In that same sense, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture, Law 7384, determines in its Article 5, subsection ch), that it is the responsibility of Incopesca to regulate the supply of fishery production intended for human consumption in domestic markets and of raw material for the national industry.

The discretionary nature is evident in the assessment that the Costa Rican Institute of Fisheries and Aquaculture may carry out in light of the need to ensure the most adequate conservation and exploitation of the marine resource; however, such nature does not confer upon that institution an unlimited power of action, since the Costa Rican legal system establishes that its decisions regarding the fishery resource must be based on the availability of the resource, the need for local consumption, and the supply of raw material for Costa Rican industry.

10.—That the national tuna industry has expressed, by means of official communication dated September 22, 2020, and a sworn statement on file, the request to expand the catch quota (cuota de captura) for nationally sourced tuna for the remainder of 2020, given the eventuality of lacking raw material to meet the delivery commitments acquired for this year, indicating the need to increase the available amount of originally authorized nationally sourced tuna, which, once analyzed in accordance with the data and information obtained, is feasible for up to 9686 MT.

11.—That the Directorate of Fisheries and Aquaculture Management, through official communication DGT-194-2020, taking into consideration a data update and assessing the best available information, suggests an adjustment of the extraction quota (cuota de extracción) for the year 2020.

12.—That for making these decisions, it has been determined that the unequivocal rules of logic and science are not being contravened; in any event, the aim is to establish food security (seguridad alimentaria) given the population's need for protein at accessible costs to feed families, besides the fact that current legislation did not contemplate the eventual situation of the national processing industry's need for more raw material in the face of events such as those currently being experienced; reasons for which, and in response to what that industry has stated, it is necessary to adopt the following agreement, such that it does not contravene the legal system, ensures the sustainability of the fishery resource, and addresses the food needs of Costa Ricans in light of the situations caused by the Covid-19 pandemic, for which the Government of the Republic has issued directives to public institutions to do whatever is legally and technically appropriate to address the consequences of the pandemic.

13.—That this provision does not contravene private interests, while it is adopted in consideration of the superior public interest of supplying raw material to the national processing industry to produce food at accessible prices for Costa Rican families in the face of the consequences generated by Covid-19.

14.—That the necessary criteria and inputs for adopting this agreement are available and have been duly analyzed within the Board of Directors, and, taking into account criteria of reasonableness and proportionality, but above all to satisfy the superior public interest of the State to provide food security to the inhabitants of the Republic, the Board of Directors resolves: Therefore The Board of Directors of Incopesca agrees.

INCOPESCA shall grant, for the year 2020, fishing licenses to foreign-flagged purse-seine tuna vessels, up to a total of 9686 metric tons of frozen brine tuna, which must be verified based on unloadings performed in port for supply to the national processing industry.

En ese mismo sentido La Ley de Creación del Instituto Costarricense de pesca y Acuicultura, Ley 7384, determina en su artículo 5 inciso ch) que corresponde al Incopesca regular el abastecimiento de la producción pesquera, destinada al consumo humano en los mercados internos y el de materia prima para la industria nacional.

La discrecionalidad se evidencia en la valoración que puede efectuar el Instituto Costarricense de Pesca y Acuicultura ante la necesidad de garantizar la más adecuada conservación y institución un poder de actuación ilimitado, ya que el ordenamiento costarricense establece que sus decisiones en torno al recurso pesquero deben estar fundamentadas en la disponibilidad del recurso, la necesidad del consumo local y suministro de materia prima para la industria costarricense.

10.-Que la industria atunera nacional ha manifestado por medio de oficio de fecha de 22 de setiembre de 2020 y declaración jurada que consta en el para lo que resta del año 2020, ante la eventualidad de carecer de materia prima para poder cumplir con los compromisos adquiridos de entrega para el presente año, señalando la necesidad de que se aumente el disponible de atún de origen nacional originalmente autorizado, mismo que una vez analizado en concordancia con los datos e información obtenida, es factible hasta por 9686 TM.

11.-Que la Dirección de Ordenamiento Pesquero y Acuícola mediante oficio DGT-194-2020 tomando en consideración una actualización de datos y valorando la mejor información disponible, sugiere un ajuste de la cuota de extracción para el año 2020.

12.-Que para la toma de estas decisiones se ha determinado que no se está contraviniendo las reglas inequívocas de la lógica y la ciencia, de toda suerte que se busca establecer seguridad alimentaria ante la necesidad de la población de contar con proteína a costos accesibles para alimentar a las familias, amén de que la legislación vigente no contempló la eventual situación de necesidad de la industria procesadora nacional de contar con más materia prima, ante acontecimientos como los que se viven en la actualidad, motivos por los cuales y ante lo manifestado por dicha industria, se hace necesario adoptar el siguiente acuerdo, de manera que no contraviene el ordenamiento jurídico, se asegura la sostenibilidad del recurso pesquero y la atención de alimentos que los costarricenses necesitan, ante las situaciones causadas por la pandemia del Covid 19, ante lo cual el Gobierno de la República, ha girado las directrices a las instituciones públicas, de hacer lo que jurídica y técnicamente sea procedente para atender las consecuencias de la pandemia.

13.-Que esta disposición no contraviene intereses particulares, al tiempo que se adopta en atención del interés público superior de suplir materia prima a la industria procesadora nacional para elaborar alimentos a precios accesibles para las familias costarricenses ante las consecuencias generadas por el Covid-19.

14.-Que se cuenta con los criterios e insumos necesarios para adoptar el presente acuerdo y han sido debidamente analizados en el seno la Junta Directiva, siendo que, atendiendo criterios de razonabilidad y proporcionalidad, pero sobre todo sobre satisfacer el interés públicos superior de Estado de dar seguridad alimentaria a los habitantes de la República, la Junta Directiva, resuelve: Por tanto La Junta Directiva de Incopesca acuerda.

El INCOPESCA otorgará para el año 2020, licencias de pesca a embarcaciones atuneras con red de cerco de bandera extranjera, hasta completar un total de 9686 toneladas métricas de atún congelado en salmuera, las cuales deberán verificarse según descargas realizadas en puerto para abastecimiento de la industria procesadora nacional.
