in the entirety of the text - Complete Text of Norm 08 Officializes the educational centers subcategory of the Organizational Category of the Country Program for Carbon Neutrality MINISTRY OF ENVIRONMENT AND ENERGY No.-08-2021-MINAE THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers conferred by articles 50 and 148 of the Political Constitution; articles 2 subsection c), 6, and 49 of the Organic Law of the Environment No. 7554, of October 4, 1995; article 27 subsection 1), 28 subsection 2) paragraph a, and 240 of the General Law of Public Administration, No. 6227 of May 2, 1978; article 2 of the Organic Law of the Ministry of Environment and Energy, No. 7152 of June 5, 1990, the United Nations Framework Convention on Climate Change, Law No. 7414 of June 13, 1994; the Law Approving the Kyoto Protocol to the United Nations Framework Convention on Climate Change, No. 8219 of March 8, 2002; the Paris Agreement, Law No. 9405 of October 4, 2016; the Decree officializing the Action Plan of the National Climate Change Strategy, Decreto Ejecutivo No. 39114-MINAE of July 25, 2015; the Decree officializing the National Climate Change Adaptation Policy, Decreto Ejecutivo No. 41091 of April 20, 2018; the Decree officializing the Decarbonization Plan Commitment of the Bicentennial Government, Decreto Ejecutivo No. 41581 of February 24, 2019, and articles 42 and 43 of Decreto Ejecutivo No. 35669-MINAET of December 4, 2009, Organic Regulation of the Ministry of Environment and Energy.

1. 1That the country ratified the United Nations Framework Convention on Climate Change (UNFCCC).
2. 2That Costa Rica subscribed to the Sustainable Development Goals established in the United Nations 2030 Agenda, whose goal thirteen -Climate Action- calls for adopting urgent measures to combat climate change and its effects.
3. 3That Costa Rica signed and ratified the Paris Agreement through law number No. 9405 of October 4, 2016, and officialized its Nationally Determined Contribution (NDC).
4. 4That through Decreto Ejecutivo No. 41091-MINAE of April 20, 2018, the National Climate Change Adaptation Policy 2018-2030 was officialized.
5. 5That by means of Decreto Ejecutivo No. 41581-MINAE of February 24, 2019, the Decarbonization Plan Commitment of the Bicentennial Government was officialized.
6. 6That the Bicentennial National Development and Public Investment Plan (PNDIP) 2019-2022, issued through Decreto Ejecutivo No. 41848-MIDEPLAN of June 18, 2019, establishes management mechanisms applicable to climate action.
7. 7That Costa Rica is in the process of accession to the Organization for Economic Cooperation and Development (OECD), having to take actions for compliance with a set of legal instruments of said organization. In environmental matters, these legal instruments promote that member countries adopt international norms and standards, best practices, and policy guidelines regarding climate change, biodiversity, desertification, ecosystem deterioration, and water and air pollution.
8. 8That by means of Decreto Ejecutivo No. 42884-MINAE of March 4, 2021, the Country Program for Climate Leadership of the Climate Change Directorate of the Ministry of Environment and Energy was created, composed of the Country Programs for Carbon Neutrality and Climate Adaptation.
9. 9That article 5 of Decreto Ejecutivo No. 42884-MINAE of March 4, 2021, establishes the procedure for the creation and officialization of the categories and subcategories that make up the Country Programs for Carbon Neutrality and Climate Adaptation.

10.-That in compliance with said procedure, the Climate Change Directorate prepared the necessary documentation for the creation of the educational centers subcategory of the Organizational category of the Country Program for Carbon Neutrality, which it submitted for assessment and decision to the Minister of Environment and Energy.

11.-That once the documentation presented by the Climate Change Directorate was assessed, it was verified that it fully complies with the objectives and purposes of the Country Program for Carbon Neutrality. Therefore, AGREES:

TO OFFICIALIZE THE EDUCATIONAL CENTERS SUBCATEGORY OF THE ORGANIZATIONAL CATEGORY OF THE COUNTRY PROGRAM FOR CARBON NEUTRALITY

Considering:

en la totalidad del texto - Texto Completo Norma 08 Oficializa la subcategoría Centros Educativos de la Categoría Organizacional del Programa País para la Carbono Neutralidad MINISTERIO DE AMBIENTE Y ENERGÍA N°-08-2021-MINAE LA MINISTRA DE AMBIENTE Y ENERGÍA En uso de las facultades conferidas en los artículos 50 y 148 de la Constitución Política; artículos 2 inciso c), 6 y 49 de la Ley Orgánica del Ambiente N° 7554, del 04 de octubre de 1995; artículo 27 inciso 1), 28 inciso 2) acápite a y 240 de la Ley General de la Administración Pública, N° 6227 del 02 de mayo de 1978; artículo 2 de la Ley Orgánica del Ministerio de Ambiente y Energía, N° 7152 del 05 de junio de 1990, la Convención Marco de Naciones Unidas sobre el Cambio Climático, Ley N° 7414 del 13 de junio de 1994; la Ley de Aprobación del Protocolo de Kyoto de la Convención Marco de las Naciones Unidas sobre el Cambio Climático, N° 8219 del 08 de marzo de 2002; el Acuerdo de París, Ley N° 9405 del 04 de octubre de 2016; el Decreto que oficializa el Plan de Acción de la Estrategia Nacional de Cambio Climático, Decreto Ejecutivo N°39114-MINAE del 25 de julio de 2015; el Decreto que oficializa la Política Nacional de Adaptación al Cambio Climático, Decreto Ejecutivo N°41091 del 20 de abril de 2018; el Decreto que oficializa el Plan de Descarbonización Compromiso del Gobierno del Bicentenario, Decreto Ejecutivo N° 41581 del 24 de febrero de 2019 y los artículos 42 y 43 del Decreto Ejecutivo Nº 35669-MINAET del 04 de diciembre del 2009, Reglamento Orgánico del Ministerio de Ambiente y Energía.

1. 1Que el país ratificó la Convención Marco de Naciones Unidas sobre el Cambio Climático (CMNUCC).
2. 2Que Costa Rica suscribió los Objetivos de Desarrollo Sostenible establecidos en la Agenda 2030 de las Naciones Unidos, cuyo objetivo trece -Acción por el Clima- llama a adoptar medidas urgentes para combatir el cambio climático y sus efectos.
3. 3Que Costa Rica firmó y ratificó el Acuerdo de París mediante la ley número N° 9405 del 04 de octubre del 2016 y oficializó su Contribución Nacionalmente Determinada (NDC por sus siglas en inglés).
4. 4Que a través del Decreto Ejecutivo Nº41091-MINAE del 20 de abril de 2018, fue oficializada la Política Nacional de Adaptación al Cambio Climático 2018-2030.
5. 5Que por medio del Decreto Ejecutivo Nº 41581-MINAE del 24 de febrero de 2019, se oficializó el Plan de Descarbonización Compromiso del Gobierno del Bicentenario.
6. 6Que el Plan Nacional de Desarrollo y de Inversión Pública (PNDIP) del Bicentenario 2019-2022, emitido a través del Decreto Ejecutivo Nº41848-MIDEPLAN del 18 de junio de 2019, establece mecanismos de gestión aplicables a la acción climática.
7. 7Que Costa Rica se encuentra en proceso de adhesión a la Organización para la Cooperación y Desarrollo Económico (OCDE), debiendo tomar acciones para el cumplimiento de un conjunto de instrumentos legales de dicha organización. En materia ambiental estos instrumentos legales promueven que los países miembros adopten normas y estándares internacionales, mejores prácticas y directrices de política en materia de cambio climático, biodiversidad, desertificación, el deterioro de ecosistemas y la contaminación de aguas y aire.
8. 8Que por medio del Decreto Ejecutivo N°42884-MINAE del 4 de marzo de 2021, se creó Programa País para el Liderazgo Climático de la Dirección de Cambio Climático del Ministerio de Ambiente y Energía integrado por los Programas País de Carbono Neutralidad y de Adaptación Climática.
9. 9Que el artículo 5 del Decreto Ejecutivo N°42884- MINAE del 4 de marzo de 2021 establece el procedimiento para la creación y oficialización de las categorías y subcategorías que componen los Programas País de Carbono Neutralidad y de Adaptación Climática.

10.-Que en cumplimiento de dicho procedimiento, la Dirección de Cambio Climático elaboró la documentación necesaria para la creación de la subcategoría Centros Educativos de la categoría Organizacional del Programa País para la Carbono Neutralidad, la cual sometió a valoración y decisión de la Ministra de Ambiente y Energía.

11.-Que una vez valorada la documentación presentada por la Dirección de Cambio Climático, se constató que la misma cumple a cabalidad con los objetivos y fines del Programa País para la Carbono Neutralidad. Por tanto, ACUERDA:

OFICIALIZAR LA SUBCATEGORÍA CENTROS EDUCATIVOS DE LA CATEGORÍA ORGANIZACIONAL DEL PROGRAMA PAÍS PARA LA CARBONO NEUTRALIDAD

Considerando:
