in the entirety of the text - Complete Text of Norm 008 Delimitation of the public zone of a sector of the Estero/Manglar Changua in the Bahía Ballena District, Osa Canton, Puntarenas Province INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO NOTICE No. 2021-008 MARITIME TERRESTRIAL ZONE Delimitation of the public zone of a sector of the Estero / Manglar Changua in the Bahía Ballena District, Osa Canton, Puntarenas Province Based on the provisions of Articles 140 and 240 of Law No. 6227, the General Public Administration Law of May 2, 1978; Law No. 59, the Law for the Creation and Organization of the Instituto Geográfico Nacional of July 4, 1944; Law No. 8905, Reform of Article 2 of Law No. 5695, Creation of the National Registry, and its reforms; and modification of Law No. 59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its reforms of December 7, 2010; Law No. 6043, the Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulation; and Articles 2 and 3 of Law No. 5695, the Law for the Creation of the National Registry of May 28, 1975, and its reforms.
1.—That through Law No. 8905, the Instituto Geográfico Nacional, hereinafter IGN, is established as an office of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical office governing national cartography, destined for the execution of the official Base Map and the basic geographic Description of the Republic of Costa Rica, and for studies, research or work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.
2.—That Law No. 59 establishes the IGN, on a permanent basis and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any nature that originate from the work entrusted to its charge.
3.—That in accordance with Law No. 59, Article 62 of Executive Decree No. 7841-P, named the Regulation to the Law on the Maritime Terrestrial Zone, recognizes the IGN's competence for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree No. 7841-P indicates that the Instituto Geográfico Nacional shall publish a notice in the Official Gazette, for each portion of the maritime terrestrial zone in which it has demarcated the public zone.
4.—That in Executive Decree No. 36642-MP-MOPT-MINAET, the Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone, of June 28, 2011, in accordance with Articles 18, 19, and 20, it establishes that for the types of delimitation of the Public Zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, namely: a) delimitation through the placement of boundary markers (mojones); and b) georeferenced digital delimitation, which is a methodology that allows the georeferencing of the ordinary high-water mark (pleamar ordinaria), based on coordinates in the official reference system of the country, established by Executive Decree No. 33797-MJ-MOPT titled Declares as the official horizontal datum for Costa Rica, the CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, without the need for the placement of boundary markers, in order to expedite delimitations and provide greater technical security to interested parties.
5.—That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically indicating in its Article 11 that The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public office, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic work must be referenced, thereby contributing to avoiding public and comparable geographic information that is of general utility and supports decision-making at the different levels of the State; whereas Article 7 indicates that As cartographic data are produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish by appropriate means that information which has been officialized.
6.—That Executive Decree No. 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, declares in its Article 1 that The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official Horizontal Reference System for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and its update shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON, while Article 2 establishes that The CRTM05 cartographic projection system shall continue to be the official one for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection, up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State.
For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which all work must be referenced in the continental territory of our country, by indicating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the "Universal Transverse Mercator" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the national territory by any public office, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic work must be referenced, contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at the different levels of the State.
7.—That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of survey plans (visado de planos de agrimensura), the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning (ordenamiento territorial costero).
8.—That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is denominated the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone.
9.—That the GDG of the IGN on the Maritime Terrestrial Zone is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P; b) Executive Decree No. 33797-MJ-MOPT; and c) Executive Decree No. 36642-MP-MOPT-MINAET, all previously cited.
10.—That Law No. 7575, named the Forestry Law (Ley Forestal) of February 13, 1996, in its Article 16 establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).
11.—That Law No. 6043 establishes in its Article 1 of Chapter I, General Provisions, that The maritime terrestrial zone constitutes part of the national heritage, belongs to the State, and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is the obligation of the State, its institutions, and all the inhabitants of the country. Its use and exploitation are subject to the provisions of this law.
12.—That according to Article 11 of Chapter I, General Provisions of Law No. 6043, it establishes that the Public Zone is also, whatever its extension, that occupied by all the mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.
13.—That Executive Decree No. 36786-MINAET, titled Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives To identify within the Maritime Terrestrial Zone those lands that classify as forests, of forestry aptitude (soils Class VII and VIII), wetlands (mangroves, estuaries, rias, salt marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)), to certify them and incorporate them as part of the Natural Heritage of the State (Patrimonio Natural del Estado, PNE).
14.—That Executive Decree No. 36786-MINAET in point III-Competencies for delimitation and certification establishes that The classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and to duly accredited private professionals by the respective Professional Associations to classify forests, lands of forestry aptitude (Class VII and VIII soils), (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.
The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC that by territorial competence corresponds. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones.
The location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone must be carried out as part of the approval process of the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, because the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all the zones to be concessioned within the ZMT and for the classification of this at the level of cadastral plans (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the areas of the PNE so as not to count them in the total area to be concessioned.
15.—That through official communication SINAC-ACOSA-PNE-AD-124-2020 dated June 3, 2020, issued by the Osa Conservation Area (Área de Conservación Osa), the verification of the delimitation of the Estero-Manglar, Rancho La Merced Farm carried out by Eng. Melissa Uribe Mora is conducted, described in the report Delimitation of the Estero-Manglar ecosystem corresponding to the public zone in the sector of Playa Hermosa, Bahía Ballena, Osa.
16.—That through official communication SINAC-ACOSA-D-389-2020 dated August 25, 2020, signed by Ms. Laura Rivera Quintanilla, acting director of the Osa Conservation Area of the System of Conservation Areas of the Ministry of Environment and Energy, addressed to Ms. Marta Aguilar Varela, director of the Instituto Geográfico Nacional, approval is granted for the survey carried out by Eng. Melissa Uribe Mora, according to the technical reports prepared through official communications SINAC-ACOSA-PNE-AD-124-2020 and SINAC-ACOSA-PNE-AD-160-2020, carried out by the officials Top. Eng. Roberto Martínez Fernández, Forestry Eng. Ginette Jiménez Soto, Forestry Eng. Javier García Rodríguez, and Bach. Jorge Andrés Quesada Badilla of the Osa Conservation Area, based on Executive Decree No. 36786-MINAET.
17.—That through the report titled "Delimitation of the Estero-Manglar ecosystem corresponding to the public zone in the sector of Playa Hermosa, Bahía Ballena, Osa" prepared by Eng. Melissa Uribe Mora, at the time an employee of the company INCOPOAS Sociedad Anónima, at the request of Walter Odio Victory, identification number 9-0008-0897, Legal Representative of Rancho La Merced, the technical information of the topographic survey for the delimitation of the Estero-Manglar Changua ecosystem corresponding to the public zone in the sector of Playa Hermosa, Bahía Ballena, Puntarenas is presented to the IGN.
18.—That through official communication DIG-TOT-0050-2021 dated February 9, 2021, issued by the Official Limits Subprocess of the Departamento Topográfico y Observación del Territorio of the IGN, the Directorate of the Instituto Geográfico Nacional was informed that the work carried out by Eng. Melissa Uribe Mora has the technical endorsement for its publication.
19.—That Article 140 of Law No. 6227 indicates that The administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce them from the moment it is adopted, a provision that must necessarily be related to Article 240 of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by indicating that Acts of a general nature shall be communicated by publication and specific ones by notification.
Communicates:
First.—The Instituto Geográfico Nacional publishes, in the Playa Hermosa sector, located in district No. 04 Bahía Ballena, of canton No. 05 Osa, of province No. 06 Puntarenas, through the methodology used and validated by both the Osa Conservation Area (ACOSA) of SINAC-MINAE and the Instituto Geográfico Nacional, the georeferenced digital delimitation of the public zone of the Estero-Manglar Changua ecosystem of the Maritime Terrestrial Zone in said sector.
Second.—The delimited public zone of the Maritime Terrestrial Zone of the Estero-Manglar Changua ecosystem in the sector known as Playa Hermosa in the Bahía Ballena district, of the Osa canton, in the Puntarenas province, corresponds to the boundary markers whose coordinates in the Costa Rica CRTM05 cartographic projection system are indicated below:

Fourth.—The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of the Estero-Manglar Changua ecosystem of the Maritime Terrestrial Zone have been registered in the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT), in a file in shape vector format, under the codification RN/IGN_GDG-IGN-ZMT digital lines.
Fifth: It is effective from its publication.

en la totalidad del texto - Texto Completo Norma 008 Delimitación de zona pública de un sector del Estero/Manglar Changua en el Distrito Bahía Ballena, Cantón Osa, provincia Puntarenas INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO AVISO Nº 2021-008 ZONA MARÍTIMO TERRESTRE Delimitación de zona pública de un sector del Estero / Manglar Changua en el Distrito Bahía Ballena, Cantón Osa, Provincia Puntarenas Con fundamento en lo dispuesto en los artículos 140 y 240 de la ley Nº 6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978; ley Nº 59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944; ley Nº 8905 Reforma del artículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus reformas; y modificación de la ley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de diciembre del 2010; ley Nº 6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento y; artículos 2 y 3 de la ley Nº 5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.
Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.
10.-Que la ley Nº 7575 denominada Ley Forestal del 13 de febrero de 1996 en su artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno, los linderos de las áreas que conforman el Patrimonio Natural del Estado.
11.-Que la ley Nº 6043 establece en su artículo 1 del Capítulo I, Disposiciones Generales que La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley.
12.-Que según el artículo 11 del Capítulo I, Disposiciones Generales de la ley N.º 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.
13.-Que el Decreto Ejecutivo Nº 36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N.º 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).
14.-Que el Decreto Ejecutivo N.º 36786-MINAET en el punto III-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.
La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.
La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.
15.-Que en mediante oficio SINAC-ACOSA-PNE-AD-124-2020 de fecha 03 de junio de 2020 emitido por el Área de Conservación Osa, se lleva a cabo la verificación de delimitación de Estero-Manglar, Finca Rancho La Merced realizado por la Ing. Melissa Uribe Mora descrito en el informe Delimitación del ecosistema Estero-Manglar correspondiente a zona pública en sector de Playa Hermosa, Bahía Ballena, Osa.
16.-Que mediante el oficio SINAC-ACOSA-D-389-2020 de fecha 25 de agosto de 2020 suscrito por la Sra. Laura Rivera Quintanilla directora a. í. del Área de Conservación Osa del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía, dirigido a la Sra. Marta Aguilar Varela directora del Instituto Geográfico Nacional, se otorga visto bueno al levantamiento realizado por la Ing. Melissa Uribe Mora, según los informes técnicos elaborados mediante los oficios SINAC-ACOSA-PNE-AD-124-2020 y SINAC-ACOSA-PNE-AD-160-2020, realizados por los funcionarios Ing. Top. Roberto Martínez Fernández, Ing. Forestal Ginette Jiménez Soto, Ing. Forestal Javier García Rodríguez y el Bach. Jorge Andrés Quesada Badilla del área de Conservación Osa, con base en el Decreto Ejecutivo N.º 36786-MINAET.
17.-Que mediante el informe denominado "Delimitación del ecosistema Estero-Manglar correspondiente a zona pública en sector de Playa Hermosa, Bahía Ballena, Osa" elaborado por la Ing. Melissa Uribe Mora, en su momento funcionaria de la empresa INCOPOAS Sociedad Anónima, a solicitud de Walter Odio Victory, número de cédula 9-0008- 0897, Representante Legal de Rancho La Merced, se presenta al IGN la información técnica del levantamiento topográfico para la delimitación del ecosistema Estero-Manglar Changua correspondiente a zona pública en sector de Playa Hermosa, Bahía Ballena, Puntarenas.
18.-Que mediante el oficio DIG-TOT-0050-2021 de fecha 09 de febrero de 2021, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del IGN, se le comunicó a la Dirección del Instituto Geográfico Nacional que los trabajos realizados por la Ing. Melissa Uribe Mora cuentan con el aval técnico para su publicación.
19.-Que el artículo 140 de la ley Nº 6227 señala que El acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte, disposición que necesariamente debe relacionarse con el artículo 240 del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que Se comunicarán por publicación los actos generales y por notificación los concretos.
Comunica:
Primero.-El Instituto Geográfico Nacional publica en el sector de Playa Hermosa, ubicado en el distrito N° 04 Bahía Ballena, del cantón N° 05 Osa de la provincia N° 06 Puntarenas, por medio de la metodología usada y validada tanto por el Área de Conservación Osa (ACOSA) del SINAC-MINAE y por el Instituto Geográfico Nacional, la delimitación digital georreferenciada de la zona pública del ecosistema Estero-Manglar Changua de la Zona Marítimo Terrestre en dicho sector.
Segundo.-La zona pública de la Zona Marítimo Terrestre delimitada del ecosistema Estero-Manglar Changua en el sector conocido como en Playa Hermosa en el distrito Bahía Ballena, del cantón Osa de la provincia Puntarenas, corresponde a los mojones cuyas coordenadas en el sistema de proyección cartográfico Costa Rica CRTM05, se indican a continuación:

Tercero.-El mojón MU1 de la presente delimitación es coincidente con la franja de los 50m de zona publica de la ría del rio Higuerón, además el MU168 se une con el mojón de costa denominado M36 publicado en La Gaceta N°. 54 del 08 de marzo de 1985. Por último, el mojón M1 publicado en la Gaceta N°. 54 del 08 de marzo de 1985 se une con el punto de coordenadas Este: 526402.81 y Norte: 1013741.11 de la ría del rio Higuerón.
Cuarto.-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre del ecosistema Estero-Manglar Changua de la Zona Marítimo Terrestre han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en un archivo con formato vectorial shape, bajo la codificación RN/IGN_GDG-IGN-ZMT líneas digitales.
