"The Governments of the Member States of the Organization of American States.

Having Seen: The constant looting and plundering that the countries of the continent, mainly the Latin American ones, have suffered in their autochthonous cultural heritage (patrimonios culturales autóctonos), and Considering: That such depredatory acts have damaged and diminished the archaeological, historical, and artistic riches through which the national character of their respective peoples is expressed; That it is a fundamental obligation to transmit the legacy of the cultural heritage (acervo cultural) to future generations; That the defense and conservation of this heritage can only be achieved through the mutual appreciation and respect of such property, within the framework of the strongest inter-American cooperation; That the will of the Member States to establish norms for the protection and vigilance of the archaeological, historical, and artistic heritage has been repeatedly demonstrated; Declare: That it is essential to adopt, both nationally and internationally, the most effective measures leading to the adequate protection, defense, and recovery of cultural property and Have agreed as follows:

The purpose of this Convention is the identification, registration, protection, and vigilance of the property comprising the cultural heritage of the American nations, in order to: a) prevent the illicit export or import of cultural property, and b) promote cooperation among the American States for the mutual knowledge and appreciation of their cultural property.

The cultural property referred to in the preceding article is that included in the following categories:

• a)monuments, objects, fragments of dismembered buildings, and archaeological material belonging to American cultures prior to contact with European culture, as well as human, faunal, and floral remains related to them; b) monuments, buildings, artistic, utilitarian, and ethnological objects, whole or dismembered, from the colonial period, as well as those corresponding to the 19th century; c) libraries and archives; incunabula, books and other publications, iconographies, maps, and documents published up to the year 1850; d) all property originating after 1850 that the States Parties have registered as cultural property, provided they have notified such registration to the other Parties to the Treaty; e) all cultural property that any of the States Parties expressly declare or manifest to include within the scope of this Convention.

The cultural property included in the preceding article shall be subject to the maximum protection at the international level, and its export and import shall be considered illicit, unless the State to which it belongs authorizes its export for the purposes of promoting knowledge of national cultures.

Any disagreement between Parties to this Convention concerning the application of the definitions and categories of Article 2 to specific property shall be resolved definitively by the Inter-American Council for Education, Science, and Culture (CIECC), following a recommendation from the Inter-American Committee on Culture (CIDEC).

The property mentioned in Article 2, found or created within its territory, and that legally acquired from other countries, belongs to the Cultural Heritage of each State.

The ownership (dominio) of each State over its Cultural Heritage and the replevin actions (acciones reivindicatorias) regarding the property constituting it are imprescriptible.

The ownership regime for cultural property and its possession and alienation within the territory of each State shall be regulated by its domestic legislation. In order to prevent the illicit trade of such property, the following measures shall be promoted:

• a)registration of collections and of the transfer of cultural property subject to protection; b) registration of transactions carried out in establishments dedicated to the purchase and sale of said property; c) prohibition of importing cultural property from other States without the corresponding certificate and authorization.

Each State is responsible for the identification, registration, protection, conservation, and vigilance of its cultural heritage; to fulfill this function, it undertakes to promote:

• a)the preparation of the legislative and regulatory provisions needed to effectively protect said heritage against destruction through abandonment or inadequate conservation work; b) the creation of technical bodies specifically responsible for the protection and vigilance of cultural property; c) the formation and maintenance of an inventory and a registry of cultural property to allow for its identification and location; d) the creation and development of museums, libraries, archives, and other centers dedicated to the protection and conservation of cultural property; e) the delimitation and protection of archaeological sites (lugares arqueológicos) and those of historical and artistic interest; f) the exploration, excavation, research, and conservation of archaeological sites and objects by scientific institutions, carried out in collaboration with the national body responsible for the archaeological heritage.

Each State Party shall prevent, by all means within its power, illicit excavations in its respective territory and the removal of cultural property derived from them.

Each State Party undertakes to take the measures it deems effective to prevent and suppress the illicit export, import, and alienation of cultural property, as well as those necessary to return it to the State to which it belongs, should it have been stolen.

Upon learning of the illicit export of one of its cultural property items, the Government of a State Party may address the Government of the State to which the property has been transferred, requesting that it take the measures conducive to its recovery and return. Such actions shall be undertaken through diplomatic channels and shall be accompanied by proof of the illegality of the export of the property in question, in accordance with the law of the requesting State, proof that shall be considered by the requested State.

The requested State shall use all legal means at its disposal to locate, recover, and return the cultural property claimed that was stolen after the entry into force of this Convention.

If the legislation of the requested State requires judicial action for the replevin of a foreign cultural property imported or alienated illicitly, such judicial action shall be brought before the respective courts by the competent authority of the requested State. The requesting State also has the right to bring the pertinent judicial actions in the requested State for the replevin of the stolen property and for the application of the corresponding sanctions to those responsible.

As soon as the State is able to do so, it shall return the stolen cultural property to the requesting State. The expenses derived from the return of said property shall be provisionally covered by the requested State, without prejudice to the actions or proceedings available to it for reimbursement of said expenses.

No tax or fiscal charge shall be applied to cultural property returned pursuant to the provisions of Article 12.

Those responsible for crimes committed against the integrity of cultural property or resulting from its illicit export or import are subject to extradition treaties, when their application is appropriate.

The States Parties undertake to cooperate for the mutual knowledge and appreciation of their cultural values through the following means:

• a)facilitating the circulation, exchange, and exhibition of cultural property from other States for educational, scientific, and cultural purposes, as well as that of their own cultural property in other countries, when authorized by the corresponding governmental bodies; b) promoting the exchange of information on cultural property and on archaeological excavations and discoveries.

Property that is outside the State to whose cultural heritage it belongs, on loan to museums or exhibitions or scientific institutions, shall not be subject to seizure arising from public or private judicial actions.

In order to fulfill the objectives of this Convention, the General Secretariat of the Organization of American States is entrusted with:

• a)ensuring the application and effectiveness of this Convention; b) promoting the adoption of collective measures aimed at the protection and conservation of the cultural property of the American States; c) establishing an Inter-American Registry of cultural property, movable and immovable, of special value; d) promoting the harmonization of national legislation on this matter; e) granting and managing the technical cooperation required by the States Parties; f) disseminating information on the cultural property of the States Parties and on the objectives of this Convention; g) promoting the circulation, exchange, and exhibition of cultural property among the States Parties.

None of the provisions of this Convention shall impede the conclusion by the States Parties of bilateral or multilateral agreements relating to their Cultural Heritage, nor shall it limit the application of those currently in force for the same purpose.

This Convention is open for signature by the Member States of the Organization of American States, as well as for accession by any other State.

This Convention shall be ratified by the signatory States in accordance with their respective constitutional procedures.

The original instrument, whose texts in Spanish, French, English, and Portuguese are equally authentic, shall be deposited with the General Secretariat of the Organization of American States, which shall send certified copies to the signatory States for the purposes of its ratification. The instruments of ratification shall be deposited with the General Secretariat of the Organization of American States, and it shall notify said deposit to the signatory governments.

This Convention shall enter into force among the States that ratify it, in the order in which they deposit their respective instruments of ratification.

This Convention shall remain in force indefinitely, but any of the States Parties may denounce it. The denunciation shall be transmitted to the General Secretariat of the Organization of American States, and said Secretariat shall communicate it to the other States Parties. One year after the denunciation, the Convention shall cease to have effect for the denouncing State, remaining in force for the other States Parties.

IN WITNESS WHEREOF, the undersigned Plenipotentiaries, whose full powers were found to be in good and due form, sign this Convention in the city of Washington D.C., on the dates appearing next to their signatures."

Arqueológico, Histórico y Artístico de las Naciones Americanas (Convención de San Salvador), aprobada el 16 de junio de 1976, en el sexto período ordinario de sesiones de la Asamblea General en Santiago de Chile, y cuyo texto es el siguiente:

"Los Gobiernos de los Estados Miembros de la Organización de los Estados Americanos.

Visto: El constante saqueo y despojo que han sufrido los países del continente, principalmente los latinoamericanos, en sus patrimonios culturales autóctonos, y Considerando: Que tales actos depredatorios han dañado y disminuido las riquezas arqueológicas, históricas y artísticas, a través de las cuales se expresa el carácter nacional de sus respectivos pueblos; Que es obligación fundamental transmitir a las generaciones venideras al legado del acervo cultural; Que la defensa y conservación de este patrimonio sólo,o puede lograrse mediante el aprecio y respeto mutuos de tales bienes, en el marco de la más sólida cooperación interamericana; Que se ha evidenciado en forma reiterada la voluntad de los Estados Miembros de establecer normas para la protección y vigilancia del patrimonio arqueológico, histórica y artístico; Declaran: Que es imprescindible adoptar, tanto en el ámbito nacional como en el internacional, medidas de al mayor eficacia conducentes a la adecuada protección, defensa y recuperación de los bienes culturales y Han convenido lo siguiente:

La presente Convención tiene como objeto la identificación, registro, protección y vigilancia de los bienes que integran el patrimonio cultural de las naciones americanas, para: a) impedir la exportación o importación ilícita de bienes culturales, y b) promover la cooperación entre los Estados Americanos par el mutuo conocimiento y apreciación de sus bienes culturales.

Los bienes culturales a que se refiere el artículo precedente son aquellos que se incluyen en las siguientes categorías:

• a)monumentos, objetos, fragmentos de edificios desmembrados y material arqueológico, pertenecientes a las culturas americanas anteriores a los contactos con la cultura europea, así como los restos humanos, de la fauna y flora, relacionados con las mismas; b) monumentos, edificios, objetos artísticos, utilitarios, etnológicos, íntegros o desmembrados, de la época colonial, así como los correspondientes al siglo XIX; c) bibliotecas y archivos; incunables, libros y otras publicaciones, iconografías, mapas y documentos editados hasta el año de 1850; d) todos aquellos bienes de origen posterior a 1850 que los Estados Partes tengan registrados como bienes culturales, siempre que hayan notificado tal registro a las demás Partes del Tratado; e) todos aquellos bienes culturales que cualesquiera de los Estados Partes declaren o manifiesten expresamente incluir dentro de los alcances de esta Convención.

Los bienes culturales comprendidos en el artículo anterior serán objeto de máxima protección a nivel internacional, y se considerarán ilícitas su exportación en importación, salvo que el Estado a que pertenecen autorice su exportación para los fines de promover el conocimiento de las culturas nacionales.

Cualquier desacuerdo entre Partes de esta Convención acerca de la aplicación de las definiciones y categorías del artículo 2 a bienes específicos, será resuelto en forma definitiva por el Consejo Interamericano par le Educación, la Ciencia y la Cultura (CIECC), previo dictamen del comité Interamericano de Cultura (CIDEC).

Pertenecen al Patrimonio Cultural de cada Estado los bienes mencionados en el artículo 2, hallados o creados en su territorio y los procedentes de otros países, legalmente adquiridos.

El dominio de cada Estado sobre su Patrimonio Cultural y las acciones reivindicatorias relativas a los bienes que lo constituyen son imprescriptibles.

El régimen de propiedad de los bienes culturales y su posesión y enajenación dentro del territorio de cada Estado serán regulados por su legislación interna. Con el objeto de impedir el comercio ilícito de tales bienes se promoverán las siguientes medidas:

• a)registro de colecciones y del traspaso de los bienes culturales sujetos a protección; b) registro de la transacciones que se realicen en los establecimientos dedicados a la compro y venta de dichos bienes; c) prohibición de importar bienes culturales procedentes de otros Estados sin el certificado y la autorización correspondiente.

Cada Estado es responsable de la identificación, registro, protección, conservación y vigilancia de su patrimonio cultural, para cumplir tal función se compromete a promover:

• a)la preparación de las disposiciones legislativas y reglamentarias que se necesiten para proteger eficazmente dicho patrimonio contra la destrucción por abandono o por trabajos de conservación inadecuados; b) la creación de organismos técnicos encargados específicamente de al protección y vigilancia de los bienes culturales c) la formación y mantenimiento de un inventario y un registro de los bienes culturales que permitan identificarlos y localizarlos; d) la creación y desarrollo de museos, bibliotecas, archivos y otros centros dedicados a la protección y conservación de los bienes culturales; e) la delimitación y protección de los lugares arqueológicos y de interés histórico y artístico; f) la exploración, excavación, investigación y conservación de lugares y objetos arqueológicos por instituciones científicas que las realicen en colaboración con el organismo nacional encargado del patrimonio arqueológico.

Cada Estado Parte deberá impedir por todos los medios a su alcance las excavaciones ilícitas en su respectivo territorio y la sustracción de los bienes culturales procedentes a ellas.

Cada Estado Parte se compromete a tomar las medidas que considere eficaces para prevenir y reprimir la exportación, importación y enajenación ilícitas de bienes culturales, así como las que sean necesarias par restituirlas al Estado a que pertenecen, en caso de haberle sido sustraídos.

Al tener conocimiento el Gobierno de un Estado Parte de la exportación ilícita de uno se sus bienes culturales, podrán dirigirse al Gobierno del Estado adonde el bien haya sido trasladado, pidiéndole, que tomo las medidas conducentes a su recuperación y restitución. Dichas gestiones se harán por la vía diplomática y se acompañarán de las pruebas de lailicitud de la exportación del bien de que se trata, de conformidad con la ley del Estado requirente, pruebas que serán consideradas por el Estado requerido.

El Estado requerido empleará todos los medios legales a su disposición para localizar, recuperar y devolver los bienes culturales que se reclamen y que hayan sido sustraídos después de la entrada en vigor de esta Convención.

Si la legislación del Estado requerido exige acción judicial para reivindicación de un bien cultural extranjero importado o enajenado en forma ilícita, dicha acción judicial será promovida ante los tribunales respectivos por la autoridad competente del Estado requerido. El Estado requirente también tiene derecho de promover en el Estado requerido las acciones judiciales pertinentes para la reivindicación de los bienes sustraídos y para al aplicación de las sanciones correspondientes a los responsables.

Tan pronto como el Estado este en posibilidad de hacerlo, restituirá el bien cultural sustraído al Estado requirente. Los gastos derivados de la restitución de dicho bien serán cubiertos provisionalmente por el Estado requerido, sin perjuicio de las gestiones o acciones que le competan para ser resarcido por dichos gastos.

No se aplicará ningún impuesto ni carga fiscal a los bienes culturales restituidos según lo dispuesto en el artículo 12.

Están sujetos a los tratados sobre extradición, cuando su aplicación fuera procedente, los responsables por delitos cometidos contra la integridad de bienes culturales o los que resulten de su exportación o importación ilícitas.

Los Estados Partes se obligan a coopera para el mutuo conocimiento y apreciación de sus valores culturales para los siguientes medios:

• a)facilitando la circulación, intercambio y exhibición de bienes culturales procedentes de otros Estados, con fines educativos, científicos y culturales, así como de los de sus propios bienes culturales en otros países, cuando sean autorizados por los órganos gubernamentales correspondientes; b) promoviendo el intercambio de informaciones sobre bienes culturales y sobre excavaciones y descubrimientos arqueológicos.

Los bienes que se encuentren fuera del Esto a cuyo patrimonio cultural pertenecen, en carácter de préstamo a museos o exposiciones o instituciones científicas, no serán objeto de embargo originado en acciones judiciales públicas o privadas.

A fin de cumplir con los objetivos de la presente Convención, se encomienda a la Secretaría General de la Organización de los Estado Americanos:

• a)velar por la aplicación y efectividad de esta Convención; b) promover la adopción de medidas colectivas destinadas a la protección y conservación de los bienes culturales de los Estados Americanos; c) establecer un Registro Interamericano de bienes culturales, muebles e inmuebles, de especial valor; d) promover la armonización de las legislaciones nacionales sobre esta materia; e) otorgar y gestionar la cooperación técnica que requieran los Estados Partes; f) difundir informaciones sobre los bienes culturales de los Estados Partes y sobre los objetivos de esta Convención; g) promover la circulación, intercambio y exhibición de bienes culturales entre los Estados Partes.

Ninguna de las disposiciones de esta Convención impedirá la concertación por los Estados Partes, de acuerdos bilaterales o multilaterales relativos a su Patrimonio Cultural, ni limitará la aplicación de los que se encuentran vigentes para el mismo fin.

La presente Convención queda abierta a la firma de los Estados Miembros de la Organización de los Estados Americanos, así como a la adhesión de cualquier otro Estado.

La presente Convención será ratificada por los Estados signatarios de acuerdo con sus respectivos procedimientos constitucionales.

El instrumento original, cuyos textos en español, francés, inglés y portugués son igualmente auténticos, será depositado en la Secretaría General de la Organización de los Estados Americanos, la cual enviará copias certificadas a los Estados signatarios para los fines de su ratificación. Los instrumentos de ratificación serán depositado en la Secretaria General de la Organización de los Estado Americanos y Esta notificará dicho depósito a los gobierno signatarios.

La presente Convención estará en vigor entre los Estados que la ratifiquen, en el orden en que depositen los instrumentos de sus respectivas ratificaciones.

La presente Convención regirá indefinidamente, pero cualquiera de los Estados Partes podrá denunciarla. La denuncia será transmitida a la Secretaría General de la Organización de los Estados Americanos y dicha Secretaría la comunicará a los demás Estados Partes. Transcurrido un año a partir de la denuncia, la Convención cesará en sus efectos para el Estado denunciante, quedando subsistente para los demás Estados Partes.

EN FE DE LO CUAL, los Plenipotenciarios, infrascritos, cuyos plenos poderes fueron hallados en buena y debida forma, firman esta Convención en la ciudad de Washington D.C., en las fechas que aparecen junto a sus firmas.
