the entire text - Complete Text of Norm 010 Delimitation of the public zone corresponding to the Ría of the Río Tarcolitos, Tárcoles District, Garabito Canton, Puntarenas NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT NOTICE No. 2021-010 MARITIME TERRESTRIAL ZONE Delimitation of the Public Zone Corresponding to the Ría of the Río Tarcolitos, Tárcoles District, Garabito Canton, Puntarenas Based on the provisions of articles 140 and 240 of Law No. 6227, the General Public Administration Law of May 2, 1978; Law No. 59, the Law on the Creation and Organization of the Instituto Geográfico Nacional of July 4, 1944; Law No. 8905, Reform of Article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and modification of Law No. 59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments of December 7, 2010; Law No. 6043, the Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulations; and articles 2 and 3 of Law No. 5695, the Law on the Creation of the National Registry of May 28, 1975, and its amendments.

1. 1That by means of Law No. 8905, the Instituto Geográfico Nacional, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the necessary contracts and agreements for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical body governing national cartography, intended for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.
2. 2That Law No. 59 establishes the IGN permanently and in representation of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to activities of any nature originating from the work entrusted to its charge.
3. 3That in accordance with Law No. 59, Article 62 of Executive Decree No. 7841-P, called the Regulations to the Law on the Maritime Terrestrial Zone, recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree No. 7841-P indicates that the Instituto Geográfico Nacional must publish a notice in the Official Gazette for each portion of the maritime terrestrial zone in which it has demarcated the public zone.
4. 4That in Executive Decree No. 36642-MP-MOPT-MINAET, the Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone, of June 28, 2011, in accordance with articles 18, 19, and 20, it establishes that for the types of delimitation of the Public Zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, namely: a) delimitation through the placement of boundary markers (mojones) and; b) georeferenced digital delimitation, which is a methodology that allows the georeferencing of the ordinary high-water mark (pleamar ordinaria), based on coordinates in the official reference system of the country, established by Executive Decree No. 33797-MJ-MOPT titled "Declares CR05 as the official horizontal datum for Costa Rica," linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, without the need for placing boundary markers, in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which, among other aspects, determines the National Geodetic Horizontal Reference Network CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in its Article 11 that the National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed within the National Territory by any public agency, person, or national or foreign private entity that undertakes or contracts geodetic and cartographic work must be referenced, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information of general utility that supports decision-making at the various levels of the State; while Article 7 indicates that as cartographic data is produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish, by appropriate means, that information which has been made official.
6. 6That Executive Decree No. 40962-MJP, Updating the Official Horizontal Geodetic Reference System for Costa Rica, declares in its Article 1 that the official horizontal geodetic reference system for Costa Rica, called CR05, and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, the changes and its updating shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) called SIRGAS-CON, while Article 2 establishes that the CRTM05 cartographic projection system shall remain official for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for measuring the maximum breadth of all jurisdictional marine areas of the Costa Rican State.

For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that the horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea and the "Universal Transverse Mercator" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed within the national territory by any public agency, person, or private entity, national or foreign, that undertakes or contracts geodetic and cartographic work must be referenced, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information of general utility that supports decision-making at the various levels of the State.

1. 7That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), approving surveying plans, granting concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning (ordenamiento territorial costero).
2. 8That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone.
3. 9That the IGN's GDG on the Maritime Terrestrial Zone is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P; b) Executive Decree No. 33797-MJ-MOPT and; c) Executive Decree No. 36642-MP-MOPT-MINAET, all previously cited.

10.—That Law No. 7575, called the Forestry Law (Ley Forestal) of February 13, 1996, in its Article 16 establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that make up the State's Natural Heritage (Patrimonio Natural del Estado).

11.—That Law No. 6043 establishes in its Article 1 of CHAPTER I, General Provisions, that the maritime terrestrial zone constitutes part of the national heritage, belongs to the State, and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is an obligation of the State, its institutions, and all inhabitants of the country. Its use and exploitation are subject to the provisions of this law.

12.—That according to Article 11 of CHAPTER I, General Provisions of Law No. 6043, it establishes that the public zone is also, whatever its extension, that which is occupied by all mangroves on the continental and insular coastlines and tidal creeks (esteros) of the national territory.

13.—That Executive Decree No. 36786-MINAET, titled Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives to identify within the Maritime Terrestrial Zone those lands that classify as forests, of forest aptitude (Class VII and VIII soils), wetlands (mangroves, tidal creeks, rías, salt marshes, coastal lagoons, swamps, flooded forests, salt flats (salitrales)), in order to certify them and incorporate them as part of the State's Natural Heritage (PNE).

14.—That Executive Decree No. 36786-MINAET, in point III.—Competencies for delimitation and certification, establishes that the classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations, in order to classify the forests, lands of forest aptitude (Class VII and VIII soils), (mangroves, tidal creeks, rías, salt marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.

The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC with corresponding territorial jurisdiction. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the State's Natural Heritage and the protection zones.

The location and delimitation of the areas of the State's Natural Heritage within the Maritime Terrestrial Zone must be carried out as part of the approval process of the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all zones to be granted as concessions within the ZMT and for the classification thereof at the cadastral plan level. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the areas of the PNE so as not to count them in the total area to be concessioned.

15.—That according to Article 69 of Law No. 276, the Water Law, it states: The maritime zone is understood to mean the space of the coasts of the Republic that the sea bathes in its flow and ebb, and the immediate lands up to a distance of one mile, that is, one thousand six hundred seventy-two meters, counted from the line marking the high tide.

This maritime zone also extends along the banks of rivers up to the point where they are navigable or where the tides become noticeable, with a width of two hundred meters from each bank, counted from the line marking the high tide.

16.—That through certification SINAC-ACOPAC-D-C-001-2021 of May 12, 2021, signed by Lic. Luis Sánchez Arguedas, Director of the Central Pacific Conservation Area (ACOPAC), the extent of the ría of the Río Tarcolitos is certified, located in the 02° district Tárcoles, 11° canton Garabito of the 06° province Puntarenas(*), according to official communication SINAC-ACOPAC-OSRO-0312-2021 of April 12, 2021, which presents the technical report called "Report: SINAC-ACOPA-OSRO-0311-2021, Identification and Delimitation of Estuarine System-type Wetlands, to determine the maximum point of intertidal influence (Ría) in the Río Tarcolitos" of the sector subject to this notice.

(*) (Corrected by means of Fe de Erratas and published in La Gaceta No. 19 of January 31, 2022, page No. 2, which corrected the location of the Ría of the Río Tarcolitos) 17.—The Instituto Geográfico Nacional used the methodology of "Georeferenced Digital Delimitation" to delimit the public zone of the Maritime Terrestrial Zone in the ría of the Río Tarcolitos, located in the 02° district Tárcoles, 11° canton Garabito of the 06° province Puntarenas(*).

(*) (Corrected by means of Fe de Erratas and published in La Gaceta No. 19 of January 31, 2022, page No. 2, which corrected the location of the Ría of the Río Tarcolitos) 18.—That the Instituto Geográfico Nacional carried out the delimitation of both banks of the estuarine system determined by ACOPAC, through the report called "Delimitation in 2016 orthophotos of a 50-meter protection zone on the banks of the ría of the Río Tarcolitos, Garabito," corresponding to official communications DIG-TOT-0240-2021 of May 24, 2021, issued by the Territorial Classification Subprocess, and DIG-TOT-INF-52-2021 of May 21, 2021, and in accordance with certification SINAC-ACOPAC-D-CERT-001-2021.

19.—That the delimitation performed has internal technical endorsement in accordance with official communication DIG-TOT-0246-2021 of May 24, 2021, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the Instituto Geográfico Nacional and addressed to the Directorate of the IGN.

20.—That Article 140 of Law No. 6227, General Public Administration Law, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it only grants rights, in which case it shall produce it from the moment it is adopted," a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific acts by notification." Communicates:

First.—The Instituto Geográfico Nacional used the methodology of "Georeferenced Digital Delimitation" to delimit the public zone of the Maritime Terrestrial Zone in the ría of the Río Tarcolitos, located in the 02° district Tárcoles, 11° canton Garabito of the 06° province Puntarenas(*), based on official communication SINAC-ACOPAC-D-C-001-2021 of May 12, 2021, signed by Lic. Luis Sánchez Arguedas, Director of the Central Pacific Conservation Area (ACOPAC).

(*) (Corrected by means of Fe de Erratas and published in La Gaceta No. 19 of January 31, 2022, page No. 2, which corrected the location of the Ría of the Río Tarcolitos) Second.—The public zone of the Maritime Terrestrial Zone corresponding to the ría of the Río Tarcolitos corresponds to the tidal affectation, the approximate coordinates of the extreme point "upstream" defined by ACOPAC are indicated in the official cartographic projection system of Costa Rica CRTM05, as follows:

Third.—That the sectors in the vicinity of the Río Tarcolitos that currently have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette La Gaceta maintain their official status.

Fourth.—The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, delimitation of the public zone corresponding to the ría of the Río Tarcolitos, Tárcoles district, Garabito canton of the Puntarenas province, have been registered in the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT), in a file in vector shape format, under the code: RN/IGN_GDG-IGN-ZMT_CR_Rías.

Fifth: Effective as of its publication.

1. 1Que mediante ley N° 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la ley N° 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la ley N° 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la ley N° 59; el artículo 62 del Decreto Ejecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.
4. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre, del 28 de junio del 2011, de conformidad con los artículos 18, 19 y 20 establece que los tipos de delimitación de la Zona Pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución a saber: a) delimitación a través de la colocación de mojones y; b) delimitación digital georreferenciada, que es una metodología que permite la georreferenciación de la pleamar ordinaria, a partir de coordenadas en el sistema de referencia oficial del país, establecido por el Decreto Ejecutivo N° 33797-MJ-MOPT titulado Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83, sin que sea necesario la colocación de mojones, con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en su artículo 11 que La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose de esta forma a evitar el gasto público y obteniendo por otra parte información geográfica confiable, uniforme y comparable que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.; mientras que el artículo 7 indica que Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado.
6. 6Que el Decreto Ejecutivo N° 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense.

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.

1. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre.
3. 9Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P; b) el Decreto Ejecutivo N.º 33797-MJ-MOPT y; c) el Decreto Ejecutivo N.º 36642-MP-MOPT-MINAET, todos previamente citados.

10.-Que la ley N° 7575 denominada Ley Forestal del 13 de febrero de 1996 en su artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno, los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que la ley N° 6043 establece en su artículo 1 del CAPÍTULO I, Disposiciones Generales que La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley.

12.-Que según el artículo 11 del CAPÍTULO I, Disposiciones Generales de la ley N° 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

13.-Que el Decreto Ejecutivo N° 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

14.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.

15.-Que según el artículo 69 de la ley N° 276, Ley de Aguas, menciona: Por zona marítima se entiende el espacio de las costas de la República que baña el mar en su flujo y reflujo y los terrenos inmediatos hasta la distancia de una milla, o sean mil seiscientos setenta y dos metros, contados desde la línea que marque la marea alta.

Esta zona marítima se extiende también por las márgenes de los ríos hasta el sitio en que sean navegables o se hagan sensibles las mareas, con un ancho de doscientos metros desde cada orilla, contados desde la línea que marque la marea alta.

16.-Que mediante la certificación SINAC-ACOPAC-D-C-001-2021 de fecha 12 de mayo de 2021 suscrita por el Lic. Luis Sánchez Arguedas, Director del Área de Conservación Pacífico Central (ACOPAC), se certifica el alcance de la ría del río Tarcolitos, ubicado en el distrito 02° Tárcoles, cantón 11° Garabito de la provincia 06° Puntarenas(*), según el oficio SINAC-ACOPAC-OSRO-0312-2021 de fecha 12 de abril de 2021 que presenta el informe técnico denominado "Informe: SINAC-ACOPA-OSRO-0311-2021, Identificación y Delimitación de Humedales tipo Sistema Estuarino, para determinar el punto máximo de la influencia intermareal (Ría) en el Río Tarcolitos" del sector objeto del presente aviso.

(*) (Corregido mediante Fe de Erratas y publicada en La Gaceta N° 19 del 31 de enero de 2022, página N° 2, que corrigió la ubicación de la Ría del Río Tarcolitos) 17.-El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en la ría del Río Tarcolitos, ubicado en el distrito 02° Tárcoles, cantón 11° Garabito de la provincia 06° Puntarenas(*).

(*) (Corregido mediante Fe de Erratas y publicada en La Gaceta N° 19 del 31 de enero de 2022, página N° 2, que corrigió la ubicación de la Ría del Río Tarcolitos) 18.-Que el Instituto Geográfico Nacional realizó la delimitación de ambas márgenes del sistema estuarino dictaminado por ACOPAC, mediante el informe denominado "Delimitación en ortofotos del año 2016 de una zona de protección de 50 metros en las márgenes de la ría del río Tarcolitos, Garabito", correspondiente a los oficios DIG-TOT-0240-2021 del 24 de mayo 2021, emitido por el Subproceso de Clasificación Territorial y el DIG-TOT-INF-52-2021 de fecha 21 de mayo de 2021 y de conformidad a la certificación SINAC-ACOPAC-D-CERT-001-2021.

19.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio DIG-TOT-0246-2021 del 24 de mayo 2021, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional y dirigido a la Dirección del IGN.

20.-Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos".

Comunica:

Primero.-El Instituto Geográfico Nacional utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en la ría del Río Tarcolitos, ubicado en el distrito 02° Tárcoles, cantón 11° Garabito de la provincia 06° Puntarenas(*) con base en el oficio SINAC-ACOPAC-D-C-001-2021 de fecha 12 de mayo de 2021 suscrita por el Lic. Luis Sánchez Arguedas, Director del Área de Conservación Pacífico Central.

(*) (Corregido mediante Fe de Erratas y publicada en La Gaceta N° 19 del 31 de enero de 2022, página N° 2, que corrigió la ubicación de la Ría del Río Tarcolitos) Segundo.-La zona pública de la Zona Marítimo Terrestre correspondiente a la ría del río Tarcolitos corresponde a la afectación mareal cuyas coordenadas aproximadas de punto extremo "aguas arriba" definido por ACOPAC, se indican en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, como sigue:

Tercero.-Que los sectores en las cercanías del río Tarcolitos, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

Cuarto.-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, delimitación de la zona pública correspondiente a la ría del Río Tarcolitos, distrito de Tárcoles, cantón Garabito de la provincia Puntarenas han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_CR_Rías.

Quinto: Rige a partir de su publicación.
