in the entirety of the text - Full Text of Regulation 43398 Declaration of public interest and preparation of the national energy balance No. 43398-MINAE (This executive decree was repealed by article 2 of executive decree No. 45747 of February 25, 2026) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by articles 50, 140 subsections 3), 18) and 20), and 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) heading b) of the General Law of Public Administration No. 6227 of May 2, 1978; article 2 subsections b) and c) of the Organic Law of the Environment No. 7554 of October 4, 1995; article 4 and chapter IV of the Law of the National Statistics System No. 9694 of June 4, 2019; chapters I, II, IV and VI of the National Planning Law No. 5525 of May 2, 1974.
I.—That the Law of the National Statistics System No. 9694 creates and regulates a National Statistics System (SEN) and the institutions that compose it, with the purpose of establishing basic norms of coordination and obtaining of information that allows for statistical development in a truthful and timely manner, applicable to the institutions that make up said system, as well as to its informants.
II.—That article 3 on definitions of the Law of the National Statistics System No. 9694 establishes that the National Statistical Plan (PEN) will comprise the statistical operations, products, and statistical projects that the member bodies of the National Statistics System must execute, to fulfill the objectives of the law.
III.—That article 4 of the Law of the National Statistics System No. 9694 declares statistical activity to be of public interest, allowing for the production and dissemination of reliable and timely statistics for the truthful and comprehensive knowledge of the Costa Rican reality, as a foundation for efficient public and private administrative management. This same article 4 indicates that the SEN is composed of: a) the National Institute of Statistics and Censuses (INEC); b) the institutions of the Public Administration, whose statistical activity is relevant in the various fields of Costa Rican life or that possess administrative records of interest for the production of official statistics; c) private law persons that request their incorporation and are accepted by the INEC Board of Directors (CDINEC), in accordance with what the regulation of that law establishes, that are responsible for producing and disseminating official statistics or possess records of information that serve as input for their preparation.
IV.—That the National Statistical Plan (PEN) 2018-2022 contemplates that the National Energy Balance is an official statistical operation for the period 2018-2022.
V.—That article 9 of the Regulation on Organization of the Energy Subsector, Executive Decree No. 35991-MINAE of January 19, 2010, establishes the functions of the Secretariat of Planning of the Energy Subsector (SEPSE), among which the following are indicated: "a) Prepare the National Energy Plan, based on the guidelines issued by the Rector Minister and the National Development Plan, and monitor and inform the Subsector Energy Council and the Rector Minister of its compliance... h) Prepare studies, diagnostics, and others concerning the activity of the Energy Subsector. i) Develop energy planning instruments. . n) Provide documentation and statistical information to the institutions that make up the Energy subsector." In light of the above, it is evident that the Energy Balance is a statistical operation that allows for preparing diagnostics of the subsector's situation, feeding energy planning models, and also supporting studies conducted by the institutions that make up the subsector.
VI.—That article 61 of the Law of the National Statistics System No. 9694 indicates, in what is relevant: "Article 61- Without prejudice to the civil, criminal, labor, or other liability that violators may incur, the INEC and other public entities must impose the corresponding sanctions, with strict adherence to the law and the due process provided for by national legislation." Additionally, the Office of the Attorney General of the Republic in Legal Opinion No. C-290-2020 of July 17, 2020, concluded that: ".c) Starting from the above, the current Law No. 9694 authorizes the INEC and the institutions of the National Statistics System to have free access to public and private information for strictly statistical purposes, except for sensitive nature data which are provided voluntarily. This, however, does not diminish the confidential nature of private information. (.) e) The sanctioning regime is provided for in the law in the event of non-submission, delay, falsehood, or incomplete or inaccurate submission of the information required for statistical purposes." VII.—That the National Energy Balance has been prepared uninterruptedly for almost 40 years with information provided by public and private companies and institutions, as an indispensable input in national and sector planning, to support the tasks and studies of other public and private users, as well as the statistical bases of international organizations.
VIII.—That the National Energy Balance is a basic input used for the preparation of official environmental statistics, among which are: the National Inventory of Greenhouse Gases and the environmental energy accounts, which allow for coherently and integratedly accounting for the physical and economic value of natural resources and their relevance to national wealth.
IX.—That the National Energy Balance is a basic input for supplying statistical information to international organizations with which the country has commitments, especially the Organisation for Economic Co-operation and Development, OECD; Latin American Energy Organization, OLADE; United Nations Organization, UN; International Renewable Energy Agency, IRENA.
X.—That the National Energy Balance is a basic input for supplying information to studies and statistics of national interest such as the State of the Nation Report, decarbonization policy and energy policy modeling.
XI.—That the country has committed itself, in the context of the OECD accession process, as well as with other international organizations such as the World Bank, to improving various aspects regarding its energy and environmental statistics.
XII.—That the National Energy Balance is a basic input for the generation of energy indicators and energy statistics used to support national policy, as well as sectoral policy in the country's energy and environmental area.
XIII.—That in accordance with the Regulation to the Law on Citizen Protection from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MPMEIC of February 22, 2012, and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or procedures that the administered party must comply with, a situation for which the prior control procedure was not undertaken. The statistical activity that allows gathering information to produce the National Energy Balance (BEN) is declared of public interest, as it is a statistical operation of public interest that allows for disseminating reliable and timely statistics for the truthful and comprehensive knowledge regarding the annual behavior of the chain of production, transformation, and consumption of energy in the country.
The preparation of the BEN shall be carried out annually and will be the responsibility of the Secretariat of Planning of the Energy Subsector (SEPSE), which may rely for this task on international or national standards applicable to this task, related to at least the topics of energy and statistics. For the above, the available information generated through own statistical instruments or information published or supplied by other public and private entities will be used. The SEPSE will publish the BEN on its internet page (https://sepse.go.cr/), annually in the month of November starting from the year 2022. The period accounted for in the BEN will correspond to the year immediately preceding its publication.
The public bodies, institutions, and companies, public service providers, private law persons, and informants of the National Statistical System (SEN) must make available and share with the SEPSE the information required for the preparation of the BEN. For these purposes, cooperation agreements or arrangements may be entered into with the Ministry of Environment and Energy (MINAE) for the generation and supply of information within the current legal framework with these actors; as well as with other institutional actors, civil society, research centers and academia, the private sector, non-governmental organizations, international cooperation entities, municipalities, and local communities, which will contain the clauses and provisions necessary to allow the supply of data required for the BEN and to safeguard the legitimate interests and rights of the counterparties.
For the purpose of organizing the supply of the information required for the preparation of the BEN, the provisions established in the Law of the National Statistics System No. 9694 and its regulation shall apply.
It shall enter into force upon its publication.

en la totalidad del texto - Texto Completo Norma 43398 Declaratoria de interés público y elaboración del balance energético nacional Nº 43398-MINAE (Este decreto ejecutivo fue derogado por el artículo 2 del decreto ejecutivo N° 45747 del 25 de febrero de 2026) EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE AMBIENTE Y ENERGÍA En uso de las facultades conferidas en los artículos 50, 140 incisos 3), 18) y 20), y 146 de la Constitución Política; los artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública N° 6227 del 2 de mayo de 1978; el artículo 2 incisos b) y c) de la Ley Orgánica del Ambiente N° 7554 del 4 de octubre de 1995; el artículo 4 y capítulo IV de la Ley del Sistema de Estadística Nacional Nº 9694 del 4 de junio de 2019; los capítulos I, II, IV y VI de la Ley de Planificación Nacional Nº 5525 del 2 de mayo de 1974.
I.-Que la Ley del Sistema de Estadística Nacional Nº 9694, crea y regula un Sistema de Estadística Nacional (SEN) y las instituciones que lo componen, con el objeto de fijar normas básicas de coordinación y obtención de información que permita el desarrollo estadístico de una manera veraz y oportuna, de aplicación para las instituciones que conforman dicho sistema, así como a los informantes del mismo.
II.-Que el artículo 3 sobre definiciones de la Ley del Sistema de Estadística Nacional Nº 9694, establece que el Plan Estadístico Nacional (PEN) comprenderá las operaciones estadísticas, los productos y los proyectos estadísticos que deben ejecutar los organismos integrantes del Sistema de Estadística Nacional, para dar cumplimiento a los objetivos de la ley.
III.-Que el artículo 4 de la Ley del Sistema de Estadística Nacional Nº 9694, declara de interés público la actividad estadística que permita producir y difundir estadísticas fidedignas y oportunas para el conocimiento veraz e integral de la realidad costarricense, como fundamento para la eficiente gestión administrativa pública y privada. Este mismo artículo 4, indica que el SEN esta conformado por: a) el Instituto Nacional de Estadísticas y Censos (INEC); b) las instituciones de la Administración Pública, cuya actividad estadística sea relevante en los diversos campos de la vida costarricense o que posean registros administrativos de interés para la producción de las estadísticas oficiales; c) las personas de derecho privado que soliciten su incorporación y sean aceptadas por el Consejo Directivo del INEC (CDINEC), en concordancia con lo que establezca el reglamento de esa ley, que sean responsables de producir y divulgar estadísticas oficiales o posean registros de información que sirvan de insumo para la elaboración de estas.
IV.-Que el Plan Estadístico Nacional (PEN) 2018- 2022 contempla que el Balance Energético Nacional es una operación estadística oficial para el periodo 2018-2022.
V.-Que el artículo 9 del Reglamento de Organización del Subsector Energía, Decreto Ejecutivo Nº 35991-MINAE del 19 de enero de 2010, establece las funciones de la Secretaria de Planificación del Subsector Energía (SEPSE), entre las cuales se indican las siguientes: "a) Elaborar el Plan Nacional de Energía, con base en los lineamientos que emane el Ministro Rector y el Plan Nacional de Desarrollo, y dar seguimiento e informar al Consejo Subsectorial de Energía y al Ministro Rector de su cumplimiento... h) Elaborar estudios, diagnósticos y otros concernientes a la actividad del Subsector Energía. i) Desarrollar instrumentos de planeamiento energético. . n) Proporcionar documentación e información estadística a las instituciones integrantes del subsector Energía.". En atención a lo anterior, queda de manifiesto que el Balance de Energía es una operación estadística que permite elaborar diagnósticos de la situación del subsector, alimentar modelos de planeamiento energético y también, dar apoyo a estudios que realizan las instituciones integrantes del subsector.
VI.-Que el artículo 61 de la Ley del Sistema de Estadística Nacional Nº 9694, indica, en lo que interesa: "Artículo 61- Sin perjuicio de la responsabilidad civil, penal, laboral o de otro orden en que puedan incurrir los infractores, el INEC y las demás entidades públicas deberán imponer las sanciones que les correspondan, con estricto ajuste al derecho y el debido proceso previsto por la legislación nacional." Adicionalmente, la Procuraduría General de la Republica en Dictamen Nº C-290- 2020 del 17 de julio de 2020 concluyó que : ".c) Partiendo de lo anterior, la Ley vigente N°9694 autoriza al INEC y a las instituciones del Sistema de Estadística Nacional, a tener libre acceso a información de carácter público y privado para fines estrictamente estadísticos, salvo los datos de naturaleza sensible que son de entrega voluntaria. Esto, sin embargo, no desmerita el carácter confidencial de la información de carácter privado. (.) e) El régimen sancionatorio está previsto en la ley ante la no remisión, retraso, falsedad o remisión incompleta o inexacta de la información requerida con fines estadísticos.".
VII.-Que el Balance Energético Nacional se elabora ininterrumpidamente desde hace casi 40 años con información proporcionada por empresas e instituciones publicas y actores privados, como un insumo indispensable en la planificación nacional y de sector, para apoyar las tareas y estudios de otros usuarios públicos y privados, así como las bases estadísticas de organismos internacionales.
VIII.-Que el Balance Energético Nacional es un insumo básico utilizado para la elaboración de estadísticas ambientales oficiales, entre las que se cuentan: el Inventario Nacional de Gases de Efecto Invernadero y las cuentas ambientales de energía, las cuales permiten contabilizar de manera coherente e integrada el valor físico y económico de los recursos naturales y su relevancia para la riqueza nacional.
IX.-Que el Balance Energético Nacional es un insumo básico para suministro de información estadística a organismos internacionales con los que el país mantiene compromisos, especialmente la Organización para la Cooperación y Desarrollo Económicos, OCDE; Oganización Latinoamericana de Energía, OLADE; Organización de las Nacional Unidas, ONU; Agencia Internacional de las Energías Renovables, IRENA.
X.-Que el Balance Energético Nacional es un insumo básico para suministro de información a estudios y estadísticas de interés nacional como el Informe del Estado de la Nación, modelaciones de política de descarbonización y de política energética.
XI.-Que el país se ha comprometido en el contexto del proceso de adhesión a OCDE, así como con otros organismos internacionales tales como el Banco Mundial, a mejorar diversos aspectos en cuanto a sus estadísticas energéticas y ambientales.
XII.-Que el Balance Energético Nacional es insumo básico para la generación de indicadores energéticos y estadísticas energéticas utilizadas para fundamentar la política nacional, así como la sectorial en el área energética y ambiental del país.
XIII.-Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MPMEIC del 22 de febrero de 2012 y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto,
DECLARATORIA DE INTERÉS PÚBLICO Y ELABORACIÓN DEL BALANCE ENERGÉTICO NACIONAL
Considerando:

Se declara de interés público la actividad estadística que permite recabar información para producir el Balance Energético Nacional (BEN), por ser una operación estadística de interés público que permite difundir estadísticas fidedignas y oportunas para el conocimiento veraz e integral sobre el comportamiento anual de la cadena de producción, transformación y consumo de la energía en el país.
La elaboración del BEN se realizará anualmente y estará a cargo de la Secretaría de Planificación del Subsector Energía (SEPSE), la cual podrá basarse para esta labor en estándares internacionales o nacionales aplicables a esta tarea, relacionadas con al menos los temas de energía y estadística. Para lo anterior, se utilizará la información disponible, generada mediante instrumentos estadísticos propios o información que publiquen o suministren otras entidades públicas y privadas. La SEPSE publicará el BEN en su página de internet (https://sepse. go.cr/), anualmente en el mes de noviembre a partir del año 2022. El periodo contabilizado en el BEN corresponderá al año inmediato anterior de su publicación.
Los órganos, instituciones y empresas públicas, los prestadores de servicios públicos, personas de derecho privado e informantes del Sistema Estadístico Nacional (SEN), deberán poner a disposición y compartir con la SEPSE la información requerida para la elaboración del BEN. Para estos efectos se podrán celebrar con el Ministerio de Ambiente y Energía (MINAE), convenios o acuerdos de cooperación para la generación y suministro de información dentro del marco legal vigente con estos actores; así como, con otros actores institucionales, sociedad civil, centros de investigación y academia, sector privado, organizaciones no gubernamentales, entidades de cooperación internacional, municipalidades y comunidades locales, los cuales contendrán las cláusulas y disposiciones necesarias para permitir el suministro de datos requeridos para el BEN y para resguardar los intereses legítimos y los derechos de las contrapartes.
Para efectos de ordenar el suministro de la información requerida para la elaboración del BEN serán aplicables las disposiciones establecidas en la Ley del Sistema de Estadística Nacional Nº 9694 y su reglamento.
