in the entirety of the text - Complete Text of Regulation 43110 Declaration of public utility for state interests of the Association for the Protection of the Nandamojo River Basin No. 43110-MJP (This executive decree was repealed by Article 1 of Executive Decree No. 44618 of 5 March 2024) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Associations Law No. 218 of 8 August 1939 and Articles 27 et seq. of the Regulations to the Associations Law No. 29496-J, published in La Gaceta No. 96 of 21 May 2001, as well as the provisions of Article 3, subsection ch) of the Income Tax Law No. 7092 and Articles 103 and 104 of the Code of Tax Norms and Procedures No. 4755.
I.-That Article 32 of the Associations Law No. 218 of 8 August 1939 and its amendments grants the Executive Branch the power to declare of public utility simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State and thereby contribute to meeting a social need.
II.-That the Association for the Protection of the Nandamojo River Basin, legal entity identification number: 3-002-699237, was registered in the Associations Registry of the National Public Registry since 15 July 2015, volume 215 and entry 20963.
III.-That the purposes pursued by the association, according to its bylaws, are: "A) Protect the water resource, flora, and fauna of the Nandamojo River Basin through Environmental Education, as well as the dissemination of good land-use (uso de suelo) practices, as well as the promotion of sustainable economic activities and any other type of activity that facilitates the protection of Natural Resources in the basin and adjacent areas. B) Promote the spirit of righteousness, participation, solidarity, and responsibility of its members." IV.-That such purposes meet a first-order social need, for which reason they merit the support of the Costa Rican State. Therefore,

I.-Que el artículo 32 de la Ley de Asociaciones N° 218 de 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación para la Protección de la Cuenca del Río Nandamojo, cédula de persona jurídica número: 3-002-699237, se inscribió en el Registro de Asociaciones del Registro Público Nacional desde el día 15 de julio de 2015, tomo 215 y asiento 20963.
III.-Que los fines que persigue la asociación, según sus estatutos son: "A) Proteger el recurso hídrico, flora y fauna de la cuenca del Río Nandamojo a través de la Educación Ambiental, así como la divulgación de buenas prácticas de uso de suelo, así como el fomento de actividades económicas sostenibles y cualquier otro tipo de actividad que facilite la protección de los Recursos Naturales en la cuenca y las zonas adyacentes. B) Fomentar el espíritu de rectitud, participación, solidaridad y responsabilidad de sus asociados".
IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado costarricense. Por tanto,
