throughout the text - Complete Text of Regulation 43234 Regulation for the exercise of permitted activities within the Lomas Barbudal Biological Reserve Nº 43234-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by articles 50, 140 subsections 3) and 18) and 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration Nº 6227 of May 2, 1978, articles 1, 32 and 35 of the Organic Law of the Environment N°7554 of October 4, 1995; articles 1 and 3 subsection d) of the National Parks Service Law N°6084 of August 24, 1977; articles 1 and 49 of the Biodiversity Law Nº7788 of April 30, 1998; article 1, second paragraph of the Forest Law Nº7575 of February 13, 1996, Executive Decree N°16849 of January 23, 1986 declaring Lomas Barbudal Biological Reserve; and the Regulation to the Biodiversity Law, Executive Decree Nº34433-MINAE of March 11, 2008.

I: That the Lomas Barbudal Biological Reserve was created by Executive Decree N°16849-MAG of January 23, 1986.

II: That the Biodiversity Law Nº7788 of April 30, 1998, in its article 22 created the National System of Conservation Areas (SINAC), as a decentralized and participatory institutional management and coordination system, which integrates competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.

III: That the General Management Plan for the Lomas Barbudal Biological Reserve has been issued by resolution N° R-SINAC-CONAC-24-2016 published in the Official Gazette N°211 of Thursday, November 3, 2016.

IV: That the Organic Law of the Environment N°7554 provides that the creation, conservation, administration, development, and monitoring of Protected Wilderness Areas shall have the objectives of conserving natural environments, ensuring the balance and continuity of the evolutionary and ecological processes upon which some wild species depend.

V: That the Organic Law of the Environment N°7554 determines the Management Categories, as well as the competencies, regulations, and responsibilities designated to the State through the Ministry of Environment and Energy (MINAE) and SINAC, to achieve compliance with its conservation objectives.

VI: That the 2016-2026 Five-Year Strategic Plan of the National System of Conservation Areas includes, as a strategic action, the development of the sustainable tourism program in protected areas.

VII: That the Sustainable Tourism Policy establishes that tourism management in protected wilderness areas (ASP) must be developed within a framework of sustainability, integrated with their areas of influence, and articulated with national conservation and tourism policies, plans, and programs.

VIII: That in accordance with policy 6 of the Policies for the Protected Wilderness Areas of the SINAC, the management of protected wilderness areas will be supported by a solid base of scientific, technical, and traditional knowledge that allows for continuous improvement and greater levels of effectiveness and efficiency in the conservation of biodiversity. Thus, research is constituted as a priority action within the Lomas Barbudal Biological Reserve.

IX: That technically, the Biological Reserve management category constitutes a restrictive management category, such that activities must be strictly regulated to guarantee the conservation of the focal management elements.

X: That it is necessary to issue rules that regulate the exercise of permitted activities within the Lomas Barbudal Biological Reserve, in accordance with what is established in the General Management Plan of this protected wilderness area, in relation to the activities that the management category technically admits.

XI: That this regulation responds to the highest environmental principles provided in articles 9 and 11 of the Biodiversity Law N°7788, for the adequate conservation of the protected wilderness area; fully complying with the provisions of Directive N°052-MP-MEIC.

XII: That in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures, Executive Decree Nº37045-MP-MEIC and its amendments, this proposal complies with the principles of regulatory improvement according to the positive report DMR-DAR-INF-063-2021 of May 12, 2021, issued by the Department of Regulatory Analysis of the Directorate of Regulatory Improvement of the MEIC.

General Provisions

Considering:

CHAPTER I

a)MINAE: Ministry of Environment and Energy b) SINAC: National System of Conservation Areas.
c)CORACAT: Regional Council of the Arenal Tempisque Conservation Area.
d)ACAT: Arenal Tempisque Conservation Area.
e)RBLB: Lomas Barbudal Biological Reserve.
f)ICT: Costa Rican Tourism Institute.

a. Academy: Activity oriented towards teaching or training in theoretical and practical knowledge of biodiversity components.

b. Harass (Acosar): The action of cornering, trapping, pursuing, or trying to extract an animal from its natural habitat.

c. Open-air classroom (Aula abierta): An outdoor site where the academy exercise is carried out.

d. Hunting (Caza): The action, for any purpose, of harassing (acosar), capturing, or killing wild animals, as well as the collection of products or subproducts derived from them.

e. Campfires (Fogatas): Fire generated with sticks, branches, leaf litter, charcoal, and other fuels.

f. Contaminate (Contaminar): Negatively altering the natural conditions of an environment, landscape, or ecosystem, whether physically or chemically.

g. Extract (Extraer): Removing wildlife, its parts, products, or derivatives.

h. Manipulate (Manipular): Operating with hands or any instrument on wild flora or fauna species.

i. General Management Plan (Plan General de Manejo): Planning instrument that guides the management of the RBLB towards the fulfillment of its long-term conservation objectives. It is based on strategic lines of action in the medium term and on management objectives for the natural and cultural elements included within the area, as well as on the relationship of the latter with their socio-environmental surroundings. It is the basis for the development of other planning and regulation instruments for the RBLB.

j. Volunteer (Voluntario): refers to the natural person who voluntarily and without financial remuneration collaborates with the National System of Conservation Areas (SINAC), supporting the actions carried out by the SINAC personnel, both in the Protected Wilderness Areas (ASP) and in the rest of the administrative offices of SINAC.

CHAPTER II

a)To carry out commercial, scientific, educational, touristic, or journalistic filming, the interested party must complete the procedures provided in section V of Chapter III of this Regulation.
b)To carry out research and scientific or academic collection must be governed by the provisions of articles 19 and 20 of this Regulation.
c)To carry out guided walks, regardless of their purpose, the interested party must complete the procedure provided in articles 24 and 25 of this Regulation.

The Administration of the RBLB will maintain an updated control system, which will allow it to determine, at all times, the number of visitors present.

The entrances through the sectors of Agua Fría, Balas de Cañon, Papayito, Marañonal, Madroño, Cabuyo, and Las Mesas will have gates that will limit access to the Lomas Barbudal Biological Reserve.

Regulation of Permitted Activities within the Lomas Barbudal Biological Reserve

Permitted Activities

CHAPTER III

SECTION I

a)Absolute Protection Zone (ZPA).
b)Special Use Zone (ZUE).
c)Restricted Use Zone (ZUR).
d)Buffer Zone (ZA).

The Exercise of Research

SECTION II

To exercise this activity, the interested party must have the respective duly issued and valid permits and licenses.

For this purpose, they must coordinate with the Administrator of the Protected Area to determine the date and place. The presentation must contain at least:

a)Results obtained during the research.
b)Recommendations for the management of the protected area in light of the findings discovered.

The Exercise of Ecotourism

SECTION III

a)In the Absolute Protection Zone (Zona de Protección Absoluta), the exercise of any ecotourism activity is totally prohibited.
b)In the Restricted Use Zone (Zona de Uso Restringido), only restricted ecotourism is authorized, and by exception. According to the following list of activities by zone:

b.1. Guided Walks: On the trails called Gigantes del Bosque, La Catarata, El Toledo, El Corral, Caoba, research trail.

b.2. Entry and bathing in bodies of water: In the La Poza sector.

a)Any person conducting activities as a tour guide within the Lomas Barbudal Biological Reserve must have the tour guide credential issued by the Costa Rican Tourism Institute (Instituto Costarricense de Turismo), for which they must comply with the accreditation process and requirements before that entity according to the provisions of the Regulation for Tour Guides, Executive Decree N°41369-MEIC-TUR.
b)The uniform worn by tour guides in this protected area may not, at any time, be similar or alike in shirt and pants color to that of the officials of the Administration of the Lomas Barbudal Biological Reserve.
c)The guide must have a prior site recognition accreditation issued by the Administration of the Lomas Barbudal Biological Reserve. Such accreditation shall be granted in accordance with the provisions of article 26 of this Regulation.
d)Groups shall consist of a maximum of 15 people per guide.
e)During the ecotourism activity, unmanned aerial vehicles (drones) may not be used.

The request must be submitted at least 15 calendar days in advance of the date on which the activity is intended to be carried out and contain the following requirements:

a)Name and qualifications of the applicant. If the applicant is a legal entity, the request must be signed by the legal representative or, failing that, by whoever holds a general or special power of attorney granting them sufficient authority to make the request.
b)Name of the tour guide, identification number, and number of the tour guide credential assigned by the Costa Rican Tourism Institute (ICT).
c)Number of ecotourists in the group.
d)Date on which the activity is intended to be carried out.
e)Number of the prior site recognition accreditation issued by the Administration of the RBLB.
f)Signature of the applicant.
g)Means for receiving notifications.

Upon completion of the familiarization tour, the corresponding accreditation shall be issued, which shall be valid for 3 years.

All requirements established in article 25 of this Regulation having been met, the Administration of the RBLB shall proceed to authorize or deny the request by duly substantiated administrative resolution, which must be issued within a period not exceeding five calendar days once all requirements are met. If, for due reasoning, it is not possible to authorize the ecotourism activity for the requested date, the Administrator shall suggest in the same administrative act another date for consideration by the interested party.

The exercise of this activity does not require a tour guide.

a)The use of soap, shampoo, repellents, or other chemicals is not permitted while entering the water. Nor is the washing of clothes or shoes with soap or other detergents authorized.
b)Amorous scenes or the use of obscene language that threatens the stay and morals of other visitors is not permitted.
c)The use of tires or articles used for floating is not permitted, except for life jackets or flotation devices attached to the body.
d)Jumping from the riverbanks, trees, or rocks to perform "diving" actions is not permitted.
e)In the La Poza sector and nearby areas, building campfires (fogatas) or carrying out picnic activities is not permitted.
f)The ecotourist entering La Poza does so at their exclusive responsibility.

This work may also be performed by volunteers, but they may not exercise actions pertaining to the police function.

The Exercise of the Academy

SECTION IV

This activity is restricted under the following terms:

a)The teacher guiding the activity must have a prior site recognition accreditation issued by the Administration of the Lomas Barbudal Biological Reserve. Such accreditation shall be granted in accordance with the provisions of article 33 of this Regulation.
b)Groups shall consist of a maximum of 30 people.
c)During the activity, wildlife or geological material may not be manipulated (manipular). The teacher must use special equipment such as binoculars, a telescope, a guide to birds, plants, insects, or other guides to taxonomic groups to show the elements of nature they wish to show with primary interest to the students.

Excepted from the provisions of subsection c) above are those cases where the teacher has a research or academic collection permit; in such a case, the researcher may carry out the manipulation (manipulación) or capture following the rules established in the permit or license that has been issued by the SINAC.

a)Any person conducting activities as a tour guide within the Lomas Barbudal Biological Reserve must have the tour guide credential issued by the Costa Rican Tourism Institute, for which they must comply with the accreditation process and requirements before that entity according to the provisions of the Regulation for Tour Guides, Executive Decree N°41369-MEIC-TUR.

a)Name and qualifications of the applicant. If the applicant is a legal entity, the request must be signed by the legal representative or, failing that, by whoever holds a general or special power of attorney granting them sufficient authority for making the request.

The Exercise of the Academy

SECTION IV

b)Groups shall consist of a maximum of 30 people.
c)During the activity, wildlife or geological material may not be manipulated (manipular). The teacher must use special equipment such as binoculars, a telescope, a guide to birds, plants, insects, or other guides to taxonomic groups to show the elements of nature they wish to show with primary interest to the students.

The request must be submitted at least one month in advance of the date on which the activity is intended to be carried out and contain the following requirements:

a)Name of the academic center or non-governmental organization and the name and qualifications of the teacher who will conduct the activity.
b)Specific objectives intended to be achieved with the academic activity.
c)Number of students in the group.
d)Date on which the academic activity is intended to be carried out.
e)Number of the prior site recognition accreditation issued by the Administration of the RBLB.
f)Signature of the teacher responsible for the academic activity with the approval of the Directorate of the Academic Center or non-governmental organization.
g)Means for receiving notifications.

Upon completion of the reconnaissance tour, the due accreditation shall be issued, which shall be valid for 5 years.

In the event that the request is incomplete, a single written notice (prevención) shall be made to the applicant to complete the omitted requirements in the request or to clarify or rectify the information, granting a reasonable period of up to ten days to complete or clarify. Said notice shall temporarily suspend the period for resolution. In the event that the notice is not addressed by the applicant, the proceeding shall be archived. In the event that, under due reasoning, it is not possible to authorize the academic activity for the requested date, the Administrator shall suggest, in the same administrative act, another date for consideration by the interested party.

Under no circumstances may the authorized educational center or non-governmental organization charge any fee for the presence of these persons assigned by the Administration to participate in the activity.

On the Exercise of Filming

SECTION V

38295-MINAE. This activity may be carried out only under the following circumstances: a) By those who, while carrying out another activity that has been authorized for them, wish to film for the sole purpose of preserving a memory.

b)Commercial, scientific, educational, or tourist filming activities duly authorized by the ACAT Directorate in the zones permitted by the General Management Plan (Plan General de Manejo).
c)Journalistic filming activities duly authorized by the RBLB Administrator.

If, for maintenance, protection, or conservation reasons, filming permits are restricted, filming for scientific research and management activity purposes shall have priority over commercial filming.

The ACAT Directorate shall grant or deny the requested permit by means of a duly reasoned resolution, which shall be issued within a maximum period of 10 calendar days after the submission of the request made completely and correctly.

Said request must contain the following data:

a)Name and qualifications of the applicant. In the event that the applicant is a legal entity, the request must be signed by the legal representative or, failing that, by whoever holds a general or special power of attorney granting them sufficient authority to make the request.
b)Purposes of the material to be filmed.
c)Indication of the number of days intended for filming. d) Indicate the means for receiving notifications.

In addition, the following documents must be attached to the request:

a)Registration certification of legal status in the case of legal entities.
b)Copy of the filming script. The request must be made using the format established in Annex No. 1 of these Regulations.

At the time of submitting the request, the applicant's identity card must be presented in the case of a domestic natural person, passport in the case of a foreign natural person, or that of the legal representative in the case of a legal entity, so that the official receiving the submission can verify the identity and record the verification.

In the event that the request is submitted incompletely, the applicant shall be notified (prevención) to submit the missing requirements within a maximum period of 3 business days, or to rectify any required information; under warning of the request being archived in case of non-compliance.

For this purpose, the interested party must request authorization by filling out the form that will be provided for this purpose at the RBLB Administration, which shall contain the following: a) Name and qualifications of the applicant. In the event that they belong to a media outlet, detail the company's qualifications. b) Purposes of the material to be filmed. c) Indication of the means for receiving notifications; for which, the applicant shall use the format established in Annex No. 1 of these Regulations. The period for approval by the Administration shall be two hours. At the time of submitting the request, the applicant must also present their identity card in the case of a domestic natural person, passport in the case of a foreign natural person, or that of the legal representative in the case of a legal entity, so that the official receiving the submission can verify the identity and record it as such.

Prohibited Activities

SECTION VI

a)The trade and trafficking of any wildlife product of aquatic or terrestrial origin.
b)Fishing, hunting, extracting, manipulating, harassing, and molesting individuals of any type of aquatic or terrestrial animal species.
c)Extracting and manipulating organisms of any type of aquatic or terrestrial plant species.
d)Extracting and manipulating any species belonging to the Kingdom Fungi (fungi).
e)Extracting any type of organic or inorganic material, including sand, or stones for any type of use.
f)The use of cages for fauna observation, except for scientific or educational purposes, provided that they have the respective permit granted by the competent authority.
g)Feeding aquatic and terrestrial organisms.
h)Entering the Protected Wild Area with any type of pet.

Excepted from the foregoing prohibitions are activities for scientific, educational, or management purposes carried out by SINAC personnel or by researchers who have the respective authorization and that are in compliance with the application of the Wildlife Conservation Law (Ley de Conservación de Vida Silvestre) No. 7317 and its regulation, Executive Decree 40548-MINAE, such that they are not prohibited or constitute a crime or contravention according to said norms.

a)Making any type of mark on trees, rocks, and any other element within the boundaries of the RBLB.
b)The carrying or use of any type of weapon (such as firearms, bladed weapons, compressed air or spring weapons, slingshot arrows, crossbows) unless they are used for management purposes authorized by the ACAT or for control and surveillance exercised by the State.
c)The sale and consumption of drugs. Excepted from this provision are those substances for medical treatment.
d)Camping or lighting campfires within the boundaries of the protected wild area. e) Nudism.
f)Any type of environmental pollution produced by solid or liquid waste.
g)The generation of excessive noise, except that which is generated for administrative reasons.
h)The entry of food containing seeds.
i)The entry of prepared foods. Except for the minimum sustenance that must be brought in by persons with a health condition that warrants the entry of certain foods.
j)Deviating outside the width of the trails during guided walks.

Powers of the Administration

CHAPTER IV

If the restriction needs to be applied for a period longer than one month, it shall issue it and bring it to the attention of the Scientific Technical Committee of the Conservation Area for recommendation to the ACAT Directorate to extend its validity for the time deemed necessary, in light of the principles governing environmental matters and sound judgment.

Volunteers who are assisting in the work carried out by officials in their different programs may likewise access the different geographical zones and sectors of the RBLB, as required and arranged by the Administration.

Closure may also be ordered when necessary for the execution of actions recommended by the management programs, whose proper development could be affected by the presence of visitors in the area.

These administrative provisions may include the partial or total closure of the protected wild area for the time deemed appropriate.

Likewise, the authorization for stay and the carrying out of activities may be suspended due to adverse weather conditions or any other duly justified reason, without this generating liability for the Administration.

Failure to comply with this provision shall be grounds to suspend the authorization for stay within the protected wild area.

Said activities shall respect the technical criteria for zoning and conservation provided for in the General Management Plan.

Final Provisions

CHAPTER V

6084, in Chapters XI and XII of the Wildlife Conservation Law No. 7317 and its amendments, as well as with the application of any other sanctioning regulation in force on the date of the events.

PRIMERO: Que la Reserva Biológica Lomas Barbudal, fue creada mediante el Decreto Ejecutivo N°16849-MAG del 23 de enero de 1986.

SEGUNDO: Que la Ley de Biodiversidad Nº7788 del 30 de abril de 1998, en su artículo 22 creó el Sistema Nacional de Áreas de Conservación (SINAC), como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integra las competencias en materia forestal, vida silvestre, áreas protegidas y el Ministerio de Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos, dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.

TERCERO: Que se ha dictado el Plan General de Manejo de la Reserva Biológica Lomas Barbudal mediante resolución N° R-SINAC-CONAC-24-2016 publicada en el Diario Oficial la Gaceta N°211 del jueves 3 de noviembre de 2016.

CUARTO: Que la Ley Orgánica del Ambiente N°7554, dispone que la creación, la conservación, la administración y desarrollo y la vigilancia de las Áreas Silvestres Protegidas, tendrán como objetivos, conservar los ambientes naturales asegurando el equilibrio y la continuidad de los procesos evolutivos y ecológicos de los que dependen algunas especies silvestres.

QUINTO: Que la Ley Orgánica del Ambiente N°7554, determina las Categorías de Manejo, así como las competencias, regulaciones y responsabilidades que le son designadas al Estado a través del Ministerio de Ambiente y Energía (MINAE) y el SINAC, para lograr el cumplimiento de los objetivos de conservación de la misma.

SEXTO: Que en el Plan Estratégico Quinquenio 2016-2026 del Sistema Nacional de Áreas de Conservación, se incluye como una acción estratégica el desarrollo del programa de turismo sostenible en las áreas protegidas.

SEPTIMO: Que la Política de Turismo sostenible establece que la gestión del turismo en las áreas silvestres protegidas (ASP) deberá desarrollarse dentro de un marco de sostenibilidad, integrado con sus áreas de influencia y articulado con las políticas, planes y programas nacionales de conservación y turismo.

OCTAVO: Que conforme a lo dictado por la política 6 de las Políticas para las Áreas Silvestres Protegidas del SINAC, la gestión de las áreas silvestres protegidas estará sustentada en una sólida base de conocimiento científico, técnico y tradicional que permita el mejoramiento continuo y mayores niveles de eficacia y eficiencia en la conservación de la biodiversidad. Constituyéndose así la investigación en una acción prioritaria dentro de la Reserva Biológica Lomas Barbudal.

NOVENO: Que técnicamente la categoría de manejo Reserva Biológica, constituye una categoría de manejo restrictiva de manera que las actividades deben ser reguladas de manera estricta para garantizar la conservación de los elementos focales de manejo.

DÉCIMO: Que resulta necesario dictar normas que regulen el ejercicio de las actividades permitidas dentro de la Reserva Biológica Lomas Barbudal, de acuerdo a lo establecido en el Plan General de Manejo de esta área silvestre protegida, en relación con las actividades que técnicamente admite la categoría de manejo.

DÉCIMO PRIMERO: Que el presente reglamento responde a los más altos principios ambientales previstos en los artículos 9 y 11 de la Ley de Biodiversidad N°7788, para la adecuada conservación del área silvestre protegida; cumpliéndose cabalmente con lo dispuesto en la Directriz N°052-MP-MEIC.

DÉCIMO SEGUNDO: Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº37045-MP-MEIC y sus reformas, la presente propuesta cumple con los principios de mejora regulatoria según el informe positivo DMR-DAR-INF-063-2021 del 12 de mayo de 2021, emitido por el Departamento de Análisis Regulatorio de la Dirección de Mejora Regulatoria del MEIC.

Considerando:

Por tanto,

DECRETAN:

CAPÍTULO I

Disposiciones Generales

a)MINAE: Ministerio de Ambiente y Energía b) SINAC: Sistema Nacional de Áreas de Conservación.
c)CORACAT: Consejo Regional del Área de Conservación Arenal Tempisque.
d)ACAT: Área de Conservación Arenal Tempisque.
e)RBLB: Reserva Biológica Lomas Barbudal.
f)ICT: Instituto Costarricense de Turismo.

a. Academia: Actividad orientada a la enseñanza o capacitación en conocimientos teórico prácticos de los componentes de la biodiversidad.

b. Acosar: Acción de acorralar, atrapar, perseguir o tratar de extraer de hábitat natural a un animal.

c. Aula abierta: Sitio al aire libre en el que se realiza el ejercicio de la academia.

d. Caza: La acción, con cualquier fin, de acosar, apresar o matar animales silvestres, así como la recolección de productos o subproductos derivados de estos.

e. Fogatas: Fuego generado con palos, ramas, hojarasca, carbón y otros combustibles.

f. Contaminar: Alterar negativamente las condiciones naturales de un medio, paisaje, ecosistema, sea física o químicamente.

g. Extraer: Sacar vida silvestre, sus partes, productos o derivados.

h. Manipular: Operar con las manos o con cualquier instrumento especies de flora o fauna silvestre.

i. Plan General de Manejo: Instrumento de planificación que permite orientar la gestión de la RBLB hacia el cumplimiento de sus objetivos de conservación a largo plazo. Se fundamenta en líneas de acción estratégicas a mediano plazo y en objetivos de manejo para los elementos naturales y culturales incluidos dentro del área, así como en la relación de estos últimos con su entorno socio ambiental. Es la base para el desarrollo de otros instrumentos de planificación y reglamentación de la RBLB.

j. Voluntario: se refiere a la persona física que de manera voluntaria y sin remuneración económica, colabora con el Sistema Nacional de Áreas de Conservación (SINAC), apoyando en las acciones desarrolladas por el personal del SINAC, tanto en las Áreas Silvestres Protegidas (ASP), como en el resto de las oficinas administrativas del SINAC.

CAPÍTULO II

En todo caso la hora límite para presentarse en el sitio de salida oficial lo será las 16:30 horas.

CAPÍTULO II

a)Para la realización de filmación comercial, científica, educativa, turística o periodística, el interesado deberá realizar los trámites previstos en la sección V del Capítulo III del presente Reglamento.
b)Para la realización de investigación y colecta científica o académica deberá regirse por lo dispuesto en los artículos 19 y 20 del presente Reglamento.
c)Para la realización de caminatas guiadas independientemente de su fin, el interesado deberá realizar el trámite previsto en los artículos 24 y 25 del presente Reglamento.

La Administración de la RBLB, llevará un sistema de control actualizado, que le permitirá determinar en todo momento, el número de visitantes presentes.

Las entradas por los sectores de Agua Fría, Balas de Cañon, Papayito, Marañonal, Madroño, Cabuyo y Las Mesas, tendrán portones que limitarán el acceso a la Reserva Biológica Lomas Barbudal.

Del Ejercicio de la Investigación

SECCIÓN II

Para el ejercicio de dicha actividad el interesado deberá contar con los permisos y licencias respectivas debidamente emitidas y vigentes.

Para tal efecto deberá coordinar con el Administrador del Área Protegida a efectos de determinar la fecha y lugar. La presentación deberá contener como mínimo:

a)Resultados obtenidos durante la investigación.
b)Recomendaciones para la gestión del área protegida a la luz de los hallazgos encontrados.

Del Ejercicio del Ecoturismo

SECCIÓN III

a)En la Zona de Protección Absoluta se encuentra totalmente prohibido el ejercicio de toda actividad ecoturística.
b)En la Zona de Uso Restringido únicamente se autorizará ecoturismo restringido y por excepción. De acuerdo a la siguiente relación de actividades por zona:

b.1. Caminatas Guiadas: En los senderos denominados Gigantes del Bosque, La Catarata, El Toledo, El Corral, Caoba, sendero de investigación.

b.2. Ingreso y baño en cuerpos de agua: En el sector La Poza.

a)Toda persona que ejerza actividades como guía de turismo dentro de la Reserva Biológica Lomas Barbudal, deberá contar con la credencial de guía de turismo emitida por el Instituto Costarricense de Turismo para lo cual deberá cumplir ante esa instancia el proceso y requisitos de acreditación según lo dispuesto en el Reglamento de los guías de turismo, Decreto Ejecutivo N°41369-MEIC-TUR.
b)El uniforme que usen los guías de turismo en esta área protegida no podrá ser en ningún momento semejante o parecido en color de camisa y pantalón con el de las personas funcionarias de la Administración de la Reserva Biológica Lomas Barbudal.
c)El guía deberá contar con una acreditación de reconocimiento previo del sitio emitida por la Administración de la Reserva Biológica Lomas Barbudal. Tal acreditación se otorgará de acuerdo a lo estipulado en el artículo 26 del presente Reglamento.
d)Los grupos deberán estar integrados por un máximo de 15 personas por guía.
e)Durante la actividad de ecoturismo no podrá utilizarse aeronaves no tripuladas (drones).

La solicitud deberá ser presentada con al menos 15 días naturales de antelación a la fecha en que se pretende realizar la actividad y contener los siguientes requisitos:

a)Nombre y calidades del solicitante. En caso de que el solicitante sea una persona jurídica la solicitud deberá estar suscrita por el representante legal o en su defecto por quien posea poder general o especial que le otorgue facultades suficientes para realizar la solicitud.
b)Nombre del guía turístico, número de identificación y número de credencial de guía de turismo asignada por el Instituto Costarricense de Turismo (ICT).
c)Cantidad de ecoturistas que conforman el grupo.
d)Fecha en la que se pretende efectuar la actividad.
e)Número de la acreditación de reconocimiento previo del sitio emitida por la Administración de la RBLB.
f)Firma del solicitante.
g)Medio para recibir notificaciones.

Al culminar la gira de reconocimiento se emitirá la debida acreditación que tendrá una vigencia de 3 años.

Habiéndose cumplido los requisitos establecidos en el artículo 25 del presente Reglamento, la Administración de la RBLB procederá a autorizar o denegar la solicitud mediante resolución administrativa debidamente fundamentada, misma que deberá emitirse en un plazo no mayor a cinco días naturales una vez cumplidos todos los requisitos. En caso de que bajo debido razonamiento no sea posible autorizar la actividad ecoturística para la fecha solicitada, el Administrador sugerirá en el mismo acto administrativo otra fecha para que sea considerada por el interesado.

El ejercicio de esta actividad no requiere guía turístico.

a)No se permite el uso de jabón, champú, repelentes u otros químicos durante el ingreso al agua. Tampoco se autoriza el lavado de ropa o zapatos con jabones u otros detergentes.
b)No se permiten las escenas amorosas o el uso de lenguaje obsceno que atente contra la estadía y la moral de los demás visitantes.
c)No se permite el uso de neumáticos o artículos que se utilicen para flotar, excepto chaleco salvavidas o flotadores ligados al cuerpo.
d)No se permite lanzarse de los bordes del río, árboles o rocas para practicar acciones tipo "clavados".
e)En el sector de La Poza y áreas cercanas, no se permite efectuar fogatas ni desarrollar actividades de comida campestre.
f)El ecoturista que realice el ingreso a La Poza, lo realiza bajo su exclusiva responsabilidad.

Esta labor podrá ser realizada también por voluntarios, pero estos no podrán ejercer acciones propias de la función policial.

Del Ejercicio de la Academia

SECCIÓN IV

Esta actividad se restringe en los siguientes términos:

a)El docente que guie la actividad deberá contar con acreditación de reconocimiento previo del sitio emitida por la Administración de la Reserva Biológica Lomas Barbudal. Tal acreditación se otorgará de acuerdo a lo estipulado en el artículo 33 del presente Reglamento.
b)Los grupos deberán estar integrados por un máximo de 30 personas.
c)Durante la actividad no podrá manipularse vida silvestre o material geológico. El docente deberá utilizar equipo especial como binoculares, telescopio, guía de aves, plantas, insectos u otras guías de grupos taxonómicos para mostrar los elementos de la naturaleza que desee mostrar con principal interés a los estudiantes.

Se exceptúa de lo establecido en el inciso c) anterior, aquellos casos en que el docente cuente con permiso de investigación o colecta académica; en tal caso, podrá el investigador realizar la manipulación o captura siguiendo las reglas establecidas en el permiso o licencia que haya sido emitido por el SINAC.

Del Ejercicio de la Academia

SECCIÓN IV

Esta actividad se restringe en los siguientes términos:

a)El docente que guie la actividad deberá contar con acreditación de reconocimiento previo del sitio emitida por la Administración de la Reserva Biológica Lomas Barbudal. Tal acreditación se otorgará de acuerdo a lo estipulado en el artículo 33 del presente Reglamento.
b)Los grupos deberán estar integrados por un máximo de 30 personas.
c)Durante la actividad no podrá manipularse vida silvestre o material geológico. El docente deberá utilizar equipo especial como binoculares, telescopio, guía de aves, plantas, insectos u otras guías de grupos taxonómicos para mostrar los elementos de la naturaleza que desee mostrar con principal interés a los estudiantes.

La solicitud deberá ser presentada con al menos un mes de antelación a la fecha en que se pretende realizar la actividad y contener los siguientes requisitos:

a)Nombre del centro académico u organización no gubernamental y nombre y calidades del docente que realizará la actividad.
b)Objetivos específicos que se pretenden cumplir con la actividad académica.
c)Cantidad de estudiantes que conforman el grupo.
d)Fecha en que se pretende efectuar la actividad académica.
e)Número de la acreditación de reconocimiento previo del sitio emitida por la Administración de la RBLB.
f)Firma del docente responsable de la actividad académica con visto bueno de la Dirección del Centro Académico u organización no gubernamental.
g)Medio para recibir notificaciones.

Al culminar la gira de reconocimiento se emitirá la debida acreditación que tendrá una vigencia de 5 años.

En caso de que la solicitud se encuentre incompleta, se realizará una única prevención escrita al solicitante para que complete los requisitos omitidos en la solicitud o para que aclare o subsane la información otorgando un plazo razonable de hasta diez días para completar o aclarar. Dicha prevención suspenderá temporalmente el plazo para resolver. En caso de que la prevención no sea atendida por el solicitante, se procederá con el archivo del trámite. En caso de que bajo debido razonamiento no sea posible autorizar la actividad académica para la fecha solicitada, el Administrador sugerirá en el mismo acto administrativo otra fecha para que sea considerada por el interesado.

En ningún caso el centro educativo u organización no gubernamental autorizada podrá realizar cobro alguno por la presencia de estas personas asignadas por la Administración para participar en la actividad.

Del Ejercicio de la Filmación

SECCIÓN V

Esta actividad podrá ser realizada únicamente en las siguientes circunstancias: a) Por quienes realizando otra actividad que les haya sido autorizada, deseen realizar filmación con el único fin de mantener un recuerdo.

b)Las actividades de filmación comercial, científica, educativa o turística debidamente autorizadas por la Dirección del ACAT en las zonas permitidas por el Plan General de Manejo.
c)Las actividades de filmación periodística debidamente autorizadas por el Administrador de la RBLB.

Si por razones de mantenimiento, protección o conservación, se restringen los permisos de filmación, tendrá prioridad la filmación por motivos de investigación científica y de actividades de manejo sobre la filmación comercial.

La Dirección del ACAT otorgará o denegará el permiso solicitado, mediante resolución debidamente fundamentada, la cual se emitirá en un plazo máximo de 10 días naturales posterior a la presentación de la solicitud realizada de forma completa y correcta.

Dicha solicitud deberá contener los siguientes datos:

a)Nombre y calidades del solicitante. En caso de que el solicitante sea una persona jurídica, la solicitud deberá estar suscrita por el representante legal o en su defecto por quien posea poder general o especial que le otorgue facultades suficientes para realizar la solicitud.
b)Fines del material a ser filmado.
c)Indicación de la cantidad de días que se pretende realizar filmación. d) Indicar medio para recibir notificaciones.

Además, deberá adjuntarse a la solicitud los siguientes documentos:

a)Certificación registral de la personería jurídica en caso de personas jurídicas.
b)Copia del guion de filmación. La solicitud debe hacerse utilizando el formato establecido en el Anexo N°1 del presente Reglamento.

Al momento de presentación de la solicitud, deberá presentarse la cédula de identidad del solicitante en caso de persona física nacional, pasaporte en caso de persona física extranjera, o del representante legal en caso de persona jurídica, a efectos de que el funcionario que recibe la gestión verifique la identidad y deje constancia de la constatación.

En caso de que la solicitud sea presentada de manera incompleta se prevendrá al solicitante para que en un plazo máximo de 3 días hábiles presente los requisitos faltantes, subsane cualquier información requerida; bajo apercibiendo del archivo de la solicitud en caso de no cumplimiento.

Para tal efecto, el interesado deberá solicitar la autorización llenando el formulario que para tal efecto se dispondrá en la Administración de la RBLB y que contendrá lo siguiente: a) Nombre y calidades del solicitante. En caso de que pertenezca a un medio de comunicación, detallar las calidades de la empresa. b) Fines del material a filmar. c) Indicación del medio para recibir notificaciones; para lo cual, el solicitante utilizará el formato establecido en el Anexo N°1 del presente Reglamento. El plazo para aprobación por parte de la Administración será de dos horas. Al momento de presentarse la solicitud, también deberá presentar la cédula de identidad del solicitante en caso de persona física nacional, pasaporte en caso de persona física extranjera, o del representante legal en caso de persona jurídica, a efectos de que el funcionario que recibe la gestión, verifique la identidad y así lo haga constar.

Actividades Prohibidas

SECCIÓN VI

a)El comercio y trasiego de cualquier producto de vida silvestre de origen acuático y terrestre.
b)Pescar, cazar, extraer, manipular, acosar, y hostigar a individuos de cualquier tipo de especies animales acuáticas o terrestres.
c)Extraer y manipular organismos de cualquier tipo de especies vegetales acuáticas o terrestres.
d)Extraer y manipular cualquier especie perteneciente al reino Fungi (hongos).
e)Extraer cualquier tipo de material orgánico o inorgánico, incluye arena, piedras para cualquier tipo de uso.
f)El uso de jaulas para la observación de fauna, salvo para fines científicos o educativos, siempre y cuando, cuenten con el permiso respectivo otorgado por la autoridad competente.
g)Alimentar a los organismos acuáticos y terrestres.
h)Ingresar con cualquier tipo de mascota al Área Silvestre Protegida.

Se exceptúa de las anteriores prohibiciones las actividades con fines científicos, educativos o de manejo realizadas por parte de personal del SINAC o por investigadores que cuenten con la respectiva autorización y que sean conformes a la aplicación de la Ley de Conservación de Vida Silvestre N°7317 y su reglamento, Decreto Ejecutivo 40548-MINAE, de manera que no se encuentren prohibidas o constituyan delito o contravención de acuerdo a dichas normas.

a)Realizar cualquier tipo de marca en árboles, rocas y cualquier otro elemento dentro de los límites de la RBLB.
b)La portación ni el uso de ningún tipo de arma (tales como armas de fuego, armas blancas, armas de aire comprimido o resorte, flechas de liga, arbaletas) excepto que éstas se usen con fines de manejo autorizado por el ACAT o el control y vigilancia ejercido por el Estado.
c)La venta y consumo de drogas. Se exceptúan de la presente disposición aquellas sustancias de tratamiento médico.
d)Acampar o encender fogatas dentro de los límites del área silvestre protegida. e) El nudismo.
f)Cualquier tipo de contaminación ambiental producida por residuos sólidos o líquidos.
g)La generación de ruidos excesivos salvo los que se generen por razones administrativas.
h)El ingreso de alimentos que contengan semillas.
i)El ingreso de alimentos preparados. Salvo la alimentación mínima que deba ser ingresada por personas con alguna afectación de salud que amerite el ingreso de determinados alimentos.
j)Desviarse fuera del ancho de los senderos durante las caminatas guiadas.

Potestades de la Administración

CAPÍTULO IV

Si la restricción requiere ser aplicada para un plazo mayor de un mes, la dictará y la pondrá en conocimiento del Comité Técnico Científico del Área de Conservación para que recomiende a la Dirección del ACAT prorrogar su vigencia por el tiempo que se considere necesario, a la luz de los principios que rigen la materia ambiental y la sana crítica.

Los voluntarios que se encuentren coadyuvando en las labores que desarrollan los funcionarios en sus diferentes programas, podrán de igual manera accesar a las diferentes zonas y sectores geográficos de la RBLB, según lo requiera y disponga la Administración.

También podrá ordenarse el cierre cuando sea necesario para la ejecución de las acciones recomendadas por los programas de manejo, cuyo buen desarrollo pudiera ser afectado por la presencia de visitantes en el área.

Estas disposiciones administrativas podrán incluir el cierre parcial o total del área silvestre protegida por el tiempo que se considere conveniente

Asimismo, podrá suspenderse la autorización de permanencia y la realización de actividades por motivo de condiciones climáticas adversas o cualquier otra razón debidamente justificada, sin que ello genere responsabilidad para la Administración.

El incumplimiento a esta disposición será causal para suspender la autorización de permanencia dentro del área silvestre protegida.

Dichas actividades respetarán los criterios técnicos de zonificación y conservación previstos en el Plan General de Manejo.

CAPÍTULO V

Disposiciones finales

Dado en la Presidencia de la República. San José, el nueve de septiembre del año dos mil veintiuno.

FORMATO SOLICITUD PARA EL PERMISO DE FILMACIÓN SEGÚN LOS ARTÍCULOS 37 Y 38.

ANEXO 1:

Regulation for Activities in the Lomas Barbudal Biological ReserveReglamento para actividades en la Reserva Biológica Lomas Barbudal

Artículo 1 — This Regulation establishes the provisions for the use of the services provided, permitted activities, restricted activities, and prohibited activities within the boundaries of the Lomas Barbudal Biological Reserve.

Artículo 2 — The provisions of this Regulation and the instructions issued by the officials of the Lomas Barbudal Biological Reserve to persons entering said Protected Wilderness Area, in accordance with said instrument and current regulations, are mandatory in nature.

Artículo 5 — For the purposes of this Regulation, the following nomenclatures and abbreviations will be used:

Artículo 6 — For the purposes of this Regulation, the following terms are defined:

Artículo 7 — The Administration of the RBLB shall be responsible for approving or denying entry to the RBLB.

Artículo 8 — Entry to the RBLB is permitted only for the exercise of the activities permitted according to the provisions of Chapter III of this Regulation or for activities carried out by the Public Administration in the exercise of its competencies.

Artículo 9 — Entry to the RBLB for filming, photography, research, and ecotourism purposes may only be made through the official entrance of the RBLB located in San Ramón de Bagaces, Guanacaste, or another official operational post that the Administration officially establishes.

Artículo 10 — Any natural person wishing to enter the RBLB for ecotourism reasons may do so during the following hours: from Monday to Sunday, entering between 8:00 a.m. and 4:00 p.m. In any case, the deadline to present oneself at the official exit site shall be 4:30 p.m.

Artículo 11 — For the purposes of entering the RBLB, and to demonstrate their nationality or place of origin, visitors must show the officials at the entry booth their identity card, residency card, or passport, as applicable and when required.

Artículo 12 — In the following cases, for entry to the RBLB, the interested party must make requests for additional permits under the terms indicated below:

Artículo 13 — Officials of the RBLB may deny entry to persons when it is apparent that they are under the influence of some narcotic, psychotropic substance, or drug of unauthorized use.

Artículo 14 — The Administration of the RBLB will permit the entry of persons into this protected area, following the provisions established by the terrestrial carrying capacity studies or visitation flow studies made official by CORACAT.

Artículo 15 — Within the Lomas Barbudal Biological Reserve, the entry of bicycles, horses, or vehicles of any type is not permitted, except for control and monitoring tasks, fire prevention, emergency response, or by

Artículo 16 — According to the provisions of the General Management Plan (Plan General de Manejo) of the Lomas Barbudal Biological Reserve as well as current regulations, only the activities of research, training, and low-impact ecotourism are permitted for the administered parties.

Artículo 17 — For the purposes of authorization and application of the activities permitted in this Regulation, the zoning established in the General Management Plan (Plan General de Manejo) of the RBLB shall be considered binding; in accordance with the following classification:

Artículo 18 — Research activities and scientific and academic collection are permitted within the entire geographic zoning of the Lomas Barbudal Biological Reserve.

Artículo 20 — Research requiring access to the biochemical and genetic elements of biodiversity shall be governed in accordance with the provisions of the Biodiversity Law N°7788 and its regulation.

Artículo 23 — Ecotourism activities are permitted in the RBLB under the following terms:

Artículo 24 — Guided walks for ecotourism purposes are restricted under the following terms:

Artículo 25 — Any person interested in conducting guided walks under the concept indicated in the previous article must submit a request for entry authorization to the protected area.

Artículo 27 — If the request is submitted incomplete, the applicant shall be warned to submit the missing requirements within a maximum period of 3 business days, correcting any required information; under warning of the request being archived in case of non-compliance.

Artículo 28 — Entry and bathing in the La Poza sector is only permitted for local ecotourists as it constitutes a cultural use of the site.

Artículo 29 — The following provisions apply for bathing in the La Poza sector:

Artículo 30 — Official personnel of the ACAT, duly identified and without prior notice, may accompany the ecotourists, when they deem it convenient, in order to oversee, control, and monitor the activities they carry out, as well as to guide and provide environmental information to the visitors.

Artículo 31 — The trails designated by the General Management Plan (Plan General de Manejo) as restricted use zones (zonas de uso restringido) may be used as an open-air classroom (aula abierta) by academic centers or non-governmental organizations.

Artículo 24 — Guided walks for ecotourism purposes are restricted under the following terms:

Artículo 32 — Any academic center or non-governmental organization that is interested in carrying out open-air classroom (aula abierta) activities under the concept indicated in the previous article must submit the authorization request to the Administration of the Protected Wilderness Area.

Artículo 35 — The RBLB Administration may, in any case, integrate up to three institutional officials or volunteers into the academic activity as a knowledge management mechanism.

Artículo 36 — Filming within the RBLB is permitted under the terms set forth in Executive Decree No.

Artículo 37 — To carry out commercial, scientific, educational, or tourist filming activities, the user must process a permit before the ACAT Directorate at least 15 calendar days in advance and pay the corresponding fee.

Artículo 38 — Journalistic filming (for news purposes) shall require written authorization from the RBLB Administrator.

Artículo 39 — Amateur filming solely intended to preserve a memory of the visit to the Protected Wild Area shall be exempt from the payment of fees as provided in Executive Decree No.

Artículo 40 — Drone filming within the RBLB is prohibited, except when the filming is carried out by the Administration or if the purposes are scientific and this is duly contemplated within the methodology of the research that has been duly approved by the ACAT Directorate.

Artículo 41 — Regarding wildlife species, the following is strictly prohibited within the RBLB:

Artículo 42 — In relation to the use of the RBLB, the following is absolutely prohibited:

Artículo 43 — All activities that are considered as such by the current environmental regulations or that constitute contraventions or crimes according to the national legal system are generally prohibited.

Artículo 47 — The RBLB Administration may, at any time, restrict public-use activities and sites, following the principles governing environmental matters and the objectives established in the General Management Plan.

Artículo 48 — RBLB personnel, duly identified, may, when deemed necessary, carry out any other inspection that the Administration considers necessary for compliance with these regulations and related regulations, for which they have the authority to access the entire protected area.

Artículo 50 — In case of emergency, the RBLB Administration shall have the power to execute the contingency plan established for this purpose, in order to safeguard the physical integrity of users and/or officials.

Artículo 51 — Any ACAT official may expel from the boundaries of the RBLB those persons who, being present in the protected area, carry out prohibited activities or fail to obey provisions issued by officials in the timely performance of their duties.

Artículo 52 — Obligatorily, every visitor must comply with the safety and orientation instructions given by the official, guide, or authorized teacher in charge of the group.

Artículo 54 — SINAC, through the ACAT and the RBLB Administration, may carry out within the boundaries of the RBLB training and instruction activities for officials, Natural Resource Vigilance Committees (COVIRENAS), and volunteers, for the adequate management of the protected wild area.

Artículo 55 — The stated prohibitions shall be sanctioned in accordance with the provisions of Article 9 of the National Parks Service Law (Ley del Servicio de Parques Nacionales) No.

Artículo 56 — Effective as of its publication in the Official Gazette La Gaceta.

Artículo 1 — El presente Reglamento establece las disposiciones para el uso de los servicios brindados, actividades permitidas, actividades restringidas y actividades prohibidas dentro de los límites de la Reserva Biológica Lomas Barbudal.

Artículo 2 — Las disposiciones del presente Reglamento y las indicaciones que emitan los funcionarios de la Reserva Biológica Lomas Barbudal a las personas que ingresen a dicha Área Silvestre Protegida, en apego a dicho instrumento y la normativa vigente, son de carácter obligatorio.

Artículo 5 — Para efectos del presente Reglamento se utilizarán las siguientes nomenclaturas y abreviaturas:

Artículo 6 — Para efectos del presente Reglamento se definen los siguientes términos:

Artículo 7 — Corresponderá a la Administración de la RBLB, aprobar o denegar el ingreso a la RBLB.

Artículo 8 — El ingreso a la RBLB está permitido únicamente para el ejercicio de las actividades permitidas de acuerdo a lo establecido en el Capítulo III del presente Reglamento o para actividades efectuadas por la Administración Pública en el ejercicio de sus competencias.

Artículo 9 — El ingreso a la RBLB para fines de filmación, fotografía, investigación y ecoturismo, podrá realizarse únicamente por la entrada oficial de la RBLB ubicada en San Ramón de Bagaces, Guanacaste u otro puesto operativo oficial que la Administración establezca oficialmente.

Artículo 10 — Toda persona física que desee ingresar por razones de ecoturismo a la RBLB podrá hacerlo en el siguiente horario: los días que corren de lunes a domingo ingresando entre las 8:00 y las 16:00 horas.

Artículo 12 — En los siguientes casos, para el ingreso a la RBLB, el interesado deberá realizar solicitudes de permisos adicionales en los términos que seguidamente se indican:

Artículo 13 — Los funcionarios de la RBLB podrán denegar el ingreso a personas cuando sea aparente que se encuentren bajo los efectos de algún estupefaciente, sustancia psicotrópica o droga de uso no autorizado.

Artículo 14 — La Administración de la RBLB, permitirá el ingreso de personas en esta área protegida, siguiendo las disposiciones que establezcan los estudios de capacidad de carga terrestre o flujo de visitación oficializados por el CORACAT.

Artículo 16 — Según lo establecido en el Plan General de Manejo de la Reserva Biológica Lomas Barbudal así como la normativa vigente, únicamente se permite a los administrados las actividades de investigación, capacitación y ecoturismo de bajo impacto.

Artículo 17 — Para efectos de autorización y aplicación de las actividades permitidas en el presente Reglamento, se considerará con carácter vinculante la zonificación establecida en el Plan General de Manejo de la RBLB; de conformidad con la siguiente clasificación:

Artículo 18 — Las actividades de investigación y de colecta científica y académica están permitidas dentro de toda la zonificación geográfica de la Reserva Biológica Lomas Barbudal.

Artículo 20 — Las investigaciones que requieran acceso a los elementos bioquímicos y genéticos de la biodiversidad se regirán de acuerdo a lo dispuesto en la Ley de Biodiversidad N°7788 y su reglamento.

Artículo 23 — Las actividades de ecoturismo están permitidas en la RBLB en los siguientes términos:

Artículo 24 — Las caminatas guiadas con fines ecoturísticos se restringen en los siguientes términos:

Artículo 25 — Toda persona interesada en desarrollar caminatas guiadas bajo el concepto indicado en el artículo anterior, deberá presentar solicitud de autorización de ingreso al área protegida.

Artículo 28 — El ingreso y baño en el sector La Poza, está únicamente permitido a los ecoturistas locales por constituir un uso cultural del sitio.

Artículo 29 — Para bañarse en el sector de La Poza se aplican las siguientes disposiciones:

Artículo 31 — Los senderos determinados por el Plan General de Manejo como zonas de uso restringido podrán ser utilizados como aula abierta por centros académicos u organizaciones no gubernamentales.

Artículo 24 — Las caminatas guiadas con fines ecoturísticos se restringen en los siguientes términos:

Artículo 25 — Toda persona interesada en desarrollar caminatas guiadas bajo el concepto indicado en el artículo anterior, deberá presentar solicitud de autorización de ingreso al área protegida.

Artículo 28 — El ingreso y baño en el sector La Poza, está únicamente permitido a los ecoturistas locales por constituir un uso cultural del sitio.

Artículo 29 — Para bañarse en el sector de La Poza se aplican las siguientes disposiciones:

Artículo 31 — Los senderos determinados por el Plan General de Manejo como zonas de uso restringido podrán ser utilizados como aula abierta por centros académicos u organizaciones no gubernamentales.

Artículo 32 — Todo centro académico u organización no gubernamental que esté interesado en desarrollar actividades de aula abierta bajo el concepto indicado en el artículo anterior, deberá presentar la solicitud de autorización ante la Administración del Área Silvestre Protegida.

Artículo 35 — La Administración de la RBLB podrá integrar en todo caso hasta tres funcionarios institucionales o voluntarios a la actividad académica como mecanismo de gestión del conocimiento.

Artículo 36 — La filmación dentro de la RBLB está permitida en los términos previstos en el Decreto Ejecutivo N°38295-MINAE.
