in the entirety of the text - Full Text of Official Standard 002 Delimitation of the Public Zone of the Bejuco River Full Text of Record: 138523 INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO NOTICE No. 2020-002 ZONA MARÍTIMA TERRESTRE DELIMITATION OF THE PUBLIC ZONE OF THE RÍO BEJUCO Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, General Law of Public Administration, and on the provisions of Law No. 59 creating the Instituto Geográfico Nacional, Law No. 8905 transferring the Instituto Geográfico Nacional to the National Registry, Law No. 6043 on the Zona Marítimo Terrestre, of March 2, 1977, and its respective regulation.

1. That by means of Law No. 8905, the Instituto Geográfico Nacional is established as a dependency of the National Registry, and that the Administrative Board of the National Registry shall administer the Institute's budget and sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the Instituto Geográfico Nacional shall be the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, research or work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.

2. That the Law Creating the Instituto Geográfico Nacional, No. 59, permanently constitutes it, in representation of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic, its authority extending to activities of any kind originating from the work entrusted to it.

3. That in accordance with the Law Creating the Instituto Geográfico Nacional (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the Instituto Geográfico Nacional for the delimitation of the public zone of the Zona Marítimo Terrestre, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The Instituto Geográfico Nacional shall publish a notice in the Official Gazette for each portion of the Zona Marítimo Terrestre in which it has demarcated the public zone." 4. That Executive Decree No. 36642-MP-MOPTMINAET, "Regulation of Specifications for the Delimitation of the public zone of the Zona Marítimo Terrestre," establishes, according to Article 18, that for the delimitation of the public zone of the Zona Marítimo Terrestre, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Zona Marítimo Terrestre through the placement of boundary markers (mojones) and/or through digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.

5. That Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the National Territory by any public dependency, person, or private national or foreign entity must be referenced."; while Article 7 indicates that "As cartographic data are produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish, through appropriate means, that information which has been officialized." 6. That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Zona Marítimo Terrestre enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving cadastral survey plans, granting concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning.

7. That the georeferenced digital information on the delimitation of the public zone of the Zona Marítimo Terrestre held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT).

8. That the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Zona Marítimo Terrestre", b) Executive Decree No. 33797-MJ-MOPT "Declares CR05 and its associated cartographic projection CRTM05 as the official horizontal datum for Costa Rica", and c) Executive Decree No. 36642-MP-MOPTMINAET "Regulation of Specifications for the Delimitation of the public zone of the Zona Marítimo Terrestre".

9. That Article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).

10. The Instituto Geográfico Nacional used the "Georeferenced Digital Delimitation" (Delimitación Digital Georreferenciada) methodology to delimit the public zone of the Zona Marítimo Terrestre in the estuary (ría) of the Río Bejuco, located in district 06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste, in accordance with the provisions of Article 19 and 20 of Executive Decree No. 36642-MP-MOPTMINAET.

11. That by means of certification ACT-OR-DR-001-2018, the Área de Conservación Tempisque certifies the extent of the estuary (ría) of the Río Bejuco, located in district 06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste, according to the "Final Delimitation Report on Orthophotos Scale 1:5000/1:1000 and Field Verification on the Rivers, Estuaries and Mangroves of the Pacific Coast of Costa Rica, product of Contracting 2009EI-000084-UE of the Cadastre and Registry Regularization Program, Loan Contract 1284/ OC-CR" for the sector subject to this notice.

12. That the delimitation performed has internal technical endorsement in accordance with official communication No. DIG-TOT-307-2018, issued by the Official Limits Subprocess of the Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional.

13. That Article 140 of Law No. 6227, General Law of Public Administration, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted," a provision that must necessarily be related to numeral 204 of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication, and specific acts by notification." COMMUNICATES:

1. The Instituto Geográfico Nacional, utilized in the Río Bejuco, located in district 06 Bejuco, canton 9 Nandayure, province 05 Guanacaste, based on official communications ACT-ORDR-985-18 dated July 30, 2018, referring to official communication DGT-TOT-094-18 and certification ACT-OR-DR-001-2018, a copy of report ACT-OSRHN-572-18 from the Sistema de Áreas de Conservación Tempisque.

2. The public zone of the Zona Marítimo Terrestre of the Río Bejuco located in district 06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste, determined in the official cartographic projection system of Costa Rica CRTM05, from Map MBCR- 1/50.000 Sheet Herradura, namely:

The sectors of the estuary (ría) of the Río Bejuco located in district 06 Bejuco, canton Nandayure, province 05 Guanacaste, which currently have the delimitation of the public zone of the Zona Marítimo Terrestre through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

5. The official technical data of the georeferenced digital delimitation of the public zone of the Zona Marítimo Terrestre of the estuary (ría) of the Río Bejuco located in district 06 Bejuco, canton 09 Nandayure, province 05 Guanacaste, have been registered in the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT), in a vector shape file format, under the coding: RN/IGN_GDG-IGN-ZMT_rias.

en la totalidad del texto - Texto Completo Norma 002 Delimitación de Zona Pública del Río Bejuco Texto Completo acta: 138523 INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO AVISO Nº 2020-002 ZONA MARÍTIMA TERRESTRE DELIMITACIÓN DE ZONA PÚBLICA DEL RÍO BEJUCO Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley Nº 6227 General de la Administración Pública, y en lo dispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley Nº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su respetivo reglamento.

1. 1Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
7. 7Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
8. 8Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".
9. 9Que el artículo 16 de la Ley Forestal, Ley Nº 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

10.-El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en la ría del Río Bejuco, ubicado en el distrito 06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste, esto conforme al 11.-Que mediante la certificación ACT-OR-DR-001-2018, el Área de Conservación tempisque, certifica el alcance de la ría del Río Bejuco, ubicado en el distrito 06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste según el "Informe Final de Delimitación sobre Ortofotos Escala 1:5000/1:1000 y la Verificación de Campo sobre los Ríos, Esteros y Manglares del Litoral Pacifico de Costa Rica producto de la Contratación 2009EI-000084-UE del Programa de Regularización del Catastro Y Registro Contrato Préstamo 1284/ OC-CR" del sector objeto del presente aviso.

12.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio Nº DIG-TOT-307-2018, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

13.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1º-El Instituto Geográfico Nacional, utilizó en el Río Bejuco, ubicado en el distrito 06 Bejuco, cantón 9 Nandayure, provincia 05 Guanacaste, con base en los oficios ACT-ORDR-985-18 con fecha del 30 de julio de 2018 referente al oficio DGT-TOT-094-18 y a la certificación ACT-OR-DR-001-2018 copia del informe ACT-OSRHN-572-18 del Sistema de Áreas de Conservación Tempisque.

2º-La zona pública de la Zona Marítimo Terrestre del utilizó en el Río Bejuco ubicado en los distritos 06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste, determinada, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, del Mapa MBCR- 1/50.000 Hoja Herradura, a saber:

3º-Los sectores de la ría del Río Bejuco ubicado en los distritos 06 Bejuco, cantón Nandayure, provincia 05 Guanacaste, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

5º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de la ría del Río Bejuco ubicado en los distritos 06 Bejuco, cantón 09 Nandayure, provincia 05 Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_rias.
