the EURO VI, TIER III emission standard or higher shall enter into force.
It shall be effective as of its publication.

I.Que mediante el Decreto Ejecutivo N°39724 del 02 de mayo de 2016, publicado en el Alcance Digital N°87 a la Gaceta N°.103. del lunes 30 de mayo del 2016 del Diario Oficial La Gaceta, se emitió el Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos con Motor de Combustión Interna, en el cual se estableció la obligatoriedad de acatar los estándares de emisiones aplicando los emitidos por la Unión Europea (Euro) y las especificaciones Federales de los Estados Unidos (TIER) para los vehículos nuevos o usados que ingresaban al territorio nacional, de conformidad con la tabla de cronograma de ingresos. En razón de lo anterior, a partir del año 2018 sólo se permitía el ingreso de los vehículos nuevos y usados que cumplían con las normas Euro IV y TIER II o superior, y a partir del 2021 solo ingresaban los vehículos nuevos y usados que cumplían con las normas Euro VI y TIER III o superior, con el fin de proteger la salud de las personas y el medio ambiente, así como los derechos fundamentales de tercera generación, sin que por ello se obstaculicen las condiciones de competitividad, para el desarrollo de la actividad económica del país.
II.Que mediante el Decreto Ejecutivo No.43166- MOPT-MINAE-S del 11 de agosto de 2021, Reforma Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos Automotores con Motor de Combustión Interna, publicado el Alcance No. 213 de La Gaceta No.202 del día 20 de octubre del 2021, se realiza la reforma al artículo 7 del Decreto Ejecutivo No.39724, Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos con Motor de Combustión Interna, en la cual para los vehículos nuevos o usados que ingresaba en el territorio nacional, se establece la entrada en vigencia de la norma Euro VI, TIER III o superior, a partir del 1 de enero de 2023.
III.Que mediante el Comunicado de Prensa de Casa Presidencia CP-017-2022 emitido el día 22 de mayo 2022, correspondiente a las medidas para reducir el costo de los combustibles, se establece como cuarta medida la postergación de la aplicación del Decreto Ejecutivo Nº43166- MOPT-MINAE-S denominado Reforma Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna, por cuanto su aplicación vendría a encarecer aún más los precios de combustibles diésel y gasolina súper, en perjuicio de los consumidores; lo anterior como resultado del aumento en los precios de los productos refinados que debe importar Costa Rica.

A partir del primero de enero de 2027 entrará en vigor el estándar de emisiones EURO VI, TIER III o superior.
