in the entirety of the text - Complete Text of Norm 090 Approves closed season for the year 2021 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/090-2021.—Puntarenas, on the fourteenth day of the month of April, two thousand twenty-one.
1º—The technical reports DDI-012-02-2019, DDI-073-08-2019, and Technical Document No. 24 "Reproductive Season of the Queen Croaker Cynoscion albus, Aguada C. squamipinnis, and Picuda C. phoxocephalus, Species of High Commercial Interest in the Inner Zone of the Gulf of Nicoya, Pacific Slope, Costa Rica, April 2019" are accepted; issued by the Research and Development Department, a proposal for a total closed season in the Gulf of Nicoya for fishing during the year 2021 is submitted.
2º—There are scientific studies issued by Rodríguez, Palacios, and Chavarría (1989) where they reported that the sardines Opisthonema medirastre and Opisthonema bulleri spawn throughout the entire year in the Gulf of Nicoya, with maturation peaks for O. medirastre between January and April and for O. bulleri between April and June. Rodríguez, Palacios, and Chavarría (1986). This indicates that these species may be maturing asynchronously. Vega Corrales (2010a, 2010b) recommended that the closed season for sardines of the genus Opisthonema in the Gulf of Nicoya be implemented during the time of maximum reproduction to protect the spawning biomass (February–May) and another closed season in October to protect the virgin biomass.
3º—The proposal for a total closed season in the Gulf of Nicoya for fishing during the year 2021 is presented for study and assessment.
4º—Once the proposal was discussed and analyzed by the Directors, the Board of Directors, Therefore; AGREES 1º—To approve the closed season proposal for the year 2021, under the following terms and conditions:
1.1. To establish a total closed season for fishing, in the area comprised by an imaginary straight line running from Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Lighthouse of Isla Negritos offshore (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from that line inland waters up to the mouth of the Tempisque River. This fishing prohibition runs from June 1 to August 31, 2021, both dates inclusive.
1.2. In this closed area, it is recommended that those fishers whose fishing license allows them to operate in said zone be authorized to specifically carry out fishing for barracudas or candado (Sphyraena ensis), using only handline and during the months of June, July, and August 2021.
1.3. Taking into account the maturation peaks of the sardine species Opisthonema medirastre, Opisthonema bulleri, and O. libertate, to allow fishing by vessels of the semi-industrial sardine fleet only twice a week into the closed zone to conduct fishing operations for a maximum period of 12 hours each, during the daytime period, for the capture of sardines. The Monitoring, Control, and Surveillance Center will ensure compliance with this provision.
1.4. The extraction of pianguas (Anadara spp.) is not included in this closed season. The cultivation of marine organisms carried out in the Gulf of Nicoya is not subject to this closed season.
1.5. Considering the difficult socioeconomic situation of the coastal communities due to the issue of COVID-19, as long as the national state of emergency is in effect, fishing for domestic consumption is exempted, and therefore permitted, in the zone referred to in point 1 of this agreement during the present closed season. Those who choose to carry out this fishing activity must comply with the regulations as established by Board of Directors agreement AJDIP-511-2017.
1.6. The Board of Directors of INCOPESCA, taking into account the national emergency and the socioeconomic consequences thereof, may review the scope of the present closed season in order to ensure food security and social well-being.
1.7. To carry out the pertinent coordination among INCOPESCA, SENASA, and the Ministry of Public Security, in order to guarantee control and surveillance operations during the closed season period.
1.8. The map attached in the table below shall be considered an integral part of this Agreement:

Considering:
en la totalidad del texto - Texto Completo Norma 090 Aprueba veda para el año 2021 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/090-2021.-Puntarenas, a los catorce días del mes de abril de dos mil veintiuno.
1º-se acogen informes técnicos DDI-012-02-2019, DDI- 073-08-2019 y Documento Técnico Nº 24 "Época Reproductiva de La Corvina Reina Cynoscion albus, Aguada C. squamipinnis y Picuda C. phoxocephalus, Especies de Alto Interés Comercial en la Zona Interior del Golfo de Nicoya, Vertiente del Pacífico, Costa Rica, abril 2019"; emitidos por el Departamento de Investigación y Desarrollo, se remite propuesta de veda total en el Golfo de Nicoya, para la pesca durante el año 2021.
2º-Se cuenta con estudios científicos emitidos por Rodríguez, Palacios y Chavarría (1989) donde reportaron que las sardinas Opisthonema medirastre y Opisthonema bulleri desovan a lo largo de todo el año en el Golfo de Nicoya, con picos de maduración para O. medirastre entre enero y abril y para O. bulleri entre abril y junio. Rodríguez, Palacios y Chavarría (1986). Lo que indica que estas especies podrían estar madurando de manera asincrónica. Vega Corrales (2010a, 2010b) recomendó que la veda de sardinas del género Opisthonema en el Golfo de Nicoya se implementara en la época de máxima reproducción para proteger la biomasa desovante (febrero-mayo) y otra veda en octubre para proteger la biomasa virgen.
3º-Se presenta para estudio y valoración la propuesta de veda total en el Golfo de Nicoya, para la pesca durante el año 2021.
ACUERDA 1º-Aprobar la propuesta de veda para el año 2021, en los siguientes términos y condiciones:
1.1. Establecer una veda total para la pesca, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de esa línea aguas adentro hasta la desembocadura del río Tempisque. Esta prohibición de pesca va desde el 01 de junio hasta el 31 de agosto del 2021, ambas fechas incluidas.
1.2. En esta área vedada, se recomienda se autorice para aquellos pescadores cuya licencia de pesca les permita faenar en dicha zona para realizar de manera específica la pesca de barracudas o candado (Sphyraena ensis), utilizando únicamente cuerda de mano y durante los meses junio, julio y agosto del 2021.
1.3. Tomando en cuenta los picos de maduración de las especies de sardina Opisthonema medirastre, Opisthonema bulleri y O. Libertate, permitir la pesca de las embarcaciones de la flota semiindustrial de sardina, únicamente dos veces a la semana a la zona vedada para realizar faenas de pesca por un periodo de 12 horas máximo cada uno en la franja diurna, para la captura de sardina. En Centro de Seguimiento Control y Vigilancia velará por el cumplimiento de esta disposición.
1.4. En esta veda no se incluye la extracción de pianguas. Los cultivos de organismos marinos que se desarrollan en el Golfo de Nicoya no están sujetos a esta veda.
1.5. Tomando en consideración la difícil situación socioeconómica de las comunidades costeras por el tema del COVID-19, en el tanto este vigente el estado de emergencia nacional se exceptúa y por ende se permitirá en la zona comprendida en el punto 1 de este acuerdo, la pesca para el consumo doméstico durante la presente veda. Quienes opten por realizar esta pesca, deberán cumplir con la normativa según lo establecido por el acuerdo de Junta Directiva AJDIP-511-2017.
1.6. La Junta Directiva del INCOPESCA, tomado en cuenta la emergencia nacional y las consecuencias socioeconómicas de la misma, se podrá revisar los alcances de la presente veda con el fin de asegurar la seguridad alimentaria y bienestar social.
1.7. Realizar las coordinaciones pertinentes entre el INCOPESCA, SENASA y el Ministerio de Seguridad Pública, con el fin de garantizar los operativos de control y vigilancia durante la época de veda.
1.8. Téngase como parte integral del presente Acuerdo, el mapa que se anexa en el cuadro siguiente:
