throughout the entire text - Complete Text of Norm 002 Delimitation of the Public Zone of the Bejuco River Complete Text of record: 138523 NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT NOTICE No. 2020-002 MARITIME TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE OF THE BEJUCO RIVER Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, General Public Administration Act, and in accordance with Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulation.
1. That through Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget, sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, destined for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, investigations, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical nature and of a similar nature related to said works, with the aim of supporting planning processes.
2. That the Law Creating the National Geographic Institute, No. 59, establishes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature that originate from the works entrusted to its charge.
3. That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, in Article 62 of the Regulation to Law No. 6043, it recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone." 4. That in Executive Decree No. 36642-MP-MOPTMINAET, "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone," it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation (delimitación digital georreferenciada), with the aim of streamlining delimitations and providing greater technical security to interested parties.
5. That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the only official coordinate system for the Republic of Costa Rica from which all surveys and cartographic and geodetic activities developed in the National Territory by any public agency, domestic or foreign private person or entity must be referenced."; while Article 7 indicates that "As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish through appropriate means that information which has been officialized." 6. That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving cadastral survey plans (visado de planos de agrimensura), the granting of concessions in the Restricted Zone, and other aspects of coastal territorial planning.
7. That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
8. That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPTMINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone." 9. That Article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall demarcate on the ground the boundaries of the areas that constitute the Natural Heritage of the State.
10. The National Geographic Institute used the methodology of "Georeferenced Digital Delimitation (Delimitación Digital Georreferenciada)" to delimit the public zone of the Maritime Terrestrial Zone in the inlet (ría) of the Bejuco River, located in district 06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste, in accordance with 11. That through certification ACT-OR-DR-001-2018, the Tempisque Conservation Area certifies the extent of the inlet (ría) of the Bejuco River, located in district 06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste according to the "Final Report on Delimitation using Orthophotos Scale 1:5000/1:1000 and the Field Verification of Rivers, Estuaries, and Mangroves of the Pacific Coast of Costa Rica, product of Contract 2009EI-000084-UE of the Cadastre and Registry Regularization Program Loan Agreement 1284/ OC-CR" for the sector subject to this notice.
12. That the delimitation performed has internal technical endorsement in accordance with official communication No. DIG-TOT-307-2018, issued by the Official Limits Sub-process of the Topographic and Territory Observation Department of the National Geographic Institute.
13. That Article 140 of Law No. 6227, General Public Administration Act, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it only grants rights, in which case it shall produce them from the moment it is adopted," a provision that must necessarily relate to numeral 204) of the same regulatory body, which defines the appropriate instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific acts, by notification." The National Geographic Institute used, on the Bejuco River, located in district 06 Bejuco, canton 9 Nandayure, province 05 Guanacaste, based on official communications ACT-ORDR-985-18 dated July 30, 2018, referring to official communication DGT-TOT-094-18 and certification ACT-OR-DR-001-2018, a copy of report ACT-OSRHN-572-18 from the Tempisque Conservation Areas System.
2. The public zone of the Maritime Terrestrial Zone used on the Bejuco River, located in district 06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste, determined, in the official cartographic projection system of Costa Rica CRTM05, from Map MBCR- 1/50,000 Sheet Herradura, namely:

3. 10.-El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en la ría del Río Bejuco, ubicado en el distrito 06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste, esto conforme al 11.-Que mediante la certificación ACT-OR-DR-001-2018, el Área de Conservación tempisque, certifica el alcance de la ría del Río Bejuco, ubicado en el distrito 06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste según el "Informe Final de Delimitación sobre Ortofotos Escala 1:5000/1:1000 y la Verificación de Campo sobre los Ríos, Esteros y Manglares del Litoral Pacifico de Costa Rica producto de la Contratación 2009EI-000084-UE del Programa de Regularización del Catastro Y Registro Contrato Préstamo 1284/ OC-CR" del sector objeto del presente aviso.
12.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio Nº DIG-TOT-307-2018, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

1º-El Instituto Geográfico Nacional, utilizó en el Río Bejuco, ubicado en el distrito 06 Bejuco, cantón 9 Nandayure, provincia 05 Guanacaste, con base en los oficios ACT-ORDR-985-18 con fecha del 30 de julio de 2018 referente al oficio DGT-TOT-094-18 y a la certificación ACT-OR-DR-001-2018 copia del informe ACT-OSRHN-572-18 del Sistema de Áreas de Conservación Tempisque.
2º-La zona pública de la Zona Marítimo Terrestre del utilizó en el Río Bejuco ubicado en los distritos 06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste, determinada, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, del Mapa MBCR- 1/50.000 Hoja Herradura, a saber:
