in the entirety of the text - Complete Text of Norm 224 Creation of the Marine Area of Responsible Fishing 201 and its fisheries management plan COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/224-2021.—Puntarenas, on the thirteenth day of the month of October, two thousand twenty-one.
1.—That the Board of Directors of INCOPESCA approved, through Agreement No. AJDIP/138-2008, of April 4, 2008 and Executive Decree No. 35502-MAG, the "Reglamento para el establecimiento de las Áreas Marinas de Pesca Responsable (AMPR) y declaración de interés público nacional las Áreas Marinas de Pesca Responsable," the Asociación de Pescadores Artesanales of the zone submitted a formal request to the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture (Incopesca) to approve the formation of the working group and the preparation of the Fisheries Management Plan (Plan de Ordenamiento Pesquero) for the Marine Area of Responsible Fishing 201.
2.—That pursuant to the agreement reached in session 035-2021 of August 20, 2021, in Agreement AJDIP/186-2021, support is given to the follow-up on the establishment of the AMPR and, in accordance with the inputs provided by the Research Department (Departamento de Investigación) of Incopesca, it is approved to begin preparing the necessary documents for the development of the Fisheries Management Plan, as well as to define the characteristics, regulations, and programs for the creation and start-up of the Marine Area of Responsible Fishing.
3.—That Article 50 of the Political Constitution establishes the State's obligation to seek the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. It also recognizes every person's right to a healthy and ecologically balanced environment.
4.—It is the responsibility of INCOPESCA, as the public institution governing fisheries and aquaculture in our country, to establish management measures for the sustainable use of hydrobiological resources, to protect reproduction, recruitment, and feeding areas that favor the increase of species and the growth of their biomass, in order to guarantee the sustainability of the resource.
5.—The Code of Conduct for Responsible Fisheries, Executive Decree No. 27919-MAG, recognizes in Article 6 the important contribution of small-scale artisanal fishing to the generation of employment, income, and food security. Hence the need for the State to appropriately manage the rights of fishermen and fisherwomen, adopting regulatory measures that favor the management and conservation of fishery resources in waters under national jurisdiction. Therefore, the Board of Directors,
1.—To approve the Creation of the Marine Area of Responsible Fishing 201 and its Fisheries Management Plan, in accordance with the information presented by the Research Department and submitted to the Board of Directors of INCOPESCA, under the terms and conditions, geographic coordinates, and zoning of the Marine Area of Responsible Fishing 201. (see Figure No. 3).
2.—The Management Plan (Plan de Ordenación) for the Marine Area of Responsible Fishing 201 is hereby incorporated into this agreement; however, the adoption of management, handling, and conservation measures must be generated, aimed at guaranteeing the restoration of fish populations and producing the maximum sustainable yield, in accordance with the recommendations of the Governance Committee of the Marine Area of Responsible Fishing (Comité de Gobernanza del Área Marina de Pesca Responsable) and the Research Department, within a period of 2 years to substitute gradually and progressively toward legal and sustainable fishing gear. At the same time, take into consideration the possibility of incorporating the fishing gear known as bolichero and nasas. The foregoing in accordance with the recommendations of the results report of the policy evaluation of fisheries and aquaculture in Costa Rica by the OECD Fisheries Committee.

4º-Corresponde al INCOPESCA como institución pública rectora de la pesca y la acuicultura en nuestro país, establecer medidas de ordenamiento para el aprovechamiento sostenible de los recursos hidrobiológicos, proteger áreas de reproducción, reclutamiento y alimentación, que favorezcan el incremento de las especies y el aumento de su biomasa, para garantizar la sostenibilidad del recurso.
5º-El Código de Conducta para la Pesca Responsable, Decreto Ejecutivo núm. 27919-MAG reconoce en su artículo núm. 6, la importante contribución de la pesca artesanal en pequeña escala a la generación de empleo, ingresos y seguridad alimentaria. De ahí la necesidad que el Estado gestione apropiadamente el derecho de los pescadores y pescadoras, adoptando medidas de regulación que favorezcan el manejo y conservación de los recursos pesqueros en las aguas de jurisdicción nacional, Por tanto, la Junta Directiva, Acuerda:
1º-Aprobar la Creación del Área Marina de Pesca Responsable 201 y su Plan de Ordenamiento Pesquero, de conformidad con la información presentada por el Departamento de Investigación y presentados ante la Junta Directiva del INCOPESCA, en los términos y condiciones, coordenadas geográficas y zonificación Área Marina de Pesca Responsable 201. (ver Figura número 3).
2º-Téngase por incorporado, el Plan de Ordenación del Área Marina de Pesca Responsable de 201, al presente acuerdo; sin embargo, se deberá generar la adopción de medidas de ordenamiento, manejo y conservación, tendientes a garantizar el restablecimiento de las poblaciones de peces y producir el máximo rendimiento sostenible de conformidad con las recomendaciones del Comité de Gobernanza del Área Marina de Pesca Responsable y el Departamento de Investigación, en un plazo de 2 años para sustituir de manera gradual y progresiva hacia las artes de pesca legales y sostenibles. Al mismo tiempo tomar en consideración la posibilidad de incorporar los artes de pesca denominados bolichero y nasas. Lo anterior en concordancia con las recomendaciones del informe de resultados de la evaluación de la política de la evaluación de la pesca y la acuicultura en Costa Rica por el Comité de la Pesca de OCDE.
