in the entirety of the text - Complete Text of Norm 42464 Assignment to the Ministry of Environment and Energy of real property for its use, oversight, and maintenance Complete Text of act: 139770 N° 42464-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE In accordance with the powers granted by subsection 18) of article 140 and article 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1), and 28 subsection 2.b) of Law N° 6227, General Law of Public Administration of May 2, 1978 and its amendments, Decree N° 40797-H of November 28, 2017; as well as official letters numbers 08339 (DAGJ-1985-2005) of July 12, 2005 and 06525 (DCA-1385) of May 23, 2006, both from the Contraloría General de la República.

I.-That by public deed number thirty-six dated September twenty-first, nineteen ninety-nine, issued by the then State Notary, Fernando Casafont Odor, the company MGJ de San José S. A., gratuitously transferred, free of mortgage liens and debts of any kind, to the State, the property of the Partido de San José, registered in folio real, registration N° 388625-000, which is under the administration of the Ministry of Finance.

II.-That the property, folio real registration N° 1-388625-000, is described as follows: nature for building, located in district 02 Granadilla, canton 18 Curridabat of the province of San José, which currently borders on the north: succession of Herminia Coto Rojas, south: public street, east and west: Hermanos Pérez Fernández, measuring three hundred fifty-nine point fifty-one square meters, according to cadastral map number SJ-0939284-1990.

III.-That through official letter N° 08339 (DAGJ-1985-2005) of July 12, 2005, reconsidered through official letter N° 06525 (DCA-1385-2006) of May 23, 2006, the Legal Advisory and Management Division of the Contraloría General de la República considered that every public institution, in order to dispose of its assets and transfer them to decentralized entities, non-state public entities, or public enterprises, may do so provided there is a legal norm that such entities, unless the transfer is between bodies of the same entity -Executive Branch-, in which case a law would not be necessary, since the property would remain registered in the name of the State.

IV.-That the Ministry of Environment and Energy requires a physical space to install an instrument calibration laboratory and other activities specific to the field of Meteorology of the Instituto Meteorológico Nacional, an entity attached to that Ministry as provided in article 4 of Law N° 7152 of June 5, 1990, and therefore, through official letter number DM-0033-2020 dated January 14, 2020, it expressed its interest in having the Ministry of Finance assign it the administration of the property of the Partido de San José, registered in folio real, registration number 388625-000, located in district 2 Granadilla of canton 18, Curridabat, 800 meters east and 250 meters north of Taller Wabe, Barrio los Álamos.

V.-That by virtue of the foregoing and for reasons of public interest, it is appropriate to assign to the Ministry of Environment and Energy the administration of the property registered in the National Registry, Partido de San José, registration N° 388625-000, described as to its location and measurements in considering II of this Decree, to be used as facilities for the instrument calibration laboratory and other activities of the Instituto Meteorológico Nacional (IMN).

VI.-That in accordance with the provisions of article 12 bis of Executive Decree N° 37045-MP-MEIC of February 22, 2012, called Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures and its amendment, it is pertinent to note that this regulation does not establish or modify procedures, requirements, or formalities that the citizen must comply with before the Central Administration; therefore, the prior control of the Regulatory Improvement Directorate is not required.

I.-Que mediante escritura pública número treinta y seis de fecha veintiuno de setiembre de mil novecientos noventa y nueve, otorgada por el entonces Notario del Estado, Fernando Casafont Odor, la empresa MGJ de San José S. A., traspasó gratuitamente, libre de gravámenes hipotecarios y deudas de toda índole, al Estado, la finca del Partido de San José, inscrita a folio real, matrícula N° 388625-000, misma que se encuentra en administración del Ministerio de Hacienda.

II.-Que la finca matrícula de folio real N° 1-388625-000, se describe de la siguiente manera: naturaleza para construir, situado en el distrito 02 Granadilla, cantón 18 Curridabat de la provincia de San José, que actualmente colinda con norte: sucesión de Herminia Coto Rojas, sur: calle pública, este y oeste: Hermanos Pérez Fernández, mide trescientos cincuenta y nueve metros con cincuenta y un decímetros cuadrados, según el plano catastrado número SJ-0939284-1990.

III.-Que mediante oficio N° 08339 (DAGJ-1985-2005) del 12 de julio de 2005, reconsiderado mediante oficio N° 06525 (DCA-1385-2006) del 23 de mayo de 2006, la División de Asesoría y Gestión Jurídica de la Contraloría General de la República consideró que toda institución pública, para disponer de sus bienes y trasladarlos a entes descentralizados, entes públicos no estatales o empresas públicas, puede hacerlo siempre y cuando exista una norma legal que en forma expresa le autorice a incurrir en actos de liberalidad en beneficio de tales entidades, salvo que el traspaso sea entre órganos del mismo ente -Poder Ejecutivo-, en cuyo caso la existencia de una ley no sería necesaria, ya que el inmueble se mantendría inscrito a nombre del Estado.

IV.-Que el Ministerio de Ambiente y Energía requiere de un espacio físico para instalar un laboratorio de calibración de instrumentos y otras actividades propias en el ámbito de la Meteorología del Instituto Meteorológico Nacional, entidad adscrita a ese Ministerio según lo dispuesto en el artículo 4 de la Ley N° 7152 del 05 de junio de 1990, por lo que mediante oficio número DM-0033-2020 de fecha 14 de enero de 2020, manifestó su interés para que el Ministerio de Hacienda le asigne la administración de la finca del Partido de San José, inscrita a folio real, matrícula número 388625-000, ubicada en el distrito 2 Granadilla del cantón 18, Curridabat, 800 metros al este y 250 metros al norte del Taller Wabe, Barrio los Álamos.

V.-Que en virtud de lo expuesto y atendiendo a razones de interés público, procede asignar al Ministerio de Ambiente y Energía la administración de la finca inscrita en el Registro Nacional, Partido de San José, matrícula N° 388625-000, descrita en cuanto a su ubicación y medidas en el considerando II de este Decreto, para ser utilizada como instalaciones del laboratorio de calibración de instrumentos y otras actividades del Instituto Meteorológico Nacional (IMN).

VI.-Que conforme a los dispuesto en el artículo 12 bis del Decreto Ejecutivo N° 37045-MP-MEIC de fecha 22 de febrero de 2012, denominado Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos y su reforma, es oportuno señalar que la presente regulación, no establece ni modifica trámites, requisitos o procedimientos que el administrado deba cumplir ante la Administración Central, por lo que no se requiere el control previo de la Dirección de Mejora Regulatoria.

ASIGNACIÓN DE LA FINCA FOLIO REAL N° 1-388625-000 AL MINISTERIO DE AMBIENTE Y ENERGÍA
