Climate Neutrality Strategy Phase II Cooperation Agreement with GermanyAcuerdo de Cooperación sobre Neutralidad Climática Fase II con Alemania

Honorable Madam:

I have the honor to address Your Excellency on the occasion of acknowledging receipt of your kind note N.V. No. 180/2019 dated October 20, 2019, which reads as follows:

"His Excellency Mr. Manuel Ventura Robles:

In compliance with the Convention on Technical Cooperation, concluded between our two Governments on July 23, 1965, as well as the Amendment Protocols of March 13, 1986, and December 18, 2006.

I have the honor to propose to Your Excellency, on behalf of the Government of the Federal Republic of Germany, the following additional Agreement on the project "Promotion of the climate neutrality strategy of Costa Rica as a low-carbon emission development model (Phase II)", within the framework of the International Climate Protection Initiative of the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety.

1. The Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica will jointly continue the promotion of the project "Promotion of the climate neutrality strategy of Costa Rica as a low-carbon emission development model (Phase II)", if, after examination, it continues to be eligible for support.

2. The project objective is to contribute to climate protection and sustainable development in the Republic of Costa Rica, through the promotion of measures for the mitigation of greenhouse gases.

3. The Government of the Federal Republic of Germany will provide additional human resources and will make additional material contributions and, if applicable, additional financial contributions for the project for a total amount of up to 1,000,000 euros (in words: one million euros).

It shall entrust the implementation to the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.

4. On behalf of the Government of the Republic of Costa Rica, the Ministry of Environment and Energy (MINAE) shall be responsible for the project implementation.

5. The details of the project and of the respective contributions and obligations shall be established in an implementation contract and, if applicable, a financing contract to be concluded between the GIZ and the institution to which the Government of the Republic of Costa Rica entrusts the project implementation, and which shall be subject to the legal provisions in force in the Federal Republic of Germany.

6. The commitment of the Government of the Federal Republic of Germany for the project shall be null and void if the implementation contract and, if applicable, the financing contract mentioned in paragraph 5, are not concluded within a period of four years, counting from the year of entry into force of this Agreement. For the amount in question, the period shall expire on December 31, 2023.

7. The Government of the Republic of Costa Rica shall exempt the materials, vehicles, goods, and equipment imported for the project on behalf and at the expense of the Government of the Federal Republic of Germany, as well as the respective supplies used for the project mentioned in paragraph 1, from all import and export duties, as well as licenses, port fees, storage charges, and other public levies, and shall ensure that they clear customs without delay.

8. The Government of the Republic of Costa Rica shall exempt the GIZ from all direct taxes accruing in the Republic of Costa Rica in connection with the conclusion and implementation of the implementation contract and, if applicable, the financing contract mentioned in paragraph 5.

9. The Government of the Republic of Costa Rica shall, at the request of the GIZ, reimburse the value-added tax or other similar indirect taxes that have been applied in the Republic of Costa Rica on items purchased and services used in connection with the conclusion and implementation of the implementation contract and, if applicable, the financing contract mentioned in paragraph 5. Special consumption taxes applied in this context shall be borne by the Government of the Republic of Costa Rica upon request.

10. This Agreement shall apply both to the project mentioned in paragraph 1 and to future follow-up measures with the same title in the event that our two Governments wish to continue the promotion of the project. The commitments of the Government of the Federal Republic of Germany regarding the granting of promotion for follow-up measures to the project mentioned in paragraph 1 shall be communicated by official communication from the Government of the Federal Republic of Germany, which will make explicit reference to this Agreement.

11. Moreover, the provisions of the Convention on Technical Cooperation of July 23, 1965, and the Amendment Protocols of March 13, 1986, and December 18, 2006, mentioned at the beginning, shall also apply to this Agreement.

12. This Agreement is concluded in German and Spanish, both texts being equally authentic.

In this regard, I have the honor to inform Your Excellency that the foregoing proposal is acceptable to the Government of Costa Rica and that Your Excellency's note and the present one constitute an Agreement between our Governments, which shall enter into force on the day the Government of the Republic of Costa Rica has communicated to the Government of the Federal Republic of Germany, through diplomatic channels, the fulfillment of the internal requirements necessary for the entry into force of this Exchange of Notes.

I take this opportunity to reiterate to Your Excellency the assurances of my highest and most distinguished consideration.

Should the Government of the Republic of Costa Rica declare its agreement with the proposals contained in paragraphs 1 to 12, this Note and the Note in response from Your Excellency expressing your Government's agreement shall constitute an Agreement between our Governments, which shall enter into force on the day the Government of the Republic of Costa Rica has communicated to the Government of the Federal Republic of Germany, through diplomatic channels, the fulfillment of the internal requirements necessary for the entry into force of this Exchange of Notes.

Tengo el honor de dirigirme a Su Excelencia, en ocasión de acusar recibo de su atenta nota N.V. Nº180/2019 de fecha 20 de octubre de 2019, que dice lo siguiente:

En cumplimiento del Convenio sobre Cooperación Técnica, concertado entre nuestros dos Gobiernos el 23 de julio de 1965, así como de los Protocolos de Enmienda del 13 de marzo de 1986 y del 18 de diciembre de 2006.

Tengo el honor de proponer a Vuestra Excelencia, en nombre del Gobierno de la República Federal de Alemania, el siguiente Acuerdo adicional sobre el proyecto "Fomento de la estrategia de neutralidad climática de Costa Rica como modelo de desarrollo bajo en. emisiones de carbono (Fase II)", en el marco de la Iniciativa Internacional de Protección del Clima del Ministerio Federal de Medio Ambiente, Protección de la Naturaleza y Seguridad Nuclear.

1. El Gobierno de la República Federal de Alemania y el Gobierno de la República de Costa Rica seguirán conjuntamente con e/ fomento del proyecto "Fomento de la estrategia de neutralidad climática de Costa Rica como modelo de desarrollo bajo en emisiones de carbono (Fase II)", si después de examinado, sigue resultando susceptible de apoyo.

2. El objetivo del proyecto es contribuir a la protección del clima y al desarrollo sostenible en la República de Costa Rica, a través del fomento de medidas para la mitigación de gases de efecto invernadero.

3. El Gobierno de la República Federal de Alemania facilitará recursos humanos adicionales y realizará prestaciones materiales adicionales y, si procede, aportaciones financieras adicionales para el proyecto por un monto total de hasta 1.000.000 euros (en letras: un millón de euros).

Confiará la ejecución a la Deutsche Gesellschaft für lnternafionale Zusammenarbeit (GIZ) GmbH.

4. Por parte del Gobierno de la República de Costa Rica será responsable de la ejecución del proyecto el Ministerio de Ambiente y Energía (MINAE).

5. Los detalles del proyecto y de las prestaciones y obligaciones respectivas se fijarán en un contrato de ejecución y, si procede, de financiación que habrá de ser concertado entre la GIZ y la Institución a la que el Gobierno de la República de Costa Rica encargue la ejecución del proyecto y que estará sujeto a las disposiciones legales vigentes en la República Federal de Alemania.

6. El compromiso del Gobierno de la República Federal de Alemania para el proyecto quedará sin efecto si el contrato de ejecución y, si procede, de financiación mencionado en el párrafo 5, no se concierta dentro de un plazo de cuatro años, contado a partir del año de la entrada en vigor del presente Acuerdo. Para el monto en cuestión el plazo concluirá el 31 de diciembre de 2023.

7. El Gobierno de la República de Costa Rica eximirá a los materiales, vehículos, bienes y equipos importados para el proyecto por encargo y a expensas del Gobierno de la República Federal de Alemania, así como a los respectivos repuestos que se utilicen para el proyecto mencionado en el párrafo 1, de todos los derechos de importación y exportación, así como de licencias, tasas portuarias, derechos de almacenaje y demás gravámenes públicos, y asegurará que pasen aduana sin demora.

8. El Gobierno de la República de Costa Rica eximirá a la GIZ de todos los impuestos directos que se devenguen en la República de Costa Rica en relación con la concertación y ejecución del contrato de ejecución y, si procede, de financiación mencionado en el párrafo 5.

9. El Gobierno de la República de Costa Rica reembolsará a solicitud de la GIZ el impuesto sobre el valor añadido u otros impuestos indirectos similares que hayan sido aplicados en la República de Costa Rica sobre objetos adquiridos y servicios utilizados en relación con la concertación y ejecución del contrato de ejecución y, si procede, de financiación mencionado en el párrafo 5. Los impuestos especiales al consumo que se hayan aplicado en este contexto serán asumidos por el Gobierno de la República de Costa Rica siguiendo una solicitud.

10. El presente Acuerdo se aplicará tanto al proyecto mencionado en el párrafo 1 como a futuras medidas de seguimiento con el mismo título en caso de que nuestros dos Gobiernos deseen continuar el fomento del proyecto. Los compromisos del Gobierno de la República Federal de Alemania relativos a la concesión de fomento respecto a medidas de seguimiento del proyecto mencionado en el párrafo 1 se transmitirán mediante comunicado oficial del Gobierno de la República Federal de Alemania en el que se hará referencia explícita al presente Acuerdo.

11. Por lo demás se aplicarán también al presente Acuerdo las disposiciones del Convenio sobre Cooperación Técnica del 23 de julio de 1965 y de los Protocolos de Enmienda del 13 de marzo de 1986 y del 18 de diciembre de 2006 mencionados al Inicio.

12. El presente Acuerdo se concierta en alemán y español, siendo ambos textos igualmente auténticos.

Sobre el particular, tengo el honor de informar a Su Excelencia que la propuesta anterior es aceptable al Gobierno de Costa Rica y que la nota de Su Excelencia y la presente constituyen un Acuerdo entre nuestros Gobiernos, que entrará en vigencia el día en que el Gobierno de la República de Costa Rica haya comunicado al Gobierno de la República Federal de Alemania, por la vía diplomática, el cumplimiento de los requisitos internos necesarios para la entrada en vigor del presente Canje de Notas.

Aprovecho la oportunidad para reiterar a Su Excelencia las seguridades de mi más alta y distinguida consideración.

12. El presente Acuerdo se concierta en alemán y español, siendo ambos textos igualmente auténticos.

En caso de que el Gobierno de la República: de Costa Rica se declare conforme con las propuestas contenidas en los párrafos 1 a 12, esta Nota y la Nota de respuesta de Vuestra Excelencia en la que conste la conformidad de su Gobierno constituirán un Acuerdo entre nuestros Gobiernos que: entrará en vigor el día en que el Gobierno de la República de Costa Rica haya comunicado al Gobierno de la República Federal de Alemania, por la vía diplomática, el cumplimiento de los requisitos internos necesarios para la entrada en vigor del presente Canje de Notas.

Aprovecho la ocasión para reiterar a Vuestra Excelencia, Sr. Manuel Ventura Robles el testimonio de mi más alta y distinguida consideración.
