Safety Specifications N° 43417-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by articles 50, 140 subsections 3) and 18) and 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law on Public Administration, No. 6227 of May 2, 1978; articles 1, 2 subsections b) and c), 3 and 56 of the Organic Law of the Environment, No. 7554 of October 4, 1995; the Organic Law of the Ministry of Environment and Energy, No. 7152 of June 5, 1990; and article 5 subsection d) of the Law of the Regulatory Authority for Public Services, No. 7593 of August 9, 1996.

1. 1That the country has been making efforts to improve the safety conditions under which establishments that use or supply Liquefied Petroleum Gas (LPG) operate. To this end, a series of technical and legal provisions were established in Executive Decree No. 41150-MINAE-S of May 4, 2018, "General Regulation for the regulation of the supply of liquefied petroleum gas" and Executive Decree No. 41151-MINAE of May 4, 2018, "Technical Regulation RTCR 490:2017 Equipment for the petroleum industry, portable cylinders, stationary tanks, equipment and appliances for the supply and use of Liquefied Petroleum Gas (LPG). Safety Specifications," to fulfill this purpose.
2. 2That given the reality of the market and the current economic conditions, the concessionaire companies of the cylinder filling service consider that the deadline established in Transitory Provision I of Executive Decree No. 41151-MINAE to replace the quick-coupling valve with the threaded-coupling valve (POL Type) on all portable cylinders in use in the country, is insufficient for both technical and economic reasons, and that therefore, it is necessary to establish adjustments to said deadline.
3. 3That in accordance with the Regulation to the Law for the Protection of Citizens from the Excess of Requirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC and its reforms, it was determined that the present proposal does not establish or modify procedures, requirements, or formalities that the citizen must comply with, a situation for which the prior control procedure was not carried out. Therefore;

They Decree:

AMENDMENT TO EXECUTIVE DECREE NO. 41151-MINAE OF MAY 4, 2018, CALLED "TECHNICAL REGULATION RTCR 490:2017 EQUIPMENT FOR THE PETROLEUM INDUSTRY, PORTABLE CYLINDERS, STATIONARY TANKS, EQUIPMENT AND APPLIANCES FOR THE SUPPLY AND USE OF LIQUEFIED PETROLEUM GAS (LPG). SAFETY SPECIFICATIONS"

Considering:

Especificaciones de Seguridad N° 43417-MINAE EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE AMBIENTE Y ENERGÍA En ejercicio de las facultades que les confieren los artículos 50, 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública, Nº 6227 del 2 de mayo de 1978; los artículos 1, 2 incisos b) y c), 3 y 56 de la Ley Orgánica del Ambiente, Nº 7554 del 4 de octubre de 1995; Ley Orgánica del Ministerio del Ambiente y Energía, Nº 7152 del 5 de junio de 1990; y el artículo 5 inciso d) de la Ley de la Autoridad Reguladora de los Servicios Públicos, Nº 7593 del 09 de agosto de 1996.

1. 1Que el país viene haciendo esfuerzos en mejorar las condiciones de seguridad en que operan los establecimientos que usan o suministran Gas Licuado de Petróleo (GLP). Para ello se establecieron en los Decretos Ejecutivos N° 41150-MINAE-S del 4 de mayo del 2018, "Reglamento general para la regulación del suministro de gas licuado de petróleo" y el N° 41151-MINAE del 4 de mayo de 2018, "Reglamento Técnico RTCR 490:2017 Equipos para la industria de petróleo, cilindros portátiles, tanques estacionarios, equipos y artefactos para suministro y uso del Gas Licuado de Petróleo (GLP). Especificaciones de Seguridad", una serie de disposiciones técnicas y legales para cumplir con dicho propósito.
2. 2Que dada la realidad del mercado y las condiciones económicas actuales, las empresas concesionarias del servicio de envasado de cilindros, consideran que el plazo establecido en el Transitorio I del Decreto Ejecutivo N° 41151-MINAE para sustituir la válvula de acoplamiento rápido por la válvula de acoplamiento roscado (Tipo POL) en todos los cilindros portátiles que estén en uso en el país, es insuficiente tanto por razones técnicas, como económicas y que por lo tanto, se hace necesario establecer ajustes a dicho plazo.
3. 3Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto;

MODIFICACIÓN AL DECRETO EJECUTIVO N° 41151-MINAE DEL 4 DE MAYO DEL 2018 DENOMINADO "REGLAMENTO TÉCNICO RTCR 490:2017 EQUIPOS PARA LA INDUSTRIA DE PETRÓLEO, CILINDROS PORTÁTILES, TANQUES ESTACIONARIOS, EQUIPOS Y ARTEFACTOS PARA SUMINISTRO Y USO DEL GAS LICUADO DE PETRÓLEO (GLP). ESPECIFICACIONES DE SEGURIDAD"

Considerando:

Decretan:
