in the entirety of the text - Complete Text of Norm 43243 Declares of National Convenience the project called "Construction of the bridge over the Tures River on National Route No. 116 in Santo Domingo No. 43243-MINAE-MOPT THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT In exercise of the powers conferred upon them by Articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution; Articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration No. 6227 of May 2, 1978; the Law Creating the Ministry of Public Works and Transport, No. 3155 of August 5, 1963, amended by Law No. 4786 of July 5, 1971; Articles 3 subsection m), 19 subsection b), 33 and 34 of the Forest Law (Ley Forestal) No. 7575 of February 13, 1996; and Article 2 subsection m) of the Regulation to the Forest Law, Executive Decree No. 25721-MINAE of October 17, 1996.

I.-That the National Road Council (CONAVI) and the Ministry of Public Works and Transport (MOPT), intend to develop the project called "Construction of the bridge over the Tures River on National Route No. 116 in Santo Domingo".

II.-That currently the bridge over the Tures River on the section of National Route No. 116 between Santo Tomás and Los Ángeles, has only one lane, so the current structure will be replaced by a two-lane bridge that will have a total width of 9.70 m and a single span of 12 m in length. The accesses will also be intervened over an approximate length of 128 m, so that the total length along National Route No. 116 is 140 m and includes the intersection with Calle Quebradas, at the east access of the bridge.

III.-That to date, the bidding stage has been concluded, as there is a notified contract for Abbreviated Bid No. 2019LA-000032-0006000001, whose contractor is CODOCSA. However, to begin the construction stage, it is necessary to obtain the permit for tree felling, register the project in the Public Investment Projects Bank (BPIP), and secure the corresponding financing.

IV.-That the construction of the new bridge will benefit the residents of the districts of San Miguel (except the town of Socorro), Tures and Pará; who use the project road to connect with the cantonal capital (Santo Domingo) and with the city of Heredia. According to estimates reported by the Ministry of Public Works and Transport, an average of 17,749 vehicles per day travel over the bridge.

V.-That the Project called "Construction of the bridge over the Tures River on National Route No. 116 in Santo Domingo", under Article 17 of the Organic Environmental Law No. 7554, has the respective environmental viability (viabilidad ambiental) issued by the National Environmental Technical Secretariat (SETENA), according to resolution No. 0531-2021-SETENA of ten hours fifty-one minutes on April seven, two thousand twenty-one (administrative file No. D1-0080-2021-SETENA).

VI.-That in accordance with document number ACC-PNE-C-005-2021 of May 28, 2021, signed by the Coordinator of State Natural Heritage (Patrimonio Natural del Estado), of the Central Conservation Area of the National System of Conservation Areas (SINAC), it was certified regarding the project site that "it is OUTSIDE State Natural Heritage".

VII.-That Articles 19 subsection b) and 34 of the Forest Law No. 7575 prohibit land-use change (cambio de uso de suelo) and the cutting of trees on private lands covered by forest, as well as the cutting of trees in the protection areas defined in numeral 33 of the same regulatory body, excepting those state or private projects that the Executive Branch declares of National Convenience, these being those projects whose social benefits are greater than the socio-environmental costs.

VIII.-That by reason of the preceding Considering, the developer prepared the socio-economic evaluation of said project, which was submitted by the Ministry of Environment and Energy for assessment, in order to weigh that the social benefits are greater than the socio-environmental costs, under subsection m) of Article 03 of the Forest Law No. 7575, the foregoing so that the respective recommendations would be issued, which, as relevant, stated that the procedure used by the developer was adequate for demonstrating social welfare, and ultimately concluded:

"Conclusions: The presented study shows that there is a positive social benefit. It allows strengthening the road network, through the mobilization of people, goods and services in this zone of the country. For this reason, the project can be considered of national convenience.

For this reason, considering the foregoing and because the results of the project (TIRE AND VANE) were positive, it is considered that the project may be granted the declaration of national convenience".

IX.-That in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012 and its amendments, it was determined that this proposal does not establish nor modify procedures, requirements or processes, that the citizen must comply with, a situation for which the prior control procedure was not undertaken. Therefore, THEY DECREE:

DECLARATION OF NATIONAL CONVENIENCE OF THE PROJECT CALLED:

"CONSTRUCTION OF THE BRIDGE OVER THE TURES RIVER ON NATIONAL ROUTE NO. 116 IN SANTO DOMINGO"

Considering:

en la totalidad del texto - Texto Completo Norma 43243 Declara de Conveniencia Nacional el proyecto denominado "Construcción del puente sobre el Río Tures en la Ruta Nacional N° 116 en Santo Domingo Nº 43243-MINAE-MOPT EL PRESIDENTE DE LA REPÚBLICA, LA MINISTRA DE AMBIENTE Y ENERGÍA Y EL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES En ejercicio de las facultades que les confieren los artículos 50, 140 incisos 3) y 18), y 146 de la Constitución Política; artículos 27 inciso 1) y 28 inciso 2) acápite b)de la Ley General de la Administración Pública N°6227 del 2 de mayo de 1978;la Ley de Creación del Ministerio de Obras Públicas y Transportes, Nº3155 del 05de agosto de 1963, reformada mediante Ley N°4786 del 05 de julio de 1971; los artículos 3 inciso m), 19 inciso b), 33 y 34 de la Ley Forestal N°7575 del 13 de febrero de 1996; y el artículo 2 inciso m) del Reglamento a la Ley Forestal, Decreto Ejecutivo N°25721- MINAE del 17 de octubre de 1996.

I.-Que el Consejo Nacional de Vialidad (CONAVI) y el Ministerio de Obras Públicas y Transportes (MOPT), pretenden desarrollar el proyecto denominado "Construcción del puente sobre el río Tures en la Ruta Nacional Nº 116 en Santo Domingo".

II.-Que en la actualidad el puente sobre el Río Tures en el tramo de la Ruta Nacional Nº 116 entre Santo Tomás y Los Ángeles, presenta un sólo carril, por lo que se realizará la sustitución de la estructura actual, por un puente de dos carriles que tendrá un ancho total de 9,70 m y una sola luz de 12 m de longitud. También se intervendrán los accesos en una longitud aproximada de 128 m, de forma que la longitud total a lo largo de la Ruta Nacional Nº 116 es de 140 m y se incluye la intersección con calle Quebradas, en el acceso este del puente.

III.-Que a la fecha, se tiene concluida la etapa de licitación, pues se tiene contrato notificado para la Licitación Abreviada Nº 2019LA-000032-0006000001, cuya empresa contratista es CODOCSA. Sin embargo, para iniciar la etapa de construcción se requiere obtener el permiso para tala de árboles, inscribir el proyecto en el Banco de Proyectos de Inversión Pública (BPIP) y conseguir el financiamiento correspondiente.

IV.-Que la construcción del nuevo puente beneficiará a los pobladores de los distritos de San Miguel (excepto el poblado Socorro), Tures y Pará; los cuales usan la vía del proyecto para comunicarse con la cabecera cantonal (Santo Domingo) y con la ciudad de Heredia. Según estimaciones reportadas por el Ministerio de Obras Públicas y Transportes, sobre el puente transitan un promedio de 17.749 vehículos por día.

V.-Que el Proyecto denominado "Construcción del puente sobre el río Tures en la Ruta Nacional Nº 116 en Santo Domingo", al amparo del artículo 17 de la Ley Orgánica del Ambiente Nº7554, cuenta con la respectiva viabilidad ambiental emitida por la Secretaría Técnica Nacional Ambiental (SETENA), según resolución Nº0531-2021-SETENA de las diez horas cincuenta y un minutos del siete de abril de dos mil veintiuno (expediente administrativo Nº D1-0080-2021-SETENA).

VI.-Que de conformidad con el documento número ACC-PNE-C-005-2021 del 28 de mayo de 2021, suscrito por el Coordinador de Patrimonio Natural del Estado, del Área de Conservación Central del Sistema Nacional de Áreas de Conservación (SINAC), se certificó sobre el sitio del proyecto que "se encuentra FUERA de Patrimonio Natural del Estado".

VII.-Que los artículos 19 inciso b) y 34 de la Ley Forestal Nº7575 prohíben el cambio de uso de suelo y la corta de árboles en terrenos privados cubiertos de bosque, así como la corta de árboles en las áreas de protección definidas en el numeral 33 del mismo cuerpo normativo, exceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo declare de Conveniencia Nacional, constituyéndose en estos, aquellos proyectos cuyos beneficios sociales son mayores a los costos socio ambientales.

VIII.-Que en razón del Considerando anterior, el desarrollador elaboró la evaluación económica-social del citado proyecto, misma que fue sometida por parte del Ministerio de Ambiente y Energía a valoración, en aras de ponderar que los beneficios sociales sean superiores a los costos socio-ambientales, al amparo del inciso m) del artículo 03 de la Ley Forestal Nº7575, lo anterior a efecto de que se emitieran las recomendaciones respectivas, mismas que en lo conducente, refirieron que el procedimiento utilizado por el desarrollador fue adecuado para la demostración del bienestar social, y a la postre se concluyó:

"Conclusiones: El estudio presentado muestra que existe un beneficio social positivo. Permite fortalecer la red vial, mediante la movilización de personas, bienes y servicios en esta zona del país. Por tal motivo, el proyecto puede considerarse de conveniencia nacional.

(.)

Por tal motivo, considerando lo anterior y debido a que los resultados del proyecto (TIRE Y VANE) fueron positivos, se considera que al proyecto puede otorgársele la declaratoria de conveniencia nacional".

IX.-Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº37045-MP-MEIC del 22 de febrero de 2012 y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto,

DECLARATORIA DE CONVENIENCIA NACIONAL DEL PROYECTO DENOMINADO:

"CONSTRUCCIÓN DEL PUENTE SOBRE EL RÍO TURES EN LA RUTA NACIONAL Nº 116 EN SANTO DOMINGO"
