Technical Grade Active Ingredient, Formulated Chemical Pesticides, Related Substances, Adjuvants, and Physical Vehicles for Agricultural Use. Requirements for the Preparation of Labels and Leaflets", in the form set forth as an Annex to Resolution No. 401-2018 (COMIECO- LXXXIII) of June 28, 2018. The Central American Technical Regulation in question must be modified by virtue of the provisions in the fourth paragraph of the recitals and numeral 1 of the operative part of Resolution No. 424-2020 (COMIECO-XCI) of June 23, 2020.

That in accordance with Articles 38, 39, and 55 of the Protocol to the General Treaty on Central American Economic Integration (Protocol of Guatemala), amended by the Amendment of February 27, 2002, the Council of Ministers of Economic Integration (COMIECO) has jurisdiction over matters of Central American Economic Integration and, as such, it is responsible for approving administrative acts applicable in the States Parties of the Economic Subsystem; That according to Articles 7 and 26 of the Protocol of Guatemala, the States Parties have agreed to establish a process of regional harmonization of technical regulations; That through Resolution No. 401-2018 (COMIECOLXXXIII), of June 28, 2018, COMIECO approved the Central American Technical Regulation RTCA 65.05.67:18 Agricultural Inputs. Technical Grade Active Ingredient, Formulated Chemical Pesticides, Related Substances, Adjuvants, and Physical Vehicles for Agricultural Use. I.-Que el Consejo de Ministros de Integración Económica (COMIECO), mediante la Resolución N° 424-2020 (COMIECOXCI) del 23 del junio de 2020, en el marco del proceso de conformación de una Unión Aduanera Centroamericana, aprobó la modificación del primer párrafo del Transitorio I del "Reglamento Técnico Centroamericano RTCA 65.05.67:18 Insumos Agrícolas. Ingrediente Activo Grado Técnico, Plaguicidas Químicos Formulados, Sustancias Afines, Coadyuvantes y Vehículos Físicos de Uso Agrícola. Requisitos para la Elaboración de Etiquetas y Panfletos", en la forma en que aparece en el numeral 1 de la parte dispositiva de la Resolución en mención.
II.-Que mediante el Decreto Ejecutivo N° 41400-COMEXMEIC- MAG del 16 de julio de 2018, divulgado en el Alcance N° 199 al Diario Oficial La Gaceta N° 218 del 23 de noviembre de 2018, Costa Rica publicó el "Reglamento Técnico Centroamericano RTCA 65.05.67:18 Insumos Agrícolas. Ingrediente Activo Grado Técnico, Plaguicidas Químicos Formulados, Sustancias Afines, Coadyuvantes y Vehículos Físicos de Uso Agrícola. Requisitos para la Elaboración de Etiquetas y Panfletos", en la forma en que aparece como Anexo de la Resolución N° 401-2018 (COMIECO- LXXXIII) del 28 de junio de 2018. El Reglamento Técnico Centroamericano en comentario debe modificarse en virtud de lo dispuesto en el párrafo cuarto de la parte considerativa y el numeral 1 de la parte dispositiva de la Resolución N° 424-2020 (COMIECO-XCI) de 23 del junio de 2020.
III.-Que en cumplimiento de lo indicado en el numeral 2 de la parte dispositiva de la Resolución N° 424-2020 (COMIECO-XCI) de 23 del junio de 2020, se procede a su publicación. Por tanto,

Que de conformidad con los artículos 38, 39 y 55 del Protocolo al Tratado General de Integración Económica Centroamericana (Protocolo de Guatemala), modificado por la Enmienda del 27 de febrero de 2002, el Consejo de Ministros de Integración Económica (COMIECO), tiene bajo su competencia los asuntos de la Integración Económica Centroamericana y, como tal, le corresponde aprobar los actos administrativos aplicables en los Estados Parte del Subsistema Económico; Que según los artículos 7 y 26 del Protocolo de Guatemala, los Estados Parte han convenido en establecer un proceso de armonización regional de la normativa técnica; Que mediante la Resolución Nº 401-2018 (COMIECOLXXXIII), del 28 de junio de 2018, el COMIECO aprobó el Reglamento Técnico Centroamericano RTCA 65.05.67:18 Insumos Agrícolas. Ingrediente Activo Grado Técnico, Plaguicidas Químicos Formulados, Sustancias Afines, Coadyuvantes y Vehículos Físicos de Uso Agrícola.
