the entire text - Full Text of Regulation 42642 Declares a property registered in the Province of Guanacaste as the Cerritos experimental farm for the conservation of ecosystems and species of the tropical humid forest Full Text of record: 14014C N° 42642-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), 28 subsection 2) paragraph b), 154 of the General Public Administration Law, N° 6227 of May 2, 1978; article 46 of the Organic Environmental Law, N° 7554 of October 4, 1995; articles 7, 22, 49, and 53 of the Biodiversity Law, N° 7788 of April 30, 1998; article 8, subsections c), d), and f), of the Convention on Biological Diversity, ratified by Law N° 7416 of June 30, 1994; articles 69 and 72 of the Administrative Contracting Law N° 7494 of May 2, 1995; articles 1, 2, 13, 18, and 37 of the Forestry Law (Ley Forestal) N° 7575 of February 13, 1996, and article 11 of the Regulations to the Forestry Law, Executive Decree (Decreto Ejecutivo) N° 25721-MINAE of October 17, 1996.

1That article 8 of the Convention on Biological Diversity, ratified by Law N° 7416 of June 30, 1994, published in La Gaceta N° 143 of July 28, 1994, establishes that each Contracting Party shall, as far as possible and as appropriate: c) Regulate or manage biological resources important for the conservation of biological diversity, whether within or outside protected areas, with a view to ensuring their conservation and sustainable use; d) Promote the protection of ecosystems and natural habitats and the maintenance of viable populations of species in natural surroundings; f) Rehabilitate and restore degraded ecosystems and promote the recovery of threatened species, inter alia, through the development and implementation of plans or other management strategies.
2That in accordance with article 46 of the Organic Environmental Law, Law N° 7554 of October 4, 1995, published in La Gaceta N° 215 of November 13, 1995, the State shall exercise sovereignty over biological diversity, as part of its natural heritage. That furthermore, activities aimed at conserving, improving, and, where possible, recovering the biological diversity of the national territory are of public interest, for whose execution the parameters defined by the Executive Branch, as well as the following criteria, shall be taken into account: a) The protection and conservation of natural ecosystems, species diversity, genetic diversity in the national territory, and the monitoring of reproduction zones; b) The management of biological diversity integrated into the planning of any activity related to environmental elements.
3That as provided by the Biodiversity Law N° 7788 of April 30, 1998, published in La Gaceta N° 101 of May 27, 1998, in its seventh article, biodiversity is composed of the variability of living organisms from any source and includes knowledge, innovation, and traditional, individual, and collective practice.
4That according to articles 49 and 53 of the same Biodiversity Law N° 7788, the maintenance of ecological processes is a duty of the State and its citizens. For this purpose, the Ministry of Environment and Energy (MINAE) and the other relevant public entities, taking into account the specific legislation in force, shall issue the appropriate technical standards and use mechanisms for their conservation. Furthermore, the restoration, recovery, and rehabilitation of ecosystems, species, and the environmental services they provide must be promoted by MINAE and other public entities, as established in the same body of norms.
5That the National Strategy for the Conservation and Sustainable Use of Biodiversity established, within the strategic actions for the country, the development of active management experiences for in situ conservation purposes.
6That the current conditions of global change drive the State to promote regenerative development activities based on the regeneration of functional landscapes.
7That investigative science plays a fundamental role in making timely and appropriate decisions for conservation.
8That collaborative management (gestión colaborativa) constitutes a process where the integration between society, environment, and economy is considered, with the aim of restoring the landscape's capacity to provide ecosystem goods and services to society in a sustainable manner, which is compatible with the government-based governance regime for public domain assets.
9That in accordance with articles 9 and 21 of the Regulations to the Biodiversity Law, Executive Decree N° 34433-MINAE of March 11, 2008, published in La Gaceta N° 68 of April 8, 2008, the Arenal Tempisque Conservation Area (ACAT) is one of the Conservation Areas that constitute the National System of Conservation Areas (SINAC) and is therefore under its administration.

10.—That the State ensures development in the canton of Abangares that improves the quality of life of its inhabitants, promoting activities that foster cultural and environmental wealth, thereby contributing to adequate ecoregional conservation.

11.—That by Executive Decree N° 39964-H of September 21, 2016, published in Supplement N° 254 to La Gaceta N° 216 of November 10, 2016, the property registered under Real Folio registration number 124599-000, located in the province of Guanacaste, canton 7 Abangares, district 1 Las Juntas, hamlet Santa Lucía, was assigned to MINAE; whose nature is land with various buildings, timber plantations, areas of natural regeneration of secondary forest, and pastures. It currently constitutes a property registered in the name of MINAE, under the administration of SINAC, through the Arenal Tempisque Conservation Area.

12.—That as dictated by the second article of the Forestry Law N° 7575, of February 13, 1996, published in La Gaceta N° 72 of April 16, 1996, forest plantations (plantaciones forestales) have the main objective of timber production and utilization, without prejudice to other objectives that may be determined.

13.—That in accordance with the Regulations to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or processes that the administered party must comply with, a situation for which the prior control procedure was not carried out. Therefore, They decree:

"DECLARATION OF THE PROPERTY REGISTERED UNDER REAL FOLIO REGISTRATION NUMBER 124599-000 OF THE PROVINCE OF GUANACASTE, AS THE CERRITOS EXPERIMENTAL FARM (FINCA EXPERIMENTAL CERRITOS) FOR THE CONSERVATION OF ECOSYSTEMS AND SPECIES OF THE TROPICAL HUMID FOREST (BOSQUE HÚMEDO TROPICAL)"

Considering:

The property registered under Real Folio registration number 124599-000 of the province of Guanacaste is hereby declared as the Cerritos Experimental Farm for the conservation of ecosystems and species of the tropical humid forest.

The Cerritos Experimental Farm for the conservation of ecosystems and species of the tropical humid forest is formed under a mixed-use regime (régimen de uso mixto) as detailed:

a)Sector 1: Consisting of forests, forest lands, and lands of forest aptitude; constituting Natural Heritage of the State. For carrying out and approving activities in this sector, the provisions of articles 18 and 18 Bis of the Forestry Law N° 7575 and related regulations apply.
b)Sector 2: Consisting of areas without forest cover (cobertura forestal) and with infrastructure. Activities related to any of the objectives established in these Regulations may be developed in this sector, provided that, under the technical criteria of the Administration, it is deemed appropriate.

The objectives of the Cerritos Experimental Farm for the conservation of ecosystems and species of the tropical humid forest, which shall be developed as permitted in accordance with the sectorization (sectorización) established in this Executive Decree, shall be:

a)Promote the conservation of the tropical humid forest ecosystem and species, through a representative and replicable model of protection for indicator species, umbrella species, flagship species, focal species; types of biomes, and ecological processes characteristic of the ecoregion.
b)Generate a space of scientific interest for experimentation as a mechanism for the effective protection of ecoregional biodiversity.
c)Generate a regenerative development model under collaborative management that harmoniously integrates the protection and rational use of the different elements of biological diversity, including knowledge, traditions, and innovation.
d)Manage the natural resources and ecosystems present, under technical and scientific criteria, so that they manage to maintain their key ecological attributes and the provision of ecosystem services.
e)Provide special protection and sustainably use the water resources and aquatic systems present at the site.

For the fulfillment of the objectives, the following activities may be promoted and developed:

a)Maintain, through natural regeneration, the conservation of a representative sample of the original ecosystems of the site.
b)Create a seed bank of forest species and wild flora native to the tropical humid forest.
c)Establish a nursery with native forest species to supply reforestation projects in the ecoregion.
d)Experimentally develop techniques for the rehabilitation and restoration of ecosystems and typical species present in the area, to generate information and learning with the potential to be transferred and used in the rehabilitation or restoration of similar ecosystems, outside and inside protected wild areas.
e)Generate knowledge of the present ecosystems through the development of research and experiments, so that the information guides decision-making for the management of the farm and the ecoregion.
f)Establish and maintain a data center with information generated and systematized from the research and processes developed at the Experimental Farm.
g)Develop academic activities.
h)Develop a citizen science program.
i)Create and consolidate an environmental classroom for research and training actions.
j)Carry out collaborative management activities that establish the site as a space for cultural, social, and environmental interaction.
k)Establish plantations with forest species that allow CO2 capture.
l)Develop community productive-environmental projects that promote the socio-environmental development of the communities of influence.
m)Carry out ecotourism activities.
n)Other activities consistent with the objectives of the "Experimental Farm for the conservation of ecosystems and species of the tropical humid forest" that are potentially applicable in accordance with the regulations governing the matter.

These activities shall be administered and developed as permitted, in accordance with the sectorization established in this Executive Decree and through the management mechanisms provided for in the regulations.

The activities carried out within the framework of the objectives established in this Executive Decree must respect the current existing land use (uso de suelo) of the different sectors of the property.

Exempted from this provision are areas destined for forest plantations that may be utilized and in which new forest plantations may subsequently be established or tropical humid forest ecosystems reestablished, through natural regeneration or under restoration or rehabilitation techniques.

For the fulfillment of the objectives, a collaborative management model shall be established that promotes citizen participation and cooperation with other bodies of the Centralized and Decentralized Public Administration, non-governmental organizations, and the private sector. For this purpose, agreements may be signed, use permits issued, facilities concessioned, as well as any other authorized figure regulated by the current legal system applied.

Complementarily to the ordinary budget, to guarantee financial sustainability, the resources coming from the following concepts shall be for the exclusive use of the management of the Experimental Farm for the conservation of ecosystems and species of the tropical humid forest:

A)Sale of Environmental Services (Servicios Ambientales).
B)Collection from fees (canon) for use permits.
C)Collection from fees (tarifas) for administrative contracting.
D)Funds from the sustainable use of forest plantations, complying with the provisions of the Forestry Law and applicable regulatory norms; and conducting the sale through public auction (remate), following the rules established in the Administrative Contracting Law and its Regulations.
E)Collection from public prices (precios públicos) established within the framework of the development of activities under this Decree.

1Que el artículo 8° del Convenio sobre la Diversidad Biológica, ratificado mediante Ley N° 7416 del 30 de junio de 1994, publicada en La Gaceta N° 143 del 28 de julio de 1994, establece que cada Parte Contratante, en la medida de lo posible y según proceda: c) Reglamentará o administrará los recursos biológicos importantes para la conservación de la diversidad biológica, ya sea dentro o fuera de las áreas protegidas, para garantizar su conservación y utilización sostenible; d) Promoverá la protección de ecosistemas y hábitat naturales y el mantenimiento de poblaciones viables de especies en entornos naturales; f) Rehabilitará y restaurará ecosistemas degradados y promoverá la recuperación de especies amenazadas, entre otras cosas mediante la elaboración y la aplicación de planes u otras estrategias de ordenación.
2Que de conformidad con el artículo 46 de la Ley Orgánica del Ambiente, Ley N° 7554 del 04 de octubre de 1995, publicada en La Gaceta N° 215 del 13 de noviembre de 1995, el Estado ejercerá la soberanía sobre la diversidad biológica, como parte de su patrimonio natural. Que además, son de interés público las actividades destinadas a conservar, mejorar y, en lo posible, a recuperar la diversidad biológica del territorio nacional, para cuya ejecución se tomarán en cuenta los parámetros definidos por el Poder Ejecutivo, así como los siguientes criterios: a) La protección y la conservación de los ecosistemas naturales, la diversidad de las especies, la diversidad genética en el territorio nacional y la vigilancia de las zonas de reproducción; b) El manejo de la diversidad biológica integrado a la planificación de cualquier actividad relativa a los elementos del ambiente.
3Que según lo dispone la Ley de Biodiversidad N° 7788 del 30 de abril de 1998, publicada en La Gaceta N° 101 del 27 de mayo de 1998, en su numeral séptimo, la biodiversidad se encuentra compuesta por la variabilidad de organismos vivos de cualquier fuente y contempla el conocimiento, la innovación, la práctica tradicional, individual y colectiva.
4Que según los artículos 49 y 53 de la misma Ley de Biodiversidad N° 7788, el mantenimiento de los procesos ecológicos es un deber del Estado y los ciudadanos. Para tal efecto, el Ministerio de Ambiente y Energía y los demás entes públicos pertinentes, tomando en cuenta la legislación específica vigente, dictarán las normas técnicas adecuadas y utilizarán mecanismos para su conservación. Además, la restauración, recuperación y rehabilitación de los ecosistemas, las especies y los servicios ambientales que brindan, deben ser fomentadas por el Ministerio de Ambiente y Energía y los demás entes públicos, según lo establece el mismo cuerpo de normas.
5Que la Estrategia Nacional de Conservación y Uso Sostenible de la Biodiversidad estableció dentro de las acciones estratégicas para el país, el desarrollo de experiencias de manejo activo con fines de conservación in situ.
6Que las condiciones actuales del cambio global, impulsan al Estado a fomentar actividades de desarrollo regenerativo que se basen en la regeneración de paisajes funcionales.
7Que la ciencia investigativa cumple un rol fundamental para la toma de decisiones oportunas y adecuadas para la conservación.
8Que la gestión colaborativa constituye un proceso donde se toma en cuenta la integración entre sociedad, ambiente y economía, con el fin de restaurar la capacidad del paisaje de ofrecer bienes y servicios ecosistémicos a la sociedad, de una manera sostenible, que es compatible con el régimen de gobernanza por gobierno de los bienes de dominio público.
9Que de acuerdo con los artículos 9° y 21 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N° 34433-MINAE del 11 de marzo del 2008, publicado en La Gaceta N° 68 del 08 de abril del 2008, el Área de Conservación Arenal Tempisque (ACAT) es una de las Áreas de Conservación que constituyen el Sistema Nacional de Áreas de Conservación (SINAC) y por ende se encuentra bajo su administración.

10.-Que el Estado vela por el desarrollo en el cantón de Abangares que mejore la calidad de vida de sus pobladores, promoviendo actividades que fomenten la riqueza cultural y ambiental, contribuyendo a su vez, con la adecuada conservación ecorregional.

11.-Que mediante el Decreto Ejecutivo N° 39964-H del 21 de setiembre del 2016, publicado en el Alcance N° 254 a La Gaceta N° 216, del 10 de noviembre del 2016, se asignó al Ministerio de Ambiente y Energía, el inmueble inscrito con matrícula de Folio Real 124599-000 ubicado en la provincia de Guanacaste, cantón 7 Abangares, distrito 1 Las Juntas, caserío Santa Lucía; cuya naturaleza es terreno con varias edificaciones, plantaciones maderables, áreas de regeneración natural de bosque secundario y pastos. Actualmente constituye inmueble inscrito a nombre del Ministerio de Ambiente y Energía, bajo administración del Sistema Nacional del Áreas de Conservación, a través del Área del Conservación Arenal Tempisque.

12.-Que conforme lo dicta el artículo segundo de la Ley Forestal N° 7575, del 13 de febrero de 1996, publicada en La Gaceta N° 72 del 16 de abril de 1996, las plantaciones forestales tienen como objetivo principal la producción y aprovechamiento de madera, ello sin perjuicio de otros objetivos que se determine.

13.-Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto,

"DECLARATORIA DEL INMUEBLE INSCRITO CON MATRÍCULA DE FOLIO REAL 124599-000 DE LA PROVINCIA DE GUANACASTE, COMO FINCA DE ECOSISTEMAS Y ESPECIES DEL BOSQUEHÚMEDO TROPICAL"

Considerando:

Decretan:

Declárase al inmueble inscrito con matrícula de Folio Real 124599-000 de la provincia de Guanacaste, como Finca Experimental Cerritos para la conservación de ecosistemas y especies del bosque húmedo tropical.

La finca ubicada en la provincia de Guanacaste, cantón 7 Abangares, distrito 1 Las Juntas, con un área de 5.058.681.00 metros cuadrados, plano catastrado G0717569-2001, que es inmueble del Ministerio de Ambiente y Energía, con varias edificaciones, plantaciones maderables, áreas de regeneración natural de bosque secundario y pastos, será el objeto de la presente declaratoria.

La Finca Experimental Cerritos para la conservación de ecosistemas y especies del bosque húmedo tropical, se conforma bajo un régimen de uso mixto según se detalla:

a)Sector 1: Constituido por bosques, terrenos forestales y de aptitud forestal; constituyendo Patrimonio Natural del Estado. Para la realización y aprobación de actividades en este sector, rige con lo dispuesto en los artículos 18 y 18 Bis de la Ley Forestal N° 7575 y normativa conexa.
b)Sector 2: Constituido por áreas sin cobertura forestal y con infraestructura. En este sector podrá desarrollarse actividades relacionadas con cualquiera de los objetivos establecidos en el presente Reglamento, siempre que bajo criterio técnico de la Administración resulte procedente.

La Finca Experimental Cerritos para la conservación de ecosistemas y especies del bosque húmedo tropical, será administrada por el Sistema Nacional de Áreas de Conservación, a través del Área de Conservación Arenal Tempisque.

Serán objetivos de la Finca Experimental Cerritos para la conservación de ecosistemas y especies del bosque húmedo tropical, que se desarrollarán según se permita de conformidad con la sectorización establecida en el presente Decreto Ejecutivo:

a)Fomentar la conservación del ecosistema y especies de bosque húmedo tropical, mediante un modelo representativo y replicable de protección hacia especies indicadoras, especies sombrilla, especies bandera, especies focales; tipos de biomas y procesos ecológicos propios de la ecorregión.
b)Generar un espacio de interés científico para la experimentación como mecanismo para la protección efectiva de la biodiversidad ecorregional.
c)Generar un modelo de desarrollo regenerativo bajo gestión colaborativa que integre de forma armoniosa, la protección y uso racional de los diferentes elementos de la diversidad biológica, incluyendo el conocimiento, las tradiciones y la innovación.
d)Manejar los recursos naturales y ecosistemas presentes, bajo criterio técnico y científico, de manera que logren mantener sus atributos ecológicos clave y la provisión de los servicios ecosistémicos.
e)Brindar protección especial y usar sosteniblemente, el recurso hídrico y los sistemas acuáticos presentes en el sitio.

Para el cumplimiento de los objetivos se podrán fomentar y desarrollar las siguientes actividades:

a)Mantener mediante regeneración natural, la conservación de una muestra representativa de los ecosistemas originales del sitio.
b)Crear un banco de semillas de especies forestales y de flora silvestre, propias del bosque húmedo tropical.
c)Establecer un vivero con especies forestales nativas para proveer proyectos de reforestación en la ecorregión.
d)Desarrollar experimentalmente técnicas para la rehabilitación y restauración de ecosistemas y especies típicas presentes en la zona, para generar información y aprendizaje con potencial para ser transferido y usado en la rehabilitación o restauración de ecosistemas similares, fuera y dentro de áreas silvestres protegidas.
e)Generar conocimiento de los ecosistemas presentes a través del desarrollo de investigaciones y experimentos, de manera que la información oriente la toma de decisiones de manejo de la finca y de la ecorregión.
f)Establecer y mantener un centro de datos con información generada y sistematizada, de las investigaciones y procesos desarrollados en la Finca g) Desarrollar actividades académicas.
h)Desarrollar un programa de ciencia ciudadana.
i)Crear y consolidar un aula ambiental, para acciones de investigación y capacitación.
j)Realizar actividades de gestión colaborativa que constituyan al sitio como un espacio de interacción cultural, social y ambiental.
k)Establecer plantaciones con especies forestales que permitan la captura de CO2.
l)Desarrollar proyectos productivo-ambientales comunitarios que fomenten el desarrollo socioambiental de las comunidades de influencia.
m)Realizar actividades de ecoturismo.
n)Otras actividades acordes con los objetivos de la "Finca Experimental para la conservación de ecosistemas y especies del bosque húmedo tropical" que sean de posible aplicación conforme las normas que rigen la materia.

Estas actividades se administrarán y desarrollarán según se permita, de conformidad con la sectorización establecida en el presente Decreto Ejecutivo y mediante los mecanismos de gestión previstos en la normativa.

Las Actividades que se realicen en el marco de los objetivos establecidos en el presente Decreto Ejecutivo, deberán respetar el actual uso de suelo existente de los diferentes sectores del inmueble.

Se exceptúan de la presente disposición, las áreas destinadas a plantaciones forestales que podrán ser aprovechadas y en las que posteriormente se podrán establecer nuevas plantaciones forestales o restablecer ecosistemas de bosque húmedo tropical, mediante regeneración natural o bajo técnicas de restauración o rehabilitación.

Para el desarrollo de actividades deberá elaborarse un Plan de Gestión de la Finca Experimental.

Para el cumplimiento de los objetivos, se establecerá un modelo de gestión colaborativa que fomente la participación ciudadana y la cooperación con otros órganos de la Administración Pública Centralizada y Descentralizada, organizaciones no gubernamentales y sector privado. Para tal efecto podrán suscribirse convenios, emitirse permisos de uso, concesionarse instalaciones, así como aplicar cualquier otra figura autorizada y reglamentada por el ordenamiento jurídico vigente.

Complementariamente al presupuesto ordinario, para garantizar la sostenibilidad financiera, serán para uso exclusivo de la gestión de la Finca Experimental para la conservación de ecosistemas y especies del bosque húmedo tropical, los recursos provenientes de los siguientes conceptos:

A)Venta de Servicios Ambientales.
B)Recaudación por concepto de canon por permisos de uso.
C)Recaudación por concepto de tarifas por contrataciones administrativas.
D)Fondos provenientes del aprovechamiento sostenible de las plantaciones forestales, cumpliendo con lo dispuesto en la Ley Forestal y normas reglamentarias aplicables; y realizando la venta mediante remate, siguiendo las reglas establecidas en la Ley de Contratación Administrativa y su Reglamento.
E)Recaudación por concepto de precios públicos que se establezcan en el marco del desarrollo de actividades del presente Decreto.

El SINAC por medio del Área de Conservación Arenal Tempisque, realizará la demarcación geográfica de los sectores establecidos en el artículo 3° del presente Decreto Ejecutivo, lo anterior, en el plazo de 6 meses, contados a partir de la publicación de la presente norma.

Rige a partir de su publicación en el Diario Oficial La Gaceta.
