in the entirety of the text - Complete Text of Norm 004 Delimitation of a coastal sector and estuary/mangrove of the Public Zone of Golfo Dulce, Sierpe district, Osa Canton, Puntarenas Province Complete Record Text: 139BBC NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT NOTICE No. 2020-004 MARITIME TERRESTRIAL ZONE DELIMITATION OF A COASTAL SECTOR AND ESTUARY/ MANGROVE OF THE PUBLIC ZONE OF GOLFO DULCE, SIERPE DISTRICT, OSA CANTON, PUNTARENAS PROVINCE Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, the General Law of Public Administration, and in accordance with the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulations.

1. 1That through Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry, and that the Administrative Board of the National Registry will administer the Institute's budget, sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, responsible for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, research, works, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.
2. 2That the Law Creating the National Geographic Institute, No. 59, constitutes it permanently and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the works entrusted to its charge.
3. 3That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulations to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulations states that "The National Geographic Institute shall publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That in Executive Decree No. 36642-MP-MOPTMINAET, "Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone," it is established according to Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed within the National Territory by any public agency, person, or private national or foreign entity must be referenced;" while Article 7 indicates that "As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, by adequate means, that information which has been officialized."
6. 6That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for purposes of preparing regulatory plans, approving survey plans (visado de planos de agrimensura), granting concessions in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).
7. 7That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) regarding the Maritime Terrestrial Zone (ZMT).
8. 8That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) regarding the Maritime Terrestrial Zone (ZMT) is technically based on the application of regulations established by: a) Executive Decree No. 7841-P "Regulations to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".
9. 9That Article 16° of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State.

10.—The National Geographic Institute used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in a coastal and estuary/mangrove sector on the beach known as Playa Mogos in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas.

11.—The National Geographic Institute, together with the Osa Conservation Area (Área de Conservación Osa), used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in an estuary/mangrove sector on the beach known as Playa Mogos; located in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas, this in accordance with proceedings carried out by Sonia Carvajal González, ID No. 5-01252-351 before the National Geographic Institute.

12.—That the delimitation performed has internal technical endorsement in accordance with official communication No. DIG-TOT-0014-2020 of March 26, 2020, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.

13.—That the delimitation performed included the accompaniment of the Osa Conservation Area of the National System of Conservation Areas, for the demarcation of the public zone in the estuary/mangrove ecosystem sector, according to official communication SINACACOSA-D-705-2019, dated December 19, 2020.

13.—That Article 140 of Law No. 6227 General Law of Public Administration states that "the administrative act shall produce its effect after being communicated to the administered party, unless it grants only rights, in which case it shall produce effect from the moment it is adopted," a provision that must necessarily be related to subsection 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating: "General acts shall be communicated by publication, and specific acts, by notification." COMMUNICATES:

I.—That in the months of October and November 2019, the georeferenced digital delimitation to the national coordinate system was performed to delimit a coastal and estuary/mangrove sector of the public zone of the Maritime Terrestrial Zone on the beach known as Playa Mogos; located in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas.

II.—The works for determining the public zone of the Maritime Terrestrial Zone were carried out between the months of October and November 2020; this delimitation corresponds to a coastal sector where none exists as of the date of signing this Notice; as well as an estuary/mangrove sector through the establishment of boundary markers (mojones) on the beach known as Playa Mogos, whose point coordinates are indicated below, in the official cartographic projection system of Costa Rica CRTM05, namely:

IV.—The official technical data of the delimitation of the public zone of the Maritime Terrestrial Zone of the Sierpe district have been registered in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.—Curridabat, July 22, 2020.

1. 1Que mediante Ley N° 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N° 59, en el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
7. 7Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
8. 8Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".
9. 9Que el artículo 16° de la Ley Forestal, Ley N°7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

10.-El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de costa y estero/ manglar en la playa conocida como Playa Mogos en el distrito 03 Sierpe, cantón 05 Osa; provincia 06 Puntarenas.

11.-El Instituto Geográfico Nacional junto con el Área de Conservación Osa, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de estero/manglar en la playa conocida como Playa Mogos; ubicada en distrito 03 Sierpe, cantón 05 Osa; provincia 06 Puntarenas, esto conforme diligencias realizadas por Sonia Carvajal González, cédula N° 5-01252-351 ante el Instituto Geográfico Nacional.

12.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio N° DIG-TOT-0014-2020 del 26 de marzo de 2020, emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

13.-Que la delimitación realizada contó con el acompañamiento del Área de Conservación Osa de Sistema Nacional de Áreas de Conservación, para la demarcación de la zona pública en el sector de ecosistema de estero/manglar, de acuerdo con el oficio SINACACOSA-D-705-2019, de fecha 19 de diciembre de 2020.

13.-Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

I.-Que en los meses de octubre y noviembre de 2019 se realizó la delimitación digital georreferenciada al sistema nacional de coordenadas para delimitar un sector costero y de estero/manglar de la zona pública de la Zona Marítimo Terrestre playa conocida como Playa Mogos; ubicada en distrito 03 Sierpe, cantón 05 Osa; provincia 06 Puntarenas.

II.-Los trabajos para la determinación de la zona pública de la Zona Marítimo Terrestre fueron realizados entre los meses octubre y noviembre de 2020; esta delimitación corresponde un sector de costa donde no existe a la fecha de firma del presente Aviso; así como un sector de estero/manglar mediante el establecimiento de mojones en la playa conocida como Playa Mogos cuyas coordenadas de puntos se indican a continuación, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, a saber:

IV.-Los datos técnicos oficiales de la delimitación de la zona pública de la Zona Marítimo Terrestre del distrito Sierpe, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN.-Curridabat, 22 de julio del 2020.

Considerando:
