The National Council of Conservation Areas, in accordance with Agreement No. 16 of Ordinary Session No. 11-2021 of November 9, 2021, and in compliance with Article 12, subsection d) of the Regulation to the Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE, approves and issues the following:
Executive Summary of the General Management Plan for the Bicentennial Republic Pájaro Campana Biological Reserve
FIRST: That in accordance with Article 22 of the Biodiversity Law number 7788 of May 27, 1998, the National System of Conservation Areas is created, with its own legal personality, as a deconcentrated and participatory system of institutional management and coordination, which integrates competencies in forestry, wildlife, and protected areas matters, in order to dictate policies, plan, and execute processes aimed at achieving sustainability in the management of Costa Rica's natural resources.
SECOND: That it is a priority policy of the SINAC to facilitate and promote actions that lead to the protection, conservation, and sustainable management of the natural resources and biodiversity present in the Protected Wild Areas, hereinafter the ASP, of the Conservation Areas.
THIRD: That it is the competence of the National System of Conservation Areas, through each Conservation Area, to administer and protect the Protected Wild Areas throughout the national territory.
FOURTH: That in accordance with Articles 23 and 28 of the Biodiversity Law No. 7788 and Articles 9 and 21 of its regulation, Executive Decree No. 34433-MINAE, published in La Gaceta No. 68 of April 8, 2008, the Amistad Pacífico Conservation Area, hereinafter referred to as ACLA-P, is part of the SINAC organization and is responsible for applying the current legislation on natural resources, within its geographical demarcation.
FIRST: That the Bicentennial Republic Biological Reserve was created by Executive Decree No. 42615 of September 7, 2020, with an effective date of February 17, 2021, with an extension of 5,075 hectares.
SECOND: That the Management Plan for the Protected Wild Areas (ASP) is the guiding instrument for the effective administration and management of the natural and cultural elements present in said areas and the socio-environmental dynamics linked to them. Furthermore, it is the technical tool through which each ASP establishes the management guidelines for use by managers, administrators, and interest groups; therefore, the first instance that must validate the management proposal are the authorities of the Conservation Area, as well as the official social participation bodies established therein, be these the Regional Councils and Local Committees, in accordance with the Biodiversity Law No. 7788.
THIRD: The Management Plans aim to serve as a planning and operational instrument to implement the appropriate measures for the management and conservation of protected wild areas, promoting the participation of society, especially local communities, through different processes.
FOURTH: That the National Council of Conservation Areas (CONAC) approved the "Procedures Manual for the Publication of Management Plans of the Protected Wild Areas of the National System of Conservation Areas", by Agreement No. 17, taken in Extraordinary Session No. 06-2008 of August 4, 2008.
FIFTH: That CONAC, in Agreement No. 8 of Extraordinary Session No. 02-2011 of May 2, 2011, agreed to modify Agreement No. 17 of Extraordinary Session No. 06-2008 of August 4, 2008, so that the zoning (zonificación) defined in the General Management Plan is published integrally.
SIXTH: That in February 2018, the La Amistad Pacifico Conservation Area, jointly with the Costa Rica Por Siempre Association (CRXS), prepared the terms of reference for the creation of the management plan for the RBPC.
SEVENTH: That in December 2019, the Costa Rica Por Siempre Association (CRXS) contracted the Fundación de Parques Nacionales as a facilitator for the process of creating the PGM for the Bicentennial Republic Biological Reserve - Pájaro Campana.
EIGHTH: That in January 2020, through official communication SINAC-ACLA-P-D-002-2020, the Directorate of the Amistad Pacífico Conservation Area formed the Coordinating Technical Commission that will serve as a liaison and follow up on the formulation of the PGM of the RBPC.
NINTH: That the Technical Committee of the Amistad Pacífico Conservation Area approves the Management Plan of the RBPC, according to Agreement No. 02 of the meeting minutes of June 9, 2021.
TENTH: That through official communication SINAC-ACLA-P-GASP-053-2021, Agreement No. 02 of the Technical Scientific Committee held on June 9, 2021, where the General Management Plan of the RBBRPC is approved, was notified.
ELEVENTH: That the General Management Plan of the RBBRPC was approved by the Regional Council of the Amistad Pacífico Conservation Area (CORACLAP), through Agreement No. 08 of Ordinary Session No. 03-2021 held on June 9, two thousand twenty-one.
TWELFTH: That CONAC approved the Management Plan of the RBPC, through Agreement No. 16 of Ordinary Session No. 11-2021 held on November 9, 2021.
THE EXECUTIVE SECRETARY OF THE NATIONAL COUNCIL OF CONSERVATION AREAS
FIRST: To publish the following Executive Summary of the General Management Plan for the Bicentennial Republic Pájaro Campana Biological Reserve, for the purposes of its formalization:
To manage the conservation and sustainable use of the prioritized focal management elements in the Bicentennial Republic-Pájaro Campana Biological Reserve, integrating the participation of different social actors and inter-institutional coordination.
2. Manage financial, technical, and human resources that facilitate sustainability in the management of the biological reserve.
3. Coordinate and implement activities that enable the management of the natural resources of the biological reserve.
The zoning of the Biological Reserve was carried out through three consecutive activities (FPN, 2020i), (FPN, 2020j), (FPN, 2021a). In the first instance, priority sites for the conservation of natural resources in the RBPC were identified.
In identifying priority sites for natural resource conservation, the following biophysical characteristics or territory attributes were considered: area for water resource protection, land use, terrain slope, and natural state heritage.
The following chart details the zoning of the RBPC.

Minimum Intervention Zone Two land uses are permitted in the Minimum Intervention Zone: conservation and access roads. It should be noted that the latter correspond to three existing trails in the protected wild area.
Low Intervention Zone In the case of the Low Intervention Zone, two land uses are also permitted: conservation and access roads. The former is located practically throughout the entire area of the biological reserve, while the latter is very localized towards the southeast.
High Intervention Zone In the High Intervention Zone, activities directed at conservation are permitted. Such use is distributed in small areas towards the west and south of the biological reserve.
SECOND: The General Management Plan for the Bicentennial Republic Pájaro Campana Biological Reserve will have a validity of 10 years (2021-2030); however, it is recommended that a mid-term evaluation be carried out at 5 years to propose readjustments to the plan.
THIRD: To publish the complete document of the General Management Plan for the Pájaro Campana Biological Reserve on the institutional website of SINAC, http://www.sinac.go.cr.
FOURTH: It becomes effective upon its publication in the Official Gazette La Gaceta.

El Consejo Nacional de Áreas de Conservación, de conformidad al Acuerdo N°16 de la Sesión Ordinaria N°11-2021 del 09 de noviembre del 2021, y en cumplimiento del artículo 12 inciso d) del Reglamento a la Ley de Biodiversidad N°7788, Decreto Ejecutivo N°34433-MINAE, aprueba y emite el presente:
Resumen Ejecutivo del Plan General de Manejo de la Reserva Biológica del Bicentenario de la República Pájaro Campana
PRIMERO: Que de conformidad con el artículo 22 de la Ley de Biodiversidad número 7788 del 27 de mayo de 1998, se crea el Sistema Nacional de Áreas de Conservación, con personería jurídica propia, como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integra las competencias en materia forestal, vida silvestre y áreas protegidas, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
SEGUNDO: Que es política prioritaria de EL SINAC facilitar y promover acciones que conlleven a la protección, conservación y manejo sostenible de los recursos naturales y la biodiversidad presentes en las Áreas Silvestres Protegidas, en adelante las ASP, de las Áreas de Conservación.
TERCERO: Que es competencia del Sistema Nacional de Áreas de Conservación a través de cada Área de Conservación, la administración y protección de las Áreas Silvestres Protegidas a lo largo de todo el territorio nacional.
CUARTO: Que de conformidad con los artículos 23 y 28 de la Ley de Biodiversidad N° 7788 y los artículos 9 y 21 de su reglamento, Decreto Ejecutivo N°34433-MINAE, publicado en la Gaceta N°68 del 8 de abril de 2008, el Área de Conservación Amistad Pacífico, en adelante denominada ACLA-P, es parte de la organización del SINAC y se encarga de aplicar la legislación vigente en materia de recursos naturales, dentro de su demarcación geográfica.
PRIMERO: Que la Reserva Biológica del Bicentenario de la República fue creada mediante Decreto Ejecutivo N° 42615 del 07 de setiembre del 2020 y con fecha de vigencia desde el 17 de febrero del 2021, con una extensión de 5 075 hectáreas.
SEGUNDO: Que el Plan de Manejo de las Áreas Silvestres Protegidas (ASP) es el instrumento orientador para una efectiva administración y manejo de los elementos naturales y culturales presentes en dichas áreas y de la dinámica socio ambiental ligada a estos. Además, es la herramienta técnica por medio de la cual cada ASP establece las directrices de manejo para el uso de los gestores, administradores y grupos de interés, por lo tanto, la primera instancia que debe realizar la validación de la propuesta de manejo son las autoridades del Área de Conservación, así como las instancias oficiales de participación social establecidas en ellas, sean estas los Consejos Regionales y Comités Locales, de conformidad con la Ley de Biodiversidad N°7788.
TERCERO: Los Planes de Manejo tienen como objetivo el servir como un instrumento de planificación y operación para implementar las medidas apropiadas de manejo y conservación de las áreas silvestres protegidas, promoviendo la participación de la sociedad en especial de las comunidades locales a través de diferentes procesos.
CUARTO: Que el Consejo Nacional de Áreas de Conservación (CONAC), aprobó el "Manual de Procedimientos para la Publicación de las Planes de Manejo de las Áreas Silvestres Protegidas del Sistema Nacional de Áreas de Conservación", mediante Acuerdo N° 17, tornado en Sesión Extraordinaria N° 06-2008 del 04 de agosto del 2008.
QUINTO: Que el CONAC en Acuerdo N° 8 de la Sesión Extraordinaria N° 02-2011 del 02 de mayo del 2011 acordó modificar el Acuerdo N° 17 de la Sesión Extraordinaria N° 06-2008 del 04 de agosto del 2008, para que la zonificación definida en el Plan General de Manejo se publique integralmente.
SEXTO: Que en febrero del 2018 el Área de Conservación La Amistad Pacifico en conjunto con la Asociación Costa Rica por Siempre (CRXS) elaboraron los términos de referencia para la creación del plan de manejo de la RBPC.
SEPTIMO: Que, en diciembre del 2019, la Asociación Costa Rica por Siempre (CRXS), contrató a la Fundación de Parques Nacionales, como facilitador para el proceso de la creación del PGM de la Reserva Biológica del Bicentenario de la República - Pájaro Campana.
OCTAVO: Que, en enero del año 2020, a través del oficio SINAC-ACLA-P-D-002-2020, la Dirección del Área de Conservación Amistad Pacífico, conformo la Comisión Técnica Coordinadora que servirá como enlace y dará seguimiento a la formulación del PGM de la RBPC.
NOVENO: Que el Comité Técnico del Área de Conservación Amistad Pacífico aprueba el Plan de Manejo de la RBPC, según Acuerdo Nº02 de la minuta de reunión del 9 de junio del 2021.
DECIMO: Que mediante oficio SINAC-ACLA-P-GASP-053-2021 se notifica el acuerdo N°02 de del Comité Científico Técnico realizado el 09 de junio del 2021 en donde se aprueba el Plan General de Manejo de la RBBRPC.
DECIMO PRIMERO: Que el Plan General de Manejo de la RBBRPC fue aprobado por el Consejo Regional del Área de Conservación Amistad Pacífico (CORACLAP), mediante Acuerdo N°08 de la Sesión Ordinaria Nº03-2021 efectuada el nueve de junio de dos mil veintiuno.
DECIMO SEGUNDO: Que el CONAC aprobó el Plan de Manejo de la RBPC, mediante Acuerdo Nº16 de la Sesión Ordinaria Nº11-2021 celebrada el 09 de noviembre de 2021.
EL SECRETARIO EJECUTIVO DEL CONSEJO NACIONAL DE AREAS DE CONSERVACION
PRIMERO: Publicar el siguiente Resumen Ejecutivo del Plan General de Manejo de la Reserva Biológica del Bicentenario de la República Pájaro Campana, a efectos de su oficialización:
Gestionar la conservación y el uso sostenible de los elementos focales de manejo priorizados en la Reserva Biológica del Bicentenario de la República-Pájaro Campana, integrando la participación de los diferentes actores sociales y la articulación interinstitucional.
2. Gestionar recursos financieros, técnicos y humanos que faciliten la sostenibilidad en la gestión de la reserva biológica.
3. Coordinar e implementar actividades que permitan la gestión de los recursos naturales de la reserva biológica.
La zonificación de la Reserva Biológica se llevó a cabo mediante la realización de tres actividades consecutivas (FPN, 2020i), (FPN, 2020j), (FPN, 2021a). En primera instancia, se identificaron sitios prioritarios para conservación de recursos naturales en la RBPC.
En la identificación de sitios prioritarios para conservación de recursos naturales se consideraron las siguientes características biofísicas o atributos del territorio: área para protección de recurso hídrico, uso de la tierra, pendiente del terreno y patrimonio natural del estado.
En el siguiente cuadro se detalla la zonificación de la RBPC.

Zona de Mínima Intervención Dos usos de la tierra están permitidos en la Zona de Mínima Intervención: conservación y caminos de acceso. Cabe destacar que estos últimos corresponden a tres senderos existentes en el área silvestre protegida.
Zona de Baja Intervención En el caso de la Zona de Baja Intervención, también son dos los usos de la tierra permitidos: conservación y caminos de acceso. El primero se ubica prácticamente en toda el área de la reserva biológica, mientras que el segundo está muy localizado hacia el sureste.
Zona de Alta Intervención En la Zona de Alta Intervención se permiten actividades dirigidas a la conservación. Tal uso se distribuye en pequeñas áreas hacia el oeste y sur de la reserva biológica.
SEGUNDO: El Plan General de Manejo la Reserva Biológica del Bicentenario de la República Pájaro Campana tendrá una vigencia de 10 años (2021-2030), sin embargo, se recomienda que se realice una evaluación de medio término a los 5 años para proponer reajustes al plan.
TERCERO: Publicar en la página Web institucional del SINAC, http://www.sinac.go.cr, el documento completo del Plan General de Manejo de la Reserva Biológica Pájaro Campana.
CUARTO: Rige a partir de su publicación en el Diario Oficial La Gaceta.
