in the entirety of the text - Complete Text of Norm 005 Delimitation of the public zone corresponding to the Escaramojo estuary (ría) of the district of La Cruz, canton of La Cruz, province of Guanacaste NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC DEPARTMENT AND TERRITORY OBSERVATION NOTICE No. 005-2022 MARITIME TERRESTRIAL ZONE "Delimitation of the public zone corresponding to the Escaramojo estuary (ría) of the district of La Cruz, canton of La Cruz, province of Guanacaste" Based on the provisions of Articles 140 and 240, subsection 1 of Law No. 6227, General Law on Public Administration, dated May 2, 1978, Law No. 59, Law for the Creation of the National Geographic Institute, effective January 1, 1945, Law No. 8905, Law for the Transfer of the National Geographic Institute to the National Registry, dated December 7, 2010, Law No. 6043, Law on the Maritime Terrestrial Zone, dated March 2, 1977, with its respective regulation and Articles 2 and 3 of Law No. 5695, Law for the Creation of the National Registry, dated May 28, 1975, and its amendments.

1.-That by Law No. 8905, the National Geographic Institute is established, hereinafter IGN, as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the IGN shall be the scientific and technical dependency governing national cartography, responsible for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica, and for the studies, research or work, and the development of national policies of a cartographic, geographic, geodetic, geophysical nature, and similar nature related to said works, in order to support planning processes.

2.-That in accordance with Law No. 59, the IGN Law, it is permanently constituted and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the works entrusted to it.

3.-That in accordance with Law No. 59, the IGN Law, and Article 62 of the Regulation to Law No. 6043, the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone is recognized, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime terrestrial zone in which it has demarcated the public zone." 4.-That in Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone", dated July 14, 2011, it is established according to Article 18° types of delimitation, the IGN may resort to two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.

5.-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines, the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the only official coordinate system for the Republic of Costa Rica from which all cartographic and geodetic surveys and activities developed in the National Territory by any public dependency, person, or national or foreign private entity must be referenced." ; while Article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish by appropriate means that information that has been officialized." 6.-That Executive Decree No. 40962-MJP "Update of the Official Horizontal Geodetic Reference System for Costa Rica" declares that: "The official horizontal geodetic reference system for Costa Rica, denominated CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica." , while "The CRTM05 cartographic projection system shall remain the official system for the cartographic representation of the national continental territory." For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that ".all cartographic and geodetic surveys and activities developed in the national territory by any public dependency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic works, contributing to avoiding public comparable geographic information that is of general utility and supports decision-making at the different levels of the State." For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that The CRSIRGAS horizontal reference system and its associated CRTM05 cartographic projection for the continental territory extended up to the baseline of the territorial sea and, the "Universal Transverse Mercator" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the national territory by any public dependency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic works must be referenced." 7.-That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, the approval (visado) of survey plans, the granting of concessions in the Restricted Zone, and other aspects of coastal territorial planning.

8.-That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (GDG) of the IGN on the Maritime Terrestrial Zone (ZMT).

9.-That the GDG of the IGN on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOP, and c) Executive Decree No. 36642-MP-MOPT-MINAET, previously cited.

10.-That Article 16° of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).

11.-That according to Article 69 of Law No. 276, Water Law (Ley de Aguas), it states: The maritime zone is understood to be the space of the coasts of the Republic bathed by the sea in its flow and ebb and the immediate lands up to the distance of one mile, that is one thousand six hundred seventy-two meters, counted from the line marking the high tide.

This maritime zone also extends along the banks of rivers to the point where they are navigable or the tides become noticeable, with a width of two hundred meters from each bank, counted from the line marking the high tide.

12.-That by certification No. SINAC-SE-IRT-049 dated February 9, 2018, signed by Jacklyn Rivera Wong in the capacity of coordinator of the National Wetlands Program (Programa Nacional de Humedales), it establishes the extent of the estuary (ría) of the Escaramojo River in district 01 La Cruz, canton 10 La Cruz, of province 05 Guanacaste.

13.-The IGN used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in the Escaramojo River estuary (ría), located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste.

14.-That the delimitation carried out has the internal technical endorsement of the IGN, in accordance with official letter No. DIG-TOT-0750-2021 of December 1, 2021, issued by the Official Limits Subprocess of the Topographic Department and Territory Observation of the IGN.

15.-That Article 140 of Law No. 6227, General Law of Public Administration, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce them from the moment it is adopted," a provision that must necessarily be related to numeral 240) of the same normative body, which defines the ideal instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific acts, by notification." COMMUNICATES:

1°-The IGN used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in the Escaramojo River estuary (ría), located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste, based on official letter SINAC-SE-IRT049 dated February 9, 2018, signed by Jacklyn Rivera Wong in the capacity of Coordinator of the National Wetlands Program (Programa Nacional de Humedales).

2°-The public zone of the Maritime Terrestrial Zone corresponding to the Escaramojo River, located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste, is given in the official cartographic projection system of Costa Rica CRTM05, under the following coordinates:

3°-The sectors located in district 01° La Cruz of canton 10° La Cruz, of province 05° Guanacaste that, as of the date, have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

4°-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone corresponding to the Escaramojo River estuary (ría), located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste, have been recorded in the Digital Georeferenced Geodatabase (GDG) of the IGN on the Maritime Terrestrial Zone (ZMT), in a vector shapeformat file, under the coding:

RN/IGN_GDG-IGN-ZMT_Rias.

5°-It is effective as of its publication.

Considering:

en la totalidad del texto - Texto Completo Norma 005 Delimitación de zona pública correspondiente a la ría del Escaramojo del distrito La Cruz, cantón La Cruz, provincia Guanacaste INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO AVISO N° 005-2022 ZONA MARÍTIMO TERRESTRE "Delimitación de zona pública correspondiente a la ría del Escaramojo del distrito La Cruz, cantón La Cruz, provincia Guanacaste" Con fundamento en lo dispuesto en los artículos 140 y 240, inciso 1 de la Ley N° 6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978, Ley N° 59 Ley de Creación del Instituto Geográfico Nacional vigencia del 1° de enero de 1945, Ley N° 8905 Ley de traslado del Instituto Geográfico Nacional al Registro Nacional de fecha 7 de diciembre del 2010, Ley N° 6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento y artículos 2 y 3 de la Ley N°5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.

1.-Que mediante Ley N° 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el IGN será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

2.-Que de conformidad con Ley N° 59 Ley de IGN, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

3.-Que de conformidad con Ley N° 59 Ley de IGN, y en el artículo 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".

4.-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", del 14 de julio del 2011, se establece según el artículo 18° tipos de delimitación, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

5.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." 6.-Que el Decreto Ejecutivo N° 40962-MJP "Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica" declara que: "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica." , mientras que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que ".todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos." 7.-Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

8.-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre (ZMT).

9.-Que la GDG del IGN sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N°. 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOP y c) el Decreto Ejecutivo N°. 36642-MP-MOPT-MINAET ya previamente citados.

10.-Que el artículo 16° de la Ley Forestal, Ley N°.7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que según el artículo 69 de la ley N° 276, Ley de Aguas, menciona: Por zona marítima se entiende el espacio de las costas de la República que baña el mar en su flujo y reflujo y los terrenos inmediatos hasta la distancia de una milla, o sean mil seiscientos setenta y dos metros, contados desde la línea que marque la marea alta.

Esta zona marítima se extiende también por las márgenes de los ríos hasta el sitio en que sean navegables o se hagan sensibles las mareas, con un ancho de doscientos metros desde cada orilla, contados desde la línea que marque la marea alta.

12.-Que mediante la certificación N° SINAC-SE-IRT-049 de fecha 09 de febrero del 2018, firmada por Jacklyn Rivera Wong en carácter de coordinadora del Programa Nacional de Humedales, establece el alcance de la ría del Río Escaramojo en el distrito 01 La Cruz, cantón 10 La Cruz, de la provincia 05 Guanacaste.

13.-El IGN, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en la ría del Río Escaramojo, ubicado en el distrito 01° La Cruz, cantón 10° La Cruz de la provincia de 05° Guanacaste.

14.-Que la delimitación realizada cuenta con aval técnico interno del IGN, conforme al oficio N° DIG-TOT-0750-2021 del 01 de diciembre de 2021, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del IGN.

15.-Que el artículo 140 de la Ley N° 6227 Ley General de la Administración Pública, señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 240) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1°-El IGN, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en la ría del Río Escaramojo, ubicado en el distrito 01° La Cruz, cantón 10° La Cruz de la provincia de 05° Guanacaste con base en el oficio SINAC-SE-IRT049 de fecha 09 de febrero de 2018 firmada por Jacklyn Rivera Wong en carácter de Coordinadora del Programa Nacional de Humedales.

2°-La zona pública de la Zona Marítimo Terrestre correspondiente en el Río Escaramojo, ubicado en el distrito 01° La Cruz, cantón 10° La Cruz de la provincia de 05° Guanacaste, está dada en el sistema de proyección cartográfica oficial de Costa Rica CRTM05, bajo las siguientes coordenadas:

3°-Los sectores ubicados en el distrito 01° La Cruz del cantón 10° La Cruz, de la provincia 05° Guanacaste que a la fecha cuentan con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

4°-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre correspondiente a la ría del Río Escaramojo, ubicado en el distrito 01° La Cruz, cantón 10° La Cruz de la provincia de 05° Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación:

RN/IGN_GDG-IGN-ZMT_Rias.

5°-Rige a partir de su publicación.
