in the entirety of the text - Complete Text of Norm 42551 Declaration of Public and National Interest of the World Hydropower Congress, called "Renewable energies working together in an interconnected world" Complete Text record: 140775 N° 42551-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers conferred in Articles 50, 140 subsections 3), 18) and 20) and 146 of the Political Constitution; Articles 25 subsection 1), 27 subsection 1), 28 subsection 2) subparagraph b) and 113 of the General Law of Public Administration N° 6227 of May 2, 1978; numerals 12 and 13 of the Organic Law of the Environment N° 7554 of October 4, 1995; Article 11, subsection 3) of the Biodiversity Law N° 7788 of April 30, 1998; and the Law of Creation of the Instituto Costarricense de Electricidad N° 449 of April 8, 1949.
I.-That it is the responsibility of the Ministry of Environment and Energy to promote and publicize energy policies in which the State, civil society, public and private enterprise participate, that incentivize the production of energy from non-conventional renewable sources.
II.-That the Organic Law of the Environment N° 7554 indicates that the utilization of energy resources must be carried out in a rational and efficient manner, this with the purpose of guaranteeing the conservation and protection of the environment and fostering sustainable economic development.
III.-That the Law of Creation of the Instituto Costarricense de Electricidad (ICE), N° 449, establishes in its Article 2, subsections c) and e), among the purposes of the ICE, the rational development of the physical energy-producing sources that the country possesses, among them hydraulic resources and the utilization of hydroelectric energy.
IV.-That as a framework for the celebration of the Bicentennial of the Independence of Costa Rica, the World Hydropower Congress, called "Renewable energies working together in an interconnected world", will be held in the country, organized by the International Hydropower Association (IHA) on the 20th, 21st, 22nd, 23rd, 24th and 25th of September of the year 2021, which has the backing of the following institutions: a) Instituto Costarricense de Electricidad (ICE), b) Ministry of Environment and Energy (MINAE), c) Ministry of Foreign Affairs and Worship, d) Instituto Costarricense de Turismo (ICT), e) the Promotora de Comercio Exterior de Costa Rica (PROCOMER), f) the Instituto Nacional de Seguros (INS) and g) the Instituto de Acueductos y Alcantarillados (AyA).
V.-That the World Hydropower Congress, called "Renewable energies working together in an interconnected world", is of importance for the country because it provides an ideal space for raising awareness among Governments, International Organizations, Financial Institutions, Research Institutes, Non-Governmental Organizations and Industry, of the possibility of decarbonizing a country's electricity matrix; through a combination of different renewable sources, as is the case of Costa Rica's electricity matrix.
VI.-That, in accordance with the Regulation to the Law for the Protection of the Citizen from Excessive Requirements and Administrative Procedures, Executive Decree N° 37045-MP-MEIC and its amendments, it was determined that the present proposal does not establish or modify procedures, requirements or formalities that the administered party must comply with, a situation for which the prior control procedure was not carried out. Considering:
The World Hydropower Congress called "Renewable energies working together in an interconnected world" is declared of public and national interest, to be held on the 20th, 21st, 22nd, 23rd, 24th and 25th of September of 2021, under the coordination of the Instituto Costarricense de Electricidad.
The aforementioned Congress will be comprised of the following activities:
With the purpose of achieving the success of this activity, national institutions, public and private, as well as other organizations, shall provide, to the extent of their possibilities and within the respective legal framework, the collaboration and assistance within their reach for the holding of the activity, without prejudice to their own objectives.
Public institutions shall carry out the duties corresponding to them according to their legal competencies - without prejudice to their own objectives - and that are conducive to the success of the activities associated with the holding of the World Hydropower Congress called "Renewable energies working together in an interconnected world".
That in accordance with Executive Decree N° 40540-H called "Fiscal Contingency" and its amendments, this declaration does not imply any granting of fiscal benefits, such as exemptions.
It enters into force upon its publication in the Official Gazette La Gaceta.

I.-Que le corresponde al Ministerio de Ambiente y Energía, promover y promocionar las políticas energéticas en las cuales participe el Estado, la sociedad civil, la empresa pública y privada, que incentiven la producción de energía a partir de fuentes renovables no convencionales.
II.-Que la Ley Orgánica del Ambiente N° 7554, indica que el aprovechamiento de los recursos energéticos deberá realizarse en forma racional y eficiente, esto con el fin de garantizar la conservación y protección del ambiente y propiciar un desarrollo económico sostenible III.-Que la Ley de Creación del Instituto Costarricense de Electricidad (ICE), N° 449, establece en su artículo 2, incisos c) y e), dentro de las finalidades del ICE, el desarrollo racional de las fuentes productoras de energía física que posee el país, entre ellas los recursos hidráulicos y el aprovechamiento de la energía hidroeléctrica.
IV.-Que como marco de la celebración del Bicentenario de la Independencia de Costa Rica, se celebrará en el país el Congreso Mundial de Hidroelectricidad, denominado "Las energías renovables trabajando de forma conjunta en un mundo interconectado", organizado por la Asociación Internacional de Hidroelectricidad (IHA por sus siglas en inglés) los días 20, 21, 22, 23, 24 y 25 de setiembre del año 2021, que cuenta con el respaldo de las siguientes instituciones: a) Instituto Costarricense de Electricidad (ICE), b) Ministerio de Ambiente y Energía (MINAE), c) Ministerio de Relaciones Exteriores y Culto, d) Instituto Costarricense de Turismo (ICT), e) la Promotora de Comercio Exterior de Costa Rica (PROCOMER), f) el Instituto Nacional de Seguros (INS) y g) el Instituto de Acueductos y Alcantarillados (AyA).
V.-Que el Congreso Mundial de Hidroelectricidad, denominado "Las energías renovables trabajando de forma conjunta en un mundo interconectado", resulta de importancia para el país por brindar un espacio ideal para la concientización de los Gobiernos, Organizaciones Internacionales, Instituciones Financieras, Institutos de Investigación, Organizaciones no Gubernamentales e Industria, de la posibilidad de la descarbonización de la matriz eléctrica de un país; por medio de una combinación de diferentes fuentes renovables, tal es el caso de la matriz eléctrica de Costa Rica.
VI.-Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano de Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se precedió con el trámite de control previo. Considerando:
Decretan:
Se declara de interés público y nacional el Congreso Mundial de Hidroelectricidad denominado "Las energías renovables trabajando de forma conjunta en un mundo interconectado" a celebrarse los días 20, 21, 22, 23, 24 y 25 de setiembre de 2021, bajo la coordinación del Instituto Costarricense de Electricidad.
El citado Congreso estará conformado por las siguientes actividades:
Con el propósito de lograr el éxito de esta actividad, las instituciones nacionales, públicas y privadas, así como demás organizaciones, brindarán en la medida de sus posibilidades y dentro del marco jurídico respectivo, la colaboración y facilidades que estén a su alcance para la realización de la actividad, sin perjuicio de sus propios objetivos.
Las instituciones públicas realizarán las tareas que les corresponda según sus competencias legales - sin perjuicio de sus propios objetivos - y que sean coadyuvantes en el éxito de las actividades asociadas a la realización del Congreso Mundial de Hidroelectricidad denominado "Las energías renovables trabajando de forma conjunta en un mundo interconectado".
Que de conformidad con el Decreto Ejecutivo N° 40540-H denominado "Contingencia Fiscal" y sus reformas, la presente declaratoria no implica ningún otorgamiento de beneficios fiscales, tales como exoneraciones.
Rige a partir de su publicación en el Diario Oficial La Gaceta.
