in the entirety of the text - Complete Text of Norm 005 Appointment of the donations committee of the Ministry of Environment and Energy MINISTRY OF ENVIRONMENT AND ENERGY A-005-2022-MINAE APPOINTMENT OF THE DONATIONS COMMITTEE OF THE MINISTRY OF ENVIRONMENT AND ENERGY In accordance with the powers conferred by Article 28, subsection 2), sub-item a) and Article 89 of Law No. 6227, the General Public Administration Act (Ley General de la Administración Pública) of May 2, 1978, and its amendments; as well as Articles 25, subsections e) and d), 26, and 39 of Decree No. 40797-H, "Regulation for the Registration and Control of Assets of the Central Administration and amendment to Article 144 of Executive Decree No. 32988, Regulation to the Law on Financial Administration of the Republic and Public Budgets of January 31, 2006" (Reglamento para el Registro y Control de Bienes de la Administración Central y reforma al artículo 144 del Decreto Ejecutivo Nº 32988 Reglamento a la Ley de Administración Financiera de la República y Presupuestos Públicos del 31 de enero del 2006), published in Digital Supplement (Alcance Digital) No. 24 to La Gaceta No. 20 of February 2, 2018.

I.-That by Agreement No. 001-P, published in Digital Supplement (Alcance Digital) No. 91 to La Gaceta No. 85 of May 10, 2022, Mr. Franz Tattenbach Capra, identity card 1 0622 0325, is appointed to the position of Minister of Environment and Energy, effective as of May 8, two thousand twenty-two.

II.-That the appointment of the Donations Committee of the Ministry of Environment and Energy is the responsibility of the highest-ranking authority of the Institution, as provided in articles 25, subsections e) and d), and 39 of the "Regulation for the Registration and Control of Assets of the Central Administration and amendment to Article 144 of Executive Decree No. 32988, Regulation to the Law on Financial Administration of the Republic and Public Budgets of January 31, 2006", according to Executive Decree No. 40797-H, published in Digital Supplement (Alcance Digital) No. 24 of February 2, 2018.

III.-That article 53 of the Organic Regulation of the Ministry of Environment and Energy, Executive Decree No. 35669-MINAE, published in La Gaceta of January 6, 2010, sets forth the functions corresponding to the Office of the Official Mayor-Executive Directorate (Oficialía Mayor-Dirección Ejecutiva), among these, the coordination of ministerial administrative activities to ensure compliance with policies, guidelines, directives, and strategies in administrative matters at the senior, managerial, executive, and regional levels for the fulfillment of institutional and sectoral objectives and goals. Likewise, to implement personnel development, the acquisition, control, and safeguarding of material resources, provision of services, organizational development, control of basic service expenditures, service comptrollership, as well as acting as the immediate superior for administrative purposes of executive-level officials, and any other functions established by the legal order that pertain to the matter.

IV.-That the Ministry of Finance (Ministerio de Hacienda), in its capacity as Governing Body of the Financial Administration System, and the Directorate General of Goods Administration and Procurement (Dirección General de Administración de Bienes y Contratación Administrativa) have been adjusting the use of computer systems supporting management, for the purpose of implementing digital signatures and electronic documents, in accordance with the provisions of the Law on Certificates, Digital Signatures, and Electronic Documents, Law No. 8454, and its Regulation, to promote efficiency, effectiveness, and transparency.

V.-That Article 28, subsections 1) and 2), sub-item a), of the General Public Administration Act (Ley General de la Administración Pública) provides that the Minister is the highest hierarchical body of the respective Ministry, responsible for directing and coordinating all services of the Ministry. Therefore:

THE MINISTER OF ENVIRONMENT AND ENERGY HEREBY AGREES:

I.-To appoint the Donations Committee of the Ministry of Environment and Energy, which shall be composed of the officials occupying the following positions: Official Mayor (Oficial Mayor) of MINAE or their representative, who shall preside, Institutional Supplier of MINAE, Coordinator of the Institutional Asset Management Unit (Unidad de Administración de Bienes Institucionales) or their representative, who shall be responsible for recommending donations at the institutional level, in accordance with the provisions of article 25 of the Regulation for the Registration and Control of Assets of the Central Administration, Executive Decree No. 40797-H.

II.-The Donations Committee of MINAE shall have the following main functions: A) To be aware of the list of assets eligible for decommissioning by donation. B) To select the recipient institution (institución donataria) from the Registry of Institutions Eligible to Receive Donations (Registro de Instituciones Aptas para Recibir Donaciones, RIARD), maintained for these purposes by the Directorate General of Goods Administration and Procurement (Dirección General de Administración de Bienes y Contratación Administrativa) of the Ministry of Finance. C) To recommend to the Ministerial Authority the institution selected for the respective donation, for the signing of the Donation Record (Acta de la Donación).

III.-The Donations Committee of MINAE shall be convened to meet whenever its Chairperson deems it necessary. The Committee's sessions may be in-person or virtual, according to their convenience. The respective documentation may be signed physically or digitally, in accordance with the provisions of the Law on Certificates, Digital Signatures, and Electronic Documents, Law No. 8454 and its Regulation.

IV.-It shall take effect upon its publication in the Official Gazette (Diario Oficial) La Gaceta.

V.-Let it be published and communicated to the Directorate General of Administration of Goods and Procurement (Dirección General de Administración de Bienes y Contratación Administrativa) of the Ministry of Finance.

I.-Que mediante Acuerdo Nº001-P, publicado en el Alcance Digital N° 91 a La Gaceta N° 85 del 10 de mayo del 2022, se nombra al señor Franz Tattenbach Capra, cédula de identidad 1 0622 0325, en el cargo de Ministro de Ambiente y Energía, a partir del 08 de mayo del dos mil veintidós.

II.-Que el nombramiento de la Comisión de Donación del Ministerio de Ambiente y Energía, es competencia del máximo jerarca de la Institución, conforme lo dispone los numerales 25 incisos e) y d) y 39 del "Reglamento para el Registro y Control de Bienes de la Administración Central y reforma al artículo 144 del Decreto Ejecutivo Nº 32988, Reglamento a la Ley de Administración Financiera de la República y Presupuestos Públicos del 31 de enero del 2006", según Decreto Ejecutivo Nº 40797-H del publicado en el Alcance Digital Nº 24 del 02 de febrero del 2018.

III.-Que el numeral 53 del Reglamento Orgánico del Ministerio de Ambiente, y Energía, Decreto Ejecutivo N° 35669-MINAE, publicado en La Gaceta del 6 de enero del 2010; dispone sobre las funciones que le corresponde a la Oficialía Mayor-Dirección Ejecutiva, entre éstas, la coordinación de las actividades administrativas ministeriales que permitan cumplir con las políticas, lineamientos, directrices y estrategias en materia administrativa en los niveles superior, gerencial, ejecutivo y regional para el cumplimiento de los objetivos y metas institucionales y sectoriales. De igual forma, instrumentar el desarrollo de personal, la adquisición, control y salvaguarda de los recursos materiales, prestación de servicios, desarrollo organizacional, control del gasto de servicios básicos, contraloría de servicios, así como ejercer como superior inmediato para efectos administrativos de los funcionarios del nivel ejecutivo, y cualquier otra establecida por el ordenamiento legal, que correspondan a la materia.

IV.-Que el Ministerio de Hacienda en su carácter de Órgano Rector del Sistema de Administración Financiera y la Dirección General de Administración de Bienes y Contratación Administrativa, ha venido ajustando el uso de los sistemas informáticos de apoyo a la gestión, a efectos de implementar la firma digital y documentos electrónicos, conforme a lo preceptuado en la Ley de Certificados, Firmas Digitales y Documentos Electrónicos, Ley Nº 8454 y su Reglamento, a efectos de propiciar la eficiencia y eficacia y transparencia V.-Que el artículo 28 inciso 1) y 2) aparte a) de la Ley General de la Administración Pública dispone que el Ministro es el órgano jerárquico superior del respectivo Ministerio, correspondiéndole dirigir y coordinar todos los servicios del Ministerio. Por tanto:

EL MINISTRO DE AMBIENTE Y ENERGÍA ACUERDA:

I.-Nombrar la Comisión de Donaciones del Ministerio de Ambiente y Energía, la cual estará integrada por los funcionarios que ocupen los siguientes cargos: Oficial Mayor de MINAE o su representante, quien Presidirá, Proveedor Institucional de MINAE, Coordinador de la Unidad de Administración de Bienes Institucionales o su representante, quienes se encargarán de recomendar las donaciones a nivel institucional, conforme lo regula el numeral 25 del Reglamento para el Registro y Control de Bienes de la Administración Central, Decreto Ejecutivo Nº 40797-H.

II.-La Comisión de Donación del MINAE, tendrá como principales funciones las siguientes: A) Conocer la lista de bienes susceptibles a dar de baja por donación. B) Escoger la institución donataria del Registro de instituciones aptas para recibir donaciones (RIARD), que lleva a esos efectos la Dirección General de Administración de Bienes y Contratación Administrativa del Ministerio de Hacienda. C) Recomendar al Jerarca Ministerial, la institución que fue seleccionada para la respectiva donación, para que firme el Acta de la Donación.

III.-La Comisión de Donación de MINAE, será convocada a sesionar cuando así lo considere necesario su Presidente. Las sesiones de la Comisión, podrán ser presenciales o virtuales, de acuerdo a su conveniencia. La documentación respectiva podrá ser firmada en físico o en digital, conforme a lo dispuesto en la Ley de Certificados, Firmas Digitales y Documentos Electrónicos, Ley N° 8454 y su Reglamento.

IV.-Rige a partir de su publicación en el Diario Oficial La Gaceta.

V.-Publíquese y comuníquese a la Dirección General de Administración de Bienes y Contratación Administrativa del Ministerio de Hacienda.

Considerando:
