in the entirety of the text - Complete Text of Norm 011 Shortage of orange-colored plates in SINAC NATIONAL SYSTEM OF CONSERVATION AREAS R-SINAC-CONAC-011-2022.—National System of Conservation Areas, at two hours fifteen minutes on March 11, 2022.
2º—According to the Forest Law No. 7575 (Ley Forestal), it is established "... as an essential and priority function of the State, to ensure the conservation, protection and administration of natural forests and the production, harvesting, industrialization and promotion of forest resources in the country destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources."
10.—That Article 31 of the Forest Law No. 7575 (Ley Forestal) requires for the hauling of timber originating from forest plantations a certificate of origin issued by the forest regent (regente forestal).
11.—According to the General Law of Public Administration No. 6227 (Ley General de la Administración Pública), it is indicated in subparagraph 1) of Article 146 that "The Administration shall have the power to enforce by itself, without resorting to the Courts, effective, valid or annullable administrative acts, even against the will or resistance of the obligor, subject to any resulting liability." 12.—That Article 147 of the General Law of Public Administration (Ley General de la Administración Pública) establishes that "The rights of the Administration arising from its public-law capacity shall also be enforceable by the same means that this Law indicates for the enforcement of administrative acts." To establish, in the face of the shortage of orange-colored plates, a transitory mechanism that safeguards the correct application of the provisions of Articles 28 and 31 of the Forest Law (Ley Forestal), for carrying out the transport of timber originating from forest plantations, including agroforestry systems and individually planted trees and their products.
All Conservation Areas of the country, in compliance with the provisions of the Forest Law (Ley Forestal), shall have as a security and traceability mechanism the certificate of origin issued by the forest regent (regente forestal) and the timber transport guides, as applicable.
Conservation Areas that still have an inventory of orange-colored plates must continue their use until stocks are exhausted.
In each Conservation Area, to carry out the delivery of timber transport guides corresponding to certificates of origin, the SICAF user official with the custodian profile must enter the number zero (0) in the system for the issuance of the "Delivery receipt for guides and plates for timber transport." This, once the orange-colored plates have been exhausted.
The Conservation Areas of the country shall maintain the follow-up and control actions provided for in the regulations, to withdraw from circulation all timber transport devices already used by users.
They must also maintain coordination actions with the competent police authorities for the adequate follow-up and control of these devices on the country's different roadways.

2º-Según la Ley Forestal N° 7575, se establece ". como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables.".
10.-Que en el artículo 31 de la Ley Forestal N° 7575 exige para el trasiego de madera proveniente de plantaciones forestales un certificado de origen 11.-Según la Ley General de la Administración Pública N° 6227, se indica en el inciso 1) del artículo N° 146 que "La Administración tendrá potestad de ejecutar por sí, sin recurrir a los Tribunales, los actos administrativos eficaces, válidos o anulables, aún contra la voluntad o resistencia del obligado, sujeta a la responsabilidad que pudiera resultar.".
12.-Que el artículo 147 de la Ley General de la Administración Pública establece que "Los derechos de la Administración provenientes de su capacidad de derecho público serán también ejecutivos por los mismos medios que esta Ley señala para la ejecución de los actos administrativos.". Por tanto, EL SECRETARIO EJECUTIVO DEL CONCEJO NACIONAL DE ÁREAS DE CONSERVACIÓN, RESUELVE:

Establecer, ante la carencia de placas anaranjadas un mecanismo transitorio que salvaguarde la correcta aplicación de lo dispuesto en los artículos 28 y 31 de la Ley Forestal, para realizar el transporte de madera proveniente de plantaciones forestales incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos.
Todas las Áreas de Conservación del país, en atención a lo establecido en la Ley Forestal, tendrán como mecanismo de seguridad y trazabilidad el certificado de origen emitido por el regente forestal y las guías de transporte de la madera según corresponda.
Las Áreas de Conservación que aún cuentan con inventario de placas anaranjadas deberán continuar con su utilización hasta agotar existencias.
En cada Área de Conservación, para realizar la entrega de guías de transporte de madera correspondientes a los certificados de origen, el funcionario usuario del SICAF con el perfil de custodio, deberá consignar en el sistema el número cero (0) para la emisión del "Comprobante de entrega de guías y placas para el transporte de madera". Esto una vez agotadas las placas anaranjadas.
Las Áreas de Conservación del país mantendrán las acciones de seguimiento y control dispuestos en la normativa, para sacar de circulación todos los dispositivos de transporte de la madera ya utilizados por los usuarios.
También deberán mantener las acciones de coordinación con las autoridades policiales competentes para el adecuado seguimiento y control de estos dispositivos en las diferentes vías del país.
La presente resolución administrativa tiene una vigencia de un año y rige a partir de su publicación en el Diario Oficial La Gaceta.
