CONSIDERING
article 50 of the Political Constitution, the State must guarantee the development of fishing activities, in a manner that generates the greatest benefit for the citizens, organizing and stimulating production and the most adequate distribution of wealth in a healthy balance between the Right to development of the communities and the Right to a healthy and ecologically balanced environment.
Likewise, by reason of its objective of conserving biological diversity, measures must be established that reduce the impact of fisheries on populations of elasmobranchs, sharks, turtles, billfish, and marine mammals.

For the purposes of installing Satellite Tracking devices or beacons on the vessels of the Costa Rican fishing fleet, a maximum of 36 months is established for the advanced commercial fleet and for the medium-scale commercial fleet a maximum of 88 months from the entry into force of this Decree for its due implementation.

CONSIDERANDO
Así mismo en razón de su objetivo de conservación de la diversidad biológica se deben establecer medidas que reduzcan el impacto de las pesquerías sobre las poblaciones de elasmobranquios, tiburones, tortugas, picudos y mamíferos marinos.
11 º- Que el Ministro de Agricultura y Ganadería, mediante el oficio número DM-MAG- 1266-2021 del 13 de diciembre del 2021, estimó que la solicitud del INCOPESCA de ampliación del plazo del párrafo segundo del artículo 16 del Decreto Ejecutivo No.38681- MAG-MINAE del 09 de octubre del 2014, es razonable y proporcional, por lo que avala dicha prórroga al apegarse al ordenamiento jurídico pesquero vigente.
Reforma al Decreto Ejecutivo No.38681-MAG-MINAE del 09 de octubre del 2014; denominado: "Ordenamiento para el Aprovechamiento de Atún y especies afines en la Zona Económica Exclusiva del Océano Pacífico Costarricense", publicado en el Diario Oficial La Gaceta N° 213, el día 05 de noviembre del año 2014.

"Artículo 16.- (...)
A efectos de la instalación de los dispositivos de Seguimiento Satelital o balizas a las embarcaciones de la flota pesquera costarricense, se establece un máximo de 36 meses para la flota comercial avanzada y para la flota comercial de mediana escala un máximo de 88 meses a partir de la entrada en vigencia del presente Decreto para su debida implementación.
Dado en la Presidencia de la República. - San José, a los catorce días del mes de enero del año dos mil veintidós.
