1. 1That since the creation of the Costa Rican Institute of Fisheries and Aquaculture, INCOPESCA in 1994, the Institution has utilized a functional structure that has allowed it to operate administratively in accordance with technological changes, international commitments, and new obligations that the Institution has had to assume since its creation.

2º-However, the lack of an organizational structure duly accredited before governmental Institutions has weakened the institutional action since for some actions or activities it is an indispensable requirement, for example the formulation and development of investment projects, managing an increase in human capital, attending to international treaties and agreements, and fundamentally having the management capacity to comply with institutional plans and support the National Development and Public Investment Plan (PNDIP) promoted by each Administration.

1. 3That in view of this, INCOPESCA as the governing body of fisheries and aquaculture in the country, presented, with the support of the Institutional Directors as well as a representative of ANEP, INCOPESCA AFFILIATE, a modernization proposal to the Ministry of National Planning and Economic Policy, MIDEPLAN as a tool that will allow identifying management efforts, creating alliances with public and private entities, establishing inter-institutional coordination strategies, as well as the formulation and monitoring of national and institutional strategic plans.
2. 4That the strengthening of the technical management of the Institute is proposed through the identification of processes such as research for the generation of valuable biological information on the different fishery and aquaculture species and thus guaranteeing their sustainability, as well as reliable, timely, and adequate information in areas such as species capture and reproduction zones, sizes at first sexual maturity, biomass estimation, among others.
3. 4That based on the foregoing, some substantive elements were proposed that reinforce the improvement of Institutional management regarding the support of communities linked to fishery and aquaculture activities in Costa Rica.

5º-On the other hand, the proposal emphasizes the topic of oversight so that processes and activities are developed in accordance with current national and international regulations, placing greater emphasis on topics such as fishery product landings (descargas de los productos pesqueros), satellite monitoring and tracking of vessels, as well as the rational use of fuel at preferential prices for the national commercial fishing fleet and tourist fleet, among others.

1. 6That the modernization of the Institute will boost the promotion of continental and marine aquaculture in pursuit of productive alternatives for food production and job creation, as well as promoting family aquaculture in the interest of supporting the country's food security.

7º-Thus, on March 21, 2020, MIDEPLAN, through official communication MIDEPLAN-DM-OF0231-2020, notifies approval of the new organizational structure of the Institute, granting a period of one year for its implementation.

3º-To instruct the Executive Presidency of Incopesca to issue the corresponding instructions to carry out the implementation process and that these be carried out respecting the current legal regulations, as well as the rights of Incopesca employees.

4º-The following organizational chart shall be taken as an integral part of this resolution:

1. 1Que, Desde la creación del Instituto Costarricense de Pesca y Acuicultura, INCOPESCA en el año 1994, la Institución ha utilizado una estructura funcional que le ha permitido operar administrativamente en concordancia con los cambios tecnológicos, compromisos internacionales y nuevas obligaciones que la Institución ha tenido que asumir desde su creación.

2º-Sin embargo, la carencia de una estructura organizacional debidamente acredita antes las Instituciones gubernamentales, ha debilitado el accionar institucional ya que para algunas acciones o actividades es un requisito indispensable, ejemplo de esto la formulación y desarrollo de proyectos de inversión, gestionar incremento de capital humano, atención de tratados y convenios internacionales y fundamentalmente tener la capacidad de gestión para dar cumplimiento a los planes institucionales y apoyo al Plan Nacional de Desarrollo e Inversión Pública (PNDIP) impulsado por cada Administración.

1. 3Que ante esto, el INCOPESCA como ente rector de la pesca y la acuicultura en el país, presento con el apoyo de los señores Directores Institucionales así como representante de ANEP, FILIAL INCOPESCA, propuesta de modernización al Ministerio Planificación y Política Económica, MIDEPLAN como una herramienta que permitirá identificar esfuerzos de gestión, crear alianzas con entes públicos y privados, establecer estrategias de coordinación interinstitucional, así como la formulación y seguimiento de planes estratégicos nacionales e institucionales
2. 4Que se propone el fortalecimiento de la gestión técnica del Instituto mediante la identificación de procesos tales como la investigación para la generación de valiosa información biológica de las diferentes especies pesqueras y acuícolas y así garantizar su sostenibilidad, así como información confiable, oportuna y adecuada en áreas como zonas de capturas y reproducción de especies, tallas de primera madurez sexual, estimación de biomasa, entre otras
3. 4Que a partir de lo anterior, se plantearon algunos elementos sustantivos que refuerzan la mejora de la gestión Institucional de cara al apoyo de las comunidades vinculadas a las actividades pesqueras y acuícolas en Costa Rica.

5º-Por otra parte, la propuesta da énfasis al tema de fiscalización para que los procesos y actividades se desarrollen de conformidad con la normativa nacional e internacional vigente, brindando mayor énfasis en temas como descargas de los productos pesqueros, monitoreo y seguimiento satelital de embarcaciones, así como el uso racional del combustible a precio preferencial de la flota pesquera comercial nacional y turística entre otros.

1. 6Que la modernización del Instituto dará impulso al fomento de la acuicultura continental y marina en procura de alternativas productivas para la producción de alimentos, generación de empleo, así como promover la acuicultura familiar en aras de apoyar la seguridad alimentaria del país.

7º-Es así como el 21 de marzo de 2020 MIDEPLAN, mediante oficio MIDEPLAN-DM-OF0231-2020 notifica aprobación de la nueva estructura organizacional del Instituto, otorgando el plazo de un año para su implementación

3º-Instruir a la Presidencia Ejecutiva del Incopesca, girar las instrucciones correspondientes para llevar a cabo el proceso de implementación y que las mismas se realicen respetando la normativa legal vigente, así como los derechos de los funcionarios del Incopesca.

4º-Téngase como parte integral del presente acuerdo, el siguiente organigrama:
