in the entirety of the text - Complete Text of Norm 060 Establishes the spending limit for the National Forest Financing Fund, for new projects to be financed by activity and determines the payment amounts per activity MINISTRY OF ENVIRONMENT AND ENERGY R-060-2022-MINAE.-Ministry of Environment and Energy.- San José, at 8:45 a.m. on March 7, 2022. The number of hectares to be financed per activity under the Payment for Environmental Services Program and the amount to be paid based on the allocated resources are hereby established for the National Forest Financing Fund.

Sole.-That for the 2022 fiscal year, the National Budget allocates a total of twelve billion three hundred seventy-four million five hundred nine thousand eight hundred forty-two colones and 59/100 (¢12,374,509,842.59) for the Payment for Environmental Services Program, which will be used for the payment of commitments from PSA contracts of previous years and the incorporation of new hectares for the year 2022.

1st-That Article 38 of the Regulations to the Forestry Law No. 7575, Executive Decree No. 25721-MINAE, of October 17, 1996, and its amendments, provides that the Minister of Environment and Energy, as the Head of the Ministry of Environment and Energy, acting as the State Forestry Administration, shall issue annually, by Ministerial Resolution, the activities to be financed under the Payment for Environmental Services Program and the amounts to be paid based on the resources allocated in the National Budget for the 2022 fiscal year.

2nd-That under this principle, financial instruments must be oriented to support the pillars of the National Development and Public Investment Plan for the Bicentennial (PNDIP) 2019-2022; considering the objectives of the creation of the National Forest Financing Fund according to the cited Forestry Law, without disregarding the established technical criteria. 3rd-That the cited National Development Plan considers as one of the national goals to maintain under the Payment for Environmental Services Program at least three hundred thousand hectares (300,000 ha), in its different activities.

4th-That the Ministry of Environment and Energy has issued the Guiding Principles for the Productive Forestry Sector, through Executive Decree No. 41772-MINAE, as well as the guidelines to be considered in institutional efforts for the reactivation and promotion of reforestation in the country.

5th-That by virtue of efforts to achieve international recognition of the contribution of forests to the reduction of greenhouse gas emissions, the Government of Costa Rica signed an ERPA (Emission Reductions Purchase Agreement) with the International Bank for Reconstruction and Development, on December 9, 2020, which, in its benefit- sharing plan, provided for the creation of a payment for environmental services mechanism specialized in emission reductions, which has differentiated conditions; this instrument is the CREF (Forest Emission Reductions Contract).

The aforementioned instrument is integrated into the agreement signed by the Ministry of Environment and Energy, on February 10, 2021, with the Green Climate Fund of the United Nations, through the implementing agency UNDP United Nations Development Programme, whose resources will complement the negotiation with the IBRD, indicated above. Therefore, THE MINISTER OF ENVIRONMENT AND ENERGY,

Article 1st-To establish the spending limit for the National Forest Financing Fund, for new projects to be financed by activities and to determine the payment amounts per activity.

1. Activities to be financed: For the year 2022, two modalities to be financed will be considered: a-Recovery of Forest Cover (Recuperación de la Cobertura Forestal), which includes the activities of Reforestation, Regeneration, and Agroforestry Systems, and b-Maintenance of Forest Cover (Mantenimiento de la Cobertura Forestal), which includes Forest Protection and Forest Management. To this end, the following distribution is established:

*: The Fonafifo will process all admission applications submitted for the sub-activities of Reforestation for up to 600 hectares and Agroforestry Systems, with species included in the executive decrees on logging bans and threatened or endangered species (Decree No. 25663-MINAE and Decree No. 25700-MINAE and their amendments).

**: Refers to all admission applications for farms where the forest management plan has been completed to the satisfaction of the State Forestry Administration (AFE).

Starting in the year 2022, a derived mechanism is enabled and financed with resources from contracts and agreements for Emission Reductions produced by forests; with a quantity of 450,000 hectares. This activity recognizes only one environmental service (reduction of greenhouse gas emissions), hereinafter, CREF contracts.

The National Forest Financing Fund may vary the distribution established in the previous table, in accordance with the availability of the approved budget for the Payment for Environmental Services Program.

Fonafifo is empowered to redistribute the budgeted resources from the Recovery of Forest Cover modality that remain uncommitted as of June 26th of each year, so that they are programmed for the Maintenance of Forest Cover modality.

Should there be a greater allocation of resources, pursuant to Article 5 of the Tax Simplification and Efficiency Law No. 8114, published in La Gaceta No. 131, of July 9, 2001, and other financial resources that Fonafifo secures for Payment for Environmental Services, they will be distributed according to the criteria of the financiers and the authorities of the Ministry (or corresponding authorities). In any case, the resources used for these purposes must be incorporated into the institutional budget or into the Trust 544 Fonafifo/BNCR and be approved by the Legislative Assembly or the Comptroller General of the Republic.

2. Of the payment amounts per activity and other conditions:

2.1. Reforestation Activity: The conditions that will govern the processing of applications for the recognition of environmental services under the Reforestation activity are as follows:

• a)The amount to be paid for fast-growing species, referring to: Gmelina arborea, Acacia mangium, Vochysia guatemalensis, and Vochysia hondurensis, will be seven hundred twenty-six thousand four hundred three colones and 00/100 (¢726,403) per hectare, disbursed over a period of five years. Payments will be distributed as follows: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.
• b)The amount to be paid for medium-growing species, referring to: Tectona grandis, Pinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp, and Cedrela odorata, will be eight hundred nineteen thousand thirty-six colones and 00/100 (¢819,036) per hectare, disbursed over a period of five years. Payments will be distributed as follows: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.
• c)The amount to be paid for native species included in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, will be one million two hundred twenty-eight thousand five hundred fifty-six colones and 00/100 (¢1,228,556) per hectare, disbursed over a period of five years. Payments will be distributed as follows: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.
• d)The amount to be paid for Forest Plantations with Reduced Rotation Cycles (PFTRR) for fast-growing species for packaging will be three hundred ninety thousand eight hundred thirty-one colones and 00/100 (¢390,831) per hectare. Payments will be distributed as follows: 50% the first year, 25% the second year, and 25% the fourth year.
• e)The conditions that will govern the processing of applications for the recognition of environmental services under the Reforestation activity, PSA plus Credit pilot project, are as follows:

i. The amount to be paid for the PSA plus Credit pilot project with the fast-growing species referred to as: Gmelina arborea, will be three hundred ninety thousand eight hundred thirty-one colones and 00/100 (¢390,831.00) per hectare, disbursed in a single installment of 100%, which will be delivered in advance to the organization, provided that the beneficiary has consented by formal document. For the Pilot Project, advance payment will be authorized provided a guarantee is given, covering the total amount of the advance, to the satisfaction of Fonafifo.

• f)Forest Plantations established with own resources for payment by results. The amounts to be paid will be those established in subsections a, b, and c above. The amounts will be distributed as follows: upon signing the contract, 50%; twelve, twenty-four, thirty-six, and forty-eight months after said signing, 20%, 15%, 10%, and 5% respectively. The contracts will have the term provided for in Article 2, subsections a and b of this resolution, but the years of existence of these plantations will be recognized, up to a maximum of 3 years from establishment.
• g)Natural or legal persons wishing to reforest in areas larger than the limit established in the Regulations to the Forestry Law, Decree No. 25721-MINAE and its Amendments, may apply under a special financing scheme, being able to double the limit of 750 hectares, provided that the available resources are not used by small producers. The amounts to be paid will be those established in subsections a, b, and c above.
• h)The National Forest Financing Fund is instructed to incorporate into the Payment for Environmental Services contracts for the Reforestation and Agroforestry Systems in block activities, the minimum acceptable values for making payments.

The National Forest Financing Fund will use the following reference values to process the payments corresponding to each year:

*The reference values come from permanent sample plot data from reforesting companies contributed by the National Forestry Office (ONF), data from plots contributed by Forest Regents and recorded by Fonafifo, both datasets validated by Dr. Edgar Ortiz Malavassi, Professor at the Technological Institute of Costa Rica.

To calculate the total volume, the following equation must be used: Vtot = /4 * (DBH)² * Htot * Ff * N Where:

Vtot = Total volume per hectare expressed in cubic meters.

= (pi) is the ratio of a circle's circumference to its diameter in Euclidean geometry.

DBH = Diameter at breast height of 1.3m expressed in meters.

Htot = Total height expressed in meters.

Ff = Form factor equal to 0.5.

N = Number of trees per hectare.

• a)The State, through Fonafifo, will acquire the environmental services produced by forest plantations, understood as provided in subsection k of Article 3 of the Forestry Law No. 7575.
• b)Specifically, the environmental services provided by plantations will be paid according to the annual biomass growth in accordance with parameters established in this resolution. Said payments correspond to the total number of years of the agreed term; however, in order to allow the establishment of the plantation and its maintenance, payment will be advanced during the first five years.
• c)Fonafifo may modify, when so requested, those contracts signed before 2012 that demonstrate having reached a minimum production of 13 cubic meters of mean annual increment per hectare. For such purposes, Fonafifo may request the information it deems pertinent.

2.2. Natural Regeneration Activity: The conditions that will govern the processing of applications for the recognition of environmental services under the Natural Regeneration activity, carried out in denuded areas, without forest cover (cobertura boscosa), with nearby seed sources, in areas undergoing regeneration that do not meet the definition of forest and are free of grazing, are detailed below.

• a)The amount to be paid for Natural Regeneration will be one hundred seventeen thousand nine hundred forty-eight colones and 00/100 (¢117,948) per hectare, disbursed in five annual payments of 20% over a period of five years.

2.3. Agroforestry Systems Activity: The conditions that will govern the processing of applications for the recognition of environmental services under the Agroforestry Systems activity are detailed below.

• a)The amount to be paid will be one thousand six colones and 00/100 (¢1,006) per tree, integrated into Agroforestry Systems and disbursed over a period of five years. Payments will be distributed as follows: 50% the first year, 25% the third year, and 25% the fifth year.
• b)The amount to be paid will be one thousand four hundred ninety-one colones and 00/100 (¢1,491) per tree, integrated into Agroforestry Systems, strictly with native species included in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, disbursed over a period of five years. Payments will be distributed as follows: 50% the first year, 25% the third year, and 25% the fifth year.
• c)The amount to be paid will be one thousand four hundred ninety-one colones and 00/100 (¢1,491.00) per tree under the Agroforestry Systems activity established in Forest Harvest Plantations (PPAF), financed through forest credit. Payments will be distributed as follows: 80% will be disbursed once the contract is signed and the trees have reached 36 months of age; the remaining 20% will be processed when the trees are 60 months of age, in the fifth year of the project.
• d)Mixed Agroforestry Systems for small producers: The conditions for this modality are: When carrying out forest protection activities, a payment of thirty-six thousand eight hundred twenty-three colones and 00/100 (¢36,823.00) per hectare per year, during a period of five years (here, if necessary, fractions of existing hectares will be calculated, up to the first decimal). When they are denuded areas or areas in the process of regeneration, a payment of twenty-three thousand five hundred eighty-nine colones and 00/100 (¢23,589.00) per hectare per year will be recognized, during a period of five years. When carrying out reforestation activities with timber or multi-use species outside the forested area, a payment of two hundred ninety-nine colones and 00/100 (¢299.00) per tree per year, during a period of five years; a minimum quantity of two hundred planted trees or identified existing trees will be recognized, up to a maximum of two thousand two hundred trees. Under this sub-activity, a single contract may be executed covering the different activities, and the term will be five years starting from the signing of the contract.

2.4. Forest Protection Activity: The conditions that will govern the processing of applications for the recognition of environmental services under the Forest Protection activity are detailed below:

• a)The amount to be paid will be three hundred sixty-eight thousand two hundred twenty-nine colones and 00/100 (¢368,229), disbursed in ten annual payments of 10% over a period of ten years. For applications that are located within water importance zones, identified by the Costa Rican Institute of Aqueducts and Sewers, the Water Directorate, and Fonafifo, an additional amount of ninety-two thousand sixty-two colones (¢92,062) per hectare will be recognized, disbursed in ten annual payments of 10% over a period of ten years. This additional amount will be applied until the budget allocated for this activity is exhausted.
• b)The amount to be paid for Forest Management projects will be one hundred forty-three thousand eight hundred forty-one colones and 00/100 (¢143,841) per hectare, disbursed in five annual payments of 20% over a period of five years.

2.5. Forest Emission Reduction Contracts (CREF). The conditions that will govern the processing of applications for the recognition of Forest Emission Reductions are detailed below:

• a)The amount to be paid will be eighteen dollars 00/100 ($18) per hectare per year. Under this scheme, the payment is retroactive once it has been verified that the emission reduction effectively occurred.
• b)The maximum number of hectares to be contracted will be 450,000 for private forests; this amount may increase if external financing resources are available for this purpose.
• c)The term of the contracts may be retroactive to the year 2018, and its validity will be until December 2024, as was agreed with the International Bank for Reconstruction and Development (IBRD), partial financier of the projects. Based on what is indicated in the fifth considering of this resolution.

3. Updating of payment amounts. The amounts established by activity within the Payment for Environmental Services Program will be updated annually with the Consumer Price Index (CPI), calculated by the National Institute of Statistics and Census (INEC), at the close of the previous year's period. In the case of CREFs, since the payment is estimated in dollars, the amount to be paid is subject to the exchange rate established by the BCCR on the corresponding payment date.

Article 2nd-The National Forest Financing Fund is instructed to incorporate the following conditions into the Payment for Environmental Services contracts:

1. Of the terms of the contracts: The terms of the Payment for Environmental Services contracts, generated by the activities corresponding to the modalities of recovery and/or maintenance of forest cover (cobertura boscosa), will be as follows:

• a)Contracts corresponding to the Reforestation activity through the establishment of fast-growing species will have a term of ten years from their signing.
• b)Contracts corresponding to the Reforestation activity that incorporate medium-growing species and native species included in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, will have a term of sixteen years from their signing; including reforestation contracts with own resources and reforestation contracts exceeding the established limit.
• c)Contracts corresponding to the sub-activity of Forest Plantations with Reduced Rotation Cycles (PFTRR) will have a term of six years.
• d)Contracts corresponding to the activity of establishing trees in Agroforestry Systems with fast-growing, medium-growing species, and with native species included in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700MINAE of November 15, 1996, will have a term of five years from their signing.
• e)Contracts corresponding to the sub-activity of Agroforestry Systems established in Forest Harvest Plantations (PPAF) will have a term of 5 years; however, since they are already planted, they will be recognized retroactively three years for their prior establishment.
• f)Contracts corresponding to the sub-activity of Mixed Agroforestry Systems for micro-producers will have a term of 5 years from their signing.
• g)Contracts corresponding to the activity of establishing trees in Agroforestry Systems related to agreements or other donors or partners will have a term of five years from their signing.
• h)Contracts corresponding to the Natural Regeneration activity will have a term of five years from their signing.
• i)Contracts corresponding to the Forest Management activity will have a term of five years from their signing. Prior to the signing of the contract, the PSA file must contain the certification issued by SINAC of the technical closure of the management plan, according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decree No. 27388-MINAE published on November 2, 1998, and Executive Decree No. 34559-MINAE published in La Gaceta No. 115, on June 16, 2008.
• j)Contracts corresponding to the Forest Protection and Water Resources activity will have a term of ten years from their signing.

2. Special Considerations. Conditions established for the amounts and activities of PSA applications:

2.1. The National Forest Financing Fund is empowered to establish activities and differentiated amounts from those indicated in this resolution, in accordance with agreements, covenants, contracts, or specific projects with entities that contribute financial resources to the Payment for Environmental Services Program, recognizing amounts and conditions different from those established for the different environmental services; for these projects, the prioritization criteria detailed above will not apply, but rather those agreed upon in each covenant. Payments will be made provided there is budget availability to cover the commitments acquired through the Payment for Environmental Services Program.

2.2. The amounts pending payment for contracts from previous years will be governed by the provisions established in the Executive Decrees and Administrative Resolutions corresponding to each year.

2.3. To cover the cost of registering the contract with the Public Registry, the National Forest Financing Fund will withhold 0.6% from the first disbursement of the total contract amount. In the case of CREF contracts, as it is a results-based and retroactive project, the deduction will not be applied because they are not registered in the Public Registry.

2.4. Resources recovered by virtue of breaches of payment for environmental services contracts, or refunds or settlements, will be transferred to the Trust 544-3 FONAFIFO/BNCR and will be budgeted for the execution of new promotion activities for small and medium-sized producers.

2.5. The project must have a regent during the entire term of the payment for environmental services contract. The regency form may be registered with the College of Agronomic Engineers for the entire duration of the payment for environmental services contract, or for annual or five-year periods as determined by the property owner. Whatever the form of payment, the duly registered regency form must always be provided, except in those cases where it has been determined that the project will be supervised directly by the National Forest Financing Fund, through its officials or contracted support personnel.

2.6. Without prejudice to other provisions, the beneficiary or beneficiaries must provide an annual regency report issued by a forest regent for the payment process; or eventually a technical report issued by a forest professional, for those projects where the figure of the forest regent does not apply. Additionally, for fast-growing Reforestation contracts, they must submit inspection reports certifying the status of the projects at years 8 and 10 from their planting date; for medium-growing projects and other species, they must submit said reports at year 8, 12, and 16, from their planting date.

2.7. Without prejudice to other actions representing a breach of the contract obligations, for fast-growing Reforestation or block contracts starting at 12 months, and for medium-growing plantations or blocks starting at 24 months after the plantation is established, the contract is considered breached if the plantation does not present the minimum growth established in Article 1, subsection 2.1, or that previously indicated in the respective technical study for other species. As a consequence of this breach, the producer will not receive the payment corresponding to that year, and the National Forest Financing Fund must suspend the respective payments and terminate the contract with liability for the beneficiary, following due process. In highly qualified cases, based on studies and/or reports from the managers of Fonafifo Regional Offices, the respective payment may proceed and the contract may continue, even with lower growth rates, provided these are not due to breaches, poor site or species selection, or result from inadequate management of the plantation.

2.8. As a general principle, acts of God, force majeure, and the act of a third party shall be grounds for exemption from liability for breach of contract, as general exemptions duly proven and assessed at the discretion of Fonafifo. The same shall be done when the plantation owner demonstrates that a pest or disease affected the plantation and that timely actions taken did not succeed in eradicating it, provided they are documented in the PSA file and have the endorsement of the Regional Office. The same shall be done when the damage is the result of a fire that could not be controlled despite reported preventive measures.

2.9. Projects may not be executed on farms that have been subject to pests, diseases, or fires; in such a case, the farm may not be subject to Reforestation and/or Agroforestry Systems in Block contracts for a period of 3 years, starting from the last contract terminated for this reason.

2.10. Regarding pests and diseases affecting forest plantations, the Board of Directors of Fonafifo shall determine guidelines to address and resolve these situations.

2.11. Fonafifo shall be responsible for monitoring forest plantations that enter the Program, and must not only conduct follow-up at the regional level but also a control protocol, through a random mechanism of visits according to its technical and administrative capacity, in accordance with the availability of budgeted resources. In the same way, it must safeguard the information from the permanent measurement plots of the plantations, in order to support the payments and back the carbon and other greenhouse gas sequestration.

2.12. To standardize the information required from the permanent plots of plantations and blocks, Fonafifo will issue the content format for the database in Excel, so that the regents send it annually with the individual diameter and height data. The file is available on the Fonafifo website (www.fonafifo.go.cr) for download.

2.13. In the event that overlaps or displacement are determined to exist among the submitted applications and/or with other properties, Fonafifo shall assess, according to technical and legal criteria, the approval or rejection of the entry applications.

2.14. In the case of Reforestation entry applications involving mixtures of fast-growing, medium-growing, and/or endangered species, separate contracts must be generated, due to the growth differences that occur among these groups of species. Furthermore, projects composed of native species included in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, must contain 100% of the trees of the species included in the aforementioned decrees; otherwise, it shall have a value based on the lower amount established for Reforestation.

2.15. In the case of entry applications submitted to access the Payment for Environmental Services Program (Programa de Pago por Servicios Ambientales), they must contain the contact information (email address, telephone number, address) of the property owner or owners. Without this information, the administration shall deem the application incomplete and shall proceed to flag it, so that the applicant may proceed to complete it; if the information is not provided, the application shall be archived. Said information is essential for the notification process of the PSA program.

2.16. Forest plantations and individual trees of endangered species planted with funding from environmental services contracts may be harvested based on Article 28 of the Forestry Law (Ley Forestal).

2.17. Reforestation and block Agroforestry Systems (SAF) projects from the years 2016, 2017, 2018, 2019, and 2020 shall be assessed according to the growth parameters established in ministerial resolution R-167-2019-MINAE, published in La Gaceta No. 138 of July 23, 2019.

2.18. Fonafifo shall process the payment of contracts with delinquency in accordance with the provisions of Law No. 9686 and its amendments; wherein, the CCSS established the procedure that State institutions must follow regarding beneficiaries delinquent with the CCSS.

3. Special Considerations for CREF Projects.

CREF contract projects shall be processed and regulated according to the Manual to be issued for those purposes.

Único.-Que para el ejercicio 2022 el Presupuesto Nacional dispone un total de doce mil trescientos setenta y cuatro millones quinientos nueve mil ochocientos cuarenta y dos colones con 59/100 (¢12.374.509.842,59) para el Programa de Pago por Servicios Ambientales, los cuales serán utilizados para el pago de los compromisos de contratos PSA de años anteriores y la incorporación de nuevas hectáreas para el año 2022.

1. 1Que el artículo 38 del Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo N° 25721-MINAE, del 17 de octubre de 1996 y sus reformas, dispone que el Ministro de Ambiente y Energía como Jerarca del Ministerio de Ambiente y Energía, en funciones de la Administración Forestal del Estado, emitirá anualmente mediante Resolución Ministerial, las actividades a financiar en el Programa de Pago por Servicios Ambientales y los montos a pagar con base en los recursos asignados en el Presupuesto Nacional para el ejercicio del año fiscal 2022.
2. 2Que bajo este principio, los instrumentos financieros deben orientarse a apoyar los pilares del Plan Nacional de Desarrollo y de Inversión Pública del Bicentenario (PNDIP) 2019-2022; considerando los objetivos de la creación del Fondo Nacional de Financiamiento Forestal según la citada Ley Forestal, sin dejar de lado los criterios de orden técnico establecidos. 3. 3Que el Plan Nacional de Desarrollo citado, considera como una de las metas nacionales el mantener bajo el Programa de Pago por Servicios Ambientales, al menos trescientas mil hectáreas (300.000 has), en sus diferentes actividades.
4. 4Que el Ministerio de Ambiente y Energía ha emitido los Principios Rectores del Sector Forestal Productivo, mediante el Decreto Ejecutivo N° 41772-MINAE, así como los lineamientos a considerar en las gestiones institucionales para la reactivación y promoción de la reforestación en el país.
5. 5Que en virtud de los esfuerzos para lograr el reconocimiento internacional del aporte de los bosques en la reducción de emisiones de gases de efecto invernadero, el Gobierno de Costa Rica, suscribe un ERPA (contrato de compra venta de reducción de emisiones) con el Banco Internacional de Reconstrucción y Fomento, el 9 de diciembre del año 2020, el cual en su plan de distribución de beneficios se dispuso la creación de un mecanismo de pago por servicios ambientales especializado en la reducción de emisiones, el cual posee condiciones diferenciadas, este instrumento es el CREF. (Contrato de Reducción de Emisiones Forestales).

El citado instrumento se integra a el acuerdo suscrito por el Ministerio de Ambiente y Energía, el 10 de febrero del 2021, con el Fondo Verde de las Naciones Unidas, a través de la agencia implementadora PNUD Programa de Naciones Unidas para el Desarrollo, denominado cuyos recursos complementaran la negociación con el BIRF, antes indicado. Por tanto, LA MINISTRA DE AMBIENTE Y ENERGÍA,

Resultando:

Considerando:

RESUELVE:

Artículo 1 — Establecer el límite de gasto al Fondo Nacional de Financiamiento Forestal, para proyectos nuevos a financiar por actividades y determinar los montos de pago por actividad.

1. Actividades a financiar: Para el año 2022, se considerarán dos modalidades a financiar; a-Recuperación de la Cobertura Forestal, que incluye las actividades de Reforestación, Regeneración y Sistemas Agroforestales y b-Mantenimiento de la Cobertura Forestal, que incluye Protección de bosque y Manejo de bosque. Para tal fin, se establece la siguiente distribución:

*: El Fonafifo dará trámite a todas las solicitudes de ingreso que se presenten en las subactividades de Reforestación por 600 hectáreas y Sistemas Agroforestales, con especies contenidas en los decretos ejecutivos de veda y especies amenazadas o en peligro de extinción (Decreto N° 25663-MINAE y Decreto N° 25700-MINAE y sus reformas).

**: Se refieren a todas las solicitudes de ingreso con fincas en las cuales se ha finalizado el plan de manejo forestal a satisfacción de la Administración Forestal del Estado (AFE).

A partir del año 2022, se habilita un mecanismo derivado y financiado con recursos provenientes de contratos y acuerdos de Reducción de Emisiones producidas por los bosques; con una cantidad de 450.000 hectáreas. Esta actividad reconoce solo un servicio ambiental (reducción de emisiones de gases de efecto invernadero) en adelante, contratos CREF.

El Fondo Nacional de Financiamiento Forestal, podrá variar la distribución establecida en el cuadro anterior, de acuerdo con la disponibilidad del presupuesto aprobado para el Programa de Pago por Servicios Ambientales.

Se faculta a Fonafifo para que redistribuya los recursos presupuestados de la modalidad de Recuperación de la Cobertura Forestal no comprometidos al 26 de junio de cada año, para que se programen a la modalidad de Mantenimiento de la Cobertura Forestal.

De disponer de una mayor asignación de recursos, según el artículo 5 de la Ley de Simplificación y Eficiencia Tributarias N° 8114 publicada en La Gaceta N° 131, del día 9 de julio de 2001 y otros recursos financieros que capte el Fonafifo para el Pago por Servicios Ambientales, se distribuirán según el criterio de los financiadores y de las autoridades del Ministerio (o autoridades correspondientes). En todo caso, los recursos utilizados para estos fines, deberán ser incorporados en el presupuesto institucional o al Fideicomiso 544 Fonafifo/BNCR y ser aprobados por la Asamblea Legislativa o Contraloría General de la República.

2. De los montos de pago por actividad y otras condiciones:

2.1. Actividad de Reforestación: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Reforestación, son las siguientes:

• a)El monto a pagar para las especies de rápido crecimiento referidas a: Gmelina arborea, Acacia mangium, Vochysia guatemalensis y Vochysia hondurensis, será de setecientos veintiséis mil cuatrocientos tres colones con 00/100 (¢726.403) por hectárea, desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto año.
• b)El monto a pagar para las especies de mediano crecimiento referidas a: Tectona grandis, Pinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp y Cedrela odorata, será de ochocientos diecinueve mil treinta y seis colones con 00/100 (¢819.036) por hectárea, desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto año.
• c)El monto a pagar para especies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, será de un millón doscientos veintiocho mil quinientos cincuenta y seis colones con 00/100 (¢1.228.556) por hectárea, desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto año.
• d)El monto a pagar para las Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR) para especies de rápido crecimiento para embalaje, será de trescientos noventa mil ochocientos treinta y un colones con 00/100 (¢390.831) por hectárea. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 25% el segundo año y 25% el cuarto año.
• e)Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Reforestación proyecto piloto PSA más Crédito, son las siguientes:

i. El monto a pagar para el proyecto piloto PSA más Crédito con la especie de rápido crecimiento referida a: Gmelina arborea, será de trescientos noventa mil ochocientos treinta y un colones con 00/100 (¢390.831,00) por hectárea, desembolsado en un solo tracto del 100%, que se entregará por adelantado a la organización, siempre y cuando el beneficiario haya consentido mediante documento formal. Para el Proyecto Piloto se autorizará el pago por adelantado siempre y cuando se otorgue una garantía, que cubra el monto total del adelanto, a satisfacción del Fonafifo.

• f)Plantaciones Forestales establecidas con recursos propios para pago por resultados. Los montos a pagar serán los establecidos, en los incisos a, b, y c anteriores. Los montos serán distribuidos de la siguiente forma: con la firma del contrato un 50%, doce, veinticuatro, treinta y seis y cuarenta y ocho meses después de dicha firma un 20%, 15%, 10% y 5% respectivamente. Los contratos tendrán la vigencia prevista en el artículo 2 incisos a y b de esta resolución, pero se reconocerán los años de existencias de estas plantaciones; hasta un máximo de 3 años de establecidas.
• g)Las personas físicas o jurídicas que deseen reforestar en áreas mayores al tope establecido en el Reglamento a la Ley Forestal, Decreto N° 25721-MINAE y sus Reformas, podrán aplicar en un esquema especial de financiamiento, pudiendo duplicar el tope de 750 hectáreas, siempre y cuando los recursos disponibles no sean utilizados por los pequeños productores. Los montos a pagar serán los establecidos, en los incisos a, b, y c anteriores.
• h)Se instruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los contratos de Pago por Servicios Ambientales en la actividad de Reforestación y Sistemas Agroforestales en bloque, los valores mínimos aceptables para realizar los pagos.

El Fondo Nacional de Financiamiento Forestal utilizará los siguientes valores de referencia para tramitar los pagos correspondientes a cada año:

Para el cálculo del volumen total se debe usar la siguiente ecuación: Vtot = /4 * (DAP)² * Htot * Ff * N Donde:

Vtot = Volumen total por hectárea expresado en metros cúbicos.

= (pi) es la relación entre la longitud de una circunferencia y su diámetro en geometría euclidiana.

DAP = Diámetro a la altura de 1,3m expresado en metros.

Htot = Altura total expresada en metros.

Ff = Factor de forma igual que 0,5.

N = Número de árboles por hectárea.

• a)El Estado a través del Fonafifo, adquirirá los servicios ambientales que produzcan las plantaciones forestales, entendidos éstos según dispone el inciso k del artículo 3 de la Ley Forestal N° 7575.
• b)Específicamente, los servicios ambientales brindados por plantaciones, se pagarán según el crecimiento anual de la biomasa de acuerdo con parámetros establecidos en esta resolución. Dichos pagos corresponden al total de años del plazo convenido; no obstante, a fin de permitir el establecimiento de la plantación y su mantenimiento, se adelantará durante los primeros cinco años.
• c)El Fonafifo podrá modificar cuando así se solicite, aquellos contratos suscritos antes del año 2012, que demuestren haber alcanzado una producción mínima de 13 metros cúbicos de incremento medio anual por hectárea. Para tales efectos, el Fonafifo podrá solicitar la información que considere pertinente.

2.2. Actividad de Regeneración Natural: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Regeneración Natural, que se desarrollen en áreas denudadas, sin cobertura forestal, con fuentes semilleras cercanas, en áreas en proceso de regeneración que no cumplen con la definición de bosque y libres de pastoreo; se detallan a continuación.

• a)El monto a pagar en Regeneración Natural, será de ciento diecisiete mil novecientos cuarenta y ocho colones con 00/100 (¢117.948) por hectárea, desembolsados en cinco pagos anuales de 20% durante un período de cinco años.

2.3. Actividad de Sistemas Agroforestales: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Sistemas Agroforestales, se detallan a continuación.

• a)El monto a pagar será de mil seis colones con 00/100 (¢1.006) por árbol, integrados a Sistemas Agroforestales y desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 25% el tercero año y 25% el año quinto.
• b)El monto a pagar será de mil cuatrocientos noventa y un colones con 00/100 (¢1.491) por árbol, integrados a Sistemas Agroforestales, estrictamente con especies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 25% el tercero año y 25% el año quinto.
• c)El monto a pagar será de mil cuatrocientos noventa y un colones con 00/100 (¢1.491,00) por árbol bajo la actividad de Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF), financiados mediante el crédito forestal. Los pagos serán distribuidos de la siguiente forma: 80% se girará una vez firmado el contrato y que los árboles hayan alcanzado los 36 meses de edad; el restante 20% se tramitará cuando los árboles tengan 60 meses de edad, al quinto año del proyecto.
• d)Sistemas Mixtos en Agroforestería para pequeños productores: Las condiciones para esta modalidad son: Cuando realicen actividades de protección de bosque, un pago de treinta y seis mil ochocientos veintitrés colones con 00/100 (¢36.823,00) por hectárea por año, durante un periodo de cinco años, (aquí de ser necesario se calcularán las fracciones de hectáreas existentes, hasta el primer decimal. Cuando sean áreas denudadas o en proceso de regeneración, se reconocerá un pago de veintitrés mil quinientos ochenta y nueve colones con 00/100 (¢23.589,00) por hectárea, por año durante un periodo de cinco años. Cuando realicen actividades de reforestación de especies maderables o de uso múltiple fuera del área boscosa un pago de doscientos noventa y nueve colones con 00/100 por árbol (¢299,00) por año, durante un periodo de cinco años; se reconocerá una cantidad mínima de doscientos árboles plantados o árboles existentes identificados, hasta un máximo de dos mil doscientos árboles. En esta subactividad podrá realizarse un solo contrato que comprenda las diferentes actividades y el plazo será de cinco años contados a partir de la firma del contrato.

2.4. Actividad de Protección de Bosque: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Protección de Bosque, se detallan a continuación:

• a)El monto a pagar será de trescientos sesenta y ocho mil doscientos veintinueve colones con 00/100 (¢368.229) desembolsados en diez pagos anuales de 10% durante un período de diez años. Cuando se trate de solicitudes que se ubiquen dentro de las zonas de importancia hídrica, identificadas por el Instituto Costarricense de Acueductos y Alcantarillados, la Dirección de Aguas y el Fonafifo, se reconocerá un monto adicional de noventa y dos mil sesenta y dos colones (¢92.062) colones por hectárea, desembolsados en diez pagos anuales de 10% durante un período de diez años. Este monto adicional se aplicará hasta agotar el presupuesto asignado en esta actividad.
• b)El monto a pagar en proyectos de Manejo de bosque será de ciento cuarenta y tres mil ochocientos cuarenta y un colones con 00/100 (¢143.841) por hectárea, desembolsados en cinco pagos anuales de 20% durante un período de cinco años.

2.5. Contratos de Reducción de Emisiones Forestales (CREF). Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de Reducción de emisiones forestales, se detallan a continuación:

• a)El monto a pagar será de dieciocho dólares 00/100 ($18) por hectárea por año. Bajo este esquema el pago es retroactivo una vez que se haya verificado que efectivamente la reducción de emisiones se dio.
• b)El máximo de hectáreas a contratar será de 450.000 para bosques privados, este monto podrá aumentar si existe disponibilidad de recursos de financiamiento externo para este ese fin.
• c)El plazo de los contratos podrá ser retroactivo al año 2018, y su vigencia será hasta diciembre del 2024, pues así fue acordado con el Banco Internacional de Reconstrucción y Fomento (BIRF) financiador parcial de los proyectos. Con fundamento en lo indicado en el considerando quinto de la presente resolución.

3. Actualización de los montos a pagar. Los montos establecidos por actividad dentro del Programa de Pago por Servicios Ambientales, se actualizarán anualmente con el Índice de Precios al Consumidor (IPC), calculado por el Instituto Nacional de Estadística y Censo (INEC), al cierre del período del año anterior. Para el caso de los CREF, como el pago se estima en dólares el monto a pagar está sujeto al tipo de cambio establecido por el BCCR a la fecha de pago correspondiente.

Artículo 2 — Se instruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los contratos de Pago por Servicios Ambientales las siguientes condiciones:

1. De los plazos de vigencia de los contratos: Los plazos de vigencia de los contratos de Pago por Servicios Ambientales, generados por las actividades que corresponden a las modalidades de recuperación y/o mantenimiento de cobertura forestal serán los siguientes:

• a)Los contratos correspondientes a la actividad de Reforestación mediante el establecimiento de las especies de rápido crecimiento, tendrán una vigencia de diez años a partir de su firma.
• b)Los contratos correspondientes a la actividad de Reforestación que incorporen especies de mediano crecimiento y las especies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, su vigencia será de dieciséis años, a partir de su firma; incluyendo los contratos de reforestación con recursos propios y los contratos de reforestación que superen el tope establecido.
• c)Los contratos correspondientes a la subactividad de Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), tendrán una vigencia de seis años.
• d)Los contratos correspondientes a la actividad de establecimiento de árboles en Sistemas Agroforestales con especies de rápido, mediano y con las especies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700MINAE del 15 de noviembre de 1996, tendrán una vigencia de cinco años a partir de su firma.
• e)Los contratos correspondientes a la subactividad de Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF) tendrán una vigencia de 5 años; sin embargo, dado que ya están plantados se les reconocerán retroactivamente tres años por su establecimiento previo.
• f)Los contratos correspondientes a la subactividad de Sistemas Mixtos en Agroforestería para micro productores tendrán una vigencia de 5 años a partir de su firma.
• g)Los contratos correspondientes a la actividad de establecimiento de árboles en Sistemas Agroforestales relacionados a convenios u otros donantes o socios tendrán una vigencia de cinco años a partir de su firma.
• h)Los contratos correspondientes a la actividad de Regeneración Natural tendrán una vigencia de cinco años a partir de su firma.
• i)Los contratos correspondientes a la actividad de Manejo de bosque, tendrán una vigencia de cinco años a partir de su firma. De previo a la firma del contrato, deberá constar en el expediente de PSA la certificación emitida por el SINAC del cierre técnico del plan de manejo, según los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, Decreto Ejecutivo N° 27388-MINAE publicado el 2 de noviembre de 1998, y el Decreto Ejecutivo N° 34559-MINAE publicado en La Gaceta N° 115, del día 16 de junio de 2008.
• j)Los contratos correspondientes a la actividad de Protección de Bosque y Recurso Hídrico tendrán una vigencia de diez años a partir de su firma.

2. Consideraciones Especiales. Condiciones establecidas para los montos y actividades de las solicitudes PSA:

2.1. Se faculta al Fondo Nacional de Financiamiento Forestal a establecer actividades y montos diferenciados a los señalados en esta resolución, de conformidad con acuerdos, convenios o contratos o proyectos específicos con entidades, que aporten recursos financieros al Programa de Pago por Servicios Ambientales, que reconozcan montos y condiciones diferentes a los establecidos para los diferentes servicios ambientales; para estos proyectos no aplicarán los criterios de priorización que se detallaron anteriormente, sino los pactados en cada convenio. Los pagos se realizarán siempre y cuando se tenga disponibilidad presupuestaria para cubrir los compromisos adquiridos mediante el Programa de Pago por Servicios Ambientales.

2.2. Los montos pendientes por pagar para los contratos de años anteriores, se regirán según lo establecido en los Decretos Ejecutivos y Resoluciones Administrativas correspondientes para cada año.

2.3. Para cubrir el costo de inscripción del contrato ante el Registro Público, el Fondo Nacional de Financiamiento Forestal retendrá en el primer desembolso del monto total del contrato un 0,6%. Para el caso de los contratos CREF al ser un proyecto basado en resultados y retroactivo, no se les aplicará la deducción por cuanto no se inscriben en el Registro Público.

2.4. Los recursos recuperados en virtud de los incumplimientos de contratos de pago por servicios ambientales o las devoluciones o finiquitos, serán transferidos al Fideicomiso 544-3 FONAFIFO/BNCR y serán presupuestados para la ejecución de nuevas actividades de fomento de pequeños y medianos productores.

2.5. El proyecto deberá contar con un regente durante toda la vigencia del contrato de pago por servicios ambientales. El formulario de regencia podrá inscribirse ante el Colegio de Ingenieros Agrónomos, por la totalidad del plazo del contrato de pago por servicios ambientales, o por períodos anuales o quinquenales según disponga el propietario del inmueble. Cualquiera que sea la forma de pago, siempre deberá aportarse el formulario de regencia debidamente inscrito; salvo en aquellos casos que, se haya determinado que el proyecto será supervisado directamente por el Fondo Nacional de Financiamiento Forestal; a través de sus funcionarios o personal de apoyo contratado.

2.6. Sin perjuicio de otras disposiciones, el o los beneficiarios deberán aportar un informe de regencia anual emitido por un regente forestal para el trámite de pago; o eventualmente un informe técnico emitido por un profesional forestal, para aquellos proyectos que no aplica la figura del regente forestal. Adicionalmente, para los contratos de Reforestación de rápido crecimiento, deberá presentar los informes de visita, donde certifique el estado de los proyectos en los años 8 y 10 a partir de su fecha de plantación; para los proyectos de mediano crecimiento y otras especies deberán presentar dichos informes al año 8, 12 y 16, a partir de su fecha de plantación.

2.7. Sin perjuicio de otras acciones que representen incumplimiento a las obligaciones del contrato, para los contratos de Reforestación de rápido crecimiento o bloques a partir de los 12 meses y para las plantaciones de mediano crecimiento o bloques a partir de los 24 meses de establecida la plantación, se considera incumplido el contrato si la plantación no presenta el crecimiento mínimo establecido en el artículo 1 inciso 2.1, o el indicado de previo en el estudio técnico respectivo para otras especies. Como consecuencia de este incumplimiento, el productor no recibirá el pago correspondiente a este año, siendo que el Fondo Nacional de Financiamiento Forestal debe suspender los pagos respectivos y dar por terminado el contrato con responsabilidad para el beneficiario previo cumplimiento del debido proceso. En casos muy calificados, basados en estudios y/o informes de los encargados de Oficinas Regionales de Fonafifo, se podría proceder con el pago respectivo y continuar con el contrato aun con índices de crecimiento menor, siempre y cuando estos no obedezcan a incumplimientos, por la mala selección del sitio, de la especie, o sea producto de un inadecuado manejo de la plantación.

2.8. Como principio general, serán motivo de eximente de responsabilidad por incumplimiento del contrato, el caso fortuito, la fuerza mayor, el hecho de un tercero como eximentes generales debidamente comprobadas y valoradas a juicio del Fonafifo. De igual forma, se procederá cuando el propietario de la plantación demuestre que una plaga o enfermedad afectó la plantación y que las acciones oportunamente realizadas no lograron erradicarla, siempre y cuando estén documentadas en el expediente de PSA y tengan el aval de la Oficina Regional. Se procederá de igual manera cuando el daño sea producto de un incendio que no pudo ser controlado a pesar de las medidas preventivas reportadas.

2.9. No podrán ejecutarse proyectos en fincas que hayan sido objetos de plagas, enfermedades, o incendios; en tal supuesto la finca no podrá ser sujeto de contratos en Reforestación y/o Sistemas Agroforestales en bloque, en un plazo de 3 años, a partir del último contrato finalizado por esta causa.

2.10. En relación a las plagas y enfermedades que afecten las plantaciones forestales, la Junta Directiva de Fonafifo, determinará lineamientos para abordar y resolver estos supuestos.

2.11. El Fonafifo, será el responsable de monitorear las plantaciones forestales que ingresen al Programa, debiendo no solo hacer un seguimiento a nivel regional, sino un protocolo de control, mediante un mecanismo aleatorio de visitas según su capacidad técnica y administrativa, de acuerdo a la disponibilidad de recursos presupuestados. De igual forma, deberá custodiar la información de las parcelas permanentes de mediciones de las plantaciones, a fin de sustentar los pagos y respaldar las fijaciones de carbono y otros gases de efecto invernadero.

2.12. Para uniformizar la información requerida de las parcelas permanentes de plantaciones y bloques, el Fonafifo emitirá el formato del contenido de la base de datos en Excel, para que los regentes lo remitan anualmente con los datos individuales de diámetros y alturas. El archivo se encuentra disponible en el sitio web de Fonafifo (www.fonafifo.go.cr) para su descarga.

2.13. En caso de que en las solicitudes presentadas se determinara la existencia de traslapes o desplazamiento entre ellas y/o con otras fincas, el Fonafifo valorará de acuerdo a criterios técnicos y legales la aprobación o no de las solicitudes de ingreso.

2.14. En el caso de las solicitudes de ingreso de Reforestación que involucren mezclas de especies de rápido, mediano y/o en vías de extinción, se deberá generar contratos separados, en virtud de las diferencias de crecimiento que se presentan entre estos grupos de especies. Además, los proyectos que estén conformados por especies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, deberá contener el 100% de los árboles de las especies contenidas en los mencionados decretos; de lo contrario tendrá un valor en función del monto menor establecido para Reforestación.

2.15. En el caso de las solicitudes de ingreso que se presenten para acceder al Programa de Pago por Servicios Ambientales, deben de contener la información de contacto (correo electrónico, número de teléfono, dirección) del dueño o dueños del inmueble. Sin esta información la administración estimará como incompleta la solicitud y procederá a señalarla, para que la persona solicitante proceda a completarla, de no suministrar la información se procederá con su archivo. Dicha información es fundamental para el proceso de notificación del programa de PSA.

2.16. Las plantaciones forestales y árboles individuales de especies en peligro de extinción sembrados con financiamiento de contratos de servicios ambientales podrán ser aprovechados con fundamento en el artículo 28 de la Ley Forestal.

2.17. Los proyectos de Reforestación y SAF bloques de los años 2016, 2017, 2018, 2019 y 2020 serán valorados de acuerdo a los parámetros de crecimiento establecidos en la resolución ministerial R-167-2019- MINAE, publicados en La Gaceta N° 138 del 23 de julio del 2019.

2.18. El Fonafifo realizará el trámite de pago de los contratos con morosidad según lo establecido en la Ley N° 9686 y sus modificaciones; en donde, la CCSS estableció el procedimiento que las instituciones del Estado deben de seguir ante beneficiarios morosos con la CCSS.

3. Consideraciones Especiales de los proyectos CREF.

Los Proyectos de los contratos CREF serán tramitados y regulados según el Manual que será emitido a esos efectos.
