in the entirety of the text - Full Text of Standard 08 Scope of the photointerpretative geographic studies prepared by the National Geographic Institute NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT NOTICE No. 08-2022 MARITIME TERRESTRIAL ZONE Scope of the photointerpretative geographic studies prepared by the national geographic institute Based on the provisions of articles 140 and 240 of Law No. 6227, General Public Administration Law of May 2, 1978; Law No. 59, Law for the Creation and Organization of the National Geographic Institute of July 4, 1944; Law No. 8905, Reform of article 2 of Law No. 5695, Creation of the National Registry, and its reforms; and modification of Law No. 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its reforms of December 7, 2010; Law No. 6043, Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulation; the Cadastral Qualification Criterion DC-002-2002 pursuant to Art. 110 of the Regulation to the National Cadastre Law No. 6545 and; articles 2 and 3 of Law No. 5695, Law for the Creation of the National Registry of May 28, 1975 and its reforms.

1st.-That by Law No. 8905, the National Geographic Institute, hereinafter IGN, is established as a unit of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical unit governing national cartography, intended for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical and similar nature that are related to said works, in order to support planning processes.

2nd.-That Law No. 59 constitutes the IGN permanently and in representation of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any kind originating from the work entrusted to its charge.

3rd.-That, in accordance with the foregoing, the photointerpretative geographic studies form part of the activities carried out by the IGN.

4th.-That the photointerpretative geographic studies represent a process of geographic analysis, in which various techniques in the geospatial field are used, for example: the interpretation of aerial photographs and satellite images of the terrestrial surface and the study of cartographic information. With a geographic-cartographic reference scope and not topographic precision.

5th.-That the photointerpretative geographic studies are prepared in response to requests emanating from various Public Institutions, such as the Office of the Attorney General (Procuraduría General de la República, PGR), the Public Ministry, the Ministry of Environment and Energy (MINAE), Municipalities, among others, as well as internally within the IGN and the National Registry, and private users with plan qualification memos issued by the Directorate of the Real Property Registry of the National Registry, in which, for the most part, said request is due to the need to determine the existence of mangroves and estuaries (esteros), basically in those sectors of the country where an official delimitation of the Maritime Terrestrial Zone (Zona Marítimo Terrestre, ZMT) does not yet exist.

6th.-That the determination of the existence of mangroves and estuaries (esteros) by the IGN through its photointerpretative geographic studies is subject to or contingent upon the powers of other public institutions regarding the protection of the State's Natural Heritage (Patrimonio Natural del Estado, PNE).

7th.-That Law No. 7575, called the Forestry Law (Ley Forestal) of February 13, 1996, in its article 16 establishes that the Ministry of Environment and Energy shall delimit, on the ground, the boundaries of the areas that make up the PNE.

8th.-That Law No. 6043 establishes in its article 1 of Chapter I, General Provisions that the maritime terrestrial zone constitutes part of the national heritage, belongs to the State and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is an obligation of the State, its institutions and all inhabitants of the country. Its use and exploitation are subject to the provisions of this law.

9th.-That in the same Law No. 6043, article 11 of Chapter I, General Provisions, indicates that the public Zone also comprises, whatever its extension, that occupied by all the mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.

10.-That Executive Decree No. 36786-MINAET, titled Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives to Identify within the Maritime Terrestrial Zone (ZMT) those lands that classify as forests, of forestry aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries (esteros), rias, marshes, coastal lagoons, swamps, flooded forests, salt flats), to certify them and incorporate them as part of the State's Natural Heritage (PNE).

11.-That Executive Decree No. 36786-MINAET in point III.-Powers for delimitation and certification establishes that The classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations to classify forests, lands of forestry aptitude (Class VII and VIII soils), (mangroves, estuaries (esteros), rias, marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.

The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC with the corresponding territorial competence. The ACs of SINAC with jurisdiction in the ZMT shall also be competent for the verification, control, demarcation (deslinde) and certification of the lands of the State's Natural Heritage and the protection zones.

The location and delimitation of the areas of the State's Natural Heritage within the Maritime Terrestrial Zone must be carried out as part of the approval process of the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all the zones to be concessioned within the ZMT and for its classification at the level of cadastre plans. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so as not to count them within the total area to be concessioned.

12.-That in Law No. 6227, General Public Administration Law, its article 140 indicates that The administrative act shall produce its effect after being communicated to the administered party, except if it only grants rights, in which case it shall produce them from the moment it is adopted, a provision that must necessarily be related to article No. 240 of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by indicating that General acts shall be communicated by publication and specific ones by notification.

It is hereby communicated:

First.-The photointerpretative geographic studies developed by the IGN related to the recognition and existence of the estuaries (esteros) and mangroves of the country, are constituted as technical support reports solely and exclusively for the Public Institutions of the country, internally within the IGN and the National Registry, as well as for private users with plan qualification memos issued by the Directorate of the Real Property Registry of the National Registry.

Second.-The photointerpretative geographic studies are carried out based on photointerpretative analysis from the collection of aerial photographs, satellite images and the national cartography available to the IGN.

Third.-The photointerpretative geographic studies are carried out within the geographic and cartographic scope and therefore do not have topographic-type precisions.

Fourth.-Due to their precisions, the photointerpretative geographic studies are technical inputs that help in the determination of estuaries (esteros) and mangroves observable in aerial photographs, satellite images and the national cartography, and therefore do not fulfill a binding function regarding the declaration of PNE, the latter being of exclusive competence of MINAE.

Fifth.-We proceed to instruct and communicate through this notice to the general citizenry, to academia, to the public and private sector, to the municipalities, and to any other national or international entity, that the photointerpretative geographic studies prepared by the IGN are for the purposes set forth in this publication.

Sixth.-It takes effect from its publication.

1. 1Que mediante ley N.º 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la ley N.º 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley N.º 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que, de conformidad con lo anterior, los estudios geográficos fotointerpretativos forman parte de las actividades desarrolladas por el IGN.
4. 4Que los estudios geográficos fotointerpretativos representan un proceso de análisis geográfico, en el cual se utilizan diversas técnicas en el ámbito geoespacial, por ejemplo: la interpretación de fotografías aéreas e imágenes satelitales de la superficie terrestre y el estudio de la información cartográfica. Con ámbito de referencia geográfica-cartográfica y no de precisión topográfica.
5. 5Que los estudios geográficos fotointerpretativos se elaboran en atención a solicitudes emanadas por diversas Instituciones Públicas, tales como la Procuraduría General de la República (PGR), Ministerio Público, Ministerio de Ambiente y Energía (MINAE), Municipalidades, entre otros, así como a lo interno del IGN y del Registro Nacional, y usuarios particulares con minutas de calificación de planos emitidas por la Dirección del Registro Inmobiliario del Registro Nacional, en las cuales en su mayoría, dicha solicitud es por la necesidad de determinar la existencia de manglares y esteros básicamente sobre aquellos sectores del país donde todavía no existe una delimitación oficial de la Zona Marítimo Terrestre (ZMT).
6. 6Que la determinación de la existencia de manglares y esteros por parte del IGN a través de sus estudios geográficos fotointerpretativos están sujeto o supeditados a las competencias de otras instituciones públicas acerca del resguardo del Patrimonio Natural del Estado (PNE).
7. 7Que la Ley N.º 7575 denominada Ley Forestal del 13 de febrero de 1996, en su artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno, los linderos de las áreas que conforman el PNE.
8. 8Que la Ley N.º 6043 establece en su artículo 1 del Capítulo I, Disposiciones Generales que La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley.
9. 9Que en la misma Ley N° 6043, indica el artículo 11 del Capítulo I, Disposiciones Generales, que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

10.-Que el Decreto Ejecutivo N.º 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N.º 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre (ZMT) aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

11.-Que el Decreto Ejecutivo N.º 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.

12.-Que en la Ley N.º 6227 Ley General de la Administración Pública, su artículo 140 señala que El acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte, disposición que necesariamente debe relacionarse con el artículo N° 240 del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que Se comunicarán por publicación los actos generales y por notificación los concretos.

Comunica:

Primero.-Los estudios geográficos fotointerpretativos desarrollados por el IGN relacionados con el reconocimiento y existencia de los esteros y manglares del país, se constituyen como informes técnicos de apoyo única y exclusivamente hacia a las Instituciones Públicas del país, a lo interno del IGN y del Registro Nacional, así como para los usuarios particulares con minutas de calificación de planos emitidas por la Dirección del Registro Inmobiliario del Registro Nacional.

Segundo.-Los estudios geográficos fotointerpretativos se realizan con fundamento en el análisis fotointerpretativo a partir del acervo de fotografías aéreas, imágenes satelitales y la cartografía nacional de la cual dispone el IGN.

Tercero.-Los estudios geográficos fotointerpretativos, se realizan dentro del ámbito geográfico y cartográfico por lo cual no cuentan con precisiones de índole topográfico.

Cuarto.-Por sus precisiones, los estudios geográficos fotointerpretativos son insumos técnicos que vienen a coadyubar en la determinación de esteros y manglares observables en fotografías aéreas, imágenes satelitales y la cartografía nacional, y por ende no cumplen una función vinculante en cuanto a declaratoria de PNE, esto último, por ser de competencia exclusiva del MINAE.

Quinto.-Se procede a instruir y comunicar mediante el presente aviso a la ciudadanía en general, a la academia, al sector público y privado, a las municipalidades, y a cualquier otra instancia nacional o internacional, que los estudios geográficos fotointerpretativos elaborados por el IGN son para los fines emitidos en esta publicación.

Sexto.-Rige a partir de su publicación.
