in the entirety of the text - Full Text of Norm 43106 Declaration of National Convenience for the public works project called "Replacement of the bridge over the Zapote River in Brasilito, National Route No. 180, Santa Cruz, Guanacaste" No. 43106-MINAE-MOPT THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT Exercising the powers conferred by subsections 3) and 18) of numeral 140 and article 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Public Administration Law No. 6227 of May 2, 1978; the Law Creating the Ministry of Public Works and Transport, No. 3155 of August 5, 1963, amended by Law No. 4786 of July 5, 1971; articles 3 subsection m), 19 subsection b), 33 and 34 of the Forest Law (Ley Forestal) No. 7575 of February 13, 1996; and article 2 subsection m) of the Regulation to the Forest Law, Executive Decree (Decreto Ejecutivo) No. 25721-MINAE of October 17, 1996.
I—That the National Road Council (Consejo Nacional de Vialidad, CONAVI) and the Ministry of Public Works and Transport (MOPT), in collaboration with the Rural Development Institute, and with private contribution from Reserva Conchal, intend to develop the project called "Replacement of the bridge over the Zapote River in Brasilito, National Route No. 180, Santa Cruz, Guanacaste." II.—That currently the bridge over the Zapote River on National Route No. 180 presents inadequate conditions, such as the fact that the vertical alignment of the road is abrupt, due to the bridge being at a higher level than the adjacent road, without an adequate transition; in addition to the bridge having a single lane and lacking sidewalks.
III.—That to date, the project is in the bidding stage (Abbreviated Tender No. 2020LA-000010-0006000001), through which CONAVI is managing the construction of a bridge to replace the current single-lane modular launchable metal bridge, with a new two-lane structure with sidewalks.
IV.—That the construction of the new bridge will benefit the residents of Brasilito and Potrero, in addition to the positive impact it will bring to local tourism, since several hotel complexes are located in the area, which bring development to the region. According to estimates, an average of 6,786 vehicles per day travel over the bridge.
V.—That the Project called "Replacement of the bridge over the Zapote River in Brasilito, National Route No. 180, Santa Cruz, Guanacaste," under article 17 of the Organic Environmental Law No. 7554, has the respective environmental feasibility (viabilidad ambiental) granted by the National Environmental Technical Secretariat (SETENA), according to resolution No. 3212-2019-SETENA of thirteen hours ten minutes on October seventeen, two thousand nineteen (administrative file No. D1-05972019-SETENA).
VI.—That in accordance with official letter number ACTOSRSCC-501-2021 of April 14, 2021, signed by the Head of the Santa Cruz-Carrillo Subregional Office, of the Tempisque Conservation Area of the National System of Conservation Areas (SINAC), it was certified that "...the Project Area where CONAVI will carry out the bridge replacement work on National Route number 180, this over the Zapote River, in the locality of Brasilito of Santa Cruz-Guanacaste, at the CRTM05 coordinates north number, 1151319 - East 303249, is located outside the Natural Heritage of the State (Patrimonio Natural del Estado)." VII.—That articles 19 subsection b) and 34 of the Forest Law No. 7575 prohibit the land-use change (cambio de uso del suelo) and the cutting of trees on private lands covered by forest, as well as the cutting of trees in the protection areas defined in numeral 33 of the same regulatory body, excepting those state or private projects that the Executive Branch declares of National Convenience, these being those projects whose social benefits are greater than the socio-environmental costs.
VIII.—That by reason of the previous Considering, the developer prepared the economic-social evaluation of the cited project, which was submitted by the Ministry of Environment and Energy for assessment, in order to weigh that the social benefits are superior to the socio-environmental costs, under subsection m) of article 03 of the Forest Law No. 7575, the foregoing so that the respective recommendations would be issued, which, as relevant, stated that the procedure used by the developer was adequate for the demonstration of social well-being, and ultimately concluded:
"Conclusions: The study presented shows that there is a positive social benefit. It allows for the strengthening of the road network, through the movement of people, goods, and services in this zone of the country. For this reason, the project can be considered of national convenience.
(.)
For this reason, considering the foregoing and due to the fact that the project's results (TIRE AND VANE) were positive, it is considered that the declaration of national convenience can be granted to the project." IX.—That in accordance with the Regulation to the Law for the Protection of Citizens from the Excess of Administrative Requirements and Procedures, Executive Decree No. 37045-MPMEIC of February 22, 2012, and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or processes that the citizen must comply with, a situation for which the prior control procedure was not carried out. Therefore; They decree:

Iº-Que el Consejo Nacional de Vialidad (CONAVI) y el Ministerio de Obras Públicas y Transportes (MOPT), en colaboración con el Instituto de Desarrollo Rural, y el aporte privado por parte de Reserva Conchal, pretenden desarrollar el proyecto denominado "Sustitución del puente sobre el río Zapote en Brasilito, Ruta Nacional N° 180, Santa Cruz, Guanacaste".
II.-Que en la actualidad el puente sobre el Río Zapote en la Ruta Nacional N° 180, presenta condiciones inadecuadas, tal como que el alineamiento vertical de la carretera es abrupto, en razón de que el puente se encuentra a mayor nivel que la carretera adyacente, sin que haya una transición adecuada; además de que el puente cuenta con un solo carril y no posee aceras.
III.-Que a la fecha, el proyecto se encuentra en etapa de licitación (Licitación Abreviada N° 2020LA-000010- 0006000001), mediante la que el CONAVI está gestionando la construcción de un puente que sustituya el actual puente metálico modular lanzable de un carril, por una nueva estructura de dos carriles con aceras.
IV.-Que la construcción del nuevo puente beneficiará a los pobladores de Brasilito y Potrero, además del impacto positivo que traerá al turismo local, pues en la zona se ubican varios complejos hoteleros, que traen consigo desarrollo a la región. Según estimaciones, sobre el puente transitan un promedio de 6786 vehículos por día.
V.-Que el Proyecto denominado "Sustitución del puente sobre el río Zapote en Brasilito, Ruta Nacional N° 180, Santa Cruz, Guanacaste", al amparo del artículo 17 de la Ley Orgánica del Ambiente Nº 7554, cuenta con la respectiva viabilidad ambiental emitida por la Secretaría Técnica Nacional Ambiental (SETENA), según resolución Nº 3212-2019-SETENA de las trece horas diez minutos del diecisiete de octubre de dos mil diecinueve (expediente administrativo Nº D1-05972019-SETENA).
VI.-Que de conformidad con el oficio número ACTOSRSCC- 501-2021 del 14 de abril de 2021, suscrito por el Jefe de la Oficina Subregional de Santa Cruz-Carrillo, del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación (SINAC), se certificó que ".el Área del Proyecto en donde el CONAVI realizará la obra de sustitución del puente en la Ruta Nacional número 180, esto sobre el río Zapote, en la localidad de Brasilito de Santa Cruz-Guanacaste, en las coordenadas CRTM05 número norte, 1151319 - Este 303249, se ubica fuera del Patrimonio Natural del Estado".
VII.-Que los artículos 19 inciso b) y 34 de la Ley Forestal Nº 7575 prohíben el cambio de uso de suelo y la corta de árboles en terrenos privados cubiertos de bosque, así como la corta de árboles en las áreas de protección definidas en el numeral 33 del mismo cuerpo normativo, exceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo declare de Conveniencia Nacional, constituyéndose en estos, aquellos proyectos cuyos beneficios sociales son mayores a los costos socio ambientales.
VIII.-Que en razón del Considerando anterior, el desarrollador elaboró la evaluación económica-social del citado proyecto, misma que fue sometida por parte del Ministerio de Ambiente y Energía a valoración, en aras de ponderar que los beneficios sociales sean superiores a los costos socioambientales, al amparo del inciso m) del artículo 03 de la Ley Forestal Nº 7575, lo anterior a efecto de que se emitieran las recomendaciones respectivas, mismas que en lo conducente, refirieron que el procedimiento utilizado por el desarrollador fue adecuado para la demostración del bienestar social, y a la postre se concluyó:
"Conclusiones: El estudio presentado muestra que existe un beneficio social positivo. Permite fortalecer la red vial, mediante la movilización de personas, bienes y servicios en esta zona del país. Por tal motivo, el proyecto puede considerarse de conveniencia nacional.
(.)
Por tal motivo, considerando lo anterior y debido a que los resultados del proyecto (TIRE Y VANE) fueron positivos, se considera que al proyecto puede otorgársele la declaratoria de conveniencia nacional".
IX.-Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MPMEIC del 22 de febrero de 2012 y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto;
