(COMIECO-XCII) THE COUNCIL OF MINISTERS FOR ECONOMIC INTEGRATION
That in accordance with Articles 38, 39, and 55 of the Protocol to the General Treaty on Central American Economic Integration (Protocol of Guatemala), amended by the Amendment of February 27, 2002, the Council of Ministers for Economic Integration (COMIECO), has competence over matters of Central American Economic Integration and, as such, is responsible for approving the administrative acts applicable in the States Parties of the Economic Subsystem; That according to Articles 7 and 26 of the Protocol of Guatemala, the States Parties have agreed to establish a process of regional harmonization of technical regulations; That Article 15 of the Protocol of Guatemala, contains the commitment of the States Parties to build, among their territories, a Customs Union, which shall be achieved gradually and progressively, based on programs to be established for that purpose; That the bodies of the Economic Integration have reached consensus to establish the procedures for the control and inspection of shipments, merchandise, and agricultural inputs at the Quarantine Control Posts of the States Parties, for the fulfillment of the corresponding requirements, and have submitted them to consideration of this forum; That COMIECO may meet virtually through a videoconference system, in which case, it is the responsibility of the Secretariat for Central American Economic Integration (SIECA) to collect the signature of each of the Ministers or Vice-Ministers, as appropriate, in their respective country,

1. To approve the Procedure for the Control and Inspection of Shipments, Merchandise, and Agricultural Inputs at Quarantine Control Posts, in the form appearing in the Annex of this Resolution and which forms an integral part thereof.
2. This Resolution shall enter into force on October 27, 2021 and shall be published by the States Parties.

INTRODUCTION The Procedure for the Control and Inspection of Shipments, Merchandise, and Agricultural Inputs at Quarantine Control Posts (PCC) describes the harmonized actions to be carried out by the designated personnel to perform the control and inspection of shipments, merchandise, and agricultural inputs.
It contains instructions and forms to facilitate the control and inspection activities, as well as the documentation and record-keeping of all processes. It also includes technical references to complement information needs.
2. PURPOSE To establish the procedure for the control and inspection of shipments, merchandise, and agricultural inputs at the quarantine control posts of the States Parties, for the fulfillment of the determined requirements.
3. SCOPE OF APPLICATION It applies to shipments, merchandise, and agricultural inputs entering the territory of each State Party, within the framework of the competence of the sanitary and phytosanitary authorities.

5. DEFINITIONS For the purposes of this procedure, the definitions established in the regional regulations and guidelines, as well as by the International Reference Organizations - World Organisation for Animal Health (OIE), International Plant Protection Convention (IPPC) and Codex Alimentarius, according to their specialties, are considered. Other definitions used in the procedure are shown below:
5.1. Conditioning: set of activities necessary to make shipments, merchandise, and agricultural inputs suitable, provided it does not put at risk the sanitary and phytosanitary status of the States Parties.
5.2. Competent Authority: are the official technical entities responsible for the application of sanitary, phytosanitary, and control measures for agricultural inputs of each of the States Parties.
5.3. Entry Notice: Document issued by the competent authority of the importing State Party, containing the sanitary or phytosanitary requirements for merchandise or shipments, prior to arrival in its territory.
For agricultural inputs, it is the document containing the registration information in the importing State Party.
5.4. Chain of custody: documented procedure to guarantee the traceability and physical integrity of the sample of a shipment, merchandise, or agricultural input, from the taking of the sample to its reception at the laboratory.
5.5. Sanitary Certificate and Phytosanitary Certificate: official physical or electronic document, issued by the competent authority of the exporting or re-exporting country that certifies the sanitary or phytosanitary condition of the shipments or merchandise.
5.6. CITES: Convention on International Trade in Endangered Species of Wild Fauna and Flora.
5.7. Bill of lading (conocimiento de embarque): document of title representative of shipments, merchandise, and agricultural inputs, containing the contract entered into between the consignor and the carrier to transport them to the national territory and designates the consignee thereof.
5.8. Cargo manifest: document presented by the person responsible for transporting the merchandise, prior to or upon arrival or departure of the means of transport and which contains the required information.
5.9. Waybill: is the document containing a land transport contract in which is recorded the description of the shipments, merchandise, and agricultural inputs transported, the conditions under which the transport is carried out, and designates the consignee thereof.
5.10. Air waybill: document equivalent to the bill of lading, used in the air transport of merchandise, whereby the airline company acknowledges the fact of the loading of shipments, merchandise, or agricultural inputs and states the conditions of the agreed transport.
5.11. Seizure: confiscation of shipments, merchandise, and agricultural inputs carried out by the agricultural quarantine inspector, due to non-compliance with the requirements.
5.12. Pest diagnosis: process of detection and identification of a pest.
5.13. Laboratory tests: procedure used to classify a unit as positive or negative with respect to an infection or disease.
5.14. Diagnosis: is the result of specific laboratory tests performed on the samples.
5.15. Container or packaging: any receptacle or wrapping that contains shipments, merchandise, and agricultural inputs, that covers them totally or partially, and which includes packaging and wrappers.
5.16. Shipment: quantity of plants, plant products, and/or other articles that are moved from one country to another, and which are covered, if necessary, by a single phytosanitary certificate (the shipment may be composed of one or more commodities or lots).
5.17. Agricultural quarantine inspector: person authorized by the competent authority to enforce sanitary, phytosanitary, and agricultural input regulations.
5.18. Documentary verification: checking of documentation, whether physical or electronic, that supports the shipments, merchandise, and agricultural inputs, in order to guarantee that they meet the sanitary, phytosanitary, and food safety requirements.
5.19. Physical inspection: visual examination of shipments, merchandise, and agricultural inputs, to determine if there are pests or diseases and/or to determine compliance with sanitary, phytosanitary, food safety, and agricultural input regulations.
5.20. Regulated article: any plant, plant product, storage place, packing place, means of transport, container, soil, and any other organism, object, or material capable of harboring or spreading pests, which is considered that should be subject to phytosanitary measures, particularly in international transport.
5.21. Identity inspection: physical verification to ensure that the shipment, merchandise, or agricultural input corresponds to what is described in the documentation supporting the import.
5.22. Interception: detection of a pest or disease during the inspection or testing of a shipment, merchandise, or agricultural inputs.
5.23. Laboratory: specialized technical body, official, authorized, or delegated by the competent authority to carry out official diagnoses in sanitary, phytosanitary, food safety, and agricultural input matters.
5.24. Release of the shipment, merchandise, and agricultural input: official act by means of which the agricultural quarantine inspector has verified compliance with the regulations and procedures for the definitive entry of the shipment, merchandise, or agricultural inputs into the State Party.
5.25. Lot: set of units of a single product of animal or plant origin, identifiable by its homogeneous composition, origin, among others, that forms part of a shipment or merchandise.
5.26. Means of transport: any means used for the transport of persons, shipments, merchandise, and agricultural inputs.
5.27. Merchandise: designates live animals, products and by-products of animal origin, animal genetic material, biological products, animal feed, and pathological material.
5.28. Agricultural inputs: set of products or by-products of various origins that are used to improve animal health and feeding, plant nutrition and yield, as well as to prevent and combat pests and diseases.
5.29. Sample: quantity of material whose composition represents the totality of the products that make up a shipment, merchandise, or agricultural input, for laboratory analysis and diagnosis or other purposes.
5.30. Sampling: action of taking samples from a shipment, merchandise, or agricultural input.
5.31. MSF seal or stamp: numbered physical device used to secure shipments, merchandise, samples, and means of transport, when applicable.
5.32. Quarantine Control Post (PCC): official land, maritime, air, or river installation where the competent authority of the State Party carries out sanitary or phytosanitary control of shipments, merchandise, and agricultural inputs.
5.33. Rejection: measure that implies the prohibition of import, due to non-compliance with sanitary, phytosanitary, or agricultural input registration requirements.
5.34. Detention: sanitary or phytosanitary measure that implies the action of temporarily holding shipments, merchandise, and agricultural inputs, when they fail to comply with import requirements, pending the determination of the final measure to be applied.
5.35. Minimum data set: minimum information that must be contained in the forms or records that each State Party uses for the control and inspection procedure of shipments, merchandise, and agricultural inputs at quarantine control posts.
5.36. Quarantine Treatment: sanitary or phytosanitary measure applied to shipments, merchandise, and agricultural inputs with the purpose of eliminating or inactivating vectors, pests of quarantine concern and of economic concern when applicable.
6. AUTHORITY AND RESPONSIBILITY 6.1. The superior agricultural quarantine authority supervises compliance with this procedures document.
6.2. The head of the quarantine control post is the technical and administrative person responsible for the operation of the PCC.
6.3. The agricultural quarantine inspector at the PCC is responsible for applying and enforcing the procedures described in this document.

Responsibility The competent authorities of each of the States Parties are responsible for directing, planning, managing, organizing, supervising, evaluating, and monitoring the operation of the Quarantine Control Posts, taking into account the correct application of the inspection procedures for shipments, merchandise, and agricultural inputs.
9. MONITORING AND VERIFICATION The competent authorities of the States Parties shall verify that the procedures established in this manual are applied in a harmonized manner and that the PCC has the resources for its application.
10. REVIEW The sanitary and phytosanitary authorities of the States Parties are responsible for the annual review, or whenever necessary, of this procedure.

INS-02 INSTRUCTIONS FOR THE INSPECTION OF MEANS OF TRANSPORT 1. PURPOSE To describe the inspection procedure for means of transport, including containers, of agricultural shipments, goods, and inputs to prevent them from being pathways for the introduction of pests and diseases.
2. SCOPE OF APPLICATION It applies to the means that transport agricultural shipments, goods, and inputs by land, air, sea, and river that enter through the PCCs.
