8905, the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which will sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, investigations, or works and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.

59 constitutes the IGN permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order originating from the works entrusted to its charge.

59; Article 62 of Executive Decree No. 7841-P, called the Regulation to the Law on the Maritime Terrestrial Zone, recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree No. 7841-P indicates that the National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.

36642-MP-MOPT-MINAET, "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone," it is established according to Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of milestones (mojones) and/or through digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.

33797-MJ-MOPT, which among other aspects determines, the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically indicating in Article 11 that: "The National Geodetic Network of Horizontal Reference CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person, or private entity, national or foreign, must be referenced."; while Article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, by appropriate means, that information which has been made official."

40962-MJP, Update of the Official Horizontal Reference Geodetic System for Costa Rica, declares in its Article 1 that The official horizontal reference geodetic system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, the changes and their update shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON, while Article 2 establishes that The CRTM05 cartographic projection system shall continue to be the official system for the cartographic representation of the continental national territory, extended for the purposes of application of this cartographic projection, up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line being defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for the calculation of the maximum width of all jurisdictional marine areas of the Costa Rican State.

Furthermore, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by indicating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the "Universal Transversal Mercator" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the national territory by any public agency, person, or private entity, national or foreign, undertaking or contracting geodetic and cartographic works, must be referenced.

7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares as official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

7575 of February 13, 1996, establishes that the Ministry of Environment and Energy will delimit on the ground the boundaries of the areas that form the Natural Heritage of the State (Patrimonio Natural del Estado).

6043, it establishes that the Public zone is also, whatever its extension, the area occupied by all the mangroves of the continental and insular coastlines and estuaries of the national territory.

36786-MINAET, titled Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives To identify within the Maritime Terrestrial Zone those lands that classify as forests, of forestry aptitude (forest aptitude (aptitud forestal), Class VII and VIII soils), wetlands (mangroves, estuaries, rías (rías), marshes, coastal lagoons, swamps, flooded forests, salt flats (salitrales)), to certify them and incorporate them as part of the Natural Heritage of the State (PNE).

36786-MINAET, in point III.-Competencies for delimitation and certification, establishes that The classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations (Colegios Profesionales) to classify forests, lands of forestry aptitude (Class VII and VIII soils), (mangroves, estuaries, rías (rías), marshes, coastal lagoons, swamps, flooded forests, salt flats (salitrales)) and wetlands.

The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC that corresponds by territorial competence. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, inspection, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones. The location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone must be carried out as part of the approval process of the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all the zones to be concessioned within the ZMT and for the classification of the latter at the level of cadastral plans.

6227, General Law of Public Administration, indicates that "the administrative act shall produce its effect after it has been communicated to the administered party, except if it only grants rights, in which case it shall produce them from the moment it is adopted," a provision that must necessarily be related to numeral 240) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by indicating that: "General acts shall be communicated by publication, and specific acts, by notification."

DIG-TOT- 662-2021 of October 22, 2021, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute. Furthermore, for the delimited ecosystem, there was accompaniment from the Tempisque Conservation Area-National System of Conservation Areas of MINAE, for the demarcation of the public zone in the ecosystem sector of the Brasilar and Platanar estuaries/mangroves, in accordance with official communications (oficios) ACT-OR-T-941-2021, dated August 13, 2021, and ACT-OSRSCC-1372-2021 and ACT-OSRSCC-1371-2021, both dated September 20, 2021.

COMMUNICATES:

First.—That, in the month of August 2021, the delimitation was carried out through digital georeferenced delimitation, as well as the establishment of milestones (mojones) georeferenced to the national coordinate system of the public zone of the Brasilar and Platanar Estuaries/Mangroves located in the sector known as Playa Potrero, districts: 08º Cabo Velas and 04º Tempate, canton: 03º Santa Cruz, province: 05º Guanacaste.

Second.—The National Geographic Institute publishes the Brasilar and Platanar Estuaries/Mangroves located in the sector known as Playa Potrero, districts: 08º Cabo Velas and 04º Tempate, canton: 03º Santa Cruz, province: 05º Guanacaste, by means of the methodology used and validated by the Tempisque Conservation Area Regional Directorate (ACT) of SINAC-MINAE, the digital georeferenced delimitation of the public zone of the Public Zone in said sector.

Third.—That from M51 coordinates 305124.4575E - 1154706.787N published in the Official Gazette La Gaceta 89 dated May 11, 1983, to milestone (mojón) FB1. Then, the delimitation of the Brasilar Estuary/Mangrove continues from milestone (mojón) FB1 to FB37 as follows:

Subsequently, from M57 coordinates 305588.614E- 1155133.04 published in the Official Gazette La Gaceta 89 dated May 11, 1983, to milestone (mojón) FB38. Then, the description of the Platanar Estuary/Mangrove continues from milestone (mojón) FB38 to FB105 as follows.

Ending at M517 coordinates 305724.808E - 1155258.833N published in the Official Gazette La Gaceta 76 of April 21, 1999.

Fourth.—Additionally, milestones (mojones) 864 and 865 are published, which describe the coastal public zone between milestones (mojones) M50 and M51 published in the Official Gazette La Gaceta 89 dated May 11, 1983, which remained pending publication in the Official Gazette La Gaceta 131 of July 6, 2004, with the following coordinates:

Fifth.—The sectors located in Playa Potrero, districts: 08º Cabo Velas and 04º Tempate, canton: 03º Santa Cruz, province: 05º Guanacaste, which to date have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of milestones (mojones) and their respective publication in the Official Gazette La Gaceta, maintain their official status.

Sixth.—The official technical data of the delimitation of the two sectors of the public zone of the Maritime Terrestrial Zone of Playa Potrero, districts: 08º Cabo Velas and 04º Tempate, canton: 03º Santa Cruz, province: 05º Guanacaste, have been recorded in the Digital Georeferenced Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.

Seventh.—It takes effect upon its publication.

Given in Curridabat, San José, on the 18th day of the month of February of the year 2022.

36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos..

7841-P "Reglamento a la Ley No. 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo No. 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo No. 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección. La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro.

6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 240) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

Además, para el ecosistema delimitado se contó con el acompañamiento del Área de Conservación Tempisque-Sistema Nacional de Áreas de Conservación del MINAE, para la demarcación de la zona pública en el sector de ecosistema de los esteros/manglares Brasilar y Platanar, de acuerdo con los oficios ACT-OR-T-941-2021, de fecha 13 de agosto de 2021 y ACT-OSRSCC-1372-2021 y el ACT-OSRSCC-1371-2021 ambos de fecha 20 de setiembre de 2021.

COMUNICA:

Primero.-Que, en el mes de agosto de 2021, se realizó la delimitación mediante delimitación digital georreferenciada, así como el establecimiento de mojones georreferenciados al sistema nacional de coordenadas de la zona pública de los Esteros/Manglares Brasilar y Platanar ubicados en el sector conocido como Playa Potrero, distritos: 08º Cabo Velas y 04º Tempate, cantón: 03º Santa Cruz, provincia: 05º Guanacaste.

Segundo.-El Instituto Geográfico Nacional publica los Esteros/Manglares Brasilar y Platanar ubicados en el sector conocido como Playa Potrero, distritos: 08º Cabo Velas y 04º Tempate, cantón: 03º Santa Cruz, provincia: 05º Guanacaste, por medio de la metodología usada y validada por el Área de Conservación Tempisque Dirección Regional (ACT) del SINAC-MINAE, la delimitación digital georreferenciada de la zona pública de la Zona Publica en dicho sector.

Tercero.-Que a partir del M51 coordenadas 305124.4575E - 1154706.787N publicado en el Diario Oficial La Gaceta 89 de fecha 11 de mayo de 1983 hasta el mojón FB1. Luego se continua desde el mojón FB1 al FB37 la delimitación del Estero/Manglar Brasilar de la siguiente manera:

Posteriormente desde el M57 coordenadas 305588.614E- 1155133.04 publicado en el Diario Oficial La Gaceta 89 de fecha 11 de mayo de 1983 hasta el mojón FB38. Luego se continua desde el mojón FB38 al FB105 que describe el Estero/Manglar Platanar de la siguiente manera.

Finalizando en el M517 coordenadas 305724.808E - 1155258.833N publicado en el Diario Oficial La Gaceta 76 del 21 de abril de 1999.

Cuarto.-Además de esto se publican los mojones 864 y 865 que describen la zona pública costera entre los mojones M50 y M51 publicados en el Diario Oficial La Gaceta 89 de fecha 11 de mayo de 1983, los cuales quedaron pendientes de publicar en el Diario Oficial La Gaceta 131 del 06 de julio de 2004 con las siguientes coordenadas:

Quinto. -Los sectores ubicados en Playa Potrero, distritos: 08º Cabo Velas y 04º Tempate, cantón: 03º Santa Cruz, provincia: 05º Guanacaste que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

Sexto. -Los datos técnicos oficiales de la delimitación de los dos sectores de la zona pública de la Zona Marítimo Terrestre de Playa Potrero, distritos: 08º Cabo Velas y 04º Tempate, cantón: 03º Santa Cruz, provincia: 05º Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN.

Sétimo. -Rige a partir de su publicación.
