the entire text - Complete Text of Regulation 007 Delimitation of the public zone of a sector of the Pochote Mangrove, district Paquera, canton Puntarenas, province Puntarenas NOTICE No. 007-2022 MARITIME TERRESTRIAL ZONE Delimitation of the public zone of a sector of the Pochote Mangrove, district Paquera, canton Puntarenas, province Puntarenas" Based on the provisions of articles 140 and 240 of Law No. 6227, General Law of Public Administration, dated May 2, 1978; Law No. 59, Law for the Creation and Organization of the National Geographic Institute, dated July 4, 1944; Law No. 8905, Reform of Article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and amendment of Law No. 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its amendments, dated December 7, 2010; Law No. 6043, Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulation and; articles 2 and 3 of Law No. 5695, Law for the Creation of the National Registry, dated May 28, 1975 and its amendments.

1.-That by means of Law No. 8905, the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, investigations or work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, with the purpose of supporting planning processes.

2.-That Law No. 59 constitutes the IGN permanently and in representation of the State, as the official authority in geodetic matters and of the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order that originate from the work entrusted to its charge.

3.-That in accordance with Law No. 59; Article 62 of Executive Decree No. 7841-P, called Regulation to the Law on the Maritime Terrestrial Zone, recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its formalization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree No. 7841-P indicates that the National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.

4.-That in Executive Decree No. 36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone, dated June 28, 2011, in accordance with Articles 18, 19, and 20, it establishes that for the types of delimitation of the Public Zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, namely: a) delimitation through the placement of boundary markers (mojones) and; b) georeferenced digital delimitation, which is a methodology that allows the georeferencing of the ordinary high tide line (pleamar ordinaria) based on coordinates in the official reference system of the country, established by Executive Decree No. 33797-MJ-MOPT, titled "Declares CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83," without the need for placing boundary markers (mojones), in order to expedite delimitations and provide greater technical security to interested parties.

5.-That in Executive Decree No. 33797-MJ-MOPT, which, among other aspects, determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically indicating in its Article 11 that "The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the single official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person, or national or foreign private entity that undertakes or contracts geodetic and cartographic work must be referenced, thus contributing to avoiding public expenditure and, on the other hand, obtaining reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at different levels of the State."; while Article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish by appropriate means that information which has been made official." 6.-That Executive Decree No. 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, declares in its Article 1 that "The official horizontal geodetic reference system for Costa Rica, called CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and their update shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) called SIRGAS-CON," while Article 2 establishes that "The CRTM05 cartographic projection system shall continue to be the official system for the cartographic representation of the continental national territory, extended, for the purposes of application of this cartographic projection, to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State." For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which all work must be referenced in the continental territory of our country, by indicating that "The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the single official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed in the national territory by any public agency, person, or private entity, national or foreign, must be referenced." 7.-That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of developing regulatory plans (planes reguladores), endorsing survey plans (planos de agrimensura), granting concessions in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).

8.-That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone.

9.-That the GDG of the IGN on the Maritime Terrestrial Zone is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P; b) Executive Decree No. 33797-MJ-MOPT and; c) Executive Decree No. 36642-MP-MOPT-MINAET, all previously cited.

10.-That Law No. 7575, called the Forestry Law (Ley Forestal), dated February 13, 1996, in its Article 16 establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).

11.-That Law No. 6043 establishes in its Article 1 of Chapter I that: "The maritime terrestrial zone constitutes part of the national heritage, belongs to the State, and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is the obligation of the State, of its institutions, and of all the inhabitants of the country. Its use and exploitation are subject to the provisions of this law." 12.-That according to Article 11 of Chapter I of Law No. 6043, it establishes that the Public Zone is also, whatever its extent, that occupied by all the mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.

13.-That Executive Decree No. 36786-MINAET, titled Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives to "Identify within the Maritime Terrestrial Zone those lands that classify as forests, of forestry aptitude (forestry aptitude (suelos Clase VII y VIII)), wetlands (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons (lagunas costeras), swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), in order to certify them and incorporate them as part of the Natural Heritage of the State (Patrimonio Natural del Estado, PNE)." 14.-That Executive Decree No. 36786-MINAET, in point III.-Competencies for delimitation and certification, establishes that "The classification of lands within the MTZ shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations (Colegios Profesionales) to classify forests, lands of forestry aptitude (forestry aptitude (suelos Clase VII y VIII)), (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons (lagunas costeras), swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), and wetlands.

The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC that, by territorial competence, corresponds. The ACs of SINAC with jurisdiction in the MTZ shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones.

The location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the instrument of land-use planning (ordenamiento territorial) that defines and locates all the zones to be concessioned within the MTZ, and for its classification at the level of cadastral plans (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and be concessioned." 15.-That by means of official letter ACT-OR-T-794-2021, dated July 15, 2021, signed by Mr. Fabián Bonilla Salguero, Engineer of the Tempisque Conservation Area of the System of Conservation Areas of the Ministry of Environment and Energy, addressed to Engineer Omar Sotelo Porras of the National Geographic Institute, approval (visto bueno) is granted to the survey carried out by the company Topografía Reyes Sociedad Anónima, legal identification number (cédula jurídica) No. 3-101246302.

16.-That by means of the report called "Survey Report Carried Out by the Company Topografía Francisco Reyes" prepared by José Francisco Reyes Cordero, identification number (cédula) No. 1-0965-0870, of the company Topografía Francisco Reyes Sociedad Anónima, at the request of Laura Patricia Camacho Solís, identification number (cédula) 1-1660-0541, in her capacity as Special Attorney-in-Fact (Apoderada Especial) of the company Santa Lucía de Zona Azul Sociedad de Responsabilidad Limitada, with legal identification number (cédula jurídica) No. 3-102-799237, the IGN is presented with the technical information of the topographic survey for the delimitation of the Pochote mangrove corresponding to the public zone in the sector of Pochote, Paquera, Puntarenas, Puntarenas.

17.-That by means of official letter DIG-TOT-0053-2022, dated January 27, 2022, issued by the Official Boundaries Sub-process of the Topographic and Territory Observation Department of the IGN, the Directorate of the National Geographic Institute was informed that the work carried out by the company Topografía Francisco Reyes Sociedad Anónima has the technical endorsement for its publication.

18.-That Article 140 of Law No. 6227 indicates that "The administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted," a provision that must necessarily be related to Article 240 of the same regulatory body, which defines the ideal instrument for communicating acts of a generic nature by indicating that "General acts shall be communicated by publication, and specific ones by notification." COMMUNICATES:

1°-The National Geographic Institute publishes, in the sector of Pochote, located in district 05 Paquera, of canton 01 Puntarenas, of the province 06 Puntarenas, by means of the methodology used and validated both by the Tempisque Conservation Area of SINAC-MINAE and by the IGN, the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of a sector of the Pochote mangrove.

2°-The delimited public zone of the Maritime Terrestrial Zone of a sector of the Pochote mangrove in the sector known as Pochote, in district 05 Paquera, of canton 01 Puntarenas, of province 06 Puntarenas, corresponds to the boundary markers (mojones) whose coordinates in the Costa Rica CRTM05 cartographic projection system are indicated below:

3°-The delimitation of the Pochote mangrove in the site known as Pochote, in the Paquera district, Puntarenas canton, Puntarenas province, is published in accordance with official letter ACT-OR-T-794-2021, signed by Mr. Fabián Bonilla Salguero, of the Tempisque Conservation Area, and the technical report "Survey Report Carried Out by the Company Topografía Francisco Reyes." 4°-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of the Pochote mangrove of the Maritime Terrestrial Zone have been registered in the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a vector format shapefile, under the codification RN/IGN_ GDG-IGN-ZMT.

5°-Effective from its publication.

1.-Que mediante ley N° 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la ley N° 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

2.-Que la ley N° 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

3.-Que de conformidad con la ley N° 59; el artículo 62 del Decreto Ejecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N.° 7841-P señala que El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.

4.-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre, del 28 de junio del 2011, de conformidad con los artículos 18, 19 y 20 establece que los tipos de delimitación de la Zona Pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución a saber: a) delimitación a través de la colocación de mojones y; b) delimitación digital georreferenciada, que es una metodología que permite la georreferenciación de la pleamar ordinaria, a partir de coordenadas en el sistema de referencia oficial del país, establecido por el Decreto Ejecutivo N° 33797-MJ-MOPT titulado Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83, sin que sea necesario la colocación de mojones, con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

5.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en su artículo 11 que La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose de esta forma a evitar el gasto público y obteniendo por otra parte información geográfica confiable, uniforme y comparable que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.; mientras que el artículo 7 indica que Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado.

6.-Que el Decreto Ejecutivo N° 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense.

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera." 7.-Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

8.-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre.

9.-Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N.º 7841-P; b) el Decreto Ejecutivo N° 33797-MJ-MOPT y; c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, todos previamente citados.

10.-Que la ley N° 7575 denominada Ley Forestal del 13 de febrero de 1996 en su artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno, los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que la ley N° 6043 establece en su artículo 1 del Capítulo I, que: La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley.

12.-Que según el artículo 11 del Capítulo I, de la ley N° 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

13.-Que el Decreto Ejecutivo N° 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

14.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y concesionar.

15.-Que mediante el oficio ACT-OR-T-794-2021 de fecha 15 de julio de 2021, suscrito por el Sr. Fabián Bonilla Salguero, Ingeniero del Área de Conservación Tempisque del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía, dirigido a Ing. Omar Sotelo Porras del Instituto Geográfico Nacional, se otorga visto bueno al levantamiento realizado por la Empresa Topografía Reyes Sociedad Anónima, cédula jurídica N° 3-101246302.

16.-Que mediante el informe denominado "Informe del Levantamiento Realizado por la Empresa Topografía Francisco Reyes" elaborado por José Francisco Reyes Cordero, cédula N° 1-0965-0870, de la empresa Topografía Francisco Reyes Sociedad Anónima, a solicitud de Laura Patricia Camacho Solís, cédula 1-1660-0541, en su condición de Apoderada Especial de la empresa Santa Lucía de Zona Azul Sociedad de Responsabilidad Limitada, con cédula jurídica No. 3-102-799237, se presenta al IGN la información técnica del levantamiento topográfico para la delimitación del manglar Pochote correspondiente a zona pública en el sector de Pochote, Paquera, Puntarenas, Puntarenas.

17.-Que mediante el oficio DIG-TOT-0053-2022 de fecha 27 de enero de 2022, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del IGN, se le comunicó a la Dirección del Instituto Geográfico Nacional que los trabajos realizados por la empresa Topografía Francisco Reyes Sociedad Anónima cuentan con el aval técnico para su publicación.

18.-Que el artículo 140 de la ley N° 6227 señala que El acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte, disposición que necesariamente debe relacionarse con el artículo 240 del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que Se comunicarán por publicación los actos generales y por notificación los concretos.

COMUNICA:

1°-El Instituto Geográfico Nacional publica en el sector de Pochote, ubicado en el distrito 05 Paquera, del cantón 01 Puntarenas, de la provincia 06 Puntarenas, por medio de la metodología usada y validada tanto por el Área de Conservación Tempisque del SINACMINAE y por el IGN, la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de un sector del manglar Pochote.

2°-La zona pública de la Zona Marítimo Terrestre delimitada de un sector del manglar Pochote en el sector conocido como Pochote en el distrito 05 Paquera, del cantón 01 Puntarenas de la provincia 06 Puntarenas, corresponde a los mojones cuyas coordenadas en el sistema de proyección cartográfico Costa Rica CRTM05, se indican a continuación:

Sector de Manglar Pochote:

3°-Se publica la delimitación del manglar Pochote en el sitio conocido como Pochote en el distrito Paquera del cantón Puntarenas de la provincia Puntarenas, acorde con el oficio ACT-OR-T-794-2021 suscrito por el Sr. Fabián Bonilla Salguero, del Área de Conservación Tempisque y el informe técnico Informe del Levantamiento Realizado por la Empresa Topografía Francisco Reyes.

4°-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre del manglar Pochote de la Zona Marítimo Terrestre han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en un archivo con formato vectorial shape, bajo la codificación RN/IGN_ GDG-IGN-ZMT.

5°-Rige a partir de su publicación.
