in the entirety of the text - Full Text of Regulation 071 Approves a closed season (veda) for fishing running from May 1 to July 31, 2022 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/071-2022.-Puntarenas, on the twenty-third day of March, two thousand twenty-two.

Whereas (Considerando):

1. 1That it is the responsibility and jurisdiction of INCOPESCA to ensure the promotion of responsible fishing that guarantees the sustainable use and protection of fishery resources.
2. 2That in accordance with Law 8436, the Fisheries and Aquaculture Law, INCOPESCA may establish, based on technical, economic, and social criteria, the closed season (veda) periods it deems necessary for the different fishing zones that require them due to their condition.
3. 3That having analyzed the content of Constitutional Chamber (Sala Constitucional) of the Supreme Court of Justice ruling (voto) number 2019-004046, Exp: 18-010494-0007-CO, issued at nine hours and thirty minutes on March 8, 2019, it is convenient and reasonable, in order to adjust the closed season (veda) in the Gulf of Nicoya to the terms and conditions established by current regulations and the content of said ruling (voto), to institute the closed season (veda) within the months in which peak reproduction of marine species occurs, with the aim of giving INCOPESCA a reasonable period to present the updated technical and scientific criteria and the Joint Institute for Social Assistance (Instituto Mixto de Ayuda Social, IMAS) the corresponding socio-economic studies.
4. 4That through official communication INCOPESCA-DOPA-025-2022 issued by the Fisheries and Aquaculture Management Directorate (Dirección de Ordenamiento Pesquero y Acuícola) of Incopesca, which endorses technical reports DDI-012-02-2019, DDI-073-08-2019 and Technical Document No. 24 "REPRODUCTIVE SEASON OF THE QUEEN CROAKER Cynoscion albus, WEAKFISH C. squamipinnis and BARRACUDA C. phoxocephalus, SPECIES OF HIGH COMMERCIAL INTEREST IN THE INNER ZONE OF THE GULF OF NICOYA, PACIFIC SLOPE, COSTA RICA, April 2019"; issued by the Department of Research and Development (Departamento de Investigación y Desarrollo), a proposal for a total closed season (veda) in the Gulf of Nicoya for fishing during the year 2022 is submitted.

5°-There are scientific studies issued by Rodríguez, Palacios and Chavarría (1989) that reported that the sardines Opisthonema medirastre and Opisthonema bulleri spawn throughout the year in the Gulf of Nicoya, with peak maturation for O. medirastre between January and April and for O. bulleri between April and June. Rodríguez, Palacios and Chavarría (1986). This indicates that these species could be maturing asynchronously. Vega Corrales (2010a, 2010b) recommended that the closed season (veda) for sardines of the genus Opisthonema in the Gulf of Nicoya be implemented during the season of peak reproduction to protect the spawning biomass (February-May) and another closed season (veda) in October to protect the virgin biomass.

1. 6That by means of Constitutional Chamber (Sala Constitucional) ruling (voto) No. 2019-00406 issued at nine hours and thirty minutes on March eight, two thousand nineteen, it was determined that the establishment of closed seasons (vedas) requires the social and environmental studies that justify it.
2. 7That for the case of the Gulf of Nicoya, according to the ruling (voto) indicated in the preceding whereas (considerando), any of the periods with the highest reproductive peaks determined by the corresponding technical studies must be considered, specific case of the established closed season (veda) months for 2022, where reproductive peaks are present.
3. 8That with the implementation of this closed season (veda), as conceived, the urgent need to protect and guarantee the commercially important hydrobiological resources of the Gulf of Nicoya during their most important reproductive stage is addressed; furthermore, thanks to the efforts of IMAS in coordination with INCOPESCA, the payment of temporary economic aid for fishers whose license only allows them to fish in said zones was coordinated. 9°-Having heard the presentation by the Director of Fisheries and Aquaculture Management (Ordenamiento Pesquero y Acuícola), the members of the Board of Directors express their satisfaction, their criterion being that the proposal received integrates not only the criteria of these two Commissions, but also that it is presented with the due advance notice, which will allow taking the necessary precautions for its timely and proper implementation in relation to the legal and social areas, reason for which, once the proposal was discussed and analyzed by the members of the Board of Directors, the Board of Directors (Junta Directiva),

Therefore (Por tanto); Resolves (Acuerda) 1°-To establish a total closed season (veda) for fishing, in the area comprised by an imaginary straight line that goes from Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Isla Negritos Outer Lighthouse (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from that line inland to the mouth of the Tempisque River. This fishing prohibition runs from May 1 to July 31, 2022, both dates inclusive.

2°-To allow, during the months of June and July 2022, two access days per month on an alternating basis to each semi-industrial sardine vessel, to operate in the area demarcated as zone C on the attached map, which runs from Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Isla Negritos Outer Lighthouse (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from this point an imaginary line to the Puntarenas Lighthouse (09°58´36.03´´ North Latitude, 084°51´03.93´´ West Longitude). For the purpose of supplying sardine for bait to the national fishing fleet, and the surplus may be commercialized for other purposes as established. This access will be used in daytime time slots of 12 hours each, on a weekly alternating basis by each vessel so that both vessels cannot be within said area in the same week, and prior to their entry, their owners, shipowners, or Captain must coordinate the week in which each vessel will enter. Additionally, prior to entering said zone, they must notify the date and time to the Registry Department (Departamento de Registro) and the Enforcement Department (Departamento de Fiscalización) of Incopesca.

1. 3That all landings by the semi-industrial sardine purse-seine fleet must be duly inspected by the Institution. Said inspection must cover not only the sardine landings, but also that of the bycatch (fauna de acompañamiento). In turn, the Department of Research (Departamento de Investigación) will carry out biological sampling of said catches to evaluate the reproductive behavior of the sardines and ensure that the sizes caught comply with the legal first-capture sizes. Additionally, the Department of Research (Departamento de Investigación) undertakes to coordinate the presence of a biologist on board the vessels during the months of June and July, and the representatives of the small-scale commercial sector will coordinate the presence of an observer on the trips. Said presence of the observer does not generate labor-related responsibilities or accident risks for the shipowner or Incopesca.

4°-To establish a maximum incidental catch (captura incidental) quota of 10%, relative to the total catch of sardine by the vessels of the semi-industrial sardine purse-seine fleet.

5°-Only fishers who have traditionally caught barracudas or candado (Sphyraena ensis) with handline are authorized to operate in zone C of the attached map, during the months of May, June, and July 2022.

6°-This closed season (veda) does not include the extraction of pianguas. The cultures of marine organisms developed in the Gulf of Nicoya are not subject to this closed season (veda).

7°-Taking into consideration the difficult socioeconomic situation of the coastal communities due to the issue of COVID-19, as long as the national state of emergency is in effect, fishing for domestic consumption during the present closed season (veda) is exempted and therefore permitted in the zone described in point 1 of this resolution. Those who opt to carry out this fishing must comply with the regulations as established by the Board of Directors (Junta Directiva) resolution AJDIP-511-2017.

8°-Taking into account the national emergency and its socioeconomic consequences, the scope of this closed season (veda) may be reviewed in order to ensure food security and social well-being.

9°-To carry out the pertinent coordination between INCOPESCA, SENASA, and the Ministry of Public Security (Ministerio de Seguridad Pública), in order to guarantee control and surveillance operations during the closed season (veda) period.

10.-For the purposes of ensuring its compliance, in full accordance with the provisions of Presidential Directive, Directive No. 085 Mideplan-MEIC "On measures to accelerate the simplification of procedures, requirements or processes that favorably impact the citizen and the productive sector" and in compliance with all the Health Directives and Guidelines established for COVID-19 and defined by the Ministry of Health, aimed at guaranteeing public health; every fisher receiving socioeconomic aid during the closed season (veda) period is urged to abide by the established rules in accordance with the applicable provisions on the matter.

11.-What is established in resolution AJDIP-166-2017 "Regulation for the fulfillment of Communal Work Service by the fisher registered in Closed Season (Veda)" is rendered without effect during this year 2022, to the extent that it expressly contradicts or is incompatible with the content of this resolution.

12.-The attached map is to be taken as an integral part of this Resolution.

13.-Final resolution (Acuerdo firme).

en la totalidad del texto - Texto Completo Norma 071 Aprueba veda de pesca que va desde el 01 de mayo hasta el 31 de julio del 2022 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/071-2022.-Puntarenas, a los veintitrés días del mes de marzo de dos mil veintidós.

1. 1Que es responsabilidad y competencia del INCOPESCA, velar por el fomento de la pesca responsable que garantice el aprovechamiento sostenible y protección de los recursos pesqueros.
2. 2Que de conformidad con la Ley 8436, Ley de Pesca y Acuicultura, el INCOPESCA podrá establecer con base en criterios técnicos, económicos y sociales, los periodos de veda que considere necesarios para las diferentes zonas de pesca que por su condición lo requieran.
3. 3Que analizado el contenido del voto de la Sala Constitucional de la Corte Suprema de Justicia número 2019-004046, Exp: 18-010494-0007-CO, de las nueve horas con treinta minutos del 08 de marzo del año 2019, resulta conveniente y razonable en aras de ajustar la veda en el Golfo de Nicoya a los términos y condiciones establecidos por la normativa vigente y el contenido de dicho voto, instaurar la veda dentro de los meses en que se producen picos de reproducción de las especies marinas con el objetivo de dar un plazo razonable al INCOPESCA, para que presente la actualización de criterios técnicos y científicos y al Instituto Mixto de Ayuda Social, IMAS, los estudios socioeconómicos correspondientes.
4. 4Que mediante oficio INCOPESCA-DOPA-025-2022 emitido por la Dirección de Ordenamiento Pesquero y Acuícola del Incopesca, mediante el cual se acogen informes técnicos DDI-012-02-2019, DDI-073-08-2019 y Documento Técnico N° 24 "ÉPOCA REPRODUCTIVA DE LA CORVINA REINA Cynoscion albus, AGUADA C. squamipinnis y PICUDA C. phoxocephalus, ESPECIES DE ALTO INTERÉS COMERCIAL EN LA ZONA INTERIOR DEL GOLFO DE NICOYA, VERTIENTE DEL PACÍFICO, COSTA RICA, Abril 2019"; emitidos por el Departamento de Investigación y Desarrollo, se remite propuesta de veda total en el Golfo de Nicoya, para la pesca durante el año 2022.

5°-Se cuenta con estudios científicos emitidos por Rodríguez, Palacios y Chavarría (1989) donde reportaron que las sardinas Opisthonema medirastre y Opisthonema bulleri desovan a lo largo de todo el año en el Golfo de Nicoya, con picos de maduración para O. medirastre entre enero y abril y para O. bulleri entre abril y junio. Rodríguez, Palacios y Chavarría (1986). Lo que indica que estas especies podrían estar madurando de manera asincrónica. Vega Corrales (2010a, 2010b) recomendó que la veda de sardinas del género Opisthonema en el Golfo de Nicoya se implementara en la época de máxima reproducción para proteger la biomasa desovante (febrero-mayo) y otra veda en octubre para proteger la biomasa virgen.

1. 6Que por medio del voto de la Sala Constitucional N° 2019-00406 de las nueve horas con treinta minutos del ocho de marzo del dos mil diecinueve , se determinó que para el establecimiento de las vedas se debe contar con los estudios sociales y ambientales que justifiquen la misma.
2. 7Que para el caso del Golfo de Nicoya según en el voto indicado en el considerando anterior, se debe considerar cualquiera de las épocas con picos de reproducción mayores que hayan determinado los estudios técnicos correspondientes, caso específico de los meses establecidos de veda 2022, donde se tienen picos de reproducción.
3. 8Que con la puesta en marcha de esta veda, tal cual se ha concebido, se atiende la imperiosa necesidad de proteger y garantizar los recursos hidrobiológicos de interés comercial del Golfo de Nicoya en su etapa más importante de reproducción; además gracias a los esfuerzos del IMAS en coordinación con el INCOPESCA, se logró coordinar el pago de las ayudas económicas temporales para los pescadores cuya licencia solo les permite pescar en dichas zonas. 9°-Escuchada la presentación del Director de Ordenamiento Pesquero y Acuícola, manifiestan los señores Directivos su satisfacción siendo su criterio que la propuesta recibida, integre no solo los criterios de éstas dos Comisiones, sino que la misma se presenta con la antelación debida, lo cual permitirá tomar las previsiones necesarias a efecto que su implementación en tiempo y forma en relación a los ámbitos legal y social, razón por la cual, una vez discutida y analizada la propuesta por los señores Directores, la Junta Directiva,

Por tanto; Acuerda 1°-Establecer una veda total para la pesca, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de esa línea aguas adentro hasta la desembocadura del río Tempisque. Esta prohibición de pesca va desde el 01 de mayo hasta el 31 de julio del 2022, ambas fechas incluidas.

2°-Permitir durante los meses de junio y julio 2022, dos días de acceso al mes en forma alterna a cada embarcación semi-industrial sardinera, para faenar en el área demarcada en la zona C del mapa adjunto, que va desde Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y desde este punto una línea imaginaria hasta el Faro de Puntarenas (09°58´36.03´´ Latitud Norte, 084°51´03.93´´ Longitud Oeste). A efectos que puedan suplir sardina para carnada a la flota pesquera nacional y los excedentes podrán ser comercializados para otros fines según lo establecido. Este acceso será utilizado en franjas diurnas de 12 horas cada una de forma semanal alterna por cada embarcación de modo que no podrán estar dentro de dicha área las 2 embarcaciones en la misma semana y de previo a su ingreso, deberán sus propietarios, armadores o Capitán; coordinar la semana en que ingresará cada embarcación. Además, previo al ingreso a dicha zona, deberán notificar la fecha y hora al Departamento de Registro y al Departamento de Fiscalización del Incopesca.

1. 3Que todas las descargas por parte de la flota semi-industrial bolichera de sardina deben ser debidamente inspeccionadas por parte de la Institución. Dicha inspección debe cubrir no solo las descargas de sardina, sino también la de fauna de acompañamiento. A su vez el Departamento de Investigación realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas y que las tallas capturadas cumplan con las tallas legales de primera captura. Adicionalmente el Departamento de Investigación, se compromete a coordinar la presencia de un biólogo a bordo de las embarcaciones durante los meses de junio y julio y los representantes del sector comercial pequeña escala coordinaran la presencia de un observador en los viajes. Dicha presencia del observador no genera responsabilidades de orden laboral o riesgos por accidente al armador o al Incopesca.
2. 4Que se establezca una cuota de captura incidental máxima del 10%, con respecto a la captura total de sardina por parte de los barcos de la flota semi-industrial bolichera de sardina.

5°-Se autoriza únicamente a los pescadores que tradicionalmente han capturado barracudas o candado (Sphyraena ensis) con cuerda de mano, para faenar en la zona C del mapa adjunto, durante los meses de mayo, junio y julio del 2022.

6°-En esta veda no se incluye la extracción de pianguas. Los cultivos de organismos marinos que se desarrollan en el Golfo de Nicoya no están sujetos a esta veda.

7°-Tomando en consideración la difícil situación socioeconómica de las comunidades costeras por el tema del COVID-19, en el tanto este vigente el estado de emergencia nacional se exceptúa y por ende se permitirá en la zona comprendida en el punto 1 de este acuerdo, la pesca para el consumo doméstico durante la presente veda. Quienes opten por realizar esta pesca, deberán cumplir con la normativa según lo establecido por el acuerdo de Junta Directiva AJDIP-511-2017.

8°-Tomando en cuenta la emergencia nacional y las consecuencias socioeconómicas de la misma, se podrá revisar los alcances de la presente veda con el fin de asegurar la seguridad alimentaria y bienestar social.

9°-Realizar las coordinaciones pertinentes entre el INCOPESCA, SENASA y el Ministerio de Seguridad Pública, con el fin de garantizar los operativos de control y vigilancia durante la época de veda.

10.-A los efectos de asegurar su cumplimiento, en pleno ajuste a lo establecido por la Directriz Presidencial, Directriz N° 085 Mideplan-MEIC "Sobre las medidas para acelerar la simplificación de trámites, requisitos o procedimientos que impactan de manera favorable a la persona ciudadana y al sector productivo" y en cumplimiento de todas las Directrices y Lineamientos Sanitarios establecidos para COVID-19 y definidos por el Ministerio de Salud, encaminados en garantizar la salud pública; se insta a todo pescador que reciba la ayuda socioeconómica durante el periodo de veda, acatar las normas establecidas de conformidad con las disposiciones aplicables en la materia.

11.-Se deja sin efecto durante este año 2022 lo establecido en el acuerdo AJDIP-166-2017 "Regulación para el cumplimiento del Servicio de Trabajo Comunal por parte del pescador inscrito en Veda", en lo que expresamente se oponga o resulte incompatible con el contenido del presente acuerdo.

12.-Téngase como parte integral del presente Acuerdo, el mapa que se anexa.

13.-Acuerdo firme.

Considerando:
