I.That on August 09, 2017, Executive Decree No. 40548-MINAE was issued, called "Regulation to the Wildlife Conservation Law."
II. That clause 16 of Article 4 of Decree No. 40548-MINAE, Regulation to the Wildlife Conservation Law, defines
" (.)
16. Threatened species or species with reduced populations: Species or subspecies of wild fauna or flora, or their populations, that are likely to become an endangered species in the foreseeable future, in all or part of their areas of distribution, if the factors causing their numerical decline or the degradation of their habitat continue to occur, or very thinly scattered over more extensive distribution areas, and are in real or potential possibilities of being subject to a decline and possible danger of extinction.

19. Species in danger of extinction: Species of wild fauna or flora with populations reduced to a critical level or whose habitat has been reduced to such a point that it affects its long-term genetic viability, which has been included in the list made official by MINAE or by a resolution based on technical criteria, in international red lists, or in international agreements.

III.That through Article 6 of the Regulation to the Wildlife Conservation Law it is defined: "Wildlife species in danger of extinction and with reduced or threatened populations under a ban. For the purposes of Article 14 of the LCVS and of this Regulation, wildlife species in danger of extinction, with reduced or threatened populations, are considered to be those included in the taxa that will be made official via administrative resolution, which will be reviewed by SINAC every four years. Likewise, SINAC, with the support of the National Wildlife Commission, will establish the Protocol with the mechanisms and procedures for the review of the lists."
IV.That individuals of those species found within the limits of the Costa Rican State and which are included in the appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), the Convention on Migratory Species (CMS), and the Red List of the International Union for Conservation of Nature (UICN), are considered part of these lists.
V.That Article 22 of the Biodiversity Law No. 7788 of April 30, 1998, creates the Sistema Nacional de Áreas de Conservación (hereinafter SINAC) as a deconcentrated and participatory body that integrates competencies in forestry matters, wildlife, protected wild areas, and conservation of the use of hydrographic basins and water systems, in order to dictate policies, plan, and execute processes aimed at achieving the sustainability of natural resources.
VI.That the obligations derived from the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), ratified by Law No. 5605 of October 30, 1974, are exercised by SINAC as the administrative authority, in accordance with Article 71 of the Wildlife Conservation Law.
VII.By Agreement No. 08 taken in ordinary session in ordinary session No. 01-2021 of the Consejo Nacional de Áreas de Conservación, held on January 12, 2021, this resolution is issued. Therefore,
