en la totalidad del texto - Complete Text of Norma 42653 Regulation for the Charging of Special Services by the National Meteorological Institute Complete Text acta: 13DF5E N° 42653-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers conferred in articles 140, subsections 3), 18) and 20) and 146 of the Political Constitution; articles 27, subsection 1) and 28, subsection 2), paragraph b) of the General Law of Public Administration N° 6227 of May 2, 1978; articles 1, 3, 4 and 5 of the Organic Law of the Ministry of Environment and Energy N°7152 of June 5, 1990; and article 12 subsections c) and e) of the Law Creating the National Meteorological Institute N° 5222 of June 26, 1973.
I.-That the National Meteorological Institute (IMN) is a technical-scientific body founded on April 7, 1888, as the entity responsible for the continuous monitoring of weather and climate, for weather research, variability and climate change, for prevention and mitigation of the impacts caused by extreme hydrometeorological phenomena, to protect the atmosphere and the environment, as well as to promote mitigation and adaptation to climate change, providing the Costa Rican population, the maritime, aeronautical and productive sectors of the country, with timely and effective access to high-quality meteorological and climatic information.
II.-That the Law Creating the National Meteorological Institute N° 5222, dates from June 26, 1973, and in its article 12 subsection c), authorizes income from services, regulated by specific regulation, and subsection e) authorizes any other income that the institute obtains by law or donation.
III.-That currently the "Regulation for the Charging of Special Services by the National Meteorological Institute (IMN)" Executive Decree N° 20765-MIRENEM of September 23, 1991, is in force, whose cost structure is outdated in relation to what the preparation, analysis and interpretation of the products and services that the IMN offers demands, not being in accordance with the current functional and operational structure.
IV.-That the activity of the IMN is subject to the fundamental principles of public service, to ensure its continuity and efficiency, to the fulfillment of the objectives of the National Development Plan, which is oriented towards generating inclusive economic growth, contributing to the sanitation of public finances, increasing competitiveness, productivity, through the promotion of innovation, the training of human resources and insertion into the international market.
V.-That currently, to plan for and face the risks that are associated with Climate Change, Global Warming and Extreme Hydrometeorological Events; the demand for meteorological services and information has been increasing exponentially, which requires an independent and particular treatment of basic data and the technical-scientific training of the meteorological activity.
VI.That through official letter N° DVGA-047-2018 of October 22, 2018, the Vice-Ministry of Environmental Management of the Ministry of Environment and Energy requested the review and update of all procedures linked to the substantive activity and the public service provided by the IMN, in order to comply with the provisions of Law N° 8220 of March 4, 2020 and its amendments, Law for the Protection of the Citizen from the Excess of Requirements and Administrative Procedures, as well as Directive N° 20-MP-MEIC of August 3, 2018, Immediate actions for the simplification of procedures in the Bicentennial Government, and due to this update process, the procedure is included in the platform of the National Catalog of Procedures.
VII.-That, in accordance with the Regulation to the Law for the Protection of the Citizen from the Excess of Requirements and Administrative Procedures, Executive Decree Nº 37045-MP-MEIC and its amendments, it was determined that the present proposal does not establish or modify procedures, requirements or processes that the administered party must comply with, a situation for which the process of prior control was not carried out. Therefore, They Decree:
"REGULATION FOR THE CHARGING OF SPECIAL SERVICES BY THE NATIONAL METEOROLOGICAL INSTITUTE"
Considering:
The purpose of this regulation is to establish the rules, procedures and guidelines that will regulate the charging of special services by the National Meteorological Institute (IMN), in accordance with article 12, subsection c) of the Law Creating the National Meteorological Institute, Law N° 5222 of June 26, 1973 and its amendment.
This regulation is of mandatory compliance for all users who request the services and products described in article 3 of this regulation.
III.Special Services. All those services and products that demand from the National Meteorological Institute (IMN) additional costs for preparation, analysis, design, study, research or special interpretation, and therefore subject to charging, shall be considered special services, as detailed in the following cases:
To request the special service, the user must enter the electronic address https://www.imn.ac.cr/web/imn/solicitud-de-servicios, fill in the information online and attach the requested documentation.
The cost of the service and/or product shall be estimated taking into consideration the costs of reproduction of the material, application of numerical models, climatic data projections, additional research, equipment, per diem (viáticos) and cost for travel and transportation, in accordance with the provisions of the Regulation on Travel and Transportation Expenses for Public Officials of the Comptroller General of the Republic and its updates, when applicable.
Furthermore, it is calculated based on the value of the average hour of the salary of the public official. To do this, the average monthly gross income of all the officials of the Department of Meteorological Information (DIM) must be considered; according to the current Public Administration Salary Scale, this calculation of the value of the average hour is obtained as follows:

SBM= Sum of the Gross Monthly Salaries of all DIM officials CFDIM= Number of DIM officials SBPM= Average Monthly Gross Salary 240H= Monthly working hours VHP= Value of the average hour These costs must be updated each time adjustments are decreed to the salaries of public sector officials.
The DIM shall be responsible for determining the cost for the requested special service, based on what is indicated in the previous article; having to communicate the corresponding amount to the interested party to obtain their approval within a period of three business days, prior to starting the preparation of the requested work.
Payment for the services to be provided must be made by means of a transfer or a deposit to the bank account indicated on the IMN website. Said income must be deposited in the Single State Treasury (Caja Única del Estado) and will be incorporated into the IMN budget each year.
The IMN shall provide free of charge those services of general interest, which are detailed below:
The IMN shall provide all the data, products and services it offers free of charge to central and decentralized public institutions and public enterprises, provided they are not for commercial purposes; this service may be provided through the application of the principle of inter-institutional cooperation or when there is a cooperation agreement signed between the institutions.
For carrying out research works and projects from educational centers, the IMN shall provide the required data in digital format, free of charge. In these cases, the student and the professor must enter the address www.imn.ac.cr/web/imn/solicitud-de-servicios, fill in the information online and attach the requested documentation.
The "Regulation for the Charging of Special Services by the National Meteorological Institute (IMN)", Executive Decree Nº 20765-MIRENEM of September 23, 1991, published in La Gaceta N° 199 of October 18, 1991, is hereby repealed.
This Regulation shall come into effect upon its publication in the Official Gazette La Gaceta.

I.-Que el Instituto Meteorológico Nacional (IMN) es un organismo técnico científico fundado el 7 de abril de 1888, como ente responsable de la vigilancia continua del tiempo y del clima, de la investigación del tiempo, la variabilidad y el cambio climático, para prevención y mitigación de los impactos provocados por los fenómenos hidrometeorológicos extremos, para proteger la atmósfera y el ambiente, así como fomentar la mitigación y adaptación al cambio climático, facilitando a la población costarricense, a los sectores marítimo, aeronáutico y productivos del país, el acceso oportuno y eficaz a una información meteorológica y climática de alta calidad.
II.-Que la ley de Creación del Instituto Meteorológico Nacional N° 5222, data del 26 de junio de 1973, y en su artículo 12 inciso c), autoriza los ingresos por servicios, regulados por reglamento específico y el inciso e) autoriza cualesquiera otros ingresos que por ley o donaciones obtenga el instituto.
III.-Que actualmente está vigente el "Reglamento para el cobro de servicios especiales por parte del Instituto Meteorológico Nacional (IMN)" Decreto Ejecutivo N° 20765-MIRENEM del 23 de septiembre de 1991, cuya estructura de costos se encuentra desactualizada en relación con lo que demanda la preparación, análisis e interpretación de los productos y servicios que ofrece el IMN, no estando acorde con la estructura funcional y operativa actual.
IV.-Que la actividad del IMN está sujeta a los principios fundamentales del servicio público, para asegurar su continuidad y eficiencia, al cumplimiento a los objetivos del Plan Nacional de Desarrollo, que se orienta a generar un crecimiento económico inclusivo, coadyuvando al saneamiento de las finanzas públicas, incrementando la competitividad, la productividad, mediante el fomento de la innovación, la capacitación del recurso humano y la inserción al mercado internacional.
V.-Que actualmente, para planificar y enfrentar los riesgos que se asocian al Cambio Climático, el Calentamiento Global y los Eventos Hidrometeorológicos Extremos; la demanda de los servicios e información meteorológica ha ido aumentando exponencialmente, lo cual exige un tratamiento independiente y particular de los datos básicos y la formación técnica científica de la actividad meteorológica.
VI.Que mediante oficio N° DVGA-047-2018 del 22 de octubre de 2018, el Viceministerio de Gestión Ambiental del Ministerio de Ambiente y Energía solicitó la revisión y actualización de todos los trámites vinculados con la actividad sustantiva y el servicio público que presta el IMN, con el fin de cumplir con las disposiciones de la Ley N° 8220 del 4 de marzo de 2020 y sus reformas, Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, así como la Directriz N° 20-MP-MEIC del 3 de agosto de 2018, Acciones inmediatas para la simplificación de trámites en el Gobierno del Bicentenario, y en razón de ese proceso de actualización, se incluye el trámite en la plataforma del Catálogo Nacional de Trámites.
VII.-Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto,
"REGLAMENTO PARA EL COBRO DE SERVICIOS ESPECIALES POR PARTE DEL INSTITUTO METEOROLÓGICO NACIONAL"

El presente reglamento tiene como objeto establecer las normas, procedimientos y directrices que regularán el cobro de servicios especiales por parte del Instituto Meteorológico Nacional (IMN), de conformidad con el artículo 12, inciso c) de la Ley de Creación del Instituto Meteorológico Nacional, Ley N° 5222 del 26 de junio de 1973 y su reforma.
El presente reglamento es de acatamiento obligatorio para todos los usuarios que soliciten los servicios y productos descritos en el artículo 3 de este reglamento.
II.Servicios de interés general. Los descritos en el Artículo 10 de este Decreto Ejecutivo y en el artículo 3° de la Ley N° 5222.
III.Servicios Especiales. Serán considerados servicios especiales todos aquellos servicios y productos que demanden por parte del Instituto Meteorológico Nacional (IMN), costes adicionales de preparación, análisis, diseño, estudio, investigación o interpretación especial y por tanto objeto de cobro, según se detalla en los siguientes casos:
Para solicitar el servicio especial, el usuario deberá ingresar a la dirección electrónica https://www.imn.ac.cr/web/imn/solicitud-de-servicios, llenar la información en línea y adjuntar la documentación solicitada.
El costo del servicio y/o producto se estimará tomando en consideración los costos de reproducción del material, aplicación de modelos numéricos, proyecciones de datos climáticos, investigaciones adicionales, equipo, viáticos y costo por viajes y transporte, conforme lo establecido en el Reglamento de Gastos de Viaje y de Transporte para Funcionarios Públicos de la Contraloría General de la República y sus actualizaciones, cuando proceda.
Además, se calcula con base en el valor de la hora promedio del salario del funcionario público. Para ello se debe considerar el ingreso bruto mensual promedio de todos los funcionarios del Departamento de Información Meteorológica (DIM); según la Escala de Salarios vigente de la Administración Pública, este cálculo del valor de la hora promedio, se obtiene de la siguiente manera:

SBM= Sumatoria de los Salarios Brutos Mensual de todos los funcionarios de DIM CFDIM=Cantidad de funcionarios de DIM SBPM= Salario Bruto promedio mensual 240H= Horas mensuales laborales VHP= Valor hora promedio Estos costos se deben actualizar cada vez que se decreten ajustes a los salarios de los funcionarios del sector público.
El DIM será el encargado de determinar el costo por el servicio especial solicitado, con fundamento en lo señalado en el artículo anterior; debiendo comunicar lo correspondiente al interesado para obtener su aprobación en un plazo de tres días hábiles, de previo a iniciar la elaboración del trabajo solicitado.
El pago por los servicios a brindar se debe realizar por medio de transferencia o por un depósito a la cuenta bancaria indicada en la página web del IMN. Dichos ingresos se deben depositar en la Caja Única del Estado y se incorporarán al presupuesto del IMN de cada año.
El IMN proveerá gratuitamente aquellos servicios de interés general, que se detallan a continuación:
El IMN prestará todos los datos, productos y servicios que brinda en forma gratuita a las instituciones públicas centrales, descentralizadas y a las empresas públicas, siempre y cuando no sean para fines comerciales, este servicio puede ser brindado mediante la aplicación del principio de cooperación interinstitucional o cuando medie un convenio de cooperación suscrito entre las instituciones.
Para la realización de trabajos y proyectos de investigación de centros educativos, el IMN proveerá los datos requeridos en formato digital, de manera gratuita. En estos casos, el estudiante y el profesor deberán ingresar a la dirección www.imn.ac.cr/web/imn/solicitud-de-servicios, llenar la información en línea y adjuntar la documentación solicitada.
Deróguese el "Reglamento para el cobro de servicios especiales por parte del Instituto Meteorológico Nacional (IMN)", Decreto Ejecutivo Nº20765¬MIRENEM del 23 de septiembre de 1991, publicado en La Gaceta N° 199 del 18 de octubre de 1991.
El presente Reglamento empezará a regir a partir de su publicación en el Diario Oficial La Gaceta.
