in the entirety of the text - Full Text of Standard 42696 Specifications for Cartography of the Environmental Variable in Land-Use Planning Full Text of record: 1788EB Nº 42696-MINAE (This Executive Decree was repealed by article 34 of the Regulation for the incorporation of the environmental variable in land-use planning, approved by Executive Decree N° 44710 of October 18, 2024) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the powers conferred by articles 50, 140 subsections 3), 8), and 18), and 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Public Administration Law Nº 6227 of May 2, 1978; and articles 2 subsection c), 17, and 28 of the Organic Environmental Law Nº 7554 of October 4, 1995.
I- That by Executive Decree N° 32967-MINAE, of February 20, 2006, the "Manual of Technical Instruments for the Environmental Impact Assessment Process (EIA Manual)-Part III" was established, whose Annex N° 1 establishes the "Technical procedure for the introduction of the environmental variable in regulatory plans or other land-use planning." II- That Executive Decree N° 32967-MINAE, in its Annex N° 1, refers to generalities related to the cartography involved in the procedure only in numerals 5.14.3.1, 6.11.3, and 7.1.1. Likewise, its Annex N° 5, refers to the cartographic theme only in Numeral 1.
III- That the report of the Comptroller General of the Republic N° DFOE-AE-IF-00008-2017 (Operational audit on the efficacy and efficiency of the Strategic Environmental Assessment process at SETENA), states that ".Executive Decree N° 32967-MINAE, Manual of technical instruments for the environmental impact assessment process (EIA Manual)-Part III, and its annexes, do not specify the technical elements that must be included in the maps of the studies submitted to SETENA's analysis." IV- That the same report of the Comptroller General of the Republic (N° DFOE-AE-IF- 00008-2017), states that a series of technical norms previously issued by the competent entity in the matter must be observed, indicating:
"2.47. In this regard, there are Technical norms of geographic information issued by the National Geographic Institute (IGN), among them NTIG_CR01_02.2016, Catalog of Geographic Objects for Fundamental Data of Costa Rica, to promote the standardization of geospatial information generated in the country.
Also, the norm NTIG_CR04_01.2016 Official Profile of Geographic Metadata of Costa Rica, which establishes the minimum elements that the metadata of the cartography produced must contain, according to the Raster or Shapefile format." V- That by directive DIR-DIG-001-2016 of the National Geographic Institute, the Technical Norm "NTIG_CR01_01.2016: Geodetic Reference System of Costa Rica" is established, wherein it states that "The provisions contained in this Directive and respective Technical Norm are of mandatory compliance," and its scope indicates that:
"The Technical Norm NTIG_CR01_01.2016: Geodetic Reference System of Costa Rica, constitutes a general reference framework on the minimum requirements that must be observed by the officials and users of the National Geographic Institute, and in general, the public sector (Branches of the Republic, autonomous and semi-autonomous institutions, entities attached to autonomous institutions, state public enterprises, non-state public enterprises, non-state public entities, entities administering public funds, municipalities and attached municipal bodies), private sector, individuals and the general public, producer, manager, and user for the georeferencing of geographic objects (OG) to the national reference system of our country." VI- That by directive DIR-DIG-002-2016 of the National Geographic Institute, the Technical Norm for Geographic Information "NTIG_ CR02_01.2016: Catalog of Geographic Objects for Fundamental Data of Costa Rica" is established, and that it "constitutes a general reference framework on the minimum requirements that must be observed by this Institute, other public entities, the private sector, and the general public: producers, managers, and users of georeferenced geographic information," and regarding its mandatory nature, it has been stated that "The provisions contained in this Directive and respective Technical Norm are of mandatory compliance." IX- That, according to a consultation made by SETENA to the National Geographic Institute, that technical entity has indicated in official communication DIG-0567-2017 of December 7, 2017 that ".the Catalog of Geographic Objects for Fundamental Data of Costa Rica (NTIG_CR02_01.2016), the Geodetic Reference System of Costa Rica (NTIG_CR01_01.2016), the Geographic Data Model of Costa Rica Scales 1:1,000, 1:5,000, and 1:25,000 (NTIG_CR03_01.2016), and the Official Profile of Geographic Metadata of Costa Rica (NTIG_CR04_01.2016), directly and indirectly form part of the requirements that must be applied in the Environmental Fragility Index (IFA) studies carried out by SETENA, for compliance with Provision 4.9 contained in Report N° DFOE-AE-IF-00008 2017 of July 14, 2017 issued by the Comptroller General of the Republic." X- That in the same official communication DIG-0567-2017 of December 7, 2017, the National Geographic Institute indicates that SETENA must develop and submit for validation by said entity, the Catalog of Thematic Geographic Objects of specific interest to SETENA, but that while this process is underway, SETENA must reference the norms of the Catalog of Geographic Objects for Fundamental Data of Costa Rica (NTIG_CR02_01.2016) and the Geographic Data Model of Costa Rica Scales 1:1,000, 1:5,000, and 1:25,000 (NTIG_CR03_01.2016), when they refer to geographic objects that are included totally or partially in the published and official version. Likewise, it is indicated that SETENA must fully apply the norms: Geodetic Reference System of Costa Rica (NTIG_CR01_01.2016) and the Official Profile of Geographic Metadata of Costa Rica (NTIG_CR04_01.2016).
XI- That, in accordance with the Regulation to the Law for the Protection of Citizens from Excess Administrative Requirements and Procedures, Executive Decree Nº 37045-MP-MEIC and its amendments, the present proposal complies with the principles of regulatory improvement according to the positive report DMR-DAR-INF-050-2020 of September 2, 2020, issued by the Directorate of Regulatory Improvement of MEIC.
Therefore; THEY DECREE:
"Specifications for Cartography of the Environmental Variable in Land-Use Planning"
Considering:

The purpose of this Regulation is to detail numerals 5.14.3.1, 6.11.3, and 7.1.1 of Annex 1 and numeral 1 of Annex 5, all of them from Executive Decree N° 32967-MINAE "Manual of Technical Instruments for the Environmental Impact Assessment Process (EIA Manual)-Part III" and in accordance with the current reference framework that the National Geographic Institute (IGN) has established for the country, through directives DIR-DIG-001-2016; DIR-DIG-002-2016, DIR-DIG-003-2016, and DIR-DIG-004-2016; so that the geographic information that SETENA requires as part of the technical studies for the incorporation of the environmental variable in land-use planning, is prepared and presented in accordance with the current technical norms established by the IGN.

For all types of land-use planning (with the exception of Management Plans for Mixed Wildlife Refuges), the cartography for the incorporation of the environmental variable is grouped into 5 themes: 1. Geoaptitude, 2. Bioaptitude, 3. Edaphoaptitude, 4. Anthropoaptitude, 5. Others: Integrated IFA, IFA Subclass, Environmental Zoning, Land-Use Condition.
In the case of Management Plans for Mixed Wildlife Refuges, the technical detail of the cartography requirements will be specified by the Plenary Commission of SETENA in the respective Resolution of Minimum Reference Contents for each particular case.

All cartography for the incorporation of the environmental variable that is presented before SETENA shall be submitted in two formats: digital and printed.
In the case of the digital format, it must be submitted as shapefiles, raster, or another similar format compatible with the QGIS program; on an external storage device such as a USB, DVD, or similar that can remain at SETENA as part of the administrative file kept for each case or plan.
In the case of the printed format, each map must be submitted in a maximum size of double letter, properly folded and as part of the corresponding technical study (environmental fragility index, environmental scoping analysis, sustainable development regulation). In cases where the proponent so requires, they may additionally provide an atlas containing the maps printed at whatever size they deem necessary to improve the detail of the cartographic representation.

1Que mediante Decreto Ejecutivo N°32967-MINAE, del 20 de febrero de 2006, se establece el "Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental (Manual de EIA)-Parte III", cuyo anexo N° 1 establece el "Procedimiento técnico para la introducción de la variable ambiental en los planes reguladores u otra planificación de uso del suelo".
2Que el Decreto Ejecutivo N°32967-MINAE, en su Anexo N° 1, refiere a generalidades relativas a la cartografía involucrada en el procedimiento únicamente en los numerales 5.14.3.1, 6.11.3 y 7.1.1. Asimismo, su anexo N° 5, refiere al tema cartográfico únicamente en el Numeral 1.
3Que el informe de la Contraloría General de la República N° DFOE-AE-IF-00008-2017 (Auditoría operativa acerca de la eficacia y eficiencia del proceso de Evaluación Ambiental Estratégica en la SETENA), señala que ".el Decreto Ejecutivo N° 32967-MINAE, Manual de instrumentos técnicos para el proceso de evaluación de impacto ambiental (Manual de EIA)-Parte III, y sus anexos, no especifican los elementos técnicos que deben incluir los mapas de los estudios sometidos al análisis de la SETENA".
4Que el mismo informe de la Contraloría General de la República (N° DFOE-AE-IF- 00008-2017), señala que deben observarse una serie de normas técnicas previamente emitidas por el ente competente en la materia, indicando:
"2.47. Al respecto, existen Normas técnicas de información geográfica emitidas por el Instituto Geográfico Nacional (IGN), entre ellas la NTIG_CR01_02.2016, Catálogo de Objetos Geográficos para Datos Fundamentales de Costa Rica, para propiciar la estandarización de la información geoespacial que se genere en el país.
También, la norma NTIG_CR04_01.2016 Perfil Oficial de Metadatos Geográficos de Costa Rica, la cual establece los elementos mínimos que deben contener los metadatos de la cartografía que se elabore, según el formato de elaboración Raster o Shapefile".
5Que mediante directriz DIR-DIG-001-2016 del Instituto Geográfico Nacional, se establece la Norma Técnica "NTIG_CR01_01.2016: Sistema de Referencia Geodésico de Costa Rica", en donde se señala que "Las disposiciones contenidas en esta Directriz y respectiva Norma Técnica son de acatamiento obligatorio", siendo que su alcance indica que:
"La Norma Técnica NTIG_CR01_01.2016: Sistema de Referencia Geodésico de Costa Rica, constituye un marco de referencia de carácter general sobre los requisitos mínimos que deben observar los funcionarios y usuarios del Instituto Geográfico Nacional, y en general, el sector público (Poderes de la República, instituciones autónomas y semiautónomas, entes adscritos a instituciones autónomas, empresas públicas estatales, empresas públicas no estatales, entes públicos no estatales, entes administradores de fondos públicos, municipalidades y órganos municipales adscritos), sector privado, personas físicas y público en general, productor, gestor y usuario para la georreferenciación de objetos geográficos (OG) al sistema nacional de referencia de nuestro país".
6Que mediante directriz DIR-DIG-002-2016 del Instituto Geográfico Nacional, se establece la Norma Técnica de Información Geográfica "NTIG_ CR02_01.2016: Catálogo de Objetos Geográficos para Datos Fundamentales de Costa Rica", siendo que el mismo "constituye un marco de referencia general sobre los requisitos mínimos que debe observar este Instituto, otras entidades públicas, sector privado y público en general: productores, gestores y usuarios de información geográfica georreferenciada", y respecto a su obligatoriedad se ha señalado que "Las disposiciones contenidas en esta Directriz y respetiva Norma Técnica son de acatamiento obligatorio".
7Que mediante directriz DIR-DIG-003-2016 del Instituto Geográfico Nacional, se establece la Norma Técnica de Información Geográfica "NTIG_ CR03_01.2016: Modelo de datos geográficos de Costa Rica, escalas 1:1.000, 1:5.000 y 1:25.000", siendo que así se "constituye un marco de referencia general sobre los requisitos mínimos que debe observar este Instituto, otras entidades públicas, sector privado y público en general: productores, gestores y usuarios de información geográfica georreferenciada", y respecto a su obligatoriedad se ha señalado que "Las disposiciones contenidas en esta Directriz y respetiva Norma Técnica son de acatamiento obligatorio".
8Que mediante directriz DIR-DIG-004-2016 del Instituto Geográfico Nacional, se establece la Norma Técnica de Información Geográfica "NTIG_CR04_01.2016: Perfil Oficial de Metadatos Geográficos de Costa Rica", siendo que dicha norma técnica "constituye un marco de referencia de carácter general sobre los requisitos mínimos que deben observar los funcionarios y usuarios del Instituto Geográfico Nacional, y en general, el sector público (Poderes de la República, instituciones autónomas y semiautónomas, entes adscritos a instituciones autónomas, empresas públicas estatales, empresas públicas no estatales, entes públicos no estatales, entes administradores de fondos públicos, municipalidades y órganos municipales adscritos), sector privado, personas físicas y público en general, productor, gestor y usuario para la descripción de datos geográficos, informe sobre su contenido, ofrezca al usuario la posibilidad de tener trazabilidad sobre su origen (fuentes, autor, etc.) y facilite la búsqueda de información geográfica de una forma rápida y eficaz". Respecto a su obligatoriedad se ha señalado que "Las disposiciones contenidas en esta Directriz y respetiva Norma Técnica son de acatamiento obligatorio".
9Que, según consulta efectuada por la SETENA al Instituto Geográfico Nacional, ese ente técnico ha indicado en oficio DIG-0567-2017 del 7 de diciembre de 2017 que ".el Catálogo de Objetos Geográficos para Datos Fundamentales de Costa Rica (NTIG_CR02_01.2016), el Sistema de Referencia Geodésico de Costa Rica (NTIG_CR01_01.2016), el Modelo de Datos Geográficos de Costa Rica Escalas 1:1.000, 1:5.000 y 1:25.000 (NTIG_CR03_01.2016) y el Perfil Oficial de Metadatos Geográficos de Costa Rica (NTIG_CR04_01.2016), forman parte directa e indirectamente de los requisitos que deben aplicarse en los estudios de Índices de Fragilidad Ambiental (IFA´s) realizados por la SETENA, para el cumplimiento de la Disposición 4.9 contenida en el Informe N° DFOE-AE-IF-00008 2017 del 14 de julio de 2017 emitido por la Contraloría General de la República."
10Que en el mismo oficio DIG-0567-2017 del 7 de diciembre de 2017, el Instituto Geográfico Nacional indica que la SETENA debe elaborar y someter a validación de dicho ente, el Catálogo de Objetos Geográficos Temáticos de interés específico para la SETENA, pero que en tanto este proceso se desarrolla, SETENA debe hacer referencia a las normas del Catálogo de Objetos Geográficos para Datos Fundamentales de Costa Rica (NTIG_CR02_01.2016) y el Modelo de Datos Geográficos de Costa Rica Escalas 1:1.000, 1:5.000 y 1:25.000 (NTIG_CR03_01.2016), cuando se refieran a objetos geográficos que se encuentran incluidos total o parcialmente en la versión publicada y oficial. Asimismo, se indica que la SETENA debe aplicar por completo las normas: Sistema de Referencia Geodésico de Costa Rica (NTIG_CR01_01.2016) y el Perfil Oficial de Metadatos Geográficos de Costa Rica (NTIG_CR04_01.2016).
11Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC y sus reformas, la presente propuesta cumple con los principios de mejora regulatoria según el informe positivo DMR-DAR-INF-050-2020 del 02 de septiembre de 2020, emitido por la Dirección de Mejora Regulatoria del MEIC.
Por tanto;
"Especificaciones para Cartografía de la Variable Ambiental en Planes de Ordenamiento Territorial"
Considerando:
DECRETAN:

El presente Reglamento tiene por objetivo detallar los numerales 5.14.3.1, 6.11.3 y 7.1.1 del Anexo 1 y el numeral 1 del Anexo 5, todos ellos del Decreto Ejecutivo N°32967-MINAE "Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental (Manual de EIA)-Parte III" y de conformidad con el marco de referencia vigente que el Instituto Geográfico Nacional (IGN) ha establecido para el país, mediante las directrices DIR-DIG-001-2016; DIR-DIG-002-2016, DIR-DIG-003- 2016 y DIR-DIG-004-2016; a fin de que la información geográfica que SETENA requiera como parte de los estudios técnicos de la incorporación de la variable ambiental en planes de ordenamiento territorial, se elabore y presente conforme a las normas técnicas vigentes establecidas por el IGN.

Para todo tipo de plan de ordenamiento territorial (con excepción de los Planes de Manejo de Refugios Mixtos de Vida Silvestre), la cartografía de la incorporación de la variable ambiental se agrupa en 5 temáticas: 1. Geoaptitud, 2. Bioaptitud, 3. Edafoaptitud, 4. Antropoaptitud, 5. Otros: IFA integrado, IFA subclase, Zonificación ambiental, Condición de uso de la tierra.
Para el caso de los Planes de Manejo de los Refugios Mixtos de Vida Silvestre, el detalle técnico de los requerimientos de la cartografía, serán señalados por la Comisión Plenaria de la SETENA en la respectiva Resolución de Contenidos Mínimos de Referencia para cada caso en particular.

Toda la cartografía de la incorporación de la variable ambiental que sea presentada ante SETENA, se remitirá en dos formatos: digital e impreso.
Para el caso del formato digital, debe presentarse como archivos shapefile, raster u otro similar compatible con el programa QGIS; en un dispositivo de almacenamiento externo como por ejemplo USB, DVD o similar que pueda permanecer en la SETENA como parte del expediente administrativo que para cada caso o plan se tiene.
Para el caso del formato impreso, debe presentarse cada mapa en un tamaño máximo de doble carta, debidamente doblado y como parte del estudio técnico que corresponda (índice de fragilidad ambiental, análisis de alcance ambiental, reglamento de desarrollo sostenible). En los casos que el proponente así lo requiera, puede aportar de manera adicional, un atlas que contenga los mapas impresos al tamaño que considere necesario para mejorar el detalle de la representación cartográfica.

El Catálogo de Objetos Geográficos para Datos Fundamentales de Costa Rica (NTIG_CR02_01.2016) y el Modelo de Datos Geográficos de Costa Rica Escalas 1:1.000, 1:5.000 y 1:25.000 (NTIG_CR03_01.2016), se aplicará cuando la cartografía se refiera a objetos geográficos que se encuentran incluidos total o parcialmente en la versión publicada y oficial del IGN; esto en tanto que el Catálogo de Objetos Geográficos Temáticos de interés específico para la SETENA sea elaborado por dicha Secretaría y validado por el IGN.
El Sistema de Referencia Geodésico de Costa Rica (NTIG_CR01_01.2016) y el Perfil Oficial de Metadatos Geográficos de Costa Rica (NTIG_CR04_01.2016), se aplicará para todos los casos.
