Transitional 1.—Within a period of six months from the publication of this regulation, the Departamento de Planificación Urbana y Control Constructivo, jointly with the Catastro Department, must conduct an inventory of all the real estate belonging to the Municipality or registered on the Official Maps, describing the facilities or buildings that exist, as well as their state of conservation. Said list must be delivered to the Alcaldía Municipal, the Municipal Council, and the Municipal Audit Office.
Transitional 2.—Within a maximum period of fifteen business days from the effective date of this regulation, a meeting shall be convened for the representatives of the Comité Cantonal de La Cruz, Comités Comunales de Deportes, administrative boards (juntas administradoras), and all associations, social organizations, committees, or neighborhood groups that currently administer buildings, sports facilities, or any publicly used real estate owned by the Municipality, to make known to them the content of this regulation and its application. Said organizations shall have a maximum period of thirty business days from the date of the convening meeting to submit the application for the administration of the real estate of interest and to conform to the guidelines established in this regulation. In case of non-compliance with the provisions herein, the Municipality is fully empowered by law to intervene and act as established by the current legal framework.
Transitional 3.—Organizations that have agreements (convenios) in force as of January 31, 2021, may avail themselves of the provisions of this regulation by submitting a new application with all the requirements established herein. Otherwise, the current agreement (convenio) will expire on the expiration date provided for in it, and under no circumstances shall any extension apply. In cases where an agreement (convenio) does not have a planned end date, that is, it does not have an expiration period expressly stated in its text, they will be granted a period of 12 months of validity, on the understanding that they will be immediately notified of the date on which it will cease to have effect, along with the indication that, if they are interested in remaining in charge of the administration of the real estate, they must formulate the corresponding request, with the regulatory requirements of the new normative instrument, so that the signing of a new agreement (convenio) may be evaluated. The 12-month period takes effect from the corresponding notification. In the event that any real estate is being administered by any organization, group, or natural person, without the backing of an agreement (convenio), the conclusion of their participation shall be notified.
Transitional 4.—From the approval of this regulation, the respective administration agreements (convenios) for the sports facilities under the responsibility of the Comité Cantonal de Deportes y de Recreación de la Cruz must be signed before January 30, 2021.
This regulation repeals any other regulation that opposes it regarding the management of facilities, parks, community halls or other meeting centers, libraries, boulevards, buildings, and sports, recreational, and cultural facilities intended for the use of community spaces, for the development and practice of sports, recreation, culture, physical activity, tourism, and other similar or related Public Purposes existing in the canton of La Cruz de Guanacaste.
It becomes effective upon its publication in the Diario Oficial La Gaceta, published for the second time in the Diario Oficial La Gaceta in accordance with Article 43 of the Código Municipal.
