in the entirety of the text - Full Text of Standard 001 Delimitation of the public zone of the Tempisque River Full Text of record: 1380B2 NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC DEPARTMENT AND TERRITORY OBSERVATION NOTICE No. 2020-001 MARITIME TERRESTRIAL ZONE Delimitation of the public zone of the Tempisque River Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, General Law of Public Administration, and on the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulation.

1. 1That through Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry will administer the Institute's budget, and will sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute will be the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or tasks and the development of national policies of a cartographic, geographic, geodetic, geophysical and similar nature related to said works, in order to support planning processes.
2. 2That the Law Creating the National Geographic Institute, No. 59, constitutes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the works entrusted to its charge.
3. 3That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, in Article 62 of the Regulation to Law No. 6043, the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone is recognized, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That in Executive Decree No. 36642-MP-MOPTMINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone", it is established according to Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, which are indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of landmarks (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Reference Network CR05 and the cartographic projection system CRTM05, will constitute the sole official coordinate system for the Republic of Costa Rica from which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person or private entity, national or foreign, must be referenced."; while Article 7 indicates that "As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute will publish through appropriate means that information which has been officialized."
6. 6That Executive Decree No. 40962-MJP "Update of the Official Horizontal Geodetic Reference System for Costa Rica" declares that: "The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica,.", while "The CRTM05 cartographic projection system will continue to be the official one for the cartographic representation of the national continental territory."

For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that ".all cartographic and geodetic surveys and activities developed in the national territory by any public agency, person or private entity, national or foreign, that undertake or contract geodetic and cartographic works, contributing to avoid public expenditure and obtaining, on the other hand, reliable, uniform and comparable geographic information, that is of general utility and supports decision-making at the different levels of the State."

1. 7That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of the preparation of regulatory plans (planes reguladores), the approval of surveying plans (planos de agrimensura), the granting of concessions in the Restricted Zone and other aspects of coastal territorial planning (ordenamiento territorial costero).
2. 8That the georeferenced digital information on delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN, is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
3. 9That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares CR05, and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica", c) Executive Decree No. 40962-MJP "Update of the Official Horizontal Geodetic Reference System for Costa Rica"; and d) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

10.-That Article 16° of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy will delimit on the ground the boundaries of the areas that comprise the Natural Heritage of the State.

11.-The National Geographic Institute, based on the official technical criterion competent in environmental matters of the Tempisque Conservation Area - National System of Conservation Areas (SINAC), of the Ministry of Environment and Energy (MINAE), used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in the estuary (ría) of the Tempisque River, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste.

11.-That through certifications ACT-ORDR- 1533-2018, dated November 8, 2018, and ACTPNE- 006-2018, both signed by Lic. Nelson Marín Mora, Regional Director of the Tempisque Conservation Area - SINAC, MINAE, the "Final Delimitation Report on Orthophotos Scale 1:5000/1:1000 and Field Verification on the Rivers, Estuaries and Mangroves of the Pacific Littoral of Costa Rica product of Contract 2009EI-000084-UE of the Cadastre and Registry Regularization Program Loan Contract 1284/ OC-CR" is officialized regarding the scope of the estuary of the Tempisque River, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste.

12.-That the delimitation carried out has internal technical endorsement in accordance with official letter No. DIG-TOT-0465-2018 of November 14, 2018, issued by the Official Limits Sub-process of the Topographic Department and Territory Observation of the National Geographic Institute.

13.-That Article 140 of Law No. 6227, General Law of Public Administration, states that "the administrative act will produce its effect after being communicated to the administered party, except if it grants only rights, in which case it will produce it from the moment it is adopted", a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts will be communicated by publication and concrete acts, by notification." COMMUNICATES:

1. 1That the National Geographic Institute, based on the official technical criterion competent in environmental matters of the Tempisque Conservation Area - National System of Conservation Areas (SINAC), of the Ministry of Environment and Energy (MINAE), carried out the georeferenced digital delimitation of the estuary of the Tempisque River, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste.

2º-The public zone of the Maritime Terrestrial Zone corresponding to the estuary of the Tempisque River, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste, has as the extreme point coordinates of the estuary in the official cartographic projection system of Costa Rica CRTM05, namely:

3º-The sectors of the estuary of the Tempisque River, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste, that to date have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of landmarks (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

5º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of the estuary of the Tempisque River located in Tempisque River, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste, have been registered in the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a vector shapefile format, under the coding: RN/ IGN_GDG-IGN-ZMT_rias.-Curridabat, June 1, 2020.

Considering:

en la totalidad del texto - Texto Completo Norma 001 Delimitación de zona pública del Río Tempisque Texto Completo acta: 1380B2 INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO AVISO Nº 2020-001 ZONA MARÍTIMA TERRESTRE Delimitación de zona pública del Río Tempisque Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley N° 6227 General de la Administración Pública, y en lo dispuesto en la Ley N° 59 de creación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 02 de marzo de 1977, y su respetivo reglamento.

1. 1Que mediante Ley N° 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N° 59, en el artículo 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que el Decreto Ejecutivo N° 40962-MJP "Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica" declara que: "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica,.", mientras que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental."

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que ".todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado."

1. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
3. 9Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", c) el Decreto Ejecutivo N° 40962-MJP "Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica"; y d) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

10.-Que el artículo 16° de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-El Instituto Geográfico Nacional, con base en criterio técnico oficial competencia en materia ambiental del Área de Conservación Tempisque - Sistema Nacional de Áreas de Conservación (SINAC), del Ministerio el Ambiente y Energía (MINAE), utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en la ría del Río Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda del cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa Cruz; el distrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces del cantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos cantones de la provincia 05 de Guanacaste.

11.-Que mediante las certificaciones ACT-ORDR- 1533-2018, de fecha 08 de noviembre de 2018 y ACTPNE- 006-2018, ambas firmadas por el Lic. Nelson Marín Mora Director Regional Área de Conservación Tempisque - SINAC, MINAE, se oficializa el "Informe Final de Delimitación sobre Ortofotos Escala 1:5000/1:1000 y la Verificación de Campo sobre los Ríos, Esteros y Manglares del Litoral Pacífico de Costa Rica producto de la Contratación 2009EI-000084-UE del Programa de Regularización del Catastro y Registro Contrato Préstamo 1284/ OC-CR" en lo que respecta al alcance de la ría del Río Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda del cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa Cruz; el distrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces del cantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos cantones de la provincia 05 de Guanacaste.

12.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio N° DIG-TOT-0465-2018 del 14 de noviembre de 2018, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

13.-Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1. 1Que el Instituto Geográfico Nacional, con base en criterio técnico oficial competencia en materia ambiental del Área de Conservación Tempisque - Sistema Nacional de Áreas de Conservación (SINAC), del Ministerio el Ambiente y Energía (MINAE), realizó la delimitación digital georreferenciada de la ría del Río Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda del cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa Cruz; el distrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces del cantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos cantones de la provincia 05 de Guanacaste.

2º-La zona pública de la Zona Marítimo Terrestre correspondiente a la ría del Río Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda del cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa Cruz; el distrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces del cantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos cantones de la provincia 05 de Guanacaste, tiene como coordenadas de punto extremo de la ría en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, a saber:

3º-Los sectores de la ría del Río Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda del cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa Cruz; el distrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces del cantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos cantones de la provincia 05 de Guanacaste, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

5º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de la ría del Río Tempisque ubicada en Río Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda del cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa Cruz; el distrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces del cantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos cantones de la provincia 05 de Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/ IGN_GDG-IGN-ZMT_rias.-Curridabat, 01 de junio del 2020.
