in the entirety of the text - Complete Text of Regulation 42615 Change of the management category of a section of the Las Tablas Protective Zone to the Bicentennial of the Republic-Pájaro Campana Biological Reserve Complete Text of record: 140100 No. 42615-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the powers conferred by Articles 50, 140 sections 3) and 18), and 146 of the Political Constitution; Articles 27 section 1) and 28 section 2) subparagraph b) of the General Public Administration Law No. 6227 of May 2, 1978; Article 32 of the Organic Environmental Law No. 7554 of October 4, 1995; Article 13 of the National Parks Service Law No. 6084 of August 24, 1977; Articles 13 and 18 of the Forestry Law No. 7575 of February 13, 1996; Articles 58 and 59 of the Biodiversity Law No. 7788 of April 30, 1998, and Articles 71 and 72 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008.

I.—That Article 22 of the Biodiversity Law No. 7788 provides that the National System of Conservation Areas (SINAC) is a deconcentrated and participatory management and institutional coordination system that will integrate competencies in forestry, wildlife, and Protected Wild Areas.

II.—That Article 58 of the Biodiversity Law No. 7788 establishes that "(...) protected wild areas are delimited geographical zones, constituted by lands, wetlands, and portions of sea. They have been declared as such for representing special significance due to their ecosystems, the existence of threatened species, their impact on reproduction and other needs, and for their historical and cultural significance. These areas shall be dedicated to conservation and protecting biodiversity, soil, water resources, cultural resources, and ecosystem services in general. (...) During the process of fulfilling requirements to establish state protected wild areas, the respective technical reports must include the pertinent recommendations and justifications to determine the most appropriate management category to which the proposed area must be submitted (...)" III.—That the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE, in its Article 70 section d), defines Biological Reserves within the management categories of Protected Wild Areas as: "Geographical areas that possess terrestrial, marine, marine-coastal, freshwater ecosystems, or a combination of these, and species of particular conservation interest. Their main purposes shall be the conservation and protection of biodiversity, as well as research." IV.—That the Coto Brus Protective Zone (Zona Protectora en Coto Brus) was created by Law No. 6638 of September 9, 1981, with an area of 10,000 hectares, and through Executive Decree No. 13325-A of February 4, 1982, said protective zone became an integral part of the protective zone included in Article 1 of that decree, being expanded to 19,602 hectares and named Protective Zone adjacent to La Amistad International Park.

V.—That the Attorney General's Office (Procuraduría General de la República), through opinion C-006-88 of January 14, 1988, establishes that due to its proximity to La Amistad International Park: Costa Rica-Panama (or Talamanca Mountain Range National Park), and the name by which it is designated on the Map of Areas Administered by the General Forestry Directorate (Dirección General Forestal) of the Ministry of Agriculture and Livestock (Sept. 1987), the Las Tablas protective zone is the one created by Law No. 6638 of September 9, 1981, with an area of ten thousand hectares, expanded to 19,602 hectares by Executive Decree No. 13325-A of February 4, 1982, which is located exactly between said Park (southeast side, to which it provides greater protection) and the Panamanian-Costa Rican border.

VI.—That through deed number forty-nine, of volume six of the Protocol of the State Notary, Jonathan Bonilla Córdoba, the donation of the property registered in the Public Property Registry (Registro Público de la Propiedad), Province of Puntarenas, Title number twenty-five thousand five hundred fourteen-zero zero zero, cadastral map, P-one million five hundred ninety-four thousand five hundred fifty-one-two thousand twelve, is received from the National Parks Foundation (Fundación de Parques Nacionales) to the State, a farm with an area of fifty-one million two hundred fifty-six thousand eight hundred ninety-seven square meters (51,256,897.00 m2 or 5125ha 6897.00 m2) and which is located within the Las Tablas Protective Zone.

VII.—That due to the biological and ecological importance of the zone, technical studies have been carried out in the Las Tablas Protective Zone and specifically on the property of map P-1594551-2012, determining that it is an unaltered site, containing extremely vulnerable ecosystems, features, and species of flora and fauna, in which ecological processes must follow their natural course with a minimum of human interference, hence the importance of changing the management category of the area contained in said map, to declare it a Biological Reserve.

VIII.—That in the area to be declared the Biological Reserve, three life zones are represented: Premontane very humid forest, Lower montane very humid forest, and Montane rain forest, and it harbors ecosystems and biodiversity of high scientific and conservation interest; this represents an attraction for promoting research both within the new protected area and in the surrounding lands, which would allow fostering research with different levels of pressure that generate experiences in active and adaptive management.

IX.—That in this zone there are species that are in danger of extinction, such as the tapir (Tapirus bairdii), which is the largest wild mammal of Central America; all 6 species of wild felines of the country are present: ocelot (Leopardus pardalis), margay (Leopardus wiedii), oncilla (Leopardus tigrinus), jaguar (Panthera onca), puma (Puma concolor), jaguarundi (Herpailurus yagouaroundi), and birds indicative of conserved forests such as the quetzal (Pharomachrus mocinno) and the bellbird (Procnias tricarunculata).

X.—That the Biological Reserve will form part of a block of lands with forest cover (cobertura boscosa), State Natural Heritage (Patrimonio Natural del Estado) that has different management categories and form part of the Talamanca Range-La Amistad Reserves World Heritage Site, the core zone of the La Amistad Biosphere Reserve, and the Talamanca Peatlands Ramsar Site.

XI.—The creation of a Biological Reserve would allow expanding the ecological connectivity and integrity of the other protected wild areas that surround it, "guaranteeing the conservation and exceptional value of the Talamanca Range-La Amistad Reserves World Heritage Site," and by having the Biological Reserve category, it would function as a laboratory for research and the generation of scientific knowledge in a site that presents pristine conservation characteristics.

XII.—That key actors in the zone promote the preservation of the Las Tablas Protective Zone as a relevant site for biodiversity protection and research. This represents a strength for the conservation, management, and control processes of the new protected wild area.

XIII.—That due to the low human impact allowed under this protection category, a high investment in infrastructure and visitor services would not be required.

XIV.—That prior to the issuance of this executive decree, the requirements set forth in sections 71 and 72 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE, were fulfilled, as stated in the respective file (expediente).

XV.—That the change of category of a portion of the Las Tablas Protective Zone to a Biological Reserve is a response aimed at fulfilling the country's goals and commitments in the conservation of biodiversity and the most representative ecosystems, as well as part of fulfilling the voluntary goal to achieve carbon neutrality for the 2020-2021 period.

XVI.—That the property registered in the Public Property Registry, province of Puntarenas, Folio Real registration number twenty-five thousand five hundred fourteen-zero zero zero, cadastral map, P-1594551-2012, is traversed in the southern sector by an easement (servidumbre) for the Coto Brus aqueduct.

XVII.—That two polygons corresponding to the area that is traversed in the southern sector by an easement (servidumbre) for the Coto Brus aqueduct are segregated from the property registered in the Public Property Registry, Province of Puntarenas, Folio Real registration number twenty-five thousand five hundred fourteen-zero zero zero, cadastral map, P-1594551-2012.

XVIII.—That in accordance with section 59 of the Biodiversity Law No. 7788 and Article 12 section d) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE, the National Council of Conservation Areas (CONAC), in Ordinary Session No. 0062020 held on June 8, 2020, through Agreement No. 05, approved the recommendation to change the category to Bicentennial of the Republic - Pájaro Campana Biological Reserve and that the procedure established in the Regulation to the Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE be continued. Therefore, They Decree:

CHANGE OF THE MANAGEMENT CATEGORY OF A SECTION OF THE LAS TABLAS PROTECTIVE ZONE TO THAT OF THE BICENTENNIAL OF THE REPUBLIC-PÁJARO CAMPANA BIOLOGICAL RESERVE

Considering:

en la totalidad del texto - Texto Completo Norma 42615 Cambio de la categoría de manejo a una sección de la Zona Protectora Las Tablas, a la Reserva Biológica del Bicentenario de la República-Pájaro Campana Texto Completo acta: 140100 Nº 42615-MINAE EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE AMBIENTE Y ENERGÍA En ejercicio de las facultades que les confieren los artículos 50, 140 incisos 3) y 18) y 146 de la Constitución Política; artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública N° 6227 del 2 de mayo de 1978; artículo 32 de la Ley Orgánica del Ambiente N° 7554 del 04 de octubre de 1995; artículo 13 de la Ley del Servicio de Parques Nacionales N° 6084 del 24 de agosto de 1977; artículos 13 y 18 de la Ley Forestal N° 7575 del 13 de febrero 1996; artículos 58 y 59 de la Ley de Biodiversidad N° 7788 del 30 abril de 1998 y los artículos 71 y 72 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N° 34433-MINAE del 11 de marzo de 2008.

I.-Que el artículo 22 de la Ley de Biodiversidad N° 7788, dispone que el Sistema Nacional de Áreas de Conservación (SINAC) es un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integrará las competencias en materia forestal, vida silvestre y Áreas Silvestres Protegidas.

II.-Que el artículo 58 de la Ley de Biodiversidad N° 7788, establece que "(...) las áreas silvestres protegidas son zonas geográficas delimitadas, constituidas por terrenos, humedales y porciones de mar. Han sido declaradas como tales por representar significado especial por sus ecosistemas, la existencia de especies amenazadas, la repercusión en la reproducción y otras necesidades y por su significado histórico y cultural. Estas áreas estarán dedicadas a conservación y proteger la biodiversidad, el suelo, el recurso hídrico, los recursos culturales y los servicios de los ecosistemas en general. (...) Durante el proceso de cumplimiento de requisitos para establecer áreas silvestres protegidas estatales, los informes técnicos respectivos deberán incluir las recomendaciones y justificaciones pertinentes para determinar la categoría de manejo más apropiada a que el área propuesta debe someterse (...)" III.-Que el Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N° 34433-MINAE, en su artículo 70 inciso d), define dentro de las categorías de manejo de Áreas Silvestres Protegidas, a las Reservas Bilógicas como "Áreas geográficas que poseen ecosistemas terrestres, marinos, marino-costeros, de agua dulce, o una combinación de estos y especies de interés particular para la conservación. Sus fines principales serán la conservación y la protección de la biodiversidad, así como la investigación".

IV.-Que la Zona Protectora en Coto Brus fue creada mediante Ley N° 6638 del 09 de septiembre de 1981, con un área de 10.000 hectáreas y mediante el Decreto Ejecutivo N° 13325-A del 04 de febrero de 1982, dicha zona protectora pasa a formar parte integral de la zona protectora comprendida en el artículo 1 de ese decreto, ampliándose a 19.602 hectáreas y denominada Zona Protectora colindante Parque Internacional La Amistad.

V.-Que la Procuraduría General de la República, mediante dictamen C-006-88 del 14 de enero de 1988, establece que por su inmediación al Parque Internacional La Amistad: Costa Rica- Panamá (o Parque Nacional de la Cordillera de Talamanca), y el nombre con que se le denomina en el Mapa de Áreas Administradas por la Dirección General Forestal del Ministerio de Agricultura y Ganadería (set. 1987), la zona protectora Las Tablas, es la creada mediante ley N° 6638 del 9 de setiembre de 1981, con superficie de diez mil hectáreas ampliada a 19.602 hectáreas por Decreto Ejecutivo N° 13325-A del 4 de febrero de 1982, la cual se localiza exactamente entre dicho Parque (costado Sureste, al que brinda mayor protección), y la frontera panameño-costarricense.

VI.-Que mediante escritura número cuarenta y nueve, del tomo seis del Protocolo del Notario del Estado, Jonathan Bonilla Córdoba, se recibe de la Fundación de Parques Nacionales al Estado, la donación del inmueble inscrito en el Registro Público de la Propiedad, Provincia de Puntarenas, Matrícula veinticinco mil quinientos catorce-cero cero cero, plano catastrado, P-un millón quinientos noventa y cuatro mil quinientos cincuenta y uno-dos mil doce, finca con una medida de cincuenta y un millones doscientos cincuenta y seis mil ochocientos noventa y siete metros cuadrados (51.256.897,00 m2 o 5125ha 6897,00 m2) y que se encuentra dentro de la Zona Protectora Las Tablas.

VII.-Que debido a la importancia biológica y ecológica de la zona, se han realizado estudios técnicos en la Zona Protectora Las Tablas y específicamente en el inmueble plano P-1594551-2012, determinando que es un sitio inalterado, que contiene ecosistemas, rasgos y especies de flora y fauna extremadamente vulnerables, en la cual los procesos ecológicos deben seguir su curso natural con un mínimo de interferencia humana, de ahí la importancia que se cambie la categoría de manejo al área contenida en dicho plano, para declararla como Reserva Biológica.

VIII.-Que en el área que se declarará la Reserva Biológica se encuentran representadas tres zonas de vida: Bosque muy húmedo premontano, Bosque muy húmedo montano bajo y Bosque pluvial montano y alberga ecosistemas y una biodiversidad de alto interés científico y de conservación, esto representa un atractivo para fomentar la investigación tanto dentro de la nueva área protegida como en los terrenos aledaños, lo que permitiría impulsar investigaciones con diferentes niveles de presión que generen experiencias en manejo activo y adaptativo.

IX.-Que en esta zona existen especies que se encuentran en peligro de extinción como la danta (Tapirus bairdii), que es el mamífero silvestre más grande de Centroamérica; se encuentran presentes las 6 especies de felinos silvestres del país, ocelote (Leopardus pardalis), caucel (Leopardus wiedii), tigrillo (Leopardus tigrinus), jaguar (Panthera onca), puma (Puma concolor), yaguarundi (Herpailurus yagouaroundi) y aves indicadoras de bosques conservados como el quetzal (Pharomachrus mocinno) y el pájaro campana (Procnias tricarunculata).

X.-Que la Reserva Biológica formará parte de un bloque de terrenos con cobertura boscosa, Patrimonio Natural del Estado que tiene diferentes categorías de manejo y forman parte del Sitio de Patrimonio Mundial Reservas de la Cordillera de Talamanca - Parque Internacional de La Amistad, zona núcleo de la Reserva de Biosfera La Amistad y Sitio Ramsar Turberas de Talamanca.

XI.-La creación de una Reserva Biológica permitiría ampliar la conectividad e integridad ecológicas de las demás áreas silvestres protegidas que le rodean "garantizando la conservación y el valor excepcional del Sitio de Patrimonio Mundial Reservas de la Cordillera de Talamanca - Parque Internacional de La Amistad" y que al tener la categoría de Reserva Biológica funcionaría como un laboratorio para investigación y la generación de conocimiento científico en un sitio que presenta características de conservación prístinas.

XII.-Que en la zona existen actores claves que impulsan la preservación de la Zona Protectora Las Tablas como un sitio relevante para protección e investigación de la biodiversidad. Esto representa una fortaleza para los procesos de conservación, gestión y control de la nueva área silvestre protegida.

XIII.-Que debido al bajo impacto antrópico permitido bajo esta categoría de protección, no se requeriría de una inversión elevada en infraestructura y servicios para visitantes.

XIV.-Que de previo a la emisión del presente decreto ejecutivo, se cumplieron los requisitos dispuestos en los numerales 71 y 72 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N° 34433-MINAE, según consta en el XV.-Que el cambio de categoría de una porción de la Zona Protectora Las Tablas a Reserva Biológica, es una respuesta orientada al cumplimiento de las metas y compromisos del país en conservación de la biodiversidad y los ecosistemas más representativos, así como parte del cumplimiento de la meta voluntaria para alcanzar la carbono neutralidad para el período 2020-2021.

XVI.-Que el inmueble inscrito en el Registro Público de la Propiedad, provincia de Puntarenas, matrícula de Folio Real número veinticinco mil quinientos catorce-cero cero cero, plano catastrado, P-1594551-2012, es atravesada en el sector sur por una servidumbre del acueducto de Coto Brus.

XVII.-Que al inmueble inscrito en el Registro Público de la Propiedad, Provincia de Puntarenas, matrícula de Folio Real número veinticinco mil quinientos catorce-cero cero cero, plano catastrado, P-1594551-2012, se le segregan dos polígonos correspondientes al área que es atravesada en el sector sur, por una servidumbre del acueducto de Coto Brus.

XVIII.-Que de conformidad con el numeral 59 de la Ley de Biodiversidad N° 7788 y al artículo 12 inciso d) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N° 34433-MINAE, el Consejo Nacional de Áreas de Conservación (CONAC), en Sesión Ordinaria N° 0062020 celebrada el día 08 de junio de 2020, mediante Acuerdo N° 05, aprobó la recomendación de cambiarle categoría a Reserva Biológica del Bicentenario de la República - Pájaro Campana y que se continúe el procedimiento establecido en el Reglamento a la Ley de Biodiversidad N° 7788, Decreto Ejecutivo N°34433-MINAE. Por tanto,

Considerando:
