The Municipality of La Cruz and the Comité Cantonal de Deportes of La Cruz promote this Regulation based on the principles of accessibility, universality, equality, and social participation in preventive and restorative maintenance of sports for all strata of the Cruceña community, without distinction of sex, nationality, age, or social condition.

Any act contrary to the universal principles declared herein, or any act contrary to institutional policies or the intrinsic nature of community, sports, and public park facilities, the Municipal Council, through the corresponding procedure that guarantees the right to a defense in accordance with the law, shall terminate the contractual relationship. The procedure shall be governed and subject to the timeframes and procedures established in the Ley General de la Administración Pública.

Patrimonial real estate of the Municipality may not be subject to administration or exploitation by natural persons; it may only be ceded in administration solely to legally constituted legal persons.

All public domain property allocated or intended for the satisfaction of a specific public purpose or public service must have adequate maintenance and remain in a condition of absolute operability, be they: parks, community halls or other meeting centers, libraries, boulevards, sports, recreational, or cultural buildings and facilities.

The administration of the property cited above may be ceded through an agreement (convenio) authorized by the Municipal Council, with the Alcalde being responsible for verifying its compliance, as well as compliance with the standards established in this Regulation.

The administration of streets and roads under municipal jurisdiction shall correspond exclusively and excluyently to the Municipality.

Likewise, for reasons of timeliness and convenience, the Council may immediately arrange the temporary occupancy of such facilities to assist the inhabitants of the canton who have been affected by calamitous or unfortunate situations, during the period established by that Body.

To do so, they must meet the following requirements:

• a)Current Legal Identification Number (Cédula Jurídica).
• b)Current certification of their Legal Status (Personería Jurídica), with mention of the composition of their governing body, as well as certification that their minute books of the Board of Directors or Administration, assemblies, and members' ledger are legalized and up to date.
• c)Certification issued by a Certified Public Accountant (Contador Público Autorizado) or a Private Accountant (Contador Privado) that the general journal, general ledger, and inventory and balance sheet books are legalized and up to date, when the property is used for paid or income-generating purposes. The Municipal Audit Office shall review the books and attest that they meet the established requirements.
• d)In those cases of organizations that, by their nature and purposes, must register with other government entities other than the registry of associations of the National Registry (Registro Nacional), they must provide the corresponding certification issued by the competent institution, stating that the organization is duly registered, in effect, and authorized to operate.
• e)An administration and use plan (proyecto) for the real estate must be submitted, detailing, among other aspects, the objectives, the planned investment plan, as well as the maintenance, conservation, and improvements program or plan for the property.
• f)In case of renewal of the agreement (convenio), the organization must present a certification from an Audit Office that it has complied with the provisions of Article 10 of this Regulation.
• g)Submit a copy of the minutes of the assembly where it was agreed to request the renewal of the administration of the municipal real estate.
• h)Operating regulations for the property under administration.
• i)Be up to date with public treasury and Municipal taxes.

In those cases where several groups are interested in the administration of a municipal real estate property intended for public use, the Municipal Council shall refer the requests to the Comisión de Asuntos Sociales so that it may issue a recommendation report (dictamen) for awarding its administration, attending to the general interest, with express mention of the conditions and term within which the respective agreement (convenio) must be established. If the application for the administration of the real estate is made by only one organization, the Comisión de Asuntos Sociales shall review that it meets the required provisions and shall recommend its awarding to the Municipal Council.

Once the property is approved, this must be carried out within the fifteen business days following the finality of the Municipal agreement granting the administration of the property. The agreement (convenio) takes effect from the date the signatures are subscribed.

Before the start of the agreement (convenio), each organization must issue internal regulations for the use of the facilities ceded in administration, which shall be submitted for authorization by the Municipal Council. The regulations must be placed in a visible location within the facilities for the knowledge of the users of the real estate.

The organizations indicated in Article 4 above that administer real estate property of the Municipality must semi-annually, in the months of June and December of each year, submit an accounting and administration report on their management. Said reports shall be submitted to the Alcaldía Municipal, which, within a period of one month from receipt of said document, shall render a results report to the Council.

Unjustified failure to comply with this obligation shall be grounds for termination (resolución) of the administration agreement (convenio).

The administration and use of the municipal real estate may be ceded to third parties under their contractual responsibility with municipal supervision; the administering organizations may lease the real estate for holding occasional special events included within the administration plan, when these are promoted by private entities whose activity is for profit, or in the case of sports, cultural, religious, musical, and other events with a large concentration of people. Such events must be compatible or consistent with the use for which the real estate is intended and may in no way contravene morality, tranquility, public order, or good customs. The resources derived from the usufruct of the facilities under the administration of the beneficiary organizations may be applied to the payment of public services, maintenance, improvements, and construction of the same facilities, without the need for an agreement by the general assembly. Delivering a report with the original documentation to the Alcaldía Municipal for review, on the understanding that if inconsistencies are detected and verified, it shall be grounds for termination (resolución) of the administration agreement (convenio), after submission to due process.

Constructions by way of improvements made in the future shall become part of it and shall be considered an integral part of the municipal patrimony and therefore property of the Municipality of La Cruz de Guanacaste.

All real estate must have the necessary licenses and permits for its operation, issued by competent public entities. It must also have the necessary risk insurance policies that guarantee medical care and compensation for the users of the facilities, all of which the administering organization must timely process before the Alcaldía Municipal for the respective signing of the forms required to pay the corresponding amounts.

The organization that administers the municipal real estate shall deliver a set of keys to the building or facilities under administration to the Municipal Secretariat. In the event of a lock change, they must provide the new set of keys within a period of eight days. These keys shall be used in the justified case of a duly justified Emergency, and the administrator shall be notified through the usual means, which may be physical or electronic.

In accordance with the administration plan, the cessionary organization shall conduct an annual inventory, contemplating the movable property attached to the facilities, with an indication of any incidents that have occurred. The inventory document shall be forwarded to the Alcaldía Municipal of the Municipality in the month of November of the corresponding year, without prejudice to the Alcaldía's authority to order the taking and preparation of the inventory at the time this official deems pertinent.

Said list must be delivered to the Alcaldía Municipal, the Municipal Council, and the Municipal Audit Office.

Said organizations shall have a maximum period of thirty business days from the date of the convening meeting to submit the application for the administration of the real estate of interest and to conform to the guidelines established in this regulation. In case of non-compliance with the provisions herein, the Municipality is fully empowered by law to intervene and act as established by the current legal framework.

Otherwise, the current agreement (convenio) will expire on the expiration date provided for in it, and under no circumstances shall any extension apply. In cases where an agreement (convenio) does not have a planned end date, that is, it does not have an expiration period expressly stated in its text, they will be granted a period of 12 months of validity, on the understanding that they will be immediately notified of the date on which it will cease to have effect, along with the indication that, if they are interested in remaining in charge of the administration of the real estate, they must formulate the corresponding request, with the regulatory requirements of the new normative instrument, so that the signing of a new agreement (convenio) may be evaluated. The 12-month period takes effect from the corresponding notification. In the event that any real estate is being administered by any organization, group, or natural person, without the backing of an agreement (convenio), the conclusion of their participation shall be notified.

This regulation repeals any other regulation that opposes it regarding the management of facilities, parks, community halls or other meeting centers, libraries, boulevards, buildings, and sports, recreational, and cultural facilities intended for the use of community spaces, for the development and practice of sports, recreation, culture, physical activity, tourism, and other similar or related Public Purposes existing in the canton of La Cruz de Guanacaste.

It becomes effective upon its publication in the Diario Oficial La Gaceta, published for the second time in the Diario Oficial La Gaceta in accordance with Article 43 of the Código Municipal.

La Municipalidad de la Cruz y el Comité Cantonal de Deportes de la Cruz impulsan el presente Reglamento basándose en los principios de accesibilidad, universalidad, igualdad y participación social en mantenimiento preventivo y restaurador del deporte para todos los estratos de la comunidad cruceña, sin distingo de sexo, nacionalidad, edad o condición social.

Cualquier contrario a los principios universales aquí declarados, o cualquier acto contrario a las políticas institucionales o naturaleza propia con el giro de las instalaciones comunales, deportivas y parques públicos, será el Concejo Municipal, y mediante el correspondiente procedimiento que garantice el derecho de defensa conforme a la ley, dará por concluida la relación contractual. El procedimiento estará regido y sujeto a los plazos y procedimientos establecidos en la Ley General de la Administración Pública.

No podrán ser objeto de administración o Municipalidad; únicamente podrán ser cedidos en administración únicamente a personas jurídicas legalmente constituidas.

Todos los bienes de dominio público afectados o destinados a la satisfacción de un fin o un servicio público específico deben tener un mantenimiento adecuado y permanecer en condiciones de absoluta operabilidad, sean estos: parques, salones comunales u otros centros de reunión, bibliotecas, bulevares, edificios e instalaciones deportivas, recreativas o culturales.

La administración de los bienes citados supra podrá ser cedida mediante convenio autorizado por el Concejo Municipal, correspondiendo al Alcalde la verificación de su cumplimiento, así como de las normas establecidas en el presente Reglamento.

La administración de las calles y caminos de competencia municipal corresponderá en forma exclusiva y excluyente a la Municipalidad.

De igual forma, por razones de oportunidad y conveniencia el Concejo podrá disponer de inmediato la ocupación temporal de tales instalaciones para auxiliar a los habitantes del cantón que hayan sido afectados por situaciones de calamidad o infortunio, durante el lapso que ese Órgano establezca.

Para ello deberán cumplir con los siguientes requisitos:

• a)Cédula Jurídica vigente.
• b)Certificación vigente de su Personería Jurídica, con mención de la composición de su órgano administrador, así como certificación de que sus libros de actas de Junta Directiva o Administrativa, de asambleas y libro de asociados se encuentren legalizados y al día.
• c)Certificación extendida por Contador Público Autorizado o Privado de que los libros de diario, mayor e inventario y balances se encuentren legalizados y al día, cuando sean bienes utilizados con fines remunerados o de generación de ingresos. La Auditoría Municipal revisará los libros y dará fe que cumplen con los requerimientos establecidos.
• d)En aquellos casos de organizaciones que por su naturaleza y fines deben inscribirse ante otras instancias gubernamentales diferentes del registro de asociaciones del Registro Nacional, deberán aportar la certificación correspondiente expedida por la institución competente en la cual se haga constar que la organización se encuentra debidamente inscrita, vigente y autorizada para su funcionamiento.
• e)Se deberá presentar un proyecto de administración y uso del inmueble en el cual se detallará entre otros aspectos los objetivos, el plan de inversión previsto, así como el programa o plan de mantenimiento, conservación y mejoras del bien.
• f)En caso de renovación de convenio, la organización deberá presentar certificación de Auditoría, que ha cumplido con lo estipulado por el artículo 10 de este Reglamento.
• g)Presentar copia del acta de la asamblea donde se acordó solicitar la renovación de la administración del inmueble municipal.
• h)Reglamento de funcionamiento del bien en administración.
• i)Estar al día con los tributos de hacienda pública y Municipales.

En aquellos casos que sean varias agrupaciones interesadas en la administración de un bien inmueble municipal destinado al uso público, el Concejo Municipal referirá las peticiones a la Comisión de Asuntos Sociales para que ésta presente dictamen de recomendación de adjudicación de su administración, atendiendo al interés general haciendo mención expresa de las condiciones y plazo en que deberá establecerse el convenio respectivo. En caso de que la solicitud de la administración del bien inmueble la realice solamente una organización la Comisión de Asuntos Sociales revisará que cumpla con los requerimientos previstos y recomendará al Concejo Municipal su adjudicación.

Lo anterior deberá una vez aprobado el bien realizarse dentro de los quince días hábiles siguientes a la firmeza del acuerdo Municipal de otorgamiento de la administración del bien. El convenio rige a partir de la fecha en que se dé la suscripción de las firmas.

Antes del inicio del convenio, cada organización deberá dictar un reglamento interno para el uso de las instalaciones cedidas en administración, el cual será sometido a la autorización del Concejo Municipal. El reglamento deberá ser colocado en un lugar visible dentro de las instalaciones para conocimiento de los usuarios del inmueble.

Las organizaciones indicadas en el artículo 4º anterior que administren inmuebles propiedad de la Municipalidad, deberán rendir semestralmente en los meses de junio y diciembre de todos los años, un informe contable y de administración sobre su gestión. Dichos informes se presentarán ante la Alcaldía Municipal, la que, dentro del término de un mes contado a partir del recibo de dicho documento, rendirá un informe de resultados al Concejo.

El incumplimiento injustificado de esta obligación será causal de resolución del convenio de administración.

La administración y el uso de los bienes inmuebles municipales podrán ser cedidos a terceros bajo su responsabilidad contractual con la supervisión municipal, las organizaciones administradoras podrán arrendar el inmueble para la realización de eventos especiales ocasionales incluidos dentro del plan de administración, cuando estos sean promovidos por entidades privadas cuya actividad tenga como objetivo el lucro o en el caso de eventos deportivos, culturales, religiosos, musicales, y otros de gran concentración de personas. Tales eventos deberán ser compatibles o conformes con el uso al que se encuentra destinado el inmueble y de ninguna forma podrán contravenir la moral, la tranquilidad, el orden público o las buenas costumbres. Los recursos que provengan del usufructo de las instalaciones bajo la administración de las organizaciones beneficiarias, podrán ser aplicados para el pago de servicios públicos, al mantenimiento, mejoras y construcción de las mismas instalaciones, sin necesidad de acuerdo de la asamblea general. Entregando un informe con la documentación en original, a la Alcaldía Municipal para su revisión, en el entendido que si se detecta y comprueba inconsistencias será causal de resolución del convenio de administración previo sometimiento del debido proceso.

Las construcciones por mejoras que en el futuro se realicen pasarán a formar parte de ésta y se tendrá como parte integrante del patrimonio municipal y por tanto propiedad de la Municipalidad de La Cruz de Guanacaste.

Todo inmueble deberá contar con las licencias y permisos necesarios para su funcionamiento extendidos por entidades públicas competentes, así mismo deberá contar con las pólizas de seguros de riesgo necesarias que garanticen la asistencia médica e indemnización para los usuarios de las instalaciones, todo lo cual deberá gestionar oportunamente la organización administradora ante la Alcaldía Municipal para su respectiva rubricación de los formularios que se requieran para cancelar los importes del caso.

La organización que administre los inmuebles municipales, entregará un juego de llaves del edificio o instalaciones en administración, en la Secretaría Municipal. En caso de que se dé un cambio de llavín, deberán en un plazo de ocho días aportan el nuevo juego de llaves. Estas llaves se utilizarán en caso justificado de una Emergencia debidamente justificada y se le comunicará al administrador mediante los medios usuales pudiendo ser físicos o electrónicos.

Conforme al plan de administración la organización cesionaria realizará un inventario anual contemplando los bienes muebles adscritos a las instalaciones con indicación de las incidencias presentadas. El documento de inventario será remitido a la Alcaldía Municipal de la Municipalidad en el mes de noviembre del año que corresponda, sin perjuicio de que la Alcaldía pueda ordenar el levantamiento y confección del inventario en relación en el momento en que este funcionario lo juzgue pertinente.

Dicha lista debe entregarse a la Alcaldía Municipal, Concejo Municipal y la Auditoria Municipal.

Dichas organizaciones dispondrán de un plazo máximo de treinta días hábiles a partir de la fecha de convocatoria para realizar la solicitud de administración del bien inmueble de interés y ajustarse a los lineamientos establecidos reglamentariamente. En caso de no acatarse lo aquí dispuesto, la Municipalidad queda facultada de pleno derecho para intervenir y actuar según lo establezca el marco jurídico vigente.

En caso contrario, el convenio vigente expirará en la fecha de vencimiento prevista en el mismo, y en ningún caso operará prórroga alguna. En los casos en que un convenio no tuviere fecha de finalización prevista, o sea que no tiene plazo de expiración expresamente señalado en su texto, se les otorgará un plazo de 12 meses de vigencia, en el entendido de que de inmediato serán notificados de la fecha en que quedará sin efecto, junto con la indicación de que, en caso de tener interés en mantenerse a cargo de la administración del inmueble, deberán formular la gestión correspondiente, con los requisitos reglamentarios del nuevo instrumento normativo, para que se valore la suscripción de un nuevo convenio. El plazo de 12 meses rige a partir de la notificación correspondiente. En caso de que algún inmueble estuviere siendo administrado por alguna organización, grupo o persona física, sin respaldo en un convenio, se notificará la conclusión de su participación.

El presente reglamento deroga cualquier otro que se le oponga en cuanto a manejo de instalaciones parques, salones comunales u otros centros de reunión, bibliotecas, bulevares, edificios e instalaciones deportivas, recreativas, culturales destinados al uso de los espacios comunales, para el desarrollo y práctica del deporte, la recreación, la cultura, actividad física, el turismo, y a otras similares o afines con fines Públicos existentes en el cantón de la Cruz de Guanacaste.

Rige a partir de su publicación en el Diario Oficial La Gaceta, publicado por segunda vez en el Diario Oficial La Gaceta de conformidad con el artículo 43 del Código Municipal.
