8905, the Instituto Geográfico Nacional, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical unit governing national cartography, responsible for the execution of the official base Map and the basic geographic Description of the Republic of Costa Rica, and for studies, investigations, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.

59 permanently constitutes the IGN, in representation of the State, as the official authority on geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any kind that originate from the works entrusted to its charge.

59; article 62 of Executive Decree No. 7841-P, called the Regulation to the Law on the Zona Marítimo Terrestre, recognizes the IGN's competence for delimiting the public zone of the Zona Marítimo Terrestre, and its officialization through publication in the Diario Oficial La Gaceta; article 63 of Executive Decree No. 7841-P indicates that the Instituto Geográfico Nacional must publish a notice in the Diario Oficial for each portion of the zona marítimo-terrestre in which it has demarcated the public zone.

36642-MP-MOPT-MINAET, the Regulation of Specifications for the Delimitation of the public zone of the Zona Marítimo Terrestre, dated June 28, 2011, in accordance with articles 18, 19, and 20, establishes that for the types of delimitation of the Public Zone of the Zona Marítimo Terrestre, the IGN may use two execution methodologies, namely: a) delimitation through the placement of boundary markers (mojones); and b) digital georeferenced delimitation, which is a methodology allowing the georeferencing of the mean high-water mark (pleamar ordinaria) using coordinates in the official reference system of the country, established by Executive Decree No. 33797-MJ-MOPT titled Declara como datum horizontal oficial para Costa Rica, el CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, without the need for the placement of boundary markers (mojones), in order to expedite delimitations and provide greater technical certainty to interested parties.

33797-MJ-MOPT, which among other aspects designates the Red Geodésica Nacional de Referencia Horizontal CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates must be referenced for all geodetic, cartographic, and cadastral works carried out in our country, specifically stating in its article 11 that The Red Geodésica Nacional de Referencia Horizontal CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the National Territory by any public entity, person, or private national or foreign entity undertaking or contracting geodetic and cartographic works must be referenced, thus contributing to avoiding public expenditure and, on the other hand, obtaining reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at the different levels of the State; whereas article 7 indicates that As cartographic data is produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish, through appropriate means, that information that has been officialized.

10.—That Law No. 7575, called the Ley Forestal, dated February 13, 1996, in its article 16, establishes that the Ministry of Environment and Energy shall demarcate on the ground, the boundaries of the areas that make up the Patrimonio Natural del Estado.

11.—That Law No. 6043 establishes in its article 1 of CHAPTER I, General Provisions, that The zona marítimo terrestre constitutes part of the national heritage, belongs to the State, and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is an obligation of the State, of its institutions, and of all the inhabitants of the country. Its use and exploitation are subject to the provisions of this law.

12.—That according to article 11 of CHAPTER I, General Provisions, of Law No. 6043, it establishes that the public zone (Zona pública) is also, whatever its extension, the area occupied by all mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.

13.—That Executive Decree No. 36786-MINAET, titled Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives to identify within the Zona Marítimo Terrestre those lands that classify as forests, of forest aptitude (suelos Clase VII y VIII), wetlands (humedales) (mangroves, estuaries (esteros), rías, marshes (marismas), coastal lagoons, swamps (pantanos), flooded forests, salt flats (salitrales)), to certify them and incorporate them as part of the Patrimonio Natural del Estado (PNE).

14.—That Executive Decree No. 36786-MINAET, in point III.—Competencies for delimitation and certification, establishes that The classification of lands within the ZMT shall correspond to the Áreas de Conservación (AC) of the Sistema Nacional de Áreas de Conservación (SINAC) and to duly accredited private professionals by the respective Professional Associations to classify forests, lands of forest aptitude (suelos Clase VII y VIII), (mangroves, estuaries (esteros), rías, marshes (marismas), coastal lagoons, swamps (pantanos), flooded forests, salt flats (salitrales)), and wetlands (humedales).

The validity of the classification documents issued by private professionals will be subject to approval issued by the AC with corresponding territorial jurisdiction. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation, and certification of lands belonging to the Patrimonio Natural del Estado and protection zones.

The location and delimitation of the areas of the Patrimonio Natural del Estado within the Zona Marítimo Terrestre must be carried out as part of the approval process of the Plan Regulador Costero (PRC), defined by Law 6043, since the Plan Regulador Costero is the land-use planning instrument that defines and locates all zones to be concessioned within the ZMT and for its classification at the level of cadastral plans. Therefore, the Plan Regulador Costero must clearly and expressly indicate the PNE areas so as not to count them in the total area to be concessioned.

15.—That via official letter ACT-OR-T-975-2021, dated August 20, 2021, signed by Ing. Fabián Bonilla Salguero, Surveying Engineer, and official letter ACT-OSRSCC-10762021, dated August 4, 2021, issued by Ing. Rodrigo Alberto Sáenz Espinoza, Forestry Engineer, both from the Área de Conservación Tempisque of the Sistema de Áreas de Conservación of the Ministry of Environment and Energy, approval is granted for the survey and delimitation of two sectors of the Mangrove Playa Zapotal carried out by the company DEHC Sociedad Anónima.

16.—That through the report titled "INFORME TÉCNICO DEHC_2021_002 DELIMITACION ZONA MANGLAR ZAPOTAL GUANACASTE, COSTA RICA," prepared by the company DEHC Sociedad Anónima, at the request of Ricardo Antonio Batalla Robles, holder of identity card number 1-1258-0441, in his capacity as general representative of the company GLP Guanacaste Land Partners LLC Limitada, with legal entity identification number 3-102-801133, the IGN is presented with the technical information of the topographic survey for the delimitation of the Zapotal ecosystem in District 03° Sardinal, Canton 05° Carrillo, of Province 05° Guanacaste.

17.—That via official letter DIG-TOT-0055-2022, dated January 28, 2022, issued by the Subproceso de Límites Oficiales of the Departamento Topográfico y Observación del Territorio of the IGN, the IGN Directorate is informed that the work carried out by the company DEHC Sociedad Anónima regarding the Delimitation of two sectors of the Zapotal mangrove has the technical endorsement for publication.

19.—That article 140 of Law No. 6227 indicates that The administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce them from the moment it is adopted, a provision that must necessarily be related to article 240 of the same regulatory body, which defines the appropriate instrument for communicating acts of a generic nature by indicating that General acts shall be communicated by publication and specific acts by notification.

Communicates:

First.—The IGN publishes in the Zapotal sector, located in district 03 Sardinal, canton 03 Carrillo, of province 05 Guanacaste, through the methodology used and validated both by the Área de Conservación Tempisque of SINAC-MINAE and the IGN, the digital georeferenced delimitation of the public zone of the Zona Marítimo Terrestre for two sectors of the Zapotal mangrove.

Second.—The public zone of the Zona Marítimo Terrestre delimited for two sectors of the Zapotal mangrove at the site known as Zapotal in the Sardinal district, of the referred Carrillo canton, corresponds to the boundary markers (mojones) whose coordinates in the Costa Rica CRTM05 cartographic projection system are indicated below:

Third.—The delimitation of the Zapotal mangrove at the site known as Zapotal in the Sardinal district, of the Carrillo canton of the Guanacaste province, is published in accordance with official letters ACT-OR-T-975-2021 and ACT-OSRSCC-1076-2021 from the Área de Conservación Tempisque and the technical report DEHC_2021_002 prepared by the company DEHC Sociedad Anónima.

Fourth.—The official technical data of the digital georeferenced delimitation of the public zone of the Zona Marítimo Terrestre for the two sectors of the mangrove have been recorded in the Geodatabase Digital Georreferenciada (GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT), in a file in vector shape format, under the coding RN/IGN_GDG-IGN-ZMT.

Fifth.—With this demarcation, the boundary markers (mojones) enumerated M93A, M92A, M92, and M91A published in the Diario Oficial La Gaceta No. 202 dated October 21, 1992, are eliminated.

Sixth.—It becomes effective upon its publication.

Given in Curridabat, San José, on the 6th day of the month of June of the year 2022.

Asimismo, de conformidad con la Ley N° 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público.

10.-Que la Ley N° 7575 denominada Ley Forestal del 13 de febrero de 1996 en su artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno, los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que la Ley N° 6043 establece en su artículo 1 del CAPÍTULO I, Disposiciones Generales que La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley.

12.-Que según el artículo 11 del CAPÍTULO I, Disposiciones Generales de la Ley N° 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

13.-Que el Decreto Ejecutivo N° 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

14.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.

15.-Que mediante el oficio ACT-OR-T-975-2021 de fecha 20 de agosto de 2021, suscrito por el Ing. Fabián Bonilla Salguero Ingeniero Topógrafo y el oficio ACT-OSRSCC-10762021 de fecha 04 de agosto de 2021 emitido por Ing. Rodrigo Alberto Sáenz Espinoza Ingeniero Forestal ambos del Área de Conservación Tempisque del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía, se otorga visto bueno al levantamiento y delimitación de dos sectores del Manglar Playa Zapotal realizado por la empresa DEHC Sociedad Anónima.

16.-Que mediante el informe denominado "INFORME TÉCNICO DEHC_2021_002 DELIMITACION ZONA MANGLAR ZAPOTAL GUANACASTE, COSTA RICA" elaborado la empresa DEHC Sociedad Anónima, a solicitud de Ricardo Antonio Batalla Robles, portador de la cédula de identidad número 1-1258-0441, en condición de apoderado general de la empresa GLP Guanacaste Land Partners LLC Limitada, con cédula de persona jurídica número 3-102-801133se presenta al IGN la información técnica del levantamiento topográfico para la delimitación del ecosistema Zapotal en Distrito 03° Sardinal, Cantón 05° Carrillo de la Provincia 05° Guanacaste.

17.-Que mediante el oficio DIG-TOT-0055-2022 de fecha 28 de enero de 2022, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del IGN, se le informa a la Dirección del IGN que los trabajos realizados por la empresa DEHC Sociedad Anónima relativos a la Delimitación de dos sectores del manglar Zapotal cuentan con el aval técnico para su publicación.

19.-Que el artículo 140 de la ley N° 6227 señala que El acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte, disposición que necesariamente debe relacionarse con el artículo 240 del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que Se comunicarán por publicación los actos generales y por notificación los concretos.

Comunica:

Primero.-El IGN publica en el sector de Zapotal, ubicado en el distrito 03 Sardinal, cantón 03 Carrillo, de la provincia 05 Guanacaste, por medio de la metodología usada y validada tanto por el Área de Conservación Tempisque del SINAC-MINAE y por el IGN, la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de dos sectores del manglar Zapotal.

Segundo.-La zona pública de la Zona Marítimo Terrestre delimitada de dos sectores del manglar Zapotal en el sitio conocido como Zapotal en el distrito Sardinal, del cantón Carrillo referido, corresponde a los mojones cuyas coordenadas en el sistema de proyección cartográfico Costa Rica CRTM05, se indican a continuación:

Tercero.-Se publica la delimitación del manglar Zapotal en el sitio conocido como Zapotal en el distrito Sardinal, del cantón Carrillo de la provincia Guanacaste, acorde con los oficios ACT-OR-T-975-2021 y ACT-OSRSCC-1076-2021 del Área de Conservación Tempisque y el informe técnico DEHC_2021_002 elaborado la empresa DEHC Sociedad Anónima.

Cuarto.-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de los dos sectores del manglar, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en un archivo con formato vectorial shape, bajo la codificación RN/IGN_GDG-IGN-ZMT.

Quinto.-Con esta demarcación quedan eliminados los mojones enumerados M93A, M92A, M92 y M91A publicados en el Diario Oficial La Gaceta N° 202 de fecha 21 de octubre de 1992.

Sexto.-Rige a partir de su publicación.
