throughout the text - Complete Text of Standard 065 Inspection procedure for the application of port state measures COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE BOARD OF DIRECTORS AJDIP/065-2022.-Puntarenas, on the ninth day of March, two thousand twenty-two.
Considering:

Article 50 of our Magna Carta, Constitutional Judgment 10540-2013 established as constitutional principles those contained within the Code of Conduct for Responsible Fisheries, as well as the Code of Ethics for Responsible Fisheries and Aquaculture in the States of the Central American Isthmus, (Regulation OSP-04-11), highlighting the criterion of responsibility in the fishing activity of both instruments.
7384) and in the Fisheries and Aquaculture Law (Law No. 8436), said Institute is responsible for regulating fishing activity, developing surveillance and monitoring of the legislation (Article 2 of Law No. 7384), and exercising control over fishing activity (Article 13 of Law No. 8436), being empowered to exercise the state powers of control and surveillance over marine resources and natural wealth existing in inland waters, the territorial sea, the exclusive economic zone, and the areas adjacent to the latter, over which national jurisdiction exists or may come to exist, in accordance with national laws and international treaties (Article 6 of Law No. 8436 in accordance with Article 6 of the Constitution).
8436, among these legal powers of INCOPESCA is the authorization for the landing of fishery products in Costa Rican territory by foreign vessels, as one of the competencies and powers of the Institute.
40803-MOPT provides in its Articles 11, 12, and 16 that it is the responsibility of the Maritime Port Directorate of the MOPT to ensure the safety of navigation in national waters, applying the control measures established in the current regulations of the country and in the subscribed international conventions (art 11). To authorize or deny, through the Harbor Master's Offices, the entry or clearance of national or foreign vessels that visit our deep-water maritime ports (art 12). To review compliance with the corrective measures requested of a foreign-flagged vessel based on the technical reports prepared by the Port State inspectors of the Maritime Security Unit, according to the international conventions in force.
For this reason, it is required to establish standardized procedures for the analysis of information, for the different inspections, as well as for the issuance of technical criteria, which can be applied uniformly according to the class of requesting vessel and the conditions it presents.
THE BOARD OF DIRECTORS OF INCOPESCA,
APPROVAL OF INSPECTION PROCEDURES FOR THE APPLICATION OF PORT STATE MEASURES
RESOLVES:
The Directorate of Fisheries and Aquaculture Management (DOPA), through the Enforcement Department and its Registration offices, and the Monitoring, Control, and Surveillance Center, shall be responsible for receiving the information from the requesting vessels transmitted by the Maritime Port Directorate of the Ministry of Public Works and Transport (DMP-MOPT).
If this search indicates that the vessel appears on any of the lists, it shall proceed with the application of the port use denial measure.
In the event a high risk is detected, the port use denial measure shall be applied.
The inspection shall be carried out with the corresponding procedure according to the class of vessel requesting and the requested use.
So that each vessel requesting port use is informed in advance of all the new conditions for said request.
This agreement shall guarantee the prior application of the measures and the execution of the Procedures Protocol approved herein.
It shall form a Working Commission composed of individuals with proven and sufficient knowledge and experience to address the updating, adjustment, and improvement of each and every procedure. This shall be in accordance with the experience of application, the changes occurring in the official IUU fishing lists, and the guidelines on the matter officially issued by the competent bodies, whether nationally or internationally.
Transitional Provision: Fishing vessels or vessels related to fishing that have previously entered prior to the entry into force of this agreement and are using the port shall be exempted from the application of these rules for one time only. Nevertheless, they shall be informed of the new regulations in accordance with the provisions of

en la totalidad del texto - Texto Completo Norma 065 Procedimiento de inspección para la aplicación de las medidas des estado rector de puertos INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA JUNTA DIRECTIVA AJDIP/065-2022.-Puntarenas, a los nueve días del mes de marzo de dos mil veintidós.
Considerando:
con las leyes nacionales y los tratados internacionales (artículo 6 de la Ley Nº 8436 en concordancia con el artículo 6 de la Constitución).
(art 11) Autorizar o denegar a través de las Capitanías de Puerto, la entrada o despacho a las embarcaciones nacionales o extranjeras que visitan nuestros puertos marítimos de altura (art 12). Revisar el cumplimiento de las medidas correctivas que se soliciten a un buque de bandera extranjera con base en los informes técnicos elaborados por los inspectores del Estado Rector de Puerto de la Unidad de Seguridad Marítima, según los convenios internacionales vigentes.
Por ello se requiere establecer procedimientos estandarizados tanto para el análisis de información, de las diferentes inspecciones, así como para la emisión de criterios técnicos, que puedan aplicarse uniformemente según la clase de embarcación solicitante y las condiciones que presente.
LA JUNTA DIRECTIVA DEL INCOPESCA, ACUERDA:
APROBACIÓN DE PROCEDIMIENTOS DE INSPECCIÓN PARA LA APLICACIÓN DE LAS MEDIDAS DEL ESTADO RECTOR DE PUERTO
La Dirección de Ordenamiento Pesquero y Acuícola (DOPA) a través del Departamento de Fiscalización y sus oficinas de Registro, el Centro de Seguimiento, Control y Vigilancia tendrán el encargo de recibir la información proveniente de las embarcaciones solicitantes, que transmita la Dirección Marino Portuaria del Ministerio de Obras Públicas y Transportes (DMP-MOPT).
Si esta búsqueda indica que la embarcación figura en alguna de las listas, procederá con la aplicación de la medida de denegatoria de uso de puerto.
En caso de detectarse un riesgo alto, se aplicará la medida denegatoria de uso puerto.
La inspección deberá realizarse con el procedimiento correspondiente según la clase de embarcación solicitante y el uso solicitado.
De manera que, cada embarcación solicitante de uso de puerto esté informada con anterioridad sobre todas las nuevas condiciones para dicha solicitud.
Este convenio deberá garantizar la aplicación previa de las medidas y la ejecución del Protocolo de Procedimientos aquí aprobado.
Deberá conformar una Comisión de Trabajo integrada por personas con conocimiento y experiencia comprobada y suficiente, que aborden la actualización, el ajuste y mejora de todos y cada uno de los procedimientos. Esto, conforme a la experiencia de aplicación, los cambios acaecidos en las listas oficiales de pesca INDNR y las directrices que en la materia sean dictadas de forma oficial por los organismos competentes, ya sea en el ámbito nacional o internacional.
Transitorio: Las embarcaciones pesqueras o relacionadas con la pesca que hayan ingresado previamente a la vigencia de este acuerdo y se encuentren en uso de puerto, se exceptuarán por una única vez de la aplicación de estas normas. No obstante, deberán ser informadas de las nuevas reglamentaciones conforme a lo dispuesto en el artículo 11.
Proceda la secretaría de Junta Directiva a comunicar el presente acuerdo a los órganos competentes.
