I.Whereas in Digital Supplement No. 87, of Monday, May 30, 2016, Executive Decree No. 39724-MOPT-MINAE-S was published, containing the "Regulation for the Control of Polluting Emissions Produced by Vehicles with Internal Combustion Engines," which replaced Executive Decree No. 28280 MOPT-MINAE-S, published in Supplement No. 97-A of the Official Gazette La Gaceta No. 236, of December 6, 1999, with the "Regulation for the Control and Technical Review of Polluting Gases Produced by Motor Vehicles."
II.Whereas despite the need to harmonize this matter with the scope of the Law on Transit on Land Public Roads and Road Safety, No. 9078, during its implementation process, some necessary technical amendments to the current regulation have been identified, which are being addressed by the Commission responsible for its update, so that the implementation of the Regulation is effective and due compliance can be achieved with the provisions of Article 50 of the Political Constitution.
III.Whereas by virtue of what is set forth in official communication DM-0638-2021 of July 2, 2021, signed by the Minister of Environment and Energy, in which it is estimated that the distribution of Euro 6 standard fuel may begin as of January 1, 2023, it becomes necessary to extend the effective date of Article 7, in order to provide legal certainty to the regulated parties.

I.Que en el Alcance digital N° 87, del lunes 30 de mayo del 2016, se publicó el Decreto Ejecutivo N° 39724 -MOPT-MINAE-S que contiene el "Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos con Motor de Combustión Interna" que sustituyó al Decreto Ejecutivo N° 28280 MOPT-MINAE-S, publicado en el Alcance N° 97-A del Diario Oficial La Gaceta N° 236, del 6 de diciembre de 1999, con el "Reglamento para el Control y Revisión Técnica de Gases Contaminantes Producidas por Vehículos Automotores".
II.Que a pesar de la necesidad de compatibilizar esta materia con los alcances de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, Nº 9078, en su proceso de implementación se han encontrado algunas reformas técnicas necesarias al reglamento vigente, que están siendo atendidas por parte de la Comisión encargada de su actualización, de manera que la puesta en práctica del Reglamento resulte eficaz, y se pueda cumplir debidamente con lo dispuesto en el Artículo 50 de la Constitución Política.
III.Que en virtud de lo expuesto en oficio DM-0638-2021 del 2 de julio de 2021, suscrito por la señora Ministra de Ambiente y Energía, en el que se estima que la distribución de combustible estándar Euro 6, podrá iniciarse a partir del primero de enero del año dos mil veintitrés, hace necesario extender el plazo de entrada en vigencia del artículo 7, con el fin de dar seguridad jurídica a los administrados.
Por lo tanto,
Reformar el Artículo 7 del Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos con Motor de Combustión Interna.
CONSIDERANDO:
Decretan:
A partir del primero de enero de 2027 entrará en vigor el estándar de emisiones EURO VI, TIER III o superior.
