Likewise, the Tenth Meeting of the Parties to the United Nations Convention on Biological Diversity adopted Decision X/29 on Marine and Coastal Biological Diversity, which indicates that the Parties should strive to improve coverage, representativeness, and other properties of the network of the global system of ecologically representative and effectively managed marine and coastal protected areas under national jurisdiction or in areas subject to competent international regimes for adopting such measures, and towards achieving the jointly agreed target for 2012, which proposes the establishment of marine and coastal protected areas in accordance with international law, including the United Nations Convention on the Law of the Sea, and based on the best available scientific information, including representative networks.

This proposal includes a scientific analysis of marine ecological systems to determine conservation gaps in the representativeness and integrity of the country's marine-coastal biodiversity (SINAC, 2009).

Currently, these gaps are also called Sites of Importance for Conservation (SIC).

In this effort, the studies "Marine-Coastal Habitat and the Socioeconomic Situation of the Barra del Colorado National Wildlife Refuge and the Tortuguero National Park" directed by the Keto Foundation, "Elaboration of a strategy to address the marine-coastal conservation gap of Barra del Colorado," and "Strategy to strengthen the governance model for the implementation of action lines for the Barra del Colorado conservation importance site" developed by the Neotrópica Foundation, and the "Pre-feasibility study for the fishing sector of Barra del Colorado, development of a collection center as a contribution towards socio-ecological sustainability" prepared by Andy Bystrom were conducted. These studies conclude that the marine-coastal area of Barra del Colorado is of utmost importance to the surrounding communities, because the vast majority of local people engage in fishing as their main activity. Snook (calva), shrimp, lobster, and tarpon (sábalo) are the main fisheries resources of the zone. However, the dynamics of these populations over time is unknown. The lack of fishing statistics hinders the proper management of these resources. In addition, during the process of studying the marine part, five species of cetaceans were identified, of which four are new records for the North Caribbean of Costa Rica, and two are new live sightings for the Caribbean of Costa Rica.

Sustainable management of the fishery resource, 2. Consolidation of participation capacities, 3. Promotion of sustainable tourist services, 4. Waste Management, and as transversal lines 5. Conservation of important species, sites, and resources and 6. Promotion of participation of children and youth in resource management. Through the active participation of neighboring communities, organized in the Local Council, the sustainable use of the ecosystems found in the marine area of Barra del Colorado and their elements is ensured, while citizen participation in the management and administration of protected areas is facilitated.

This approval was the result of a local plebiscite carried out on August 16, 2016, through which the community of Barra del Colorado unanimously chose that it wished to develop actions aimed at the conservation of the fishing area through the Marine Area of Responsible Fishing (AMPR) model, as the governance model to be implemented in the marine-coastal zone adjacent to the Barra del Colorado Wildlife Refuge.

The area is delimited by the following coordinates: Starting from the coordinate closest to the coast, on the maritime boundary between Costa Rica and Nicaragua MARKER 1: 1209674N - 533038E, continuing on a northeast course along the maritime boundary of Costa Rica and Nicaragua to MARKER 2: 1228686N -541483E. From this last coordinate, it moves southeast to MARKER 3: 1227895N - 546213E, MARKER 4: 1225320N - 551575E, MARKER 5: 1221286N - 556077E, MARKER 6: 1213322N - 561208E, MARKER 7: 1206574N - 563942E, MARKER 8: 1187564N - 567167E and MARKER 9: 569650E-1187116N. The representatives indicated herein must be appointed by their hierarchical superior in the case of government institutions; by the Municipal Council in the case of the representative of the local government; or by an agreement issued from within the governing body of each of the institutions they represent.

The call for the representatives indicated in subsections d, e, and f shall be made by the directorate of the Tortuguero Conservation Area, who must hold an Assembly in which all organizations interested in forming part of the Inter-institutional Commission participate.

In matters not covered by this Decree, this Inter-institutional Commission shall be governed by the provisions regulating Collegiate Bodies contained in the General Law of Public Administration, Law no. 6227 of May 2, 1978.

Government institutions and Ministries are authorized to collaborate, within the scope of their powers and to the extent of their possibilities, in the comprehensive attention of economic activities.

To engage in this activity, in addition to the respective license, the entry permit to the protected area, issued by the Tortuguero Conservation Area, must be obtained.

It involves, in addition to the State, the coastal communities through their representative organizations, and where the main focus will be the conservation, sustainable use, and fair and equitable distribution of marine-coastal resources. Therefore, the different competent Institutions shall give it special importance in their planning to address the objectives of conservation, development, management, and attention to the human groups involved.

Asimismo, la Décima Reunión de las Partes de la Convención sobre la Diversidad Biológica de las Naciones Unidas, adoptaron la Decisión X/29 sobre Diversidad Biológica Marina y Costera, en la cual se indica que las Partes deben de esforzarse para mejorar la cobertura, representatividad y otras propiedades de la red del sistema mundial de zonas protegidas marinas y costeras ecológicamente representativas y eficazmente administradas bajo la jurisdicción nacional o en zonas sujetas a regímenes internacionales competentes para adoptar tales medidas, y hacia el logro de la meta acordada conjuntamente para 2012, que plantea el establecimiento de zonas protegidas marinas y costeras de conformidad con el derecho internacional, incluida la Convención de las Naciones Unidas sobre el Derecho del Mar, y sobre la base de la mejor información científica disponible incluidas redes representativas.

Dicha propuesta incluye un análisis científico de los sistemas ecológicos marinos para determinar los vacíos de conservación en la representatividad e integridad de la biodiversidad marino costera del país (SINAC, 2009).

Actualmente, estos vacíos se denominan también Sitios de Importancia para la Conservación (SIC).

En este esfuerzo se realizaron los trabajos "Hábitat Marino-Costero y la Situación Socioeconómica del Refugio Nacional de Vida Silvestre Barra del Colorado y el Parque Nacional Tortuguero" dirigido por la Fundación Keto, "Elaboración de una estrategia de atención al vacío de conservación marino costero de Barra del Colorado" y "Estrategia de fortalecimiento del modelo de gobernanza para la implementación de las líneas de acción para el sitio de importancia de conservación de Barra del Colorado" desarrollados por la Fundación Neotrópica, y el "Estudio de pre factibilidad para el sector pesquero de Barra del Colorado, desarrollo de un centro de acopio como aporte hacia la sostenibilidad socio-ecológica" elaborado por Andy Bystrom. Dichos estudios Concluyen que el área marino costera de Barra del Colorado es de suma importancia para las comunidades aledañas, debido a que la gran mayoría de personas locales se dedican a la pesca como actividad principal.

La calva, el camarón, la langosta y el sábalo son los principales recursos pesqueros de la zona. Sin embargo, la dinámica de estas poblaciones a lo largo del tiempo es desconocida. La falta de estadísticas pesqueras dificulta el buen manejo de estos recursos. Además, en el proceso de estudio de la parte marina, se identificaron cinco especies de cetáceos, de los cuales cuatro son nuevos registros para el Caribe Norte de Costa Rica, y dos son nuevos avistamientos vivos para el Caribe de Costa Rica.

Gestión sostenible del recurso pesquero, 2. Consolidación de capacidades de participación, 3. Promoción de servicios turísticos sostenibles, 4. Gestión de Residuos y como líneas transversales 5. Conservación de especies, sitios y recursos importantes y 6. Promoción de participación de niños, jóvenes en gestión de recursos. Por medio de la participación activa de las comunidades vecinas, organizadas en el Consejo Local, se asegura el uso sostenible de los ecosistemas que se encuentran en el área marina de Barra del Colorado y sus elementos, a la vez que se facilita la participación ciudadana en la gestión y administración de las áreas protegidas.

El estudio GRUAS II: Propuesta de Ordenamiento Territorial para la conservación de la biodiversidad de Costa Rica. Volumen 3: Análisis de Vacíos en la Representatividad e Integridad de la biodiversidad marina y Costera; y el estudio Hábitat marino-costero y la situación socioeconómica referente al vacío de conservación marino aledaño al Refugio Nacional de Vida Silvestre Barra del Colorado y el Parque Nacional Tortuguero, corresponden a la descripción fisiogeográfica del sitio.

Dicha aprobación fue resultado de un plebiscito local llevado a cabo el 16 de agosto del año 2016, por medio del cual la comunidad de Barra del Colorado escogió de forma unánime que deseaba desarrollar acciones orientadas a la conservación del área de pesca a través del modelo de Área Marina de Pesca Responsable (AMPR), como el modelo de gobernanza a implementar en la zona marino-costera aledaña al Refugio de Vida Silvestre Barra del Colorado.

De esta manera, se reconoce la necesidad de fortalecer la gobernanza de los mares para construir soluciones basadas en la naturaleza y actividades económicas rentables que permitan la adaptación y mitigación del cambio climático.

a-) Conservar una muestra representativa del ecosistema marino característico de Barra del Colorado.

b-) Conservar áreas de tránsito y sitios de agregación de peces, rayas, mantas, tiburones, cetáceos, y tortugas marinas, especialmente las especies que se encuentran amenazadas y en peligro de extinción.

c-) Conservar áreas de tránsito y agregación de especies migratorias como el camarón y la langosta.

d-) Asegurar el uso sostenible de los ecosistemas y sus elementos, fomentando la activa participación de las comunidades vecinas.

e-) Promover la investigación científica, el estudio de los ecosistemas y su equilibrio, así como el conocimiento y las tecnologías que permitan el uso sostenible de los recursos naturales del país y su conservación.

  • d)Representante del gobierno local de la zona.
  • e)Representante de ONG's.
  • f)Representante del Consejo Local Marino Costero de Barra del Colorado Esta comisión podrá ampliarse una vez conformada la Unidad de Gobernanza Marina correspondiente a la zona del Caribe Norte, según lo dispuesto en el Decreto Ejecutivo 41775-MP-MSP-MAG-MINAE-MOPT-TUR, el cual establece la creación del mecanismo de gobernanza de los espacios marinos sometidos a la Jurisdicción del Estado Costarricense.

Los representantes aquí señalados deberán ser nombrados por su superior jerárquico en el caso de las instituciones del gobierno; por el Consejo Municipal en el caso del representante del gobierno local; o por un acuerdo emitido del seno del órgano director de cada una de las instituciones que representan.

La convocatoria para los representantes señalados en los incisos d, e, y f la realizará la dirección del Área de Conservación Tortuguero, quién deberá celebrar una Asamblea en la que participen todas las organizaciones interesadas en conformar parte de la Comisión Interinstitucional.

En lo no contemplado en este Decreto, está Comisión Interinstitucional se regirá por las disposiciones que regulan a los Órganos Colegiados contenidas en la Ley General de la Administración Pública, Ley no. 6227 del 2 de mayo de 1978.

Se autoriza a las instituciones del Gobierno y Ministerios a colaborar, dentro del ámbito de sus potestades y en la medida de sus posibilidades, en la atención integral de las actividades económicas.

Para el ejercicio de esta actividad, además de la respectiva licencia, deberá contarse con el permiso de ingreso al área protegida, expedido por el Área de Conservación Tortuguero.

Transitorio único. El Sistema Nacional de Áreas de Conservación de conformidad con el numeral 42 de la Ley de Biodiversidad deberá fijar las tarifas, correspondiente para ingreso y actividades en el área para los pescadores y otros usuarios, excluyendo a los usuarios de la pesca en pequeña escala de las comunidades vecinas.
