Honorable Madam:
I have the honor to address Your Excellency, on the occasion of referring to your kind note Ref.: WZ468.40/15, dated 17 December 2020, which reads as follows:
"His Excellency Mr. Minister:
With reference to the letter of endorsement from the Ministry of Environment and Energy of the Republic of Costa Rica of 20 December 2019 and in compliance with the Convention on Technical Cooperation concluded between the Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica on 23 July 1965, in the wording of the Amending Protocols of 13 March 1986 and 18 December 2006, I have the honor to propose to Your Excellency, on behalf of the Government of the Federal Republic of Germany, the following Agreement on the project 'Scaling Up of Ecosystem-Based Adaptation Measures in Rural Areas of Latin America' within the framework of the International Climate Protection Initiative of the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety:
1. The Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica shall jointly promote the project 'Scaling Up of Ecosystem-Based Adaptation Measures in Rural Areas of Latin America' if, after examination, it is deemed eligible for support.
2. The objective of the project is to contribute to climate protection and sustainable development in the Republic of Costa Rica, the Republic of Ecuador, and the Republic of Guatemala through the promotion of measures for adaptation to the consequences of climate change.
3. The Government of the Federal Republic of Germany shall provide human resources and make material contributions and, where appropriate, financial contributions for the project in a total amount of up to 20,000,000 euros (in words: twenty million euros) for the three implementing countries.
It shall entrust the execution of the project to the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.
4. On behalf of the Government of the Republic of Costa Rica, the Ministry of Environment and Energy (MINAE) shall be responsible for the execution of the project.
5. The details of the project and of the respective contributions and obligations shall be set forth in an execution contract and, where appropriate, a financing contract to be concluded between GIZ and the institution to which the Government of the Republic of Costa Rica entrusts the execution of the project, and which shall be subject to the legal provisions in force in the Federal Republic of Germany.
6. The commitment of the Government of the Federal Republic of Germany for the project shall cease to have effect if the execution contract and, where appropriate, the financing contract mentioned in paragraph 5 are not concluded by 31 December 2024.
7. The Government of the Republic of Costa Rica shall exempt the materials, vehicles, goods, and equipment imported into Costa Rica for the project, on behalf of and at the expense of the Government of the Federal Republic of Germany, as well as the respective spare parts used for the project mentioned in paragraph 1, from all import and export duties, as well as from licenses, port fees, storage charges, and other public levies, and shall ensure their customs clearance without delay.
8. The Government of the Republic of Costa Rica shall exempt GIZ from all direct taxes accruing in the Republic of Costa Rica in connection with the conclusion and fulfillment of the execution contract and, where appropriate, the financing contract mentioned in paragraph 5.
9. The Government of the Republic of Costa Rica shall reimburse, upon GIZ's request, the value-added tax or similar indirect taxes that have been applied in the Republic of Costa Rica on objects acquired and services used in connection with the conclusion and fulfillment of the execution contract and, where appropriate, the financing contract mentioned in paragraph 5. Special consumption taxes that have been applied in this context shall be borne by the Government of the Republic of Costa Rica following a request.
10. This Agreement shall apply both to the project mentioned in paragraph 1 and to future follow-up measures under the same title, should our two Governments wish to continue promoting it. The commitments of the Government of the Federal Republic of Germany relating to the granting of support for follow-up measures of the project specified in paragraph 1 shall be conveyed by official communication from the Government of the Federal Republic of Germany, in which explicit reference shall be made to this Agreement.
11. Furthermore, the provisions of the above-specified Technical Cooperation Convention of 23 July 1965, in the wording of the Amending Protocols of 13 March 1986 and 18 December 2006, shall also apply to this Agreement.
12. This Agreement is concluded in German and Spanish, both texts being equally authentic.
In the event that the Government of the Republic of Costa Rica declares itself in agreement with the proposals contained in paragraphs 1 to 12, this Note and the Note in reply from Your Excellency stating your Government's agreement shall constitute an Agreement between our Governments, which shall enter into force on the date of receipt of the Note by which the Government of the Republic of Costa Rica communicates through diplomatic channels to the Government of the Federal Republic of Germany the fulfillment of the internal requirements necessary for the entry into force of this Agreement.
In this regard, I have the honor to inform Your Excellency that the foregoing proposal is acceptable to the Government of Costa Rica and that Your Excellency's note and this one constitute an Agreement between our Governments, which shall enter into force on the day on which the Government of the Republic of Costa Rica has communicated to the Government of the Federal Republic of Germany, through diplomatic channels, the fulfillment of the internal requirements necessary for the entry into force of this Exchange of Notes.
