AUTHORIZATION FOR THE MINISTRY OF FINANCE TO RECEIVE, IN DACIÓN DE PAGO, TWO FARMS OWNED BY THE BANK OF COSTA RICA, TO TRANSFER THEM TO THE MINISTRY OF AGRICULTURE AND LIVESTOCK FOR THE INSTALLATION OF AN EXPERIMENTAL FARM, THE SEGREGATION AND TRANSFER OF PARCELS TO FARMERS OF THE PROVINCE OF CARTAGO AND THE INSTALLATION OF A WAREHOUSE ZONE FOR THE INSTALLATION OF AN AGRO-INDUSTRY IN CARTAGO

DECREES:

a)Farm registered in the Public Property Registry, under the folio real system, registration number three - two nine seven six one - zero zero zero (3-29761-000), province of Cartago, with cadastral map number C- one one five two four three five -two zero zero seven (C-1152435-2007).
b)Farm registered in the Public Property Registry, under the folio real system, registration number three -six eight four zero zero - zero zero zero (3-68400-000), province of Cartago, with cadastral map number C- one seven seven two seven four seven -two zero one four (C-1772747-2014).

The MAG, through the National Institute of Innovation and Transfer in Agricultural Technology (INTA), shall use that land for the installation of a seedling production and seed reproduction center and a collection center for agricultural and agro-industrial products from producers in the surrounding areas in the province of Cartago. The MAG shall enter into a cooperation, research, production, commercialization, and administration agreement for the collection center with the Cooperativa Comercializadora de Hortalizas del Irazú R.L., legal identification number three - zero zero four - seven eight seven three four two (3-004-787342).

For this agreement to be effective, the aforementioned Cooperative shall permit the affiliation of any farmer who wishes to join during the start-up and development of the project.

In the event that said agreement does not satisfy the purposes established in this article, another formally constituted agricultural organization with sufficient installed capacity for its proper development shall be sought.

The Ministry of Agriculture and Livestock is empowered to establish cooperation agreements with cooperatives and with public and private institutions, within the framework of satisfying the objectives and purposes established in this article.

a)For the purposes of parceling out and assigning agricultural farms to families who will develop productive enterprises based on high-technology agriculture on them, incorporating not only the use of smart machines such as sensors, equipment for detecting heavy metals in water and soil, as well as agricultural application equipment that allows reducing the chemical load and better use of water resources. For this purpose, fifty percent (50%) of the total land usable for agricultural purposes shall be allocated, to be distributed among farming families in the northern zone of the province of Cartago, which includes the districts of Tierra Blanca, Llano Grande, Potrero Cerrado, Santa Rosa, Cot, Cipreses de Oreamuno and the entirety of the canton of Alvarado.

To be beneficiaries of the agricultural farms, the benefiting families must meet the requirements established by the Institute of Rural Development and also commit to implementing and executing the agricultural production guidelines, under smart systems established by the INTA-MAG, in compliance with the requirements stipulated by the Inder.

b)The remainder of the farm shall be transferred to the Ministry of Agriculture and Livestock so that, through the INTA, a high-technology experimental farm applied to agriculture can be developed, including a training center for smart agriculture and a demonstration park with sustainable technology agriculture systems.

AUTORIZACIÓN AL MINISTERIO DE HACIENDA PARA QUE RECIBA, EN DACIÓN DE PAGO, DOS FINCAS PROPIEDAD DEL BANCO DE COSTA RICA, PARA TRASLADARLAS AL MINISTERIO DE AGRICULTURA Y GANADERÍA PARA LA INSTALACIÓN DE UNA FINCA EXPERIMENTAL, LA SEGREGACIÓN Y ENTREGA DE PARCELAS A AGRICULTORES DE LA PROVINCIA DE CARTAGO Y LA INSTALACIÓN DE UNA ZONA DE BODEGAS PARA LA INSTALACIÓN DE UNA AGROINDUSTRIA EN CARTAGO

DECRETA:

a)Finca inscrita en el Registro Público de la Propiedad, bajo el sistema de folio real matrícula tres - dos nueve siete seis uno - cero cero cero (3-29761-000), provincia de Cartago, con el número de plano catastrado C- uno uno cinco dos cuatro tres cinco -dos cero cero siete (C-1152435-2007).
b)Finca inscrita en el Registro Público de la Propiedad, bajo el sistema de folio real matrícula tres -seis ocho cuatro cero cero - cero cero cero (3-68400-000), provincia de Cartago, con el número de plano catastrado C- uno siete siete dos siete cuatro siete -dos cero uno cuatro (C-1772747-2014).

El MAG, por medio del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), dispondrá de ese terreno para la instalación de un centro de producción de plántulas y reproducción de semillas y un centro de acopio para productos agrícolas y agroindustriales de los productores de las zonas aledañas en la provincia de Cartago. El MAG celebrará un convenio de cooperación, investigación, producción, comercialización y administración del centro de acopio con la Cooperativa Comercializadora de Hortalizas del lrazú R.L., cédula jurídica tres - cero cero cuatro - siete ocho siete tres cuatro dos (3-004-787342).

Para que este convenio sea efectivo, la Cooperativa antes mencionada permitirá la afiliación de cualquier agricultor o agricultora que desee incorporarse durante el inicio y desarrollo del proyecto.

En caso de que dicho convenio no satisfaga los fines establecidos en el presente artículo, se buscará otra organización agrícola formalmente constituida con las capacidades instaladas suficientes para su correcto desarrollo.

El Ministerio de Agricultura y Ganadería queda facultado para establecer convenios de cooperación con cooperativas y con instituciones públicas y privadas, en el marco de satisfacer los objetivos y fines establecidos en este artículo.

a)Para fines de parcelación y asignación de granjas agrícolas a familias que desarrollarán en ellas emprendimientos productivos basados en una agricultura de alta tecnología, que incorpore no solo el uso de máquinas inteligentes como sensores, equipos para detección de metales pesados en aguas y suelos, así como equipos de aplicación agrícola que permitan reducir la carga química y un mejor uso del recurso hídrico. Con este propósito, se destinará un cincuenta por ciento (50%) del total del terreno aprovechable a fines agrícolas, para distribuirlo entre las familias agricultoras de la zona norte de la provincia de Cartago, que incluye los distritos de Tierra Blanca, Llano Grande, Potrero Cerrado, Santa Rosa, Cot, Cipreses de Oreamuno y la totalidad del cantón de Alvarado.

Para ser beneficiarios de las granjas agrícolas, las familias beneficiarias deberán cumplir con los requisitos establecidos por el Instituto de Desarrollo Rural y además comprometerse a implementar y ejecutar las pautas de producción agropecuaria, bajo sistemas inteligentes que establezca el INTA-MAG, en atención de los requisitos estipulados por el lnder.

b)El resto de la finca será trasladado al Ministerio de Agricultura y Ganadería para que, por medio del INTA, se pueda desarrollar una finca centro de capacitación en agricultura inteligente y un parque demostrativo con los sistemas de agricultura con tecnología sostenible.

Artículo 1 — The Ministry of Finance is authorized to receive in dación de pago, for pending tax debts with the Bank of Costa Rica or as a deductible expense, the following farms owned by it:

Artículo 2 — The amount covered from the debts, or for the purposes of the estimation for the dación en pago of both properties, shall be that determined by the appraisal performed by the Ministry of Finance.

Artículo 1 — Se autoriza al Ministerio de Hacienda para que reciba en dación de pago, por concepto de deudas tributarias pendientes con el Banco de Costa Rica o como gasto deducible, las siguientes fincas de su propiedad:

Artículo 2 — El monto que se cubra de las deudas, o para efectos de la estimación para la dación en pago de ambas propiedades, será el que determine el avalúo que realice el Ministerio de Hacienda.
