en la totalidad del texto - Full Text of Regulation 43334 Repeals Executive Decree No. 18186 "Declares the Finca de la Hacienda la Avellana Wildlife Refuge" No. 43334-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by numeral 50, subsections 3) and 18) of numeral 140 and article 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Public Administration Law No. 6227 of 2 May 1978; articles 7, 82 and 84 of the Wildlife Conservation Law No. 7317 of 30 October 1992, articles 150 and 171 subsection f) of the Regulation to the Wildlife Conservation Law for Fishing and National Wildlife Refuges, Executive Decree No. 32633-MINAE of 10 March 2005; and article 70 subsection e) sub-subsection 2) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of 11 March 2008.

1. 1That by means of Executive Decree No. 18186-MIRENEM of 02 May 1988, the Finca de la Hacienda la Avellana Wildlife Refuge, private category, was declared, at that time the property of the company Limago S.A., with legal identification number 3-101015522-36, a property in the Partido de Alajuela , folio real registration number 2-43996-001-010, cadastral map A-0688965-1987.
2. 2That the real property composing the aforementioned Refuge is registered in the Property Registry, according to the folio real described below: Partido de Alajuela, registration number 2-43996 rights 001, 002, 003, 004, 005, 006, 007, 008, 009, 010, cadastral map A-0688965-1987, whose current nature is buildable land with three houses, located in the Coyolar district, Orotina canton, Alajuela province, with an area of four million four hundred eighty-two thousand one hundred eighty-six square meters and fifty-three square decimeters , and whose registered owner is Mr. Alejandro Harting González Arellano, identity card 1-0989-0947.
3. 3That on 08 March 2021, Mr. Álvaro González Niehaus, general attorney-in-fact of the Company Limago S.A and special attorney-in-fact of Alejandro Harting González Arellano, identity card 1-0989-0947, submitted a writ to the Central Pacific Conservation Area (ACOPAC) requesting the de-designation of the Finca de la Hacienda la Avellana Wildlife Refuge and stated that since the year 2007 a request for the de-designation process of the Refuge was made, the foregoing based on article 4 of the Decree that established its creation and which literally states: "Article 4. In the event that the owners decide to change the purpose of the refuge, they must notify the Dirección General de Vida Silvestre at least one year in advance, to carry out the corresponding procedures before the Legislative Assembly". In response to the request just set forth, legal opinion number ACOPAC-AL-RESAGO-024-2007 was issued, which concluded that the de-designation of the Refuge was admissible; however, the process was not completed through the promulgation of the corresponding executive decree.
4. 4That by means of inspection report No. SINACACOPAC- DASP-113-2021 signed by Mrs. Liliana Rubí Jiménez, who holds the position of Director of Protected Wilderness Areas of ACOPAC, it is recommended: "Having the request from the owners of the property constituting the Refuge of private category wanting to de-designate the full area of the farm, the Protected Wilderness Areas department has no objection whatsoever to proceeding with the corresponding process to de-designate the refuge via decree, as stipulated in the decree of creation of said refuge".
5. 5That by means of official communication SINAC-ACOPAC-D-506-2021, dated seventeen August two thousand twenty-one, the Director of the Central Pacific Conservation Area of the National System of Conservation Areas (SINAC), accepted the de-designation request submitted by the registered owner of the Private National Wildlife Refuge Hacienda Avellana, private category, owned by Alejandro Harting González Arellano, identity card 1-989-947, based on the legal and technical recommendations present in the administrative case file, and furthermore, granted approval for the promulgation of the present executive decree.
6. 6That in accordance with the Regulation to the Law for the Protection of the Citizen from the Excess of Requirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC and its amendments, it was determined that the present proposal does not establish or modify procedures, requirements, or processes that the administered party must comply with, a situation for which the prior review process was not carried out. Therefore,

THEY DECREE:

Repeal of Executive Decree No. 18186- MIRENEM of 02 May 1988 entitled "Declares the Finca de La Hacienda La Avellana Wildlife Refuge"

Whereas:

en la totalidad del texto - Texto Completo Norma 43334 Deroga Decreto ejecutivo N° 18186 "Declara Refugio Fauna Silvestre Finca de la Hacienda la Avellana " Nº 43334-MINAE EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE AMBIENTE Y ENERGÍA En ejercicio de las facultades que les confieren el numeral 50, los incisos 3) y 18) del numeral 140 y el artículo 146 de la Constitución Política; los artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública Nº6227 del 2 de mayo de 1978; los artículos 7, 82 y 84 de la Ley de Conservación de la Vida Silvestre Nº7317 del 30 de octubre de 1992, los artículos 150 y 171 inciso f) del Reglamento a la Ley de Conservación de la Vida Silvestre para pesca y Refugios Nacionales de Vida Silvestre, Decreto Ejecutivo Nº 32633-MINAE del 10 de marzo del 2005; y el artículo 70 inciso e) sub inciso 2) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008.

1. 1Que mediante el Decreto Ejecutivo Nº18186-MIRENEM del 02 de mayo de 1988, se declara el Refugio de Fauna Silvestre Finca de la Hacienda la Avellana, categoría privada, en ese entonces propiedad de la sociedad Limago S.A., con cédula jurídica número 3-101015522-36, finca del Partido de Alajuela matrícula de folio real 2-43996-001-010, plano catastrado A-0688965-1987.
2. 2Que el inmueble que conforma el citado Refugio, se encuentra inscrito en el Registro de la Propiedad, según el folio real que se describe a continuación: Partido de Alajuela, matrícula 2-43996 derechos 001, 002, 003, 004, 005, 006, 007, 008, 009, 010, plano catastrado A-0688965-1987, cuya naturaleza actual es terreno para construir con tres casas, situada en el distrito Coyolar, cantón Orotina, provincia de Alajuela, con una medida de cuatro millones cuatrocientos ochenta y dos mil ciento ochenta y seis metros con cincuenta y tres decímetros cuadrados y cuyo propietario registral es el señor Alejandro Harting González Arellano cédula identidad 1-0989-0947.
3. 3Que en fecha 08 de marzo de 2021, el señor Álvaro González Niehaus apoderado generalísimo de la Sociedad Limago S.A y apoderado especial de Alejandro Harting González Arellano cédula de identidad 1-0989-0947, presentó un escrito al Área de Conservación Pacífico Central (ACOPAC) solicitando la desafectación del Refugio de Fauna Silvestre Finca de la Hacienda la Avellana y manifestó que desde el año 2007 se realizó la solicitud para el trámite de desafectación del Refugio, lo anterior fundamentado en el artículo 4 del Decreto que promulgó su creación y que literalmente indica: "Artículo 4º En caso de que los propietarios tomen la decisión de cambiar el destino al refugio, deben de notificar a la Dirección General de Vida Silvestre, con un año de anticipación por lo menos, para hacer los trámites correspondientes ante la Asamblea Legislativa". Ante el requerimiento recién expuesto se emitió el criterio legal número ACOPAC-AL-RESAGO-024-2007 donde se concluyó sobre la procedencia de desafectación del Refugio, sin embargo, no se culminó el proceso mediante la promulgación del decreto ejecutivo correspondiente.
4. 4Que mediante informe de inspección N° SINACACOPAC- DASP-113-2021 suscrito por la señora Liliana Rubí Jiménez quien desempeña el cargo de Directora de Áreas Silvestres Protegidas del ACOPAC, se recomienda: "Teniendo la solicitud de los propietarios del inmueble que constituye el Refugio de categoría privada de querer desafectar el área total de la finca, el departamento de Áreas Silvestres Protegidas no tiene inconveniente alguno para que se proceda a efectuar el trámite correspondiente para desafectar el refugio vía decreto, según lo estipulado en el decreto de creación de dicho refugio".
5. 5Que mediante oficio SINAC-ACOPAC-D-506-2021, de fecha diecisiete de agosto del dos mil veintiuno, el Director del Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación (SINAC), aceptó la solicitud de desafectación presentado por el propietario registral del Refugio Nacional Vida Silvestre Privado Hacienda Avellana categoría privada, propiedad de Alejandro Harting González Arellano cédula de identidad 1-989-947, con base en la recomendación legal y técnica presentes en el expediente administrativo y además, brindó el visto bueno para la promulgación del presente decreto ejecutivo.
6. 6Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto,
