Based on the provisions of Articles 140 and 240 of Law No. 6227 General Law of Public Administration of May 2, 1978; Law No. 59 Law for the Creation and Organization of the National Geographic Institute of July 4, 1944; Law No. 8905 Reform of Article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and modification of Law No. 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its amendments of December 7, 2010; Law No. 6043 Law on the Maritime Terrestrial Zone (Zona Marítimo Terrestre) of March 2, 1977, with its respective regulations; and Articles 2 and 3 of Law No. 5695 Law for the Creation of the National Registry of May 28, 1975 and its amendments.

1. 1That by means of Law No. 8905 the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical body governing national cartography, tasked with the execution of the official Basic Map and the basic geographical Description of the Republic of Costa Rica and with the studies, research, or work and the development of national policies of a cartographic, geographical, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.
2. 2That Law No. 59 establishes the IGN permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any kind that originate from the works entrusted to its charge.
3. 3That in accordance with Law No. 59; Article 62 of the Executive Decree No. 7841-P called Regulation to the Law on the Maritime Terrestrial Zone recognizes the competence of the IGN for the demarcation of the public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre), and its officialization through publication in the Official Gazette La Gaceta; Article 63 of the Executive Decree No. 7841-P indicates that The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone (zona pública).
4. 4That in Executive Decree No. 36642-MP-MOPT-MINAET Regulation of Specifications for the Demarcation of the public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre), of June 28, 2011, in accordance with Articles 18, 19, and 20, it establishes the types of demarcation of the Public Zone (Zona Pública) of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, namely: a) demarcation through the placement of boundary markers (mojones) and; b) georeferenced digital demarcation, which is a methodology that allows the georeferencing of the ordinary high-water mark (pleamar ordinaria), based on coordinates in the official reference system of the country, established by Executive Decree No. 33797-MJ-MOPT titled. Declares as the official horizontal datum for Costa Rica, the CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, without the need for the placement of boundary markers (mojones), in order to expedite demarcations and provide greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines, the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in its Article 11 that The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05, will constitute the only official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities carried out within the National Territory must be referenced by any public agency, person, or private national or foreign entity that undertakes or contracts geodetic and cartographic works, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information that is of general utility and that supports decision-making at the different levels of the State.; while Article 7 indicates that As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute will publish by appropriate means that information that has been officialized.
6. 6That Executive Decree No. 40962-MJP Update of the Official Horizontal Reference Geodetic System for Costa Rica declares in its Article 1 that The official horizontal reference geodetic system for Costa Rica, called CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and updates will be governed according to the new definitions of the ITRF implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) called SIRGAS-CON, while Article 2 establishes that The cartographic projection system CRTM05 will continue to be the official one for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection, up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State.

For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended up to the baseline of the territorial sea, and the "Universal Transverse Mercator" (U'TM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, will constitute the only official coordinate system for the Republic of Costa Rica, based on which, all cartographic and geodetic surveys and activities carried out within the national territory by any public agency, person, or private entity, national or foreign, that undertakes or contracts geodetic and cartographic works must be referenced, contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State.

1. 7That georeferencing to the national coordinate system as a mechanism to demarcate the public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre), enables the correct demarcation of the public zone (zona pública) for the purposes of preparing regulatory plans (planes reguladores), endorsing survey plans, granting concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning.
2. 8That the georeferenced digital information on the demarcation of the public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre) held by the IGN, is called the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (Zona Marítimo Terrestre).
3. 9That the GDG of the IGN on the Maritime Terrestrial Zone (Zona Marítimo Terrestre) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P; b) Executive Decree No. 33797-MJ-MOPT and; c) Executive Decree No. 36642-MP-MOPT-MINAET, all previously cited.

10.—That Law No. 7575 called Forestry Law (Ley Forestal) of February 13, 1996, in its Article 16 establishes that the Ministry of Environment and Energy will demarcate on the ground, the boundaries of the areas that make up the State's Natural Heritage (Patrimonio Natural del Estado).

11.—That Law No. 6043 establishes in its Article 1 of CHAPTER I, General Provisions that The maritime terrestrial zone (zona marítimo terrestre) constitutes part of the national heritage, belongs to the State, and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is an obligation of the State, of its institutions, and of all the inhabitants of the country. Its use and exploitation are subject to the provisions of this law.

12.—That according to Article 11 of CHAPTER I, General Provisions of Law No. 6043, it establishes that the public zone (zona pública) is also, whatever its extension, that occupied by all the mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.

13.—That Executive Decree No. 36786-MINAET titled Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone (Zona Marítimo Terrestre) in Costa Rica published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives To identify within the Maritime Terrestrial Zone (Zona Marítimo Terrestre) those lands that classify as forests, of forestry aptitude (suelos Clase VII y VIII), wetlands (humedales) (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)), to certify them and incorporate them as part of the State's Natural Heritage (Patrimonio Natural del Estado, PNE).

14.—That Executive Decree No. 36786-MINAET in point III.—Competencies for demarcation and certification establishes that The classification of lands within the ZMT will correspond to the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations to classify forests, lands of forestry aptitude (suelos Clase VII y VIII) (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)) and wetlands (humedales).

The validity of classification documents issued by private professionals will be subject to the approval issued by the AC that corresponds by territorial competence. The ACs of SINAC with jurisdiction in the ZMT will also be competent for the verification, supervision, boundary determination (deslinde), and certification of lands of the State's Natural Heritage (Patrimonio Natural del Estado) and the protection zones.

The location and demarcation of the areas of the State's Natural Heritage (Patrimonio Natural del Estado) within the Maritime Terrestrial Zone (Zona Marítimo Terrestre), must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all the zones to be concessioned within the ZMT and for the classification of the latter at the cadastral plan level. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so as not to account for them in the total area to be concessioned.

15.—That by means of official communication SINAC-ACOSA-D-393-2021 dated June 23, 2021, signed by Ms. Laura Rivera Quintanilla, Acting Director of the Osa Conservation Area (Área de Conservación Osa) of the System of Conservation Areas of the Ministry of Environment and Energy, the approval is requested from the National Geographic Institute for the publication of the demarcation works carried out by Engineer Luis Quesada Camacho; the survey was approved by the Osa Conservation Area (Área de Conservación Osa) through the Verification Report for Topographic Survey of Mangrove in Sábalo de Sierpe SINAC-ACOSA-PNE-AD-077-2021, based on Executive Decree No. 36786-MINAET.

16.—That in the Verification Report for Topographic Survey of Mangrove in Sábalo de Sierpe SINAC-ACOSA-PNE-AD-077-2021 the technical information is presented for the review of the survey of the demarcation of a sector of the estuary-mangrove (estero-manglar) ecosystem in the sector known as Sábalo de Sierpe, Osa, Puntarenas. The topographic survey was carried out by Engineer Luis Quesada Camacho.

17.—That through the Georeferenced Digital Demarcation Report Térraba Sierpe Estuary Wetland (Humedal), Puntarenas, prepared by Engineer Luis Quesada Camacho of the Company SOTOP Sociedad Anónima, at the request of Marle Quesada Jiménez, identification number 10721-0557, as an interested party in the process, the technical information of the topographic survey for the demarcation of a sector of the Estero-Manglar Térraba-Sierpe Wetland (Humedal), in Osa, Puntarenas, is presented to the IGN.

18.—That by means of official communication DIG-TOT-0546-2021 dated September 8, 2021, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the IGN, the Directorate of the National Geographic Institute was informed that the works carried out by Engineer Luis Quesada Camacho have the technical endorsement for their publication.

19.—That Article 140 of Law No. 6227 indicates that The administrative act shall produce its effect after being communicated to the administered party, except if it only grants rights, in which case it shall produce it from the moment it is adopted, a provision that must necessarily be related to Article 240 of the same regulatory body, which defines the appropriate instrument for communicating acts of a generic nature by stating that General acts shall be communicated by publication and specific ones by notification.

COMMUNICATES:

First.—The National Geographic Institute publishes the georeferenced digital demarcation of the public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre) in a sector of the Estero-Manglar Térraba Sierpe Wetland (Humedal Estero-Manglar Térraba Sierpe) of Osa in Sábalo, in district No. 03 Sierpe, of canton No. 05 of Osa, of province No. 06 of Puntarenas.

Second.—The public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre) demarcated in the sector of Sábalo, Sierpe, Osa, Puntarenas, corresponds to a total of 13 virtual boundary markers (mojones virtuales) ranging from 1 to 13, which define a sector of the Estero-Manglar Térraba-Sierpe Wetland (Humedal Estero-Manglar Térraba-Sierpe) whose georeferenced coordinates are indicated below, in the official cartographic projection system of Costa Rica CRTM05:

Third.—The demarcation of the estuary-mangrove (estero-manglar) in a sector of the Térraba-Sierpe Wetland (Humedal Térraba-Sierpe) in the sector known as Sábalo, Sierpe, Osa, Puntarenas, is published in accordance with official communication SINAC-ACOSA-D-393-2021 from the Osa Conservation Area (Área de Conservación Osa), Report SINAC-ACOSAPNE-AD-077-2021, from the Osa Conservation Area (Área de Conservación Osa), and the Georeferenced Digital Demarcation Report Térraba Sierpe Estuary Wetland (Humedal), Puntarenas prepared by Engineer Luis Quesada Camacho.

Fourth.—The official technical data of the georeferenced digital demarcation of the public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre) of an estuary-mangrove (estero-manglar) sector of the Térraba Sierpe Wetland (Humedal Térraba Sierpe) located in the sector of Sábalo, situated in district No. 03 Sierpe, of canton No. 05 of Osa, of province No. 06 of Puntarenas, have been registered in the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a file with vector shape format, under the codification RN/ IGN_GDG-IGN-ZMT digital lines.

Fifth.—Effective as of its publication.

Issued in Curridabat, San José, on the 18th day of February of the year 2022.

Con fundamento en lo dispuesto en los artículos 140 y 240 de la ley Nº 6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978; ley Nº 59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944; ley Nº 8905 Reforma del artículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus reformas; y modificación de la ley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de diciembre del 2010; ley N.º 6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento y; artículos 2 y 3 de la ley N.º 5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.

1. 1Que mediante ley Nº 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la ley Nº 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la ley Nº 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la ley N.º 59; el artículo 62 del Decreto Ejecutivo Nº 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la delimitación de la zona pública e la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo Nº 7841-P señala que El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.
4. 4Que en el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre, del 28 de junio del 2011, de conformidad con los artículos 18, 19 y 20 establece que los tipos de delimitación de la Zona Pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución a saber: a) delimitación a través de la colocación de mojones y; b) delimitación digital georreferenciada, que es una metodología que permite la georreferenciación de la pleamar ordinaria, a partir de coordenadas en el sistema de referencia oficial del país, establecido por el Decreto Ejecutivo N.º 33797-MJ-MOPT titulado. Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83, sin que sea necesario la colocación de mojones, con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N.º 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en su artículo 11 que La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose de esta forma a evitar el gasto público y obteniendo por otra parte información geográfica confiable, uniforme y comparable que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.; mientras que el artículo 7 indica que Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado.
6. 6Que el Decreto Ejecutivo N.º 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense.

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.

1. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre.
3. 9Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N.º 7841- P; b) el Decreto Ejecutivo Nº 33797-MJ-MOPT y; c) el Decreto Ejecutivo N.º 36642-MP-MOPT-MINAET, todos previamente citados.

10.-Que la ley Nº 7575 denominada Ley Forestal del 13 de febrero de 1996 en su artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno, los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que la ley Nº 6043 establece en su artículo 1 del CAPÍTULO I, Disposiciones Generales que La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley.

12.-Que según el artículo 11 del CAPÍTULO I, Disposiciones Generales de la ley Nº 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

13.-Que el Decreto Ejecutivo N.º 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N.º 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

14.-Que el Decreto Ejecutivo N.º 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.

15.-Que mediante el oficio SINAC-ACOSA-D-393-2021 de fecha 23 de junio del 2021 suscrito por la Sra. Laura Rivera Quintanilla, Directora a. í. del Área de Conservación Osa del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía, se solicita el visto bueno por parte del Instituto Geográfico Nacional para la publicación de los trabajos de delimitación a cargo del Ing. Luis Quesada Camacho, el levantamiento fue aprobado por el Área de Conservación Osa mediante el Informe de verificación de levantamiento topográfico de manglar en Sábalo de Sierpe SINAC-ACOSA-PNE-AD-077-2021, con base en el Decreto Ejecutivo N.º 36786-MINAET.

16.-Que en el Informe de verificación de levantamiento topográfico de manglar en Sábalo de Sierpe SINAC-ACOSA-PNE-AD-077-2021 se presenta para la revisión de la información técnica sobre el levantamiento de la delimitación de un sector del ecosistema de estero-manglar en el sector conocido como Sábalo de Sierpe, Osa, Puntarenas. El levantamiento topográfico estuvo a cargo del Ing. Luis Quesada Camacho.

17.-Que mediante el Informe Delimitación Digital Georreferenciada Humedal Estuario Térraba Sierpe, Puntarenas elaborado por el Ing. Luis Quesada Camacho de la Empresa SOTOP Sociedad Anónima, a solicitud de Marle Quesada Jiménez, número de cédula 10721-0557, como interesada en el proceso, se presenta al IGN la información técnica del levantamiento topográfico para la delimitación de un sector del Humedal Estero-Manglar Térraba-Sierpe, en Osa, Puntarenas.

18.-Que mediante el oficio DIG-TOT-0546-2021 de fecha 08 de setiembre de 2021, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del IGN, se le comunicó a la Dirección del Instituto Geográfico Nacional que los trabajos realizados por el Ing. Luis Quesada Camacho cuentan con el aval técnico para su publicación.

19.-Que el artículo 140 de la ley Nº 6227 señala que El acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte, disposición que necesariamente debe relacionarse con el artículo 240 del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que Se comunicarán por publicación los actos generales y por notificación los concretos.

COMUNICA:

Primero.-El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre en un sector del Humedal Estero- Manglar Térraba Sierpe de Osa en Sábalo, en el distrito N.º 03 Sierpe, del cantón Nº 05 de Osa, de la provincia N.º 06 de Puntarenas.

Segundo.-La zona pública de la Zona Marítimo Terrestre delimitada en el sector de Sábalo, Sierpe, Osa, Puntarenas, corresponde a un total de 13 mojones virtuales que van del 1 al 13, que definen un sector del Humedal Estero-Manglar Térraba-Sierpe cuyas coordenadas georreferenciados se indican a continuación, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05:

Tercero.-Se publica la delimitación del estero-manglar en un sector del Humedal Térraba-Sierpe en el sector conocido como el Sábalo, Sierpe, Osa, Puntarenas, acorde con el oficio SINAC-ACOSA-D-393-2021 del Área de Conservación Osa, el Informe SINAC-ACOSAPNE-AD-077-2021, del Área de Conservación Osa y el Informe Delimitación Digital Georreferenciada Humedal Estuario Térraba Sierpe, Puntarenas elaborado por el Ing. Luis Quesada Camacho.

Cuarto.-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de un sector estero-manglar del Humedal Térraba Sierpe situado en el sector de Sábalo, ubicado en el distrito N.º 03 Sierpe, del cantón N.º 05 de Osa, de la provincia N.º 06 de Puntarenas han quedado registrado en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en un archivo con formato vectorial shape, bajo la codificación RN/ IGN_GDG-IGN-ZMT líneas digitales.

Quinto.-Rige a partir de su publicación.
